. This is to confirm our telephone conversation of May
20, 1980 concerning the above referenced matter. •
As stated, I represent Mr. Richard Caf f al, one of
the principals in the Berea Development which was the subject
r matter of the variance proceeding B7-77 and subdivision
' proceeding S14-77. 6
As I stated in our conversation, the subdivision
approval was granted upon the condition that my client at that
time make certain street improvements in the area of Ash and
Garrett. It was understood by all concerned that in order to
• accomplish all the improvements, the city and the planning
department decided Ms. Jacobson would have to participate by
dedicating a certain portion of her property contiguous to the
street area. At the time this was first proposed, and while
the subdivision was being constructed, Ms. Jacobson refused to
� so dedicate. At that time, my client extended and expended the

sums necessary to make the improvements that could be made on
1•• ` the streets without the dedication. It is my understanding
r that this was done with the acquiescence of the City of Tigard
by virtue of Ms. Jacobson's failure to participate by
1 dedicating the necessary property

dedication necessary for the total improvement of Ash. and

between myself and, Mr: Howard. I believe this is
k effectivel y set out in the correspondence between Mr Howard
and myself which should be in your file.
My basic, position is as set forth in, my letter of
March 17, 1988, wherfin my client states that he is ready,
willing and able to contribute and

to anyone else making the necessary improvements, the sum of
$7,0330 which i .the bid amount as to the cost of the
improvements if all the improvements had been made at the time
,• they were originally contemplated. My clien; feels that it is
unfair, inequitable and improper that they be asked to make the
full improvements now, two costs years later, when the costs have

effectively doubled. ,
I feel that since the improvement will be of economic
benefit to the adjacent property, includiny the property which
is the subject matter of the MLP, that property should be
required to participate .by assisting in the improvements and
making the half-street improvement required. It will be of
economic benefit to Ms. Jacobson, and as I stated, my client
would be willing to contribute the amount of money they would a
have expended in the initial instance.. If further
documentation or discussion is necessary, please let me know.

I have a terrible feeling that you are trying to build a case by reference
to the changes in cost between the date that Ash and Garrett should have been
improved and, the costs today. Should you decide to argue this point, I
will indicate that your client's refusal to cooperate to date has been the
. cause, of increased costs. E Y Obviously, Ms» acobsen's refusal to cooperate
has postponed the completion of this improvement also.
My concern, as the Planning Director, is to resolve the issue. I
have been assured by both your client, Mr. Caffal, and by Mr. McMonagle,

that then will cooperate. I have the assurance his. Jacobsen that s.
will do what is rlecessarry. What I need is a conceptual construction plan
showing the proposed retaining wall configuration in relation to Ms. Jacobsen''s'

dedication, and we can then negotiate a settlement of the fiscal responsibilities
of all parties.

In response to your letter of September 24, 1979 enclosed please
find a photocopy of the document received from Harris and McMonagle
Associates setting forth the difference in the costs between the
1977 and the 1979 cost of construction.
Without reiterating the position of Mr. Caffal and Mr.
McMonagle,, it is felt that the intent of the staff personnel at the
time and also the Planning Commission and the Board of the City was
not such that the item was open-� el.:a*ed, but was on the basis of
obtaining immediate permission ',erom the property owner within a
reasonable time frame to allow the requested construction, and not
. an open-ended matter considering inflation, time and cost

disagreement as to the respective responsibility of the parties which
surround the requirements of a descision on the subdivision S 14-77
and the transcripts pertaining thereto as the relative responsibility

Since the complete transcripts of the hearing and the

Dear Sir:
I have reviewed the tapes of the Planning Commission meeting on July 19,
1977, concerning your request and
_e u4s� for a variance to street widths aa1
cul-de-sac configurations in Berea Subdivision.
- You clearly stated that, if the Planning Commission allowed you to reduce
the width of certain streets in Herea you would improve the Ash and
Garrett intersection. The implication is that you agreed to a trade-off: %
re.duced road building costs in terea in exchange for improvement to Ash
ti and Garrett Streets. ,
Mrs. Jacobsen is willing to dedicate the land. She objected to your
• original "personal design approach" in her front yard -_ i.e. slope it
severely to the sidewalk. She prefers a retaining wall be installed to
protect her property. We feel this is a reasonable request.
Your reasons for not completing this project are not very convincing. The
dea$gn capability and construction labor, material and equipment needed to
accomplish this task is available.
1 think we have procrastinated long enough. Mrs. Jacobsen has agreed to
dedicate

would greatly improve the visability. I have not made. a Sinai decision

question of offsite construction adjacent to the Berea Subdivision.

When the Planning Commission a ���dd Berea, it was wit
that we work out, if possible, with staff some type of improvement of Garrett
and Ash Streets adjacent to Tax Lot 400. The City was to obtain the necessary
land by dedication so the improvements could be constructed. This was to hare
been d,-;nn so ;.hat coostructi on of the improvements could be done during the
normal c'►ns tructi:on period sequence of the various construction phases of
Berea.
In all of my discussions with you and John Laws at the outset of the
project, I have made it clear that the improvements must e done during the
normal phase of construction. This was not possible due to the lack of
° " cooperation with the land owner of Trxx Lot 400.

• the proposed improvements. She a�e did not want any part of it Period, . Now
after the phases of constructi :in are complete, she makes up her mind. The ana-
logy to this is after the house is completed, she decides to put in a window.
The p o scope window during the normal construction phase would have been
minor, but after the house built it is a comp letly different operation, be-
cause of complexity and scope of the work involved.
We have dealt together in good faith to this point, but we cannottbe
expected to have our costs controlled because of a third party indecision.
I would like to meet with you to discuss this further. Please let me
know when would be a good time.

1. The site is a vacant, open Parcel , with the exception of
two small buildings that have been gutted out by fires.
The topography ranges from 250 feet at the southeast cor
1 ncr of the lot to 230 feet at the northeast corner Single
family homes surround the site on the north, east , and
south. An open field and apartments beyond the field are
located to the west , An older single family home located
at the intersection of Garrett and Ash is not included
within the subdivision

2. Water is available to the site by way of a six inch water
line along S .W. Garrett Street and a 12 inch line along
S .W. Ash Street . Sewerage sr-17vice is also available from
2 eight inch lines, one from S .W. Barnum Street and the
other from S .W. Cresmer. Both lines are of adequate ca-
pacity to facilitate the proposed density.
3. S .W. Ash and S .W. Garrett Streets are both substandard in
right-of-way and improvement width. In order to bring the
existing right-of-way to meet the NPO #1 Plan standards, a
five Toot dedication on the property along S.W. Ash Street
and a five foot dedication along S .W. Garrett Street would
be required.
4. S .W.. Creamer Drive presently terminates at the north prop-
erty line of the plat . The applicant is proposing to ex--
tend S .W. Cresmer Drive through the subdivision where it
will intersect with S .W. Ash Street. Section 17.28 .030 of
the Tigard Municipal Code states "that the arrangement of
streets in a subdivision shall provide for the continua
t ,on or appr.opri a .e projection of existing principal
streets in surrounding areas. " Joe Greulich, Tualatin
Rural Fire Marshall, has stated that S .W , Cresmer Drive i T7

in need of improvements . Sight ''visibility is impaired by
the present radius at the intersecting streets as well as
a earth embankment, which, is covered with shrubs and trees ,

not within the jurisdiction of the City.

III . CONCLUSIONARY FINDINGS
1. The proposed preliminar y plat conforms to the Tigard Com-
munity Plan, 1971 in that the proposed lotting pattern is
