The following items must be addressed during the project construction: 1. The setting of epoxy anchored seismic restraint bolts must be inspected and approved by a Special Inspection/Testing Agency. 2. The installation, inspection and monitoring of the retrofit shear walls must be approved by letter by the Engineer of Record (Final Observation Report) 3. The final building inspection will not be made until the Site Development Review permit has been finaled by the Planning and Engineering Departments. 4. All plumbing fixtures and mechanical appliances must be under separate permits, including the walk in freezer. 5. All electrical repair and new installation must be under separate permit. 6. Mr. Dalton is requesting that the exterior stairway lift be allowed for this project. The following items outline the rationale for this request. 1. Alternate methods are allowed for the accessibility requirements of Chapter 11 per Section 110 The requested stairway lift will provide a substantially equivalent means of accessibility to the lower floor level • 2. The majority of the employees (3 Maximum) work on the main floor level organizing and • preparing food trays for delivery to offsite functions. There will be a maximum 'of,2 people cooking on the,,lower level. The owner agrees that if a qualified employee is hired who has a mobility disability the owner will insure that another employee will be available to assist in the movement from the main floor level to the lower kitchen level. 5. With the proposed exterior stairway lift an accessible route from the public way (Pfaffle Street) to the main, accessible entry is completed. 6. (see attached) 3/15/02 Received revised plans and letter from Nicoli Engineering dated 3/11/02 (see Attached) 3/21/02 Response sent to Nicoli Engineering via fax regarding Nicoli response and amended plans. (Still not in compliance with code). May /02 On site meeting to discuss submitted plans, and to respond to report of work being done without permits or approvals. Letter received with plans from Nicoli Engineering, limiting their involvement and authority to the Structural, and ADA access to the main floor only. This needs to be resolved prior to issuance of any additional permits. BUP2002 -00030 The City of Tigard Building Division has reviewed the submitted building plans for the above referenced address in accordance with the Oregon Structural Specialty Code (OSSC), 1998 edition and the Uniform Fire Code, 1997 edition as amended by Tualatin Valley Fire & Rescue. The following items need to be addressed and are not in compliance with the above mentioned Codes: Note: Under City of Tigard Policy Number 1 -700 for minimum requirements for change of use. The following structure shall be reviewed as an Alteration for Accessibility for existing buildings. OSSC, Section, 1113. Provide a barrier removal plan provide the following items. 1) ADA parking stall, shall be as close as practical to the main entrance door with an accessible route from the parking stall to the building. Please alter the plans showing a new main entrance off the south elevation entering the living room/office area. Note: Floor plans show a window and possible sliding glass door, (elevation plans show egress door only). Accessible route shall be by code complying ramp system with proper width, slope and fall protection if required. 2) All areas within the structure shall be accessible by means of ramps not exceeding 1/12 slope or provide a chair lift. Since the building is comprised of a split level construction and the primary function of this occupancy is located on the main level and lower level shall comply to this requirement. Upper office area need not comply at this time because office area is provided on the main floor. 3) Unisex restroom on the lower floor does not meet clearances as specified in chapter 11. Toilet clearance to wall shall be 18 ". Clearances to water heater closet shall be of size to allow side transfer onto the water closet. An additional sink may be required in the prep kitchen on the main floor. 5) Plans indicate a walk -in freezer, please provide additional details on where the _ compressors and floor drains are located. 6) Plans indicate a "fume " hood serving a grill. Grills require a Type 1, grease hood with fire suppression system. Grills are required to maintain 18" clearances to unprotected walls or one hour construction. Plans show a non -rated openable window directly behind the grill. Grease duct terminations shall be more than 36" from any openable window or air intake. 7) Plans indicate a prep kitchen with what appears to be a range and warming ovens. Ranges and ovens are required to be served by a hood system. Depending what is prepared on the range or ovens would determine type of hood required. a. Type 1 grease, smoke (fire suppression required) b. Type 2 steam, vapor, odors and heat (no suppression required) 8) Please re submit a fair market value for the proposed work or the Building Official shall assess a value for the work decribed. New main entrance has been noted on sheet 1.1 and 2.1. The existing sliding glass door is to be removed at the prep kitchen area, and replaced with a 3' wide door and a relite with safety glazing. This will allow access from the ADA parking stall and also helps the business function better and will provide better security. The ramp from the ADA parking has a maximum rise of about 4 ". 2. The office /prep kitchen is accessible from the main south entrance from the ADA parking stall. The lower level or main kitchen is accessible from the public way. Also, the stair from the upper level (office /prep) to the lower level (work kitchen) is to be modified to meet ADA requirements. Refer to sheet 1.1 and 2.1. 3. The unisex restroom on the lower floor has been revised to meet required clearances. 4. I have notified Mr. Dalton of the necessity of a hand wash sink in this environment. He was aware of this requirement and had already discussed this issue with the Health Department. It was agreed that a section of the compartment sink would be utilized as a hand wash sink. 5. The walk in freezer is actually a cooler, not a freezer (sorry). The compressor is located at the SE corner of the building. The existing floor drains and compressor are shown on sheet 2.1. 6. If not already, the owner will move /adjust the grill to maintain 18" clearance. The window adjacent to the grill has been screened /infilled and is no longer operable. We have a note on sheet 3.1 that the second story window will either be made inoperable or the exhaust fan shall be relocated to meet the 36" clearance. The grill location and clearances. The grill is required to be under the hood. The hood shall extend to a minimum of 6" to the sides and front of the grill. If the hood is existing you may need to provide wall protection and remove the window inorder to be in compliance. Note the wall protection is normally stainless steal over one -hour construction. In regards to the oven /range if the hood system is not a true Type 1 or Type 2 and the range is not a commercial grade unit we would require it to be removed or changed out. Just because it's pre - existing would not be reason to approve it or allow it to remain. Thank you for letting Mr. Dalton know about the hand sink. I was not aware if you have a three - compartment sink you may use one compartment as a hand wash sink. I was lead to believe that the three - compartment sink was required because you need a wash section, rinse section and sanitized section. Specifically, you inquired about the application of the fire, life safety and accessibility provisions of the Oregon Structural Specialty Code (OSSC) to such scenarios. I apologize for the length of my response, but I believe the topic warrants the dialogue. In addition, I am confident that you understand many of the following applications but I have included them anyway for the sake of continuity. With regard to OSSC 3405, exception, you asked; "Does this mostly apply to non fire, life safety standards ?" You also asked; "We would like some more specific state guidelines and rationale to satisfy structural, fire and life safety, and accessibility issues in occupancy changes of this nature. Specifically, if and when these items are fire -life safety standards in new buildings, what is the rationale for not requiring them in changes of use ?" In general, each change of occupancy must be judged on its own merits including; fire, life safety and accessibility issues. I believe it was the intent of the Uniform Building Code (UBC) to allow building officials broad discretion in allowing a change of use as being discussed without mandating full compliance with the code. Requiring full compliance in any existing building may be largely impossible. If the overall proposed use is no more hazardous based on fire -, life - safety issues than the previous occupancy, the change should be approved. This may well require certain alterations to a structure to ensure basic compliance. The Handbook to the Uniform Building Code offers some excellent guidance in dealing with this question. In part it states; "... the building office must evaluate the fire and life safety and structural features of the building to determine if existing conditions satisfy the code and to determine to what extent the new use poses a greater or lesser standard than the existing use. For example, the adequacy of the floor system would need to be reviewed since a dwelling requires only a 40-pound-per-square-foot live load while an office use must be designed for a 50-pound-per-square-foot live load and a 2,000 pound concentrated load" Structurally, many older homes where built with better grades of lumber than are currently available and may well _ Gary Stutzman June 11, 2003 Page 2 meet the 50- pound - per - square -foot live load outright or the addition of supports to shorten existing spans may be an easy and simple solution. The Handbook goes on to state: "Another item that always arises with such conversions is what to do about exterior wall and opening protection. Many of the dwellings that are converted are historical in nature or, at the very least, are part of a community's cultural fabric. As a result, there is an understandable desire to maintain their present appearance. Is such cases, some jurisdictions permit the use of exterior fire sprinklers to serve as exterior protection. In other jurisdictions, a comparison is made between the two occupancies. Such things as fire loading, alertness of the building occupants, building size and similar considerations may be used by the building official in determining if the converted use poses a greater or lesser hazard than the former one." As to the question of greater or lesser hazard, I would note that most homes being converted to offices will probably not present too many challenges given their relatively small dimensions. Other fire, life- safety issues that may be addressed are: 1. Safety glazing in areas subject to human impact 2. Handrails 3. Guardrails 4. Overall structural integrity of the structure With regard to accessibility you asked; "...what is the rationale to permit barriers to the handicapped in a building that was not previously open to the public ?" As stated earlier with regard to the UBC, it was similarly the express intent of the US Department of Justice and the Oregon Legislature to allow broad discretion in allowing a change of use as being discussed without mandating full compliance with the code. In germane discussions with the US Access Board, the spokesperson was adamant that the ADA was not trying to run the remodeling industry out of business. Obviously, new structures must be in full compliance. However, the ADA recognized that requiring full access to any existing building (commercial or residential) would be largely impossible to achieve both structurally and economically. Hence, the "25% rule" was established as a reasonable threshold for achieving basic access in these instances. In reviewing existing structures for compliance with OSSC chapter 11, we must first look to OSSC section 3405 dealing with change in use of existing structures. The last paragraph here states; "Unless additions or alterations are made to the building or facility, change in use or occupancy alone shall not require compliance with the provisions of Chapter 11, Accessibility." Simply put, if an exiting structure can accommodate a new use or "occupancy classification" without modification and the applicant is proposing no additions or modifications, the provisions of OSSC chapter 11 do not apply. Where additions or alterations will occur, a careful application of OSSC 1113 and Oregon Revised Statute (ORS) 447.241 is necessary. OSSC 1113.1 refers to ORS 447.241 and mandate that; "Alterations to existing affected buildings or facilities shall comply with ORS 447.241(1) D: \e- mail\2003 06-4 Richard download.doc Gary Stutzman June 11, 2003 Page 3 through (8)." ORS 447.241 states in part that; "Every project of renovation, alteration or modification to affected buildings and related facilities that affects or could affect the usability of or access to an area containing a primary function shall be made to insure that, to the maximum extent feasible, the paths of travel to the altered area and the rest rooms, telephones and drinking fountains serving the altered area are readily accessible to and usable by persons with disabilities, unless such alterations are disproportionate to the overall alterations in terms of cost and scope." (emphasis added) When an alteration project to an affected building affects the usability of an area of primary function, the path of travel must be made accessible, unless the additional work is disproportionate to the overall alteration. ORS 447.241 defines "disproportionate" as more than 25% of the alteration to the area of primary function, and defines "path of travel" as essentially including the list given in ORS 447.241(4). An alteration must affect the usability of an area of primary function. The term "primary function" is defined in statute as "a major activity for which the facility is intended." See OSSC Section 1102. The U.S. Department of Justice's Title III Technical Assistance Manual further clarifies this definition as including customer service areas and employee work areas, such as offices. It specifically states that an area of primary function does NOT include: Mechanical rooms, boiler rooms, supply storage rooms, employee lounges or locker rooms, janitorial closets, entrances, corridors, rest rooms, windows, hardware (such as on doors), electrical outlets, and signs. Therefore, in determining the 25 percent disproportionate limit that may apply to an alteration project, only work that affects the usability of an area of primary function (customer service areas and employee work areas) should be included. For example, in this case, assume that the applicant is going to convert a residence to an office use. In so doing, they propose a customer service area, offices and an employee lounge. The only remodeling costs to be included in establishing the additional 25 percent for barrier removal would be those associated with the creation of the offices and the customer service areas. It would be appropriate to include any costs associated with bringing the floor system into compliance in the areas of primary function. Once the additional 25 percent for barrier removal fund is established, ORS 447.241(4) establishes a "priority list" of how that money is to be spent. The priorities are: (a) Accessible parking; (b) An accessible entrance (doors, hardware, ramps as necessary); (c) An accessible route to the altered area; (d) At least one accessible restroom for each sex or a single unisex restroom; (e) Accessible telephones; (f) Accessible drinking fountain; (g) When possible, additional accessible elements such as storage and alarms. D: \e- mail\2003 06-4 Richard download.doc Gary Stutzman June 11, 2003 Page 4 In satisfying the requirements for ORS 447.241, applicants are obliged statutorily to provide accessible elements in the priority established, but only up to the point where the 25 percent barrier removal funds are exhausted. For example; If the barrier removal fund was only sufficient to provide accessible parking, entrance and route (items 1 through 3), there is no requirement to provide an accessible restroom or any of the other lower priority elements. In so stating, BCD would encourage designers to voluntarily incorporate other accessible elements such as restrooms into their alteration designs. It should also be noted that, newly proposed restrooms as well as modifications to existing restrooms would need to comply with 1109.10 and 1113.3 where compliance with 1109 is technically infeasible. Finally, the application of OSSC 3405 and ORS 447.241 can be confusing and is undoubtedly subjective. I hope this information has helped clarify some of these issues for you. I have attached a letter from the State building codes department that addresses accessibility at time of change of use. Change of use alone does not trigger the need to comply with chapter 11. However, if structural modifications are required, then the 25% rule will apply to the project involved. The area of construction will need to be accessible and the route to the area of construction will be required to comply up to 25% of the project cost. In this case the issue is access to restroom facilities in the building, because an interior route is not provided. The only restroom is located on the ground floor. The grade of the site is significant and provides a grade level access to the bottom floor at the street side of the building and parking lot level access to the backside of the second floor. Based on the plans submitted to me, the alteration was confined to the site only. I believe the requirement for a lift may exceed the 25% rule. The ADA only requires accessible restrooms for the public if the buildings provide public restrooms. In this case they are not required to provide public restrooms. The employer must provide accommodation to their employees. Accommodations need not be made until an employee requests the accommodation. We feel the requirement for an exterior lift will exceed the 25% rule and cause an undue burden based on the stamped plans provided. By Darrel N. Be aware that restroom doors must self -close and that there must be at least one covered waste receptacle in the women's restroom. 10) The walkin, ice machine, sanitizng compartment of the three - compartment sink any other piece of equipment utilized to hold food or ice in that is equipped with a drain must waste indirectly. Where air gaps are required, the distance between the bottom of the waste pipe and the top of the floor sink or drain must be at least one inch or two waste pipe diameters, whichever is greater. 11) Any refrigeration unit which does not come equipped with an evaporator pan for its liquid - wastes must have its liquid wastes drain indirectly to a floor drain or floor sink. 12) Floor sinks and floor drains must be located so they are accessible for cleaning and maintenance. 13) All floor, wall and ceiling surfaces must be smooth, durable, sealed and easily cleanable and in a light color.
