Bayard,
In our conversation this morning, we discussed the site plan showing the corner of proposed Building #5 in the PUE. You
said you were aware of this and that your builder had a plan to address this, which you were going to send to me. At this
point I have not received an explanation on the matter. In the meantime, staff has discussed this issue and determined
that there are two ways to address the conflict.
1) If you wish to change the easement to preserve the proposed building footprint, then apply to the city
engineer for a request specificallV describing the extent of the easement to be relinquished and demonstrate
through letters from utility providers that existing utilities would not be affected and that adequate area is
retained for future utility use. We could provide you a list of utility companies if needed and an easement
relinquishment form. This area is in the Tualatin Valley Water District.
2) If you wish to preserve the easement and change the building footprint, there appears to be some flexibility to
move the lot #25 portion of the building out of the easement to the east, while shortening the driveway for lot
#25 (Staff report page 12 states all dwellings will have at least a minimum four -foot setback to the garage,
where you have approximately 14 feet shown).
I appreciate that you were aware of this conflict and hope we can work quickly to address it without holding up your
building permit. Dan Nelson's comments will have this issue listed as one of a number to be addressed within the
building permit process. Please let me know how you want to proceed and if I can provide any additional information to
resolve the conflict. I will be out of the office until Tuesday February 22 if you need to reach me.

Dear Al:
Please find attached the materials necessary, per the conditions of approval as adopted by the Hearings
Officer, for the Montage Townhomes Type I Final application. Compliance with the conditions are noted
in the margin, as customary, or as revised findings below.
Per Condition III.F.5 — here are revised findings for Section 413 demonstrating compliance with the on-
street parking standards based on the updated site plan:
The project proposes 18 units with three off - street parking spaces (tandem garage and driveway apron)
resulting in a need for 9 on- street spaces. The project further proposes 15 units with two off - street
parking spaces (tandem garage only) resulting in a need for 15 on- street parking spaces. The plans
illustrate 24 on- street parking spaces in compliance with the standards of Section 423.
Per Condition III.F.9 — here are revised findings for Section 431 -7 addressing recreational structures in
the open space area:
The project provides common open space in the vicinity west of the SW 92 Avenue /SW Montage Way
intersection (part of Tract H). For a project of this nature, 100 square feet of common open space is
needed per unit. With 33 units, this equates to 3,300 square feet of common open space. Tract H is
5,808 square feet in area and will include a tot -lot area along with a bench for parents or others to sit
near the tot -lot play structure. By providing both a play structure and a bench, the project meets the
standard of providing at least two of the items listed in Section 431- 7.3.B.1 of the Code.
Tract A is not necessary to meet the requirements of common open space, though it will be a
landscaped area maintained by the HOA, it will not require a decorative wall or fencing along SW Hall
Boulevard.
Per Condition III.F.11— revised plans are included with this submittal package to reflect the changes
listed in this condition.
