Dear Brandy: On July 12, 2000 I made a site visit to the Walgreen property. This letter is to provide a Project status report by the Planning Division as the applicant's representative has requested Temporary Occupancy of the building. The following is a list of unresolved planning or planning related issues on the site: 1) Lighting: The pole lighting along the drive aisle near the western property currently is located and directed into the residences to the west. The Tigard Community Development Code requires that lighting be directed away from the residences under Section 18.765.040. A neighbor has complained about these lights directly shining into the residences. Existing lighting fixtures need to be replaced with fixtures that direct the light away from the residences (such fixtures with 180 degree angle mounted to face toward Walgreen's Pharmacy). The current light fixtures should be immediately turned -off. Please provide a specific detail of the proposed fixture for the pole lighting along the west property line for review and approval, prior to installation. 2) Screening: Screening of the parking lot is required. The original landscape plan indicated that the perimeter area was to be planted with trees and a combination of different sized shrubs, and the revised landscape plan indicated perimeter hedges were to screen the headlight glare from the Pharmacy pick -up aisle. As the area where the plantings and hedge were planted are well -below grade, the screening is ineffective. Effective screening (minimum four feet above grade) needs to be installed or planted such as: a hedge, a decorative wall, raised planters, or a wood fence or cyclone fence with wood slats. Please provide a specific detailed plan of the proposed screening for review and approval prior to installation. There are only 13 street trees planted on site. Please explain the discrepancy. Two additional trees are required at this time, and should be spaced evenly as per plans. 4) Crosswalks: Detectable warnings as shown in the revised site plan are not installed as per plan. Install all detectable warnings as per plans. 5) Truck noise /sound wall: Condition # 4 in the land -use decision required that truck traffic using the loading area will not generate a noise nuisance as defined under TMC 7.40.130- 7.410.170. Alternatively, the applicant shall revise the site plan to include a sound wall to the west of the loading docks. Your letter of September 27, 1999 stated that noise level of the trucks does not exceed 75db, however, the Tigard Municipal Code (TMC) requires that for noise sensitive uses the noise shall not exceed 50db between the hours of 7AM -10PM and 40db between 10PM -7AM. Therefore, this issue must be addressed either by providing a noise study by a qualified professional to confirm that the noise levels will not be exceeded, or by proposing a sound wall or sound screening to reduce sound levels below the maximum db level. Based on the performance bond submitted today by Yorke & Curtis for $14,075 a Temporary Occupancy Permit can be issued. The bond is for the modification of lighting at the 3 pole locations on the west side of the project to meet City of Tigard Requirements; and the installation of fencing adjacent to the retaining wall and along the drive aisle at the north and west portion of the site. Items #3, 4 and 5 above are not covered by the performance bond and shall be addressed separately prior to final occupancy as will all final details. The truck noise /sound wall issue may result in code enforcement, if it becomes a problem. I am still awaiting your letter from ODOT regarding approval for final inspection on work in the right -of -way. Please call me for a site inspection prior to final occupancy, and regarding any questions you may have regarding resolving the remaining outstanding issues at 503 - 639 -4171 ext. 315.
