Dear Mr. Lautt,
I have received your letter dated December 12, 1982 Out- •
lining your reasons for requesting an extension for the approval
• of Lautts Terrace Subdivision. Unfortunately, Section 17.06.09
of the Tigard Municipal Code states that after expiration of the
approval period and extension, if any, a preliminary plat shall
be refiled and considered as a new application. Since your
original approval has expired and you have already received one
extension, a new application must be required.
• I am sending the appropriate applications for you to complete
• and return to Liz Newton of my staff. The fee for filing is
$250. 00 plus $5.00 per lot. The fee shall be submitted along
• with the written application.
If you have any additional questions or need further clarifi-
• cation on this matter please contact myself or Liz Newton of my
• staff.

/. FINDINGS OF FACT:
1. Property is zoned R-7 single-family residential. •
• The minimum lot size allowed, is 7,500 square feet.
Applicant proposed lot sizes of approximately
11,000 square feet.
2 Sewer Service is being installed, at this time.
Water is available.
3. 97th Avenue is substandard. A local improvement
• district (LID) may be formed to improve this
street, but if the LID is not, Mr. Lautt and
Mr. Iiusvar will joint-venture the public improve-
ments.
4. Necessary street R.O.W. dedications were a condi-
tion of the ZC 6-79 and these dedications will be
made.
5 . One house exists on this property and one mobile
• home is in place. The hote will stay, the mobile
home will be removed.

III. STAFF ACTION:

Staff approves this subdivision with the folloiging
conditions:
1. All conditions of ZC 6-79 shall be completed prior
to the issuance of Building Permits.
2 R.O.W. dedication on S.W. 97th shall be made to
the satisfaction of the Public Works Director.
Half street improvements to local street standards
shall be made or a Local Improvement District shall -
• be formed to accomplish street improvements.
3 . The mobile home on site will be removed prior to
the issuance of Building Permits. All septic tanks
on site shall be pumped and filled with gravel.
4. No Occupancy Permit shall be issued until ell con-
ditions placed upon this development by the City of
Tigard have been satisfied and inspections verifying
this have ben carried out by the appropriate depart- .
ment.
5. No changes will be made to approved plans or specifi-
. cations unless folwal application is made to the
appropriate City department and changes are approved
• by that department. Application for changes will be
made in writing and shall include applicable drawings.
6, Grading and construction plans for all work in public
rights-of-way and all other public improvements shall
be prepared by a registered professional engineer in
accordance with City standards, and shall be submitted
to the Public Works Department for review.
All public improvement ill require a Compliance
Agreement and must be (design) approved by the
Public Works DeparEment, and mast be either (1) fully
and satisfactorily constructed prior to the recording-
of any minor land partition, public dedication, final
plant, or issuance of Building Permits; or (2) bonded
to the City for 100% of the estimated cost thereof
prior to the recording of any minor land partition,
public dedication, final plat, or issuance of
Building PetlititS,
