96-015343 Clio d Docuw-;c - - 0 IN2615343 "Pt* 16� Lfoq 2�22�g6 CONSENT AND WAIVER OF RIGHT TO REMONSTRATE REGARDING ROAD IMPROVEMENT AND MAINTENANCE We, the undersigned, being the legal owners of the real property herein described, hereby do consent to the improvement of the base facility of SW Taylors Ferry Road lying between SW 80th Avenue and the Washington County Line in accordance with Washington County road standards currently in effect or as may be adopted in the future. Further, we expressly waive and agree not to exercise any and all right to remonstrate against the formation of a local improvement district and the improvements or maintenance proposed therein. This consent and waiver is given in consideration of approval of a land use action for a Minor Land partition recorded as Partition Plat 1993-002 at Document No. 93-001495, Records of the County Surveyor for Washington County, Item No. - MLP 91-0010 and to fulfill the conditions therein imposed. In addition, it is acknowledged that it is granted in exchange for Washington County not requiring that road improvements be made at this time. This deferral benefits the undersigned and the properties herein described by deferring the cost of improvements and providing for favorable financing mechanism. This consent and waiver shall run with the land, burdening the subject site and to the benefit of the citizens of Washington County by and through their Board of County Commissioners. It is binding on the parties, their successors, heirs, assigns and grantees, and this restrictive covenant may be removed only with the consent of Washington County. Upon annexation of any part of the above described property to a city, this waiver shall automatically be assigned to the city with full rights to enforce its terms.
