A field inspection of the public improvements for the above noted development was made on March 4, 2005 and deficiencies that must be corrected. Our records indicate your Maintenance Agreement and Assurance is dated April 29, 2004 and states that you agree to correct any defects for a period of one year. Please be advised that the following item constitutes a defect of your street project that you are required correct prior to release of your Maintenance Agreement and Assurance. Prior to release of the Maintenance Agreement and Assurance, the following must be completed: 1. Complete deficiencies as described on the attached punch list. Questions contact Philip Trecker at 503- 793 -1994. 2. Inform this office upon completion and request inspection of corrected deficiencies. 3. Submit a check to Washington County for the administration costs in excess of the original Administration Deposit. The current administrative balance is $85.00. The Administration Deposit is used by Washington County to cover the costs of processing this project (plan approval, field inspections, and contract administration). The County's costs have exceeded the deposit. As mentioned in the letter to you, dated May 5, 2003, if the County's costs are higher than the amount deposited, prior to acceptance of the project, Washington County will bill the applicant for the amount needed to cover its costs. Pacific Highway is not a designated street for credits but a state highway. I cannot say one way or another if they are eligible for credit as there may be other factors, but I would have a problem saying yes. Unless the county says otherwise, I would go ahead and have Jane proceed with either the Bancroft payment approval or full payment of the TIF fees for certificate of occupancy. Certain work appears to be eligible for credit as per the attached Washington County letter, dated March 17, 2004. We have coordinated with the contractor, Meng-Hannan Construction, Inc., for street improvements on the project to clarify the costs of the eligible credit portion of the project. The attached revised spreadsheet for quantities and costs, as prepared by the contractor identifies the total cost for that portion of the work that is eligible for TIF credits (see attached Meng - Hannan fax dated June 28, 2004). We agree with the revised spreadsheet and the total credit amount is $53,565.71. It is our understanding that the Traffic Impact Fee for the project has been calculated at $68,096.00, and payment of the fee has been deferred; therefore, a total TIF payment in the amount of $14,530.29 is due to the City of King City. It is also our understanding that payment of the fee is a requirement prior to the City of Tigard issuing the occupancy permit. Following receipt of payment to the City of King City, we will notify the City of Tigard of such so that the occupancy permit may be completed. I called Stan Stolr with Space Age Fuel and he indicated that WA County has been working on the credit analysis with Space Age Fuel for eligibility of credit. Gary with DL Design will be faxing me the updated paperwork from WA County for review. I will fax all information received to both City of Tigard and yourself upon receipt. So I'm still at a stand -still on this issue. As previously discussed I think a letter should be written to Space Age Fuel indicating that the TIF fees are outstanding & the Final Certificate of Occupancy will not be issued until the TIF fees are paid. The letter from Washington County establishes that the County's requirements have not been met and that their deadline for your meeting them is Friday, April 30. We have also confirmed that King City's requirements have not been met, either, specifically, payment of the Traffic Impact Fees (TIF.) It is my understanding that the amount in question is $68,096.00, according to the Payment Option Form executed by Jim Pliska on October 20, _ 2003. For the thirty-four days since Thursday, March 25` 2004, you have been operating and occupying the subject premises without a valid Certificate of Occupancy. Therefore, since that date you have been in and remain in violation of the following: FAILURE TO SECURE CERTIFICATE OF OCCUPANCY BEFORE OCCUPYING BUILDING. Pump canopy size is different on sheet G101 and A202. Provide consistent plans. A: Pump island canopy is shown for Reference only on sheet A202, but has been revised to match the owners intent as shown on sheet G101. �8. Provide construction/ connection details for the soffit framing shown on sheet A401. A: See our revised details 1/s - 5. We have indicated Simpson H - 4 connectors @ each joist. ✓ 9. Clarify the length of the anchor bolt shown in detail 6/S - 4. A: See revised detail 6/S - 4. We have indicated 7" minimum embedment. 10. Clarify the attachment for the top chord of the truss to the exterior wall plate. A: See our revised detail 1/S -5. We have indicated Simpson H -4 connector each side and (2) Simpson SDS 1/4x3 wood screws. • 11. Provide calculations and details for the anchorage of roof top mechanical unit RT1. See section 1632 OSSC for design requirements. • A: This shall be b rovided the unit manufacturer and contractor. P by 12. The calculations identify members as "worst case canopy beam" or "primary cantilevered canopy beam ". Revise calculations and sheet S -3 to clearly describe which members compare to which calculation, Numbers or Alphabetical. A: We have revised our calculations to match the labels shown on sheet S -3. See the attached revised calculations. 13. Provide truss calculations that indicate the uplift imposed by the cantilevered members as shown in details 1/S5, 4/S5 & 5/S6. S / A: We have revised the roof framing plan (sheet S -3) to indicate the uplift forces. We have also 0 included dead and snow load profiles for the roof joist manufacturer. Roof joists shall now be designed by the joist manufacturer. 14. The negative reaction at the cantilevered canopy framing exceeds the capacity of the 8 - 16D nails indicated on the drawings. Provide and analysis for the connections. A: (8) 16 nail have adequate capacity as shown on detail 1/S -5, and 5 &6/S -6. We have revised detail 11/S -7 to show (8) Simpson SDS 1/4x3 wood screws. PLUMBING 15. Plan note 2 on sheet C4.1 indicates the use of c900 for drainage pipe. C900 is2isted for drainage pipe. Revise all sheets with reference to C900 as drainage pipe and resubmit the drawings indicating a material approved for drainage piping. A: There are no references to C900 pipe on the plumbing drawings nor the mechanical specifications. Civil engineer to address references on site plans. FYI UNDERGROUND FUEL STORAGE TANKS REQUIRE PERMITS FROM TVF &R. CONTACT ERIC MCMULLEN @ 503 - 612 -7010. FYI Deferred submittals such as Fire Alarm, Fire Sprinkler, Truss Joist Shop Drawings, etc, will be charged a deferred submittal fee based on the valuation of the portion of the work being deferred. The minimum • fee shall be $200.00. Please provide an item by item response. Provide 4 complete sets of all revised drawings and 2 copies of supporting information such as calculations and cut sheets. When submitting revised drawings please attach a copy of the enclosed City of Tigard, Letter of Transmittal.
