WAIVER (NON-REMONSTRANCE AGREEMENT)
STREET IMPROVEMENT
The undersigned owners(including purchasers)of the real property described below do hereby record their
consent to the formation of a local improvement district by the City of.Tigard for the purposes of
improving the public streets upon which the described property abuts. The undersigned expressly waive
all present and future rights to oppose or remonstrate against the formation of a local improvement district
for the improvement of the abutting street or streets, reserving only the right to contest the inclusion of
particular cost items in the improvement district proceeding and any right they may have under the laws
of the State of Oregon to contest the"proposed assessment formula.
The real property that is the subject of this consent covenant is described on Exhibit A.

A tract of land being a portion of Lot 7 of the Plat of "Edgewood" located in the W.W. Graham
Donation Land Claim in the southeast one-quarter of Section 2, Township 2 South, Range 1
West, Willamette Meridian, in the City of Tigard, County of Washington, State of Oregon, the
boundary being more particularly described as follows:
Commencing at a 314" iron pipe at the southwest corner of Lot 7 of "Edgewood";
thence S 87°4937" E, along the south line of said Lot 7, 255.80 feet to a 112" iron pipe being
the Initial Point of said Partition.Plat;
thence N 02°55'23" E, parallel to the west line of said Lot 7, 118.60 feet to a 5/8" iron rod
with yellow plastic cap marked "G & L Land Surveying, Inc.";
thence S 89°00'17" E 264.40 feet to a 5/8" iron rod with yellow plastic cap marked "G & L
Land Surveying, Inc." in the west right-of-way line of S.W. Hall Blvd_ which bears
N 89"00'17" W 0.90 feet from a 1/2 iron pipe;
thence S 00'19'56" W, along said west right-of-way line, 8.12 feet to a 5/8" iron rod with
yellow plastic cap marked "G & 1 Land Surveying, Inc." at an angle point in said right-of-way;
thence S 00°29'49" W, along said west right-of-way line, 115.96 feet to a 518" iron rod with
yellow plastic cap marked "G & L Land Surveying, Inc." in the south line of said Lot 7;
thence N 87°49'37" W, along said south line of Lot 7, 269.55 feet to the Initial Point.
