APPLICABLE PLANNING POLICIES AND STAFF ANALYSIS 1. LCDC Goals and Guidelines: a. Citizen Involvement Goal #1 - The intent of this goal is to insure the opportunity of citizen input to the planning process. In the case of this application, all property owners of records within 250- feet of the site have been notified by U.S. mail of the date, time • and place of this hearing on this application and any interested parties will be heard. In addition, Neighborhood Planning Organize- , tion Number 6 (NPO #6) was notified of this application. b. Land Use Planning: Goal #2 - The intent of this goal is to establish a planning process and policy framework to assure an adequate factual basis for all land use decisions. In the case of this application, all applicable LCDC goals and guidelines, NPO #6 policies and Tigard Municipal Code sections have been considered in review of this appli- cation. c. Open ?pace: Goal #5 The intent of this goal is to conserve open space and protect natural and scenic resources. Approximately 3.7 acres of this is within the Floodplain and the City has stated this a rea is to be dedicated as open space area.. that d. Areas Subject to Natural Hazards: Goal #7 - It is the intent of this goal to protect life and property from natural hazards. Three of the lots and the proposed street directly abutt the floodplain, and ' the City is also concerned over the drainage system for the subdi+vit:ion as water runoff could adversely effect the lower lots and the floodplain. Therefore, the City has stated that a drainage study should be completed prior to final plat approval. g: - this g p e. Housing: Goad. ��1.0 The intent of +-his oa.l is� to provide for the housing needs of citizens of Tigard. This subdivision is a logical extension of the previous Kneeland Estate subdivisions and will provide twenty-seven additional dwelling units to Tigard's housing stock. f. Public Facilities and Services: Goal #11. - It is the intent of this goal to plan and develop land within a. timely, orderly and efficient facilities s and d se:rv�.ces. All of the neede d facilities arrangement p ties and services can be extended from the Kneeland Estates I subdivision. Transportation: Goal g. Transportation: #12. - It is the intent of this goal to provide and encourage a safe, convenient and economic transportation system. The. applicant is proposing to dedicate a 50-foot right-of-way for for street purposes to service twenty-two (22) of the 27 lots. The remaining five lots will be served from the existing cul-de-sac (S.W. 95rd Ave.) at the north end of the proposed subdivisions. �..4 r STAFF REPORT S-11.80 Page �,. 2. Applicable NPO #6 Policies: a. Polio` 3. Residential subdivisions will be developed, with paved streets, curbs and gutters, street lights, and walkways according to City standards. All utilities will be placed underground. b. Polio 4. Development will coincide with the provision of public streets, water and sewerage facilities. The facilities shall be (a) capable of adequately serving all intervening properties as well as the proposed development, and (b) designed to meet City standards. As stated in the above section all public facilities and services will be provided as per the Tigard Municipal Code requirements. c. Polio 7. Within the urban low density residential area, allow du/ilexes on lots less appropriate for single family home s to include locations at street intersections, adjacent major thorough fares, and as buffers between multi-family and single family areas. 3. Tigard Municipal Code: a. 18.56.140 Permitted Uses--Residential districts in Planned Develop- ments. For residential districts, the following uses are permitted in development district: (1) Housing concepts may includd, but are not limited to, single family residences, duplexes, row houses, townhouses, cluster units, or multiple family dwellings. Twenty-two of the twenty-seven lots are proposed as zero lot line 4. lots. Most of these lots will either directly abut or be across the street from the floodplain area. Although single family residences could be built on the proposed lots, the higher density would have more available open space. In addition, the applicant has also shown on the preliminary plat that the lots could be further divided which would encourage additional home ownership within the area. b. SectioZ 17.06,065, Tigard Municipal Code states that le"No preliminary plat for a proposed subdivision and no map or major partition shall be approved unless the planning director finds: (1) Streets and roads are laid out so as to conform to the plats of subdivisions Or maps of major partitions already approved for adjoining property as to width, general direction, and in all other respects unless the L iity determines it to be in the ptiblie interest to modify the street or road pattern;, (2) Streets and roads held for private use are clearly indicated the tentative plan and all reservations or restrictions on relating to such private roads„ and streets are Set forth thereon, .. .... ;.: ,-.:..a,.,... .,,:a,•mm,..v+o. .+.rrwac,uu.anc.r.....a av w _..,.ux: `.. ..,, ._.. ,.. r .,.....,..i i STAFF REPORT 5-11-80 Page 4 (3) The preliminary plat complies with the com pr ehensive plan, the applicable zoning regulations, and the regulations within hin this title; (4) There will exist adequate quantity and quality of water and an adequate sewage disposal system to support the proposed use of the land described in the proposed plat." The applicant is requesting preliminary approval of the proposed 27-lot subdivision (Kneeland Estates III). All of the above criteria • will be met in accordance with all City policies and ordinances. C. CONCLUSION Staff recommends that the proposed preliminary plat be approved subject to the following conditions: • 1. No Occupancy Permits shall be issued until all conditions placed upon this development by the City of Tigard have been satisfied and inspections verifying this have been carried out by the appropriate department. 2. No changes will be made to approved plans or specifications unless formal application is made to the appropriate City department, and changes are approved by that department. Application for changes will be made in writing and shall include applicable drawings. 3. Grading and construction plans for all work in public nigh -of-way and all other public improvements shall be prepared by a registered professional engineer in accordance with City standards, and shall be submitted to the Public Works Department for review. All public improvements will require a Compliance Agreement and must be (design) approved by the Public Works Department, and muse be either (1) fully and satisfactorily constructed prior to the recording of any public dedication, final plat or issuance of Building Permits;, ' or (2) bonded to the City for 100% of the estimated cost thereof prior to the recording of any public dedication, final plat or issuance of Building Permits, 4. All existing and proposed utilities shall be placed underground. Street lighting installations shall be approved by the Public Works Department. 5. A metes and bounds legal description and map shall accompany a dedication of public rights-of-way, and shall be prepared by a registered engineer or land surveyor . 6 A drainage study soil report shall be prepared showing d',�;a1nnaga,e approval ud and sb�.l re'`�ort . through the open space to the south.
