RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE FINAL PUBLIC
IMPROVEMENTS CONSTRUCTED WITHI kN MARK
WHEREAS, the City of Tigard Subdivision Ordinance requires
installation of streets, sidewalks, streetlights; storm sewers,
curbs, sanitary sewers, underground utilities and other public
facilities for the development of subdivisions; and
WHEREAS, the City required the payment of fees and execution
of a Compliance Agreement, which stipulated that:
"Upon receipt of certification by the Departmentcf Public
Works that all requirements have been met and a One Year Maint-
enance Bond, the City Council agrees to accept the public
. ,
improvements subject to the requirement for correction of
• deficiencies and maintenance for a period of one year . . . and
WHEREAS, the City Council received conditional certification
from the Department of Public Works and the maintenance bond, and
WHEREAS, the City Council accepted said improvements, subject
to correction of specified deficiencies during the maintenance period,
via Councol Resolution .No. 73-340 and
WHFREAS, the Department of Public Works has now certified
that said specified deficiencies have been corrected, and all
public Improvements thereinregard said subdivision are complete, and
WHEREAS, the required one year maintenance period has

BF.4. IT RESOLVED that the City Council of the City of
Tiard, Oregon, hereby accepts all public improvements constructed
within Burnham Park subdivision, said subdivision being mcorded in
Book 32 on Page 3 in Washington County, Oregon, -Plat Records,

bond.

Staff Findlngs and Recommendation
The staff finds that the propose 4o-foot right of way
cul-de-sacs will be adequate for utilities, 4-foot
sidewalks, and street widths. However, it is still the
staff's opinion that sidewalks are unnecessary for short
cul-de-sacs. It is also the staff's opinion that 4-foot
sidewalks should be provided, on both sides of S.W. Bill
Street.
The staff recommends that the cul-de-sac street pavement widths be
, 28 feet and that sidewalks, f required, be 4 feet in width and
located next to the curbs (to til,,,Flander around clustered mailboxes).
The staff recommends that tbr Planning Commission consider deleting
sidewalks on cul-de-sacs of -Less than 200 feet in length. The
• staff also recommends that the cul-demsac radii be 40 feet.
It is recommended that preliminary approval be granted. with
• the following conditions:
