and. S.W. Highland would be 'connected. Staff responded that unless
the. ball field for the Church was developed the road would not go
through. . "

• Tom McGuire, 9975 SW Sattler commented that the three smallest lots
bordered SW Sattler which has the lowest density. He felt these lots
were not compatible with the property across the street. He also 1 • : . .
would have preferred the 15 lot subdivision and did not, feel the
applicant, was doing any favors by changing the proposal from 25 to 22 , '

extending the road;, staff replied no.

frustrations with the Comprehensive Plan process and restated his •
opinions as to why this site is appropriate for- a 22 lot subdivision. ,"' '

possibility of constructing a cul-de-sac. r
a Commissioner Edin asked on what basis the Planning, Commission could

e John Ulwelling asked who was responsible for the street ,.
improvements; John Gibbon stated thatt the developer is responsible ,
for full street improvements on Kable, and half street improvements on
100th and SW Sattler. •
• Commissioner Edin expressed his frustration with changing the zoning
to R-5. He did not approve of the smaller lots where the applicant •
had proposed them. Pie did not feel this was a good transition. 2
• John Gibbon; presented the Commission with two alternative proposals
citing problems that they incurred, stating they felt the best;

BACKGROUND/PREVIOUS ACTION:
On June 25, 1979, the Tigard City Council approved a zone change from
Washington County RU 4 to Ci,'y of Tigard R-7 with conditioas (ZC 12-79).
41,1, On February 20, 1980,, the Plalning Diroctor approved a 15 IAA subdivision
at the R-7 density with conditions.
On September 7, 1982, the Planning Commission denied a request for a zone
A change, from R-7 to R-5 and approval of a 25 lot subdivision. On December
6, 1982, the City Council upheld the Planning Commission's decision for
denial, Oft February 28, 1983, the City Council denied a request by the
Robert Randall Co. for reconsideration of this matter. On March 28, 1983,
the Robert Randall Co. filed an intent to appeal with LUBA. On March 28,
1983 the Robert Randall Company also submitted an application (S 4,-85) for
subdivision approval. On March 16, 1983, the City Council adopted the
interim zoning map which designates this property R-5PD.. On April 11,
1983) the City Council voted to remand this matter back to the Planning
Commission.
AREA CHARACTERISTICS:
The surrounding area has been developed primarily as single family
residential. The Chu*.ch of Latter Day Saints lies directly to the south.
The lots to the west and north are developed to the R-10 density. The
property to the east is vacant.

SITE CHARACTERISTICS:
There is an existing house and garage on the site which will remain as a
part of the new subdivision. The site slopes to the south and is grass
covered. There are a few trees on the northern portion of the site.
APPLICABLE COMPREHENSIVE PLAN POLICIES:
2.1.1 The City shall maintain an ongoing citizen involvement program and
shall assure that citizens will be provided an opportunity to be
involved in all phases of the planning process.
Notices were sent to all property owners within 250 feet of this •
application. A notice was published in the Tigard Times on April
21, 1983. In addition, NPO # 6 has been notified of the
application.
2.1.3 The City shall ensure that information "n land use planning issues
is available in an understandable form for all interested citizens.
All interested parties are given, at a minimum, 10 days to respond.
in writing to the application and request under consideration and
are encouraged to do so. The planning staff is available to
address any specific questions concerning the application or the
application process.
6.1.1 The City shall provide an opportunity for diversity of housing
densities and residential types at variau.s price and rent levels.
Thz; subdivision of this property will provide 22 additional single
family building lots in Tigard.
7.1.2 The City shall require as a precondition to development; approval
that: ;.
a. Development coincide with the availability of adequate service
capacity including: � •
1. Public Water;
2. Public Sewer ( New development on septic tanks shall not
be allowed within the City); and
3. Storm Drainage.
b. The facilities are:
1. Capable of adequately serving all intervenin g properties
and the proposed development; and
2. Designed to city standards.
c. All new development utilities to be placed undervound.

7.4.4 The City shall require that all new development be connected to a
sanitary sewer service.
The applicant proposed to connect to an 8" public sewer line. in
S.W. Highland Drive.
7.6.1 The City shall require as a pre-condition to development that: ,.
a. The development be served by a water system having adequate
water pressure for fire protection purposes;

b. The development shall not reduce the water pressure in the
areas below a level adequate for fire protection purposes; and
c. The applicable fire district review all applications.
The Tualatin Rural Fire Protection District has reviewed the
i project and approved it as acceptable for fire protection
' purposes.
8.1,3 The City shall require as a precondition to development approval
that:
a. Development abut a publicly dedicated street or have adequate
access approved by the appropriate approval authority;
b. Street right-of-way be dedicated where the street is
substandard in width;
c. The developer commit to the construction of the streets, curbs
and sidewalks to city standards within the development;
d. Individual developers participate in the improvement of
existing streets, curbs and sidewalks to the extent of the
development's impacts;
f. Transit stops, bus turnout lanes and shelters be

the proposed use is of a type which generates transit
ridership;
g. Parking spaces be set aside and marked for cars operated by
disabled persons and that the spaces be located as close as
possible to the entrance designed for disabled persons; and i

h. Land be dedi.tated to implement the bicycle/pedestrian corridor
in accordance with the adopted plan.
The streets serving the Kable proposed development, SW K�bTe Street'
and SW 100th Avenue have been improved to city standards.
12.1.1 The City shall provide for housing densities in accordance ' ithy

The density proposed in the development conforms to those sat in
the newly adopted Comprehensive Plan policies, plan map and interim
zoning map.
TIGARD MUNICIPAL CODE PROVISIONS:
17.16.100 Tentative approval.
Within sixty days of the date of submission of the preliminary plat
the Planning Commission will review the plan reports of the •
agencies listed in section 17.16.090 and may give tentative
approval of the preliminary plat as submitted or may modify the
plat or, if disapproved, shall express the Planning Commission's
disapproval and reasons therefor.
No Tentative plan for a proposed subdivision and no tentative plan
for a major partitiln shall be approved unless:
1. Streets and roads are laid out so as to conform to the plats
of subdivision maps or major partition already approved for
adjoining property as to width, general direction and in all
other respects, unless the City determines it to be in the
public interest to modify the street or road pattern.
2. Streets and roads held for private use are clearly indicated
on the tentative plan asd all reservations or restrictions
relating to such private roads and streets are set forth
thereon.
3. The tentative plan complies with the Comprehensive Plan and
applicable zoning regulations of the City then in effect.
4. No tentative plat of a subdivision or map of a major partition
shall be approved unless there will exist adequate quantity
and quality of water and an adequate sewage disposal system to
support the proposed use of the land described in the proposed
plat.
18.20.030 Lot R-5 Zone. In an R-5 zone the lot size shall be as follows:
1. The minimum lot area shall be five thousand five hundred
square feet, excepting for duplex use.
STAFF ANALVSIS AND RECOMMENDATION:
After reviewing the proposed plat and conducting a field investig. ti,on.,
• staff ritcommends approval of S 4-83. Staff finds that the N'oposed
development conforms to applicable Comprehensive Plan policies, Tigard
Municipal Code provisions and is compatible with the surrounding land uses.
• staff further recommends that the following conditions be attached to
approval cf S 4-83.

1. Plans for public facilities to be installed in public rights-of-way
shall be reviewed and approved by the appropriate utility
district. All permits required for installation of public
facilities in the public right-of-way shall be obtained prior to
construction. All public streets shall be constructed to approved
city standards. Public sewer lines shall be extended to the
project boundaries in all directions.
2. All public improvements shall be bonded for 100% of the cost
thereof or constructed prior to issuance of any Building Permits.
3. The final subdivision plat shall be recorded with Washington County
prior to the issuanco of any Building Permits.
4. No changes or modifications shall be made to approved plans without
written approval from the appropriate City department.
5. No Building Permits shall be issued until 14 days after, Planning
Commission approval.
6. Access to all flag lots shall ize ten feet wide fel each lot. In
addition, a hard surface com►ni:n driveway shall be installed for
, access to the two lots. An access and maintenance agreement shall
be recorded with he deeds for lots sharing common driveways:

RESOLUTION NO. 3-2)---
IN THE MATTER OF THE DENIAL OF A MOTION FOP RECONSIDERATION OF RESOLUTION NO
82-136 ADOPTING A FINAL ORDER UPON COUNCIL REVIEW OF ITEMS S-4-82 AND ZC
12-82, AS PETITIONED BY THE ROBERT RANDALL COMPANY, APPLICANT.
(SUNNYS1DE ESTATES).
THIS MATTER came before the Council at its meeting of February 28, 1983, upon
the filing of a Motion for Reconsideration under TMC Section 18.84.330.
The Council had before it the entire record of the proceedings before the
Tigard Planning Commiss?on, which denied the, request with one dissenting vote,
on September 6, 1982. The ;applicant, The Robert Randall Company, sought
review of that decision by filing a timely Notice of Review on October 5,
1982. On December 6, 1982, the Council affirmed said denial and entered
findings and conclusions by Resolution 82-136.
Based on the record in this case, the Council makes the following FINDINGS OF
•
FACT:
1. The findings of fact contained in Resolution No 82-136 are hereby
reaffirmed by this resolution except as indicated below in Finding No 3.
2. By failing to provide a drainage plan with the application for what the
applicant has termed their "new proposal," ti'rre Council deters yes that the
applicant failed to show compliance with Statewide Plannink, Goal 11 as
well as submission requirements for subdivisions and rezonings. See
Resolution No. 82-136, Findings of Fact No. 9, December 6, 1982. The
applicant failed to deal with the drainage issue adequately by evidence
submitted in the recc_d, thus failing to carry its burden of proof on this
point.
3. The City has begun its scheduled revision of the Tigard Comprehensive Plan
which will bring the draft revised plan map, including consolidation and
revision of the existing NPO, Plans before the Council in February and
Mach 1983, rather than December 1982 as formed in Resolution 82-136. At
present, the Council has adopted the policy elements of the plan which
will be effective April 1, 1983, some of which (housing, public facilities

and services) affect the application under consideration.. During March, V�

The Council also makes the following CONCLUSIONS OF LAW:
1. The conclusions of law contained in Resolution No 82-136 are reaffirmed

2. The Council concludes that the application should not be remanded to the
Planning Commission. The issue raised by the applicant's Mot$,on for
Reconsideration (B)(1)(2)(3)(4) is the same as the issue which is the
subject of Resolution No, 82-136, Conclusions of Law Nos. 1, 2, and 3,
December 6, 1982. In view of the revision of the Tigard Comprehensive.
Plan and implementing ordinances already in progress, no purpose would be
served by the remand, due to the change in applicable criteria.
3. The staff may not waive substantive requirements of inn application when
accepting it for consideration.
4. The Council did not have a Comprehensive Plan amendment before it in this
application. The Council concludes that it was, therefore, not
appropriate to consider Comprehensive Plan issues which were not before

5. The applicant contends in Item II B(2) that the Council is free to approve
actions which vary from our NPO plans: We do not interpret either state
law, see ORS 197,175, 227.160 to 227.100, or our ordinance, TMC 18.84.100,
to allow this. In the event of con;=lict of differing standards, the
stricter regulation governs.
6. The Council also concludes that the applicant and the public are better
served by a new application being filed, if necessary after the adoption
of the Tigard Comprehensive Plan, Development Code, rather than sending
this application to the Planning Commission for a new hearing on criteria
other than that which was before the, Planning Commission previously.
The Council, therefore, ORDERS that the above referenced motion be, and the

GARBAGE RATES.
(a) Director of Public Works commented the resolution was not complete in
that it did not have the rate schedule attached. He was recommending
a "do not pass" until the applicant submits findings per the Tigard
Municipal Code that is acceptable to Legal Counsel. .
(b) There was considerable discussion by Council, staff and franchise '
haulers regarding passing through . other jurisdiction's fees and . t.
charges and meeting the existing City's code for findings.
(c) Motion by Councilor Cook to instruct staff to prepare an amendment to
` the garbage franchise ordinance to allow for pass through of fees '
increased by other sources, and an emergency clause be added for one . "",
: time only increase to be effective February 1, 1983 and that the
proof of the pass through be provided by the haulers. Motion

The private yards of the individual lots will meet the open space needs
created by the development. Landscaping requirements including two
deciduous street trees per lot will be incorporated into ce Conditions, °"
Covenants, and Restrictions of the Planned Development to enhance
present and future values of the area. In addition, the Summerfield.
Golf Course and field next to the Church will supplement this open space.
The area has sufficient recreational facilities according to the Tigard
Parks plan. Cook Park is approximately one mile away. Another park
in the vicinity is at Pinebrook and Hall. The addition of twenty two

lots will not have a significant impact on these parks. The private
yards will also serve as a recreation area for these homes.
The topographical features of the site have been incorporated into the
design of Sunnyside. Estates in order to maximize solar potential as
well as to inhance the lots individually.
SENSITIVE LAND FORMS
There are no sensitive land forms within the de; elopnient.
TRAFFIC CIRCULATIcN, IMPACTS
Thbre will be an extension of Kable from. S.W. 100th to the east property
line, plus two extended driveways off of Kable. Lots will access from
S.W. Kable, S.W. 100th and S.W. Sattler. This proposed circulation pattern
will provide safe access to each of the lots and has Fire District approval.
The extension of of will potentially allow the developers of the vacant
property (east of the subject site) to continue Kable through to 98th
upon development of that area.
Public transportation facilities are available to serve the proposed •
development. There is a Tri-Met stop o7 98th Avenue ;.nd Sattler ''pr►ute

PLANNED DEVELOPMENT APPLICATION, SUPPLEMENTAL, PART II
PROPOSED/UNDERLYING DENSITIES
•
The underlying density for the site is R5 which would allow 27 lots (see
density sheet). The proposed density is 22, or 6.4 lots per acre.
Lot sizes range from a minimum of 5,000 square feet, and are approximately
7,000 square feet, on average.
OWNERSHIP
° Individual lots will be privately owned. We do not anticipate a conversion
of ownership at a later date.
NARRATIVE STATEMENT
• The proposed development is in substantial conformance with the Compre-
hensive Plan designation as all homes are single family detached dwellings.
In addition, Sunnyside will lend to the diversification of housing densities
in accordance with Comprehensive Plan Policies (6.1) ; and, the smaller
sized lots will reduce overall costs, snaking this housing more affordable (6.2) .
Studies have shown, that 50% of the total estimated housing demand is' for
homes produced on 7,500-5,000 square foot lots. Because there is a
growing demand for owner occupied housing and for smaller; more affordable,
homes, this is an Lzpol taut consideration.
There are no exceptions from the standards of the underlying di,strict.
Due to the transitional cr sensitive nature of the area Sunnyside
Estates will be a Planned Development. The Planned Development overlay
allows an averaging of lot sizes which t°crmonizes the development with .
the surrounding area,as the proposed development lies between an �ea
of larger lots (to the north and northwest) and the smaller .Su merfielri
lots (southwest) . The vacant property to the east of Sunnyside Estates
is developable at the sPm,e density as the proposed P-D whjr,h would in-
'7° dicate furthur compatibility.
Sunnyside. Estates will be in compliance with. TIM 18.56.050 as it will
uphold existing peripheral yard requirements of the underlying zone
The approval of the development will have a beneficial effect on the area
as it will result in the construction of storm sewers solving chronic
drainage problems in the area as well as extending sewer lines needed
by some of the arena's residents. Also, the Planned Development does
not provide for the maximum density allowed under the underlying zone.
There are no deviations or variances from tl. standards, specifications or
requirements relating to this proposal.
