Dear Chris,
This confirms that:
1. Permit MST2004 -00200 for the construction of your house at 13222 SW
Rockingham Dr., Tigard, received final inspection approval on Friday, August 11,
2006 and a Certificate of Occupancy has been issued. The property is now in
compliance regarding the previously cited violation of Occupancy Without Certificate
of Occupancy /Final Inspection Approval.
2. You and the City of Tigard have signed an Easement/Encroachment Agreement and
with that agreement now in effect the property is now in compliance regarding the
previously cited violation of Encroachment Into Public Easement.
3. Permit BUP2006 -00129 has been issued to you for construction of a deck at the
residence and the property is now in compliance regarding the previously cited
violation of Construction Without Permit.
4. All issues have now been resolved regarding the violations listed in citation 89645,
issued 5/26/06, and referred to in previous correspondence and the City of Tigard
considers the property to be in compliance.
5. In acknowledgement of your cooperation in resolving the previously outstanding
issues and by copy of this letter the City of Tigard herewith respectfully requests the
Tigard Municipal Court to dismiss citation 89645 issued 5/26/06 and impose no
penalties.
Congratulations on resolving the encroachment issues that delayed completion of your home
and thank you for the cooperation you have demonstrated throughout the process. Please

I, Christopher Duffin, as the responsible person for 13222 SW Rockingham Drive,
Tax Map 2S104DB, Tax Lot 04700,,agree to the following:
A conditional approval has been granted for occupancy of the above address for a
period not to exceed 30 days from this date, by which time the following conditions
must have been met and,approved by inspection by the City of Tigard Building
Department:
Permit MST2004- 00200, BUP2006 -00129 and a recorded Encroachment Agreement
must be completed and approved, including all outstanding corrections, ancillary
permits and fees. Specifically, the corrections listed on the inspection report dated 4-
17-06.
It is understood that the City will withhold action until May 17, 2006.
Upon compliance with all above conditions, this case will be closed. It is further
understood that if these conditions are not complied with fully, a Summons and
Complaint may be served without further notice for violation of requirements set
forth in the Oregon Residential Specialty Code (Final approval required prior to
occupancy).

RE: STATUS AND NEXT STEPS: House and Deck Permits, MST2004 -00200 and BUP2006-
00129, and Easement /Encroachment Agreement.
Dear Chris,
This confirms that:
1. The Easement /Encroachment Agreement between you and the City of Tigard is now
in effect, both parties having executed it and the time for public comment having
elapsed, and the Building Division has received a copy.
2. Your application for permit BUP2006 - 00129 for construction of a deck that will
encroach into the City's Public Utility Easement at 13222 SW Rockingham Dr.,
Tigard, has, with receipt of the Easement /Encroachment Agreement, been approved
and is ready to be issued to you upon- payment of the permit fees of $240.17.
3. Now that the Agreement has become effective and as soon as the deck permit is
issued, Final Plumbing and Building Inspections may be scheduled for your permit
MST2004 -00200 for construction of your home. Upon your receiving final
inspection approval we will issue a permanent Certificate of Occupancy (CofO) (as
opposed to the Temporary and Conditional CofO previously issued.)
4. Upon issuance of the permanent CofO we will ask the Municipal Court to dismiss
citation 89645 issued 5/26/06 for Occupancy Without Final Inspection Approval.
I have enclosed a copy of the Agreement and a copy of our 4/17/06 inspection report
under permit MST2004 -00200 which shows the few corrections that were still required.
Obviously, items 3 and 4, pertaining to the deck permit and Agreement will be satisfied as
soon as the deck permit is issued. Please call for Final Plumbing and Building Inspections as
soon as items 1 (downspouts) and 2 (street trees) are completed.
