Subdivision. As I recall, Subdivision and conditional use permit applications
were submitted, but action only occured on the Conditional Use. Permit application.
The subdivision never went to a hearing because staff wanted to wait until sewer
was available, At that time we forgot to request a return of the application fee.

On behalf of some property owners between Fanno Creek and Hall Boulevard
in the City of Tigard, I am attempting to form a local improvement district

(LTD) to provide sanitary sewer service to the area north of Durham road.
Enclosed is a petition to the Tigard, City Council to initiate a LID process.
The process is in two stages:
1. Submission of the petition, which allows the city Council to begin
a sewer service study an preparation of cost estimates.
2. Final authorization of the sewer improvements following a complete
review of the cost estimates by all property owners involved.
Both of t'oeee stages in the process require a public hearing before the
• City Council. It i5 important to note, that your signature on this
petition does not eliminate your ability to oppose or comment on this
sewer improvement in the future if you feel the r-osts are too high, or
if you feel the timing is not appropriate. This petition only shows your
intereSt in forming a LID at this time.

SUBJECT: PROPOSED SUBDIVISION - CECIL BOONE PARK, S11-81
Thank you for the opportunity to comment on the proposed
subdivision, Cecil Boone Park. We ask that this letter be
made a matter of record by the Planning Commission .
Over time, the Agency has developed a good relationship
with the neighbors adjacent or near to the Durham Advanced
Wastewater Treatment Facility. Even the best operated
sewage treatment facility occasionally emits odors and can
be the source of unusual noise. In addition, because of
the size of the Durham Facility, vehicle traffic moving
personnel and materials in and out is periodically heavy.
• In conclusion, we believe that another use of the site
• would be more compatible than the proposed dense residential
neighborhood.

REQUEST
The applicant, Dave Hall & Company, is requesting approval of a Preliminary Plat to develop up to 16 single family attached homes on 5,000 ;square, foot lots on
2.70 acres of property. The subject property contains one single family house which.
is proposed to remain.
DEVELOPMENT PLAN
The proposed lots will be sorved by 50-foot wide public roads, with the main access
off of Durham Road. No lots will have driveways directly onto Durham Road. Street
"A" has been located along the west side of the subject property to eliminate sight
distance problems long of Road. Street '1 west the top of .

All of the lots are 5,000 square feet in area, and contain adequate lot width and
depth to accommodate the type of use proposed. The 40-foot right-of-way along the

create sight distance safety problems along Durham.. Road. This 40-foot right-of-way ;
should be vacated when development Of Tax Lot 5200 is proposed.

This proposed plan allows for redevelopment of surrounding properties, and provides
the opportunity to face existing and future houses on Durham Road, but with access
from new interior streets. The subdivision plan as submitted is the best plan for
development of this area, because it provides an adequate plan for future develop-.
1 ment, and it solves all the potential safety problems.

COMPLIANCE WITH THE COMPREHENSIVE PLAN AND SURROUNDING ZONING
.The. subject property is designated low density residential and is proposed to be re-
zoned R-5 upon annexation into the City of Tigard. This development complies With
the proposed zoning Lqd the existing land uses in the genreal area. The following
policies of NPO # 5 apply: •
Policy 2. This plan will be developed with all urban services and facilities.
Policy 3. This development is provided with an adequate level of public facilities
and services.
Policies 6 and 8. Duplex type units are proposed which have been identified to be
compatible with single family residential detached houses.
PUBLIC FACILITIES
A 12" waterline is available along Durham Road and sewer service will be, provided by
a pending sewer LID. Storm water will be piped into, a natural drainage swale which
flows directly into Fanno Creek. All other public services and facilities are avail-
able.

These proposed units will be sold as owner occupied units, and will be designed to be
compatible with the existing low density residential development in the area This
will retain the character of the area, implement in filling, and, provide needed mod-
erate income housing for an vver growing segment of society which is being priced ott
of the home ownership market.
Increased density through dplex development is in compliance with Metro and L,C.D.C.
Goals and will help the city of Tigard to achieve an overall higher average residevaal
density in the City Limits.
