motel will not be attracting any customers by bicycle, and the only potential for bicycle
transportation will be for employees and occasional visitors.
2 . A special circumstance exists because an apparent error was made when the bicycle
parking standard was adopted. The standard does not reasonably fit the use.
3 . A motel is a permitted use in the LC zone.
4. Public facilities and natural features will not be affected by this variance.
5 . With the amendments required by this final order, the bike parking variance would
represent the minimum variance needed to alleviate the hardship.
DECISION
Based upon the above facts, findings, and conclusions, the Planning Commission APPROVES
the proposed site plan, conditional use, and variance application subject to the following
conditions:
1. A revised site plan and supporting information shall be submitted for City Manager approval.
The plan and related information shall include:

information shall include:
a. Identification of the materials for all landscaped areas.
b. A minimum of 15% landscaped area.
1 c. An 8 - foot tall solid wood or masonry fence along the entire western boundary of the
CA property.

d. A landscaped screen along the western boundary of the site that provides:
A solid vegetative screen that will reach a height of 12 feet in five years with a mature
height of 15+ feet.
Trees located within the 10 -foot wide landscape strip and/or the parking area to provide
additional screening.

e . If requested by the Royal Garden Condominium Association for the property to the west,
the applicant shall provide additional landscaping on the condominium property. This
landscaping shall consistent of Photina fraseri (one gallon) spaced 12 feet apart along the
entire eastern edge of this property (approximately 22 plants). By mutual agreement, the
applicant and the condominium association may select an alternative
landscaping/screening arrangement.
f. A 6 - foot tall solid wood or masonry fence along the northern boundary of the property
from the northwest corner to a point that has the same front yard setback as the house on
the property to the north. The remaining northern property boundary shall be landscaped
with an evergreen hedge.
g. Yard trees that meet CDC requirements.
h. Evaluation regarding the feasibility of saving more of the existing trees on the site.
i. Demonstrate compliance with CDC standards in Chapter 16.124.
& eeO G _ 3 . Architectural plans shall be submitted for City Manager approval. The plans and related
44' of b information shall feature a building with a maximum height of 48 feet.
4. Preliminary plans for all necessary utilities, including sanitary sewer, storm water, water, and
electricity shall be provided, Storm water plans shall be made available to the City Manager
for review PRIOR TO review by USA (condition 5). The provision of utilities shall be
approved by the City Manager and/or the City Engineer.
5. The necessary permits from the Unified Sewerage Agency shall be obtained.
6. The necessary permits from ODOT to amend the access to the property and for public
improvements along the Pacific Highway frontage shall be obtained.
• 7 . At the option of the City Manager, issues related to the interpretation or administration of
conditions of approval may be brought before the Planning Commission for resolution.
8. This approval shall be valid if exercised within one year of the final approval date of this
application. No trees shall be removed or damaged prior to final city approval of the items
listed in conditions 1. through 6. above. No building permit shall be issued for site work or
to begin construction of the building until conditions 1. through 6. are satisfied.
