Time to supervise employees: Make sure you have sufficient time to supervise your employees. The Board is located at 700 Summer St. NE Suite 300, in Salem. prop- own.pm4 1 /94 • • ROAD MAINTAINANCE AGREEMENT This agreement is made this day of February, 1998 and is meant to establish a access road construction and maintenance agreerrient between the owners of Parcels 1 & 2 of Partition Plat No. 1997 -11-3 and recorded as document No. 97113736, recorded and located in Washington county, Oregon. These parcels are hereby also known as the "property". The Partition Plat provides a 15 foot wide access easement, hereby also known as the "road" which connects the building sites of the property to Pathfinder Ct. The Owners desire to provide for a common access to the property building sites connecting to SouthWest Pathfinder C9urt. The terms of the construction and maintenance of the road applies only to the area within the access easement. THE OWNERS AGREE: • • 1. Description of Road to be Constructed and Maintained. The area of the road to be constructed and maintained shall be a distance of no more than 80 feet from the property line at Pathfinder Ct. back towards the rear of the property, or to the far edge of driveway apron of each property, whichever is less. The road shall be constructed to allow access to both lots with design to be approved by owners of both parcels. The sidewalk and curb where the road meets Pathfinder Ct. shall be considered part of the road to be constructed and maintained as described in the following sections. The curb and sidewalk shall be constructed to the minimum • standards required by the City of Tigard. 2. Construction and Maintenance. The area of the road to be constructed and maintained shall be initially paved with asphalt to a width of 10 feet or the minimum standard required by the City of Tigard, whichever is less, and further constructed to the City of Tigard minimum load limits. The width of the road shall be split evenly between the two properties. The road area shall have adequate drainage. The road shall be installed by the first owner to complete a residence on either parcel within 30 days after completion of the dwelling. The road shall be maintained as a asphalt road and when necessary to keep it structurally sound. 3. Construction Expenses. It will be the responsibility of the owners of the property that build a residence on their property to equally share in the costs of construction of the access road up to the length required for the first residence built. In the event that a owner builds a residence and installs the access road prior to the other property owner's construction of a residence, the last owner to build a residence shall reimburse the first owner, that installed the access road, one half of their true costs of installing the access road to the first residence within 30 days after completion of the second parcel's residence. The last owner to build a residence shall be totally responsible for construction costs of any additional length of road from first owners road construction. 4. Maintenance Expenses. Each Parcel of the Property shall contribute equally to the maintenance of the entire access road. 5. Repair for Excessive Use.
