This letter serves to identify what is necessary for the City to approve and final the grading
permit for the fill placed at the above referenced property. Specifically, the City requires the
following:
1. As -built drawings from the Civil Engineer showing the as -built topography of the site, as
filled.
2. A final report from the geo- technical engineer indicating that the fill, as placed, is in stable
condition and does not pose a hazard. This report should include recommendations, if any,
for work required to ensure the fill can be maintained in a stable condition.
• 3. Verification that work required, if any, by the geotechnical engineer has been completed,
including a report from the geo - technical engineer so stating.
At such time as a development is proposed on or adjacent to the subject fill, the City will require
that the geo - technical report, which is normally required for such development, address the
issue of the fill and contain recommendations for the foundation and construction of the
development.

Dear Mark,
This letter is to follow -up our last conversation regarding steps you were taking to
address the issue of the uncertified fill placed at 11564 SW Pacific Highway. I am also
enclosing a copy of my last correspondence to you, dated March 11, 1996.
It has been some time since I have had any communication from you on this matter. .
Your last permit extension expired August_1_,_1996.. I was hoping, after our last
conversation, that this matter would be resolved by now. I would like to see this matter
resolved very soon.
To this end, I refer you to what I previously indicated would suffice for compliance (see
3/1/96 letter) "...non- engineered fill can remain on the site, provided an 'as- built' plan is
prepared by a licensed civil engineer and an addendum soils report is prepared to
address all issues regarding the new and previously existing fill
Please comply with the above by-September21.5,1997. Failure to comply will result in a
"Notice of Infraction" and the commencement of enforcement action.

Permits and inspections required by the Tigard Municipal Code are an important part of your project Permits help to
ensure that work is done in compliance with minimum code requirements. Inspections are intended to protect the
occupants of buildings and building owners.
In June. 1996, you were mailed a letter stating we had no record of any inspections in the prior 180 days on the :
project authorized for the above noted address. You were advised to please respond in writing if additional time was
needed to complete the project, or call the 24 -hour inspection recorder if you were ready to schedule an inspection.
As of this date, we have either had no response or an incomplete response from you. - - -
As the current property owner of the above project, you are responsible for obtaining the required inspections. The
responsibility is yours even if you were not the owner at the time of the original permit.
The City would like to work with you to close out this project with steps taken to assure that at least minimum code - -
compliance has been achieved. This documentation will be helpful to you and fitnre owners of the property. As
stated in the previous letter, the City may pursue civil enforcement if work has proceeded without inspections or if as .
tmtinished project is outstanding. Your prompt attention to this matter will avoid such action by the City. -
To correct this situation you have some choices which are noted below. No action on your part to resolve this issue
will lead to a NOTICE OF INFRACTION.
If you need additional time to complete your project please respond. IN WRITING, within 15 days. You may
request up to 180 days. Please provide the following information: Permit number, address of property, your name, a
day time phone number and the length of additional time you are requesting, including an explanation for the
extension. The City will notify you ONLY if your extension Is NOT granted.
If you are ready to schedule your next inspection please call our 24 -hour Inspection Recorder at 639 -4175
within 15 days. Be prepared to provide the following information: Permit number, address of property, your name,
your phone number, and the date you are requesting the inspection. Inspection times cannot be guaranteed. The City
will make every attempt to perform the inspection the some day if requested prior to 7:00 a.m. However, we are
expecting a large increase in inspection requests and cannot guarantee a same day inspection.
IF YOU ARE UNSURE ABOUT WHAT PROJECT THIS LETTER IS REGARDING, OR HAVE ANY
QUESTIONS, please contact the Building Division at 639 -4171 ext. 382 (voice mail). To better save you, please

Re: FILL PLACED AT 1-1-5-54 PACIFIC HIGHWAY
This letter is to document the history of this project and what the City
will require regarding the fill placed at the above referenced property.
Our records indicate the following history:
4/21/94 - Application by Waker Associates to place 11,740 cubic yards of
fill received.
5/03/94 - Permit SIT 94 -0016 to place 11,740 cubic yards of fill issued.
The permit approved plans prepared by Waker Assoc. Inc.
pursuant to a soils report prepared by Carlson Testing, Inc.
(dated 4/25/94, report CTI #94- 1435). These documents
required that the fill be placed according to very specific
guidelines and also required the removal of some existing non -
engineered fill.
5/04/94 - City receives copy of a letter from Carlson Testing, Inc. to
Bob Hatch (Contractor) indicating that the work underway
exceeded the scope of what was originally addressed in the
soils report and that Mr. Hatch had indicated that he would
not remove any of the non - engineered fill, contrary to the
recommendation of the soils report. The letter clearly warned
Mr. Hatch that continued work would most likely result in a
fill unsuitable for building support.
5/05/94 - City receives a copy of a letter from Carlson Testing, Inc.,
to Bob Hatch, indicating that Mr. Hatch's insistence on
continuing filling work without addressing the necessary
technical issues was at his own risk and that Carlson could
not be considered the Soils Engineer of Record until these
issues were resolved.
Note: After receipt of these letters, I met with Bob Hatch,
Jim Imbrie (Carlson), and Jim Midzalkowski (Waker). The
result of the meeting is summarized in the letter to Hatch
from Carlson dated 5/11/94, below.
5/10/94 - City receives copy of letter from Waker Associates to Bob
Hatch, indicating fill work not being done in compliance with
the soils report, approved plans, and City requirements.
5/11/94 - City receives compaction reports from Carlson, indicating fill
placed 5/07/94 did not meet compaction requirements.

5/11/94 - City receives copy of letter to Bob Hatch, from Carlson,
iterating City's position that non - engineered fill could be --
placed provided a final approved "as- built" plan is prepared
by Waker and the stability of the large fill slopes at the
rear of the property are addressed by Carlson. This letter
then indicates Carlson's recommendations regarding these
slopes.
Since this last letter, I have had no contact from Bob Hatch. I
understand from Carlson Testing and Waker that the work proceeded without
consideration of any of the City's requirements or the recommendations
of the engineer. I communicated with you by phone in July 1994, and you
indicated that you were pursuing the matter. I agreed to give you time,
informally. In December 1994, Miller Consulting Engineers contacted me
regarding the property. I did not hear anything further regarding this
project until this month.
In January of 1996, you were sent a form letter from the City regarding
the inactive status of the project You responded and requested a 180
day extension.
I called you after receiving your recent letter. You indicated that you
were still pursuing the matter through your attorney. I am willing to
allow you the 180 days to resolve the matter. I will honor my original
indication that non - engineered fill can remain on the site, provided an
"as- built" plan is prepared by a licensed civil engineer and an addendum
soils report is prepared to address all issues regarding the new and
previously existing fill. The extension is contingent upon one
condition: that a letter from a licensed engineer (civil or soils)
indicating that the current fill situation is stable for the interim 180"
day period (or if any remedial action is required to stabilize it for the
interim). Please submit such a letter within 2 weeks of receiving this
letter. You should note that any paving (including compacted gravel or
road debris) and use of the fill area for parking requires a Site
Development Review approval by the City and will include drainage, land -
use, and other issues.
Thank you for your cooperation in this matter. I understand your
frustration with the status of your property. Please call me at 639 -4171
if I can assist,in any way or if you would like to discuss this matter.

We issued a permit for this project on 5/3/94, however we have no record of any inspection being
performed.
Permits expire if there has not been an inspection performed for over 180 days. In that case, the
Building Division may require a new application and fees to commence or continue work. The
City may also pursue civil enforcement if work has proceeded without the required inspections.

Dear Mr. Hatch:
Jim Midzalkowski and I made a site visit today to observe the above referenced project.
At this time we are unsure of the status of this project and concerned with respect to the
completion of the project. There were several items observed that need to be brought to
•
your attention.
First, there are at least four locations in which the sediment fence is pinned down by large
rocks. The sediment fence needs to remain in a functional position for the duration of the
project.
Second, it appeared that the South and possibly West slopes of the fill exceed the 2:1 ratio
delineated on the plans. These slopes need to be at a 2:1 slope or less to be in compliance
with the recommendations from the approved soils report and the requirements set forth by
the City of Tigard.
Third, the excavation towards the north end of the property has not been backfilled. This
creates a liability problem in the event of any accident occurring because of this
excavation. Also, if it were to rain, this would act as catch pond for the rain water and
possibly damage the current fill.

Last, the fill appears to be sloped to the North. The plans show the drainage towards the
creek. If the ground is to remain sloped to the north for an interim period, some type of
temporary erosion control may be required.
