Dear Jeff:
Regarding your letter, dated May 6, 1996, we are inclined to agree that there is $43,497 of
creditable construction costs that could be applied toward other pads within the Tigard
Promenade Development. However, an application needs to be submitted to the City requesting
these credits. The application we approved on April 15, 1996 was in response to a credit request
for only Pads A, B and C.
- Enclosed is another credit request application for your use. You will need to tell us how you
would like the remaining credit to be apportioned to the other pads. The only pad that is not
eligible for credit is the Washington Federal Savings Bank. The reason for this is that the TIF
was paid when the building permit was issued. Section IV(2Xd) of the TIF Procedures Manual
states that no credit will be considered after issuance of a building permit or, if deferral was
granted, issuance of an occupancy permit. Therefore, credit could be applied against the
deferred TIF for the Les Schwab, Carl's Jr and Valvoline Instant Oil Change pads.
Once you have completed the enclosed application and indicated how the credit is to be •
apportioned, we will set up a Credit Voucher that will specify the amount of credit to be applied
against those projects. This voucher will be on file in the Development Services Division and
you will receive the original. You will need to make sure that a copy of the voucher is in the
hands of the individual who will eventually come to the City and pay the TIF for these projects.

Dear Mr. Rasak:
This is to inform you that the City has approved a Traffic Impact Fee (TIF) Credit for the
Tigard Promenade, specifically the improvements that were constructed on SW Royalty
Parkway (109th Avenue) and the traffic signal at Royalty Parkway and Highway 99W.
The total credit amount approved is $ 269,981, which will offset the calculated TIF for
this project. •
Your request for TIF credit asked the City to consider total street improvement costs of
approximately $ 620,000, which included costs for improving Highway 99W along the
frontage of the site. Briefly, we arrived at the TIF credit as follows:
1. Highway 99W.is not eligible for TIF credit. Therefore, the $ 216,306
allocated to 99W improvements was not considered.
2. Since 99W is not eligible, only 50% of the traffic signal cost is eligible,
per Section IV.A(1)(c)(6) of the Traffic Impact Fee Procedures Manual.
Therefore, the eligible cost of the signal is $ 81,689.
3. Private driveways are not eligible for credit per Section IV.A(1)(c)(3) of
the Procedures Manual.
4. Based on #1 through #3 above, the remaining $ 313,478 of construction
costs is eligible for credit. Since the TIF for this project is calculated at.$
269,981, the credit is limited to that amount. •

Per our coversation, this requirement was previously addressed, detail 10 /A6
illustrates a 1" fire code gypsum board on one side of a 2 -1/2" 22 ga. Metal
stud and 5/8 "Type 'X' gypsum board on the other, creating the one -hour
shaft.
"Draft stops as required by OSSC, Section 2516 (f) 4B iii, exception, remain a
requirement in this building. If an agreement was reached with David Scott,
Building Official, to delete draft stops, submit evidence to substantiate the

Per our coversation, the requirement for Draft Stops for this building has
been removed due to the noncombustible construction of the building, per

bakery area. This unit is interlocked with the hood
controls so make -up air shall be supplied whenever
the exhaust hood is operated.
4 Fire suppression system and controls are to be
provided by Halton. Halton shall provide the

The sprinkler system riser where it passes through a concrete slab
floor shall be provided with a clearance of 2" around the piping
[NFPA 13, Section 3- 10.3.4].
/ The automatic sprinkler system shall be supervised by an approved
monitoring service [Uniform Fire Code (UFC) 10.307]. Connect all
required tamper switches and flow monitoring switches to the
annunciator panel. Provide two dedicated phone lines for the
7/ annunciator panel [NFPA 71- 5.2.6].
The double detector check valve assembly installed in the vault
serving the water main shall be installed in accordance with the
manufacturer's installation instructions. The backflow device shall
be tested by a certified tester and a copy of the test report
/ submitted to this office [ORS 333 -61 -070].
5. The concealed space of the entry canopy shall be protected [NFPA 13-
/ 4- 4.1.7.1] .
6. The maximum floor area for any one sprinkler system riser is 52,000
sq. ft. [NFPA 13 -4 -2] .

the fuel or current supply so the utilities are
automatically shut -off when the system is actuated
[Section 2004(4)c].
2. A testing of the shut - down phase of the protection shall
be performed prior to approval.
B. A readily accessible manual activating device (pull station)
shall be provided for dry chemical, carbon dioxide, and wet
chemical fire - extinguishing systems protecting Type I hoods
[Section 2004(b)4 -(e) and NFPA 96 -7- 3.1.1].
AC -2 shall be equipped with automatic shut -down.
A. A smoke detector shall be installed in the main return air
duct of each system providing air in excess of 2,000 cfm. An
additional smoke detector shall be installed in the supply
duct, downstream of the filters. Activation of any one
detector shall effect a shut -down of the system
[Section 1009 (a) (b)].
