Dear Lisa:
In response to the question the City of Tigard raised about the toe fill slopes being two feet from
property lines, I have evaluated the fill slopes shown on the plans.
The proposed grading for this site creates two fill areas which are adjacent to the north and the west
property lines. The westerly fill meets existing ground at the existing fence which encroaches into the
Boston Chicken site by more than two feet. On the northerly side the theoretical catch point of the fill
slope is greater than two feet from the northerly property line. The proposed slope continue from this
catch point downward to create a slight swale to direct any water from this slope to the catch basin on
the Learning Tree property approximately 85 feet east of the northwest property corner of this site. A
majority of the existing drainage from this site flows to this catch basin under present conditions. With
the construction of the Boston Chicken, only a minute amount of water will flow into this catch basin
from the above described northerly slope.

Dear Lisa;
This letter is in response to your request 'co modify the original
site development approval through the provision of an additional
1,812 square feet of freezer space to allow storage for future
restaurants in the area.
Although the freezer space reduces the total number of parking
spaces, this addition does not by itself generate the need for
additional parking spaces pursuant to the Off - Street Parking
requirements. Even with the reduction in spaces the site will
continue to exceed the minimum parking standards for this type of
use. The site will also continue to exceed the landscape
requirements for the General Commercial Zoning District.
The Director has recommended approval of this modification subject
to the following conditions of approval:
1. The screen wall and landscaping revisions provided on the site
plan submitted March 6th shall be constructed.
2. The truck design and motor idling limitations detailed within
your letter dated March 6, 1995 shall be complied for
maintenance of liveability reasons for the adjoining
residences.
3. The menu board shall be repositioned such that the speaker is
pointed away from the adjoining residences (preferrably
towards the Christian Marketplace site).

Dear Mr. Roberts:
In accordance with our conversation, the following is a summary of our proposal for mitigation of possible
noise impacts related to the restaurant loading area. Boston Market will restrict loading/unloading of
refrigerated trucks between the hours of nine p.m. and seven a.m. These restricted hours are based upon
Chapter 18.90 Environmental Performance Standards section of the City of Tigard Zoning Ordinance.
During the hours of seven a.m. and nine p.m., trucks that will be loaded /unloaded will not be allowed to
idle longer than 5 minutes, but refrigerated fans will be allowed to operate continuously as required for
health code reasons.
The attached plan, for review, depicts a 6' -8' high screen wall with landscape buffering. As an added
note, Boston Market is currently looking at 18' trucks instead of the previously mentioned 26' truck. The
truck will be equipped with an undermount condenser unit for the refrigeration system, which will reduce
the refrigeration fan noise substantially due to the location.

Lisa from Boston Chicken will be bringing by some plans today. We don't need
any applications or $'s at this time. This is the scoop:
1. They have Sit and Bup already issued, so these are changes to the existing
permits.
2. They are adding a little to the previously approved building, and making
small changes to the site plan.
3. They will be submitting 5 sets of site plans (Michael, Mark, and the est
to me), and some sets of modified building plans.
4. Their goal is to start work now, so I told them they can commence work
under the existing permits, but that no inspections will be peformed on the
foundation until we approve the changes...they will be able to get many of
the inspections on the site work, because much of the utility work is not
changing.
5. We will not be issuing any new permits, but will be replacing the
approved set of plans for the new ones. I will determine the fees based upon
the increased valuation and othe factors, and just change the fee screen in
Tidemark. I'll do this later.
This is generally the drill when someone makes changes to an already
approved project. Of course, each case will have its own quirks...
