The existing sign is 24 square feet and your proposed additional sign is 48 square feet; the additional sign area would supercede the maximum allowable sign area for the property. According to Tigard Municipal Code 18.102.030.A, a visual clearance area exists at the intersection of your accessway and SW 72nd Ave. "A visual clearance area for all intersections, street and accessway intersections (accessways having 24 feet or more in width), and street or accessway and railroad track intersections shall be that triangular area formed by the right -of -way or property lines along such lots and a straight line adjoining the right -of -way or property lines at points which are 30 feet distance from the intersection of the right -of -way line and measured along such lines." The site plan you submitted indicates the sign you propose violates this code. A revised site plan reflecting appropriate placement of the sign and a revised elevation plan reflecting appropriate sign dimensions need to be submitted. As before, three copies of each are required. Copies of the cited Tigard Municipal Code sections have been attached for your perusal. These plans and applications will be on hold at my desk pending your revised submittals. However, please be aware that the City of Tigard maintains regulations on Temporary Signs. As a business owner in Tigard, you may not be aware of the ordinance below which was enacted not only to preserve and maintain the beauty of the surrounding areas, but for the safety and welfare of all citizens. TIGARD MUNICIPAL CODE SECTION 18.114.100 TEMPORARY SIGNS "A temporary sign may be an "A" board frame, banner or lawn sign which is not permanently erected or permanently affixed to any sign structure, sign tower, the ground or building. It also states that one sign permit is allowed per business for a period of 30 days, with two additional permit periods allowed per calendar year. The size of the temporary sign is limited to 24 square feet." Temporary signs cannot be placed in the public right of way or any location which would interfere with pedestrian or motor vehicle traffic. Particular attention needs to be paid to areas where a sign would create a visual impairment. A temporary sign has been observed at or near your business location which appears to be unlawful. Your business is responsible for proper placement and display of the sign. You are requested to remove the sign until all requirements which would allow you to legally display the sign are met. Please remove the sign within 72 hours. If you wish to continue to display the sign you will need to apply for a Temporary Sign Permit at Tigard City Hall. Failure to comply with this request may result in the issuance of a citation, court date and possible fine. Illegal display of temporary signs is a Class 1 Infraction which may carry a fine of $250.00 per day per violation. I am available to answer your questions specific to this notice.
