Tigard, OR 97223 OREGON Re: Fence Violation 6Z Dear Ms. Roe: The Planning Division has conducted a preliminary review of BUP 97 -0024, an application for the construction of a fence, and have found that certain Community Development Code standards cannot be satisified. Community Development Code Chapter 18.96.070.0 (Projections into Required Yards) states that open porches, decks, or balconies not-more than 36 inches in height and not covered by a roof or canopy, may extend - or project into a required rear or side yard provided such natural yard area is not . reduced to less than three (3) feet and the deck is screened from abutting properties. Chapter 18.100.090.B.1 (Setbacks for Fences or Walls) states that fences or walls may not exceed three (3) feet in height in a required front yard along local streets or eight (8) feet in all other locations and, in all other cases, shall meet the vision clearance area requirements. The site plan submitted with the building permit application shows the deck and fence to located on the property line. As previously stated, decks shall be a minimum of three (3) feet from the rear property line. The building permit cannot be approved as submitted. The deck must be removed to three (3) feet within the property line. The fence, however, can be located at the property line, but must not exceed eight (8) feet in height. The building permit plans will need to be revised to reflect City standards. The deck will have to be modified within sixty (60) days of receipt of this letter or the City will be forced to issue a citation for violation of the Community Development Code.
