CONSENT COVENANT
Street Improvements
The undersigned owners (including purchasers) of the,
real property described below do hereby record- their consent to the
formation of a local improvement district by the City of Tigard for
the purpose of improving the public street or streets upon which
the described property abuts. The undersigned expressly waive all
present and . ruture rights to -oppose or remonstrate against the
formation of a local improvement district for the improvement of the
abutting street or streets , reserving only the right to coatdst the
inclusion of particular cost items in the improvement district pro-
ceeding and any right they may have under the laws of the -state of.
Oregon to contest the"proposed assessment formula_ -
This consent and waiver shall run .wit., the title to the
described land and be binding upon the undersigned and all successor
owners, for a period- of 15 years from. the date of the last
signature below.
The real property that is the subject of this consent_
covenant is described as follows : A tract of land in Section 4, Township 2
South, Range 1 West, of the Willamette Meridian, -Washington County, described as follows: -
Beginning at the Northwest corner of that tract of land conveyed to Kenneth Olson,
et ux, by deed recorded in Book 411, Page 506, Washington County Records, said point
also being in the center of 'SW Walnut Street; thence South along the West line of
said Olson tract, 135feet to a point; said point being the true point of beginning.;
thence continuing South along said West line, 186 feet to a point; thence West parallef*.'to
the center of said Wlanut Street, 134 feet to the- Southwest corner of that certain
tract of land conveyed to Steven L. Jolivette by deed recorded April 3, 1978, as
Recorder's Fee No. 78-15304, Washington County Records; thence North along the West
line of said Jolivette tract, 321 feet, to the center of said Walnut street; thence
East along said centerline 20 feet to a point; that bears West 114 feet from the Northwest
corner of said Olson tract; thence South parallel to the West line of said Olson tract
135 feet to a point; thence East parallel to the center of said Walnut Street 114 feet
to the true point of beginning.
