CONSENT COVENANT

The undersigned owners (including purchasers) of the
real property described below do hereby record their consent to the
formation of a local improvement district by the City of Tigard for
the purpose of improving the. public street or streets upon which
the described property abuts. The undersigned expressly waive all
present and future rigtb-s t-o app,se or remonstrate against the
formation of a local improvement district for the improvement of the
abutting street or streets, reserving only the -right to contest the
inclusion of particular cost items in the improvement district pro-
ceeding and any right they may have under the lavas of the state of
Oregon to contest the proposed assessment _ormula.
This consent and waiver shall run with the title to the
described land and be binding upon the undersigned and all successor
owners, for a period of 15 years from the date of the last
signature below.
The real property that is the subject of this consent
covenant is described as follows : Description of a portion of Lot 12,
"Varnes Acres" a duly recorded Plat located in the S.E. h-of Section 1, Township 2
South, Range 1 West, Willamette Meridian, Washington County, State of Oregon, said
parcel being more particularly described as follows:
Beginning at the Southwest Corner of said Lot 12; thence NO°38' 13"E along the West ,
line of said lot 12 (being also the East line of S.W. 72nd Avenue, County Road-#472)
aidistance of 127.75 feet to an iron rod ori_ the Southerly right of way line of Oregon -
State Highway No. 217; thence along .said Southerly right of way line- the follow:a.rg-
courses and distances: S89008' 38"E 28.72 feet, N0037120"E 173.11 feet, N380
04105"E 32.73 feet, S61006'02"E 132.51 feet, S61044' 39"E 177.90 feet to an iron rod
on the East line of said Lot 12; thence S0045'W 174.26 feet to the Southeast
Corner of said Lot 12, being also a point on the North right of way line of S.W.
Varn (County Road #1286) ; thence S89020'38"W along the South line of said Lot 12
(and the North line of said right of way) 322.63 feet to the point of beginning.
The above parcel contains 78.278 square feet, 1.7970 acres.
