It is understood by the owner /tenant that the issuance of this Temporary Occupancy Permit by the City of Tigard for the use and /or
occupancy of the structure located at the site address listed above (hereinafter "structure "), does not grant or convey to the owner or

Thank -you for your request regarding the county's position on the Space Age
Fuel request to occupy before all of the frontage improvements are
completed. Space Age Fuel has requested a temporary occupancy of the station
at the intersection of 99W and Fischer Road. The east driveway cant be used
yet because utility poles need to moved. The county's Traffic Engineering
section reviewed the request and determined that capacity-wise the station
will be o.k. using just the west driveway. The sight distance certification
for the west driveway has been submitted and the illuminaire for the west
driveway has been installed. Based on the above the county is satisfied that
the station can operate safely on a temporary basis with only the west
access. There is also a utility pole on the west end of the frontage that
has to have cones placed around it. The county believes the temporary
occupancy should not be granted for longer than one month from today's date,
which would be March 25, 2004. That should provide ample time for the
construction of the east access and all other frontage improvements to be
completed.

Dear Mr_ Watkins:
On the 20 of February, I spoke with our City Planner Keith Liden as he visited the
Space Age Fuel site that morning referencing the occupancy permit. The only concern
that Mr. Liden addressed was the pole in the street which Verizon needs to move.
I am relatively certain that from my conversations with Mr. Liden that Space Age Fuel
has met the criteria and an occupancy permit can be granted.
