CDBK Properties, LLC, hereinafter called the Grantors, grant and convey unto the City of Tigard a perpetual easement for
constructing, reconstructing, operating, maintaining, inspecting, and repairing a public sidewalk, together with the right to
install appurtenances and signs needed to control or direct pedestrian travel as needed, and remove, as necessary, vegetation,
foliage, trees, and other obstructions on the parcel of land described in Exhibit "A" and "B ", situated in the City of Tigard,
Washington County, State of Oregon.
THE TRUE CONSIDERATION for this conveyance is $ 0.00. However, the actual consideration consists of or includes
other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except those expressly
stated in this easement, nor otherwise prevent Grantors from the full use and dominion thereover; provided, however, that
such use shall not interfere with the uses and purposes of the intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said
easement to be vacated, the right of the Grantee in the above - described easement will be forfeited and shall immediately
revert to the Grantors, their successors, and assigns in the case of such event.
TO HAVE AND TO HOLD the above - described and granted premises unto said Grantee, its successors, and assigns forever.

LEGAL DESCRIPTION
A tract of land situated in the southeast quarter of Section 10, Township 2 South, Range 1
West, Willamette Meridian, City of Tigard, Washington County, Oregon, being more
particularly described as follows:
Commencing at the southeast corner of Parcel 2, Partition Plat No. 1998 -128, Washington
County Plat Records; thence, along the north right of way line of SW Durham Road, being
45.00 feet from centerline, along the arc of a 432.46 foot radius curve to the left through a
central angle of 3 °17'40" (the chord of which bears South 88 °29'03" East, 24.86 feet) an arc
distance of 24.87 feet; thence, along said north right of way line, North 89 °52'07" East, 96.85
feet; thence, North 0 °07'53" West, 10.32 feet to the True Point of beginning; thence, North
0 °07'53" West, 29.68 feet; thence, along the arc of a 132.50 foot radius curve to the right
through a central angle of 31°47'25" (the chord of which bears North 15 °45'50" East, 72.58
feet) an arc distance of 73.52 feet to a point on the southerly line of an access easement
