representing the applicant explained how a purchase had occurred
which would enable them to construct Bond Park Phase III and they

o Dorothy Gage, questioned the alignment of the street. Assistant
Planner Skorney reviewed alignment to Mrs. Gage's satisfactiom.

o Commissioner Butler questioned the length of the streets and where
the streets would come out. Applicant reviewed map of phase III,
indicating proposed streets, stating the streets would be
approximately 300 feet and would eventually enter onto HAll Blvd.

AND SHALL ASSURE THAT CITIZENS WILL BE PROVIDED AN OPPORTUNITY
TO BE INVOLVED IN ALL PHASES OF THE PLANNING PROCESS.

notice of the hearing in the mail. A public notice was printed
in the Tigard Times on November 3, 1983. In addition, NPO # 5

2.1.3 THE CITY SHALL ENSURE THAT INFORMTION ON LAND USE PLANNING
ISSUES IS AVAILABLE IN AN UNDERSTANDABLE FORM FOR ALL INTERESTED

4. No tentative plat of a subdivision or map of a major partition shall
be approved unless there will exist adequate quantity and quality of
water and an adequate sewage disposal system to support the proposed •
use of the land described in the proposed plat.
• D. RECOMMENDATION
Staff recommends approval of S 9-83 with the following conditions:
1. Seven (7) sets of plan-profile public improvement construction plans
and one (1) itemized construction cost estimate, stamped by a
registered civil engineer, detailing all proposed public improvements
shall be submitted to the City's Engineering Division for review.
2. Construction of proposed public improvements shall not commence until
after the Engineering Division has issued approved public improvement
plans. The Engineering Division will require posting of a 100%
performance bond, the payment of a permit fee and a sign
installation/streetlight deposit. Also, the execution of a street
opening permit or construction compliance agreement just prior to, or
4 at the time of, it 's issuance of approved public improvement plans.
3. Public sewer lines shall be extended to the project boundaries in all
directions.
4. The final subdivision plat shall be recorded with Washington County
prior to the issuance of any Building Permits.
S. No changes or modifications shall be made, to approved plans without
written approval from the appropriate City department.
6. The applicant shall improve SW 79th Ave beyond the project boundary
to Durham using City Interim Standards,.
RECOMMENDED MOTION
Should the Planning Commission adopt staffs recommendation, the following ,
motion may be made: Move to approve, with conditions, the applicant's •
request for a Preliminary Plat of Bond Park # 2 (S 9-83), a 24 lot
subdivision."

BOND PARK #2
7-A - The current City of Tigard plan map designation is Medium tensity Resi-
dential. Our proposal of 24 single-family lots meets the requirements d
of,the plan and utilizes the land as designated.
7-B - The zoning for the proposed development site is 6-12 units per acre.
Our density is 6.40 units per acre. By utilizing the site at this den-
sity, it will be possible to provide affordable housing for many people .
heretofore priced out of the marketplace. j .
7-C - The Tigard Water District presently serves the proposed site with a 8"
di a. water line which is within the water distribution grid and is sup-
lied from S. W. Durham Rd. and S. W. Bonita Rd. and in the development
of Bond Park will create another connection between S. W. 79th and S. W.
"76th. Avenue. !;
The quality of the water meets the State of Oregon standards for potable
water.
7-D - Streets: S. W. 79th Avenue presently serves the site. In the dev 1opment
of the subdivision our frontage on S. W. 79th Avenue will be improved
to City standards. S. W. 79th Ave. is a through street from S. W. Durh ,m
Rd. to S. W. Bonita Rd. , and in the development of Bond Park another access
via S. W. 76th Ave. will be available provii!ing at least three (3) major
access points for traffic and fire prutecti on.
Drainage Facilities: A small drainage swi l e runs through the property.
In the design of the project, we will be ,;.roviding for the interception
of this drainage at our boundary and piping into the Bond Park systems
for eventual discharge to Fanno Creek. The property is not within the.
flood plain or a drainage hazard area.

Sanitary Sewer: The site will be served by the sewer line extension
through Bond Park from the U.S.A. interceptor near Fanno Creek, No prob-
lems are foreseen with this proposal.

RESOLUTION OF THE TIQARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS
CONSTRUCTED WITHIN BOND PARK NO, II SUBDIVISION, sUvECT TO SPECIFIED
CONDITIONS,

WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to
• install streets, sidewalks, street lights, curbs, storm sewers, sanitary
sewers, underground utilities and other public facilities for the development
of subdivision; and
WHEREAS, the City has required the payment of fees and thd execution of a
.
Compliance Agreement which stipulates that:
"Upon receipt of certification by the Department of Public Works
that all requirements have been met and a One Year Maintenance Bond,
the City Council agrees to accept the public improvements, subject
to the requirements for correction of deficiencies and maintenance
for a period of one year„ . . ; and
WHEREAS, said Certification has now been received, subject to correction of
hereinbelow listed defioincieo; and `

WHEREAS, the subdivider has indicated a desire to retain the subdivision •
performance bond in full force and effect throughout the aforesaid maintenance
period, in lieu of submitting a separate maintenance bond,

Waverly Construction Company requests a modification of the street alignment
in the approved preliminary plat, Bond Park IL

`S The new street pattern would allow access to the future proposal for Bond Park
III subdivision.
Attached is the staff report for Bond Park II as approved at the November 15,
1983 Planning Commission meeting. No changes have,, been made to the number
of approved lots.
The following conditions were requested by the City Surveyor to be included in
the approval of the modification of preliminary plat S 9-83:
