The Public Meetings Law authorizes governing bodies to meet in executive session in certain limited situations (ORS 192.660). An "executive session" is defined as "any meeting or part of a meeting of a governing body, which is closed to certain persons for deliberation on certain matters." Permissible Purposes for Executive Sessions: 192.660 (2) (a) - Employment of public officers, employees and agents, If the body has satisfied certain prerequisites. 192.660 (2) (b) - Discipline of public officers and employees (unless affected person requests to have an open hearing). 192.660 (2) (c) - To consider matters pertaining to medical staff of a public hospital. 192.660 (2) (d) Labor negotiations. These records are specifically identified in the Oregon Revised Statutes. 192 -660 (2) (g) - Trade negotiations - involving matters of trade or commerce in which the governing body is competing with other governing bodies. 192.660 (2) (h) - Legal counsel - for consultation with counsel concerning legal rights and duties regarding current litigation or litigation likely to be filed. 192.660 (2) (i) - To review and evaluate, pursuant to standards, criteria, and policy directives adopted by the governing body, the employment - related performance of the chief executive officer, a public officer, employee or staff member unless the affected person requests an open hearing. The standards, criteria and policy directives to be used in evaluating chief executive officers shall be adopted by the governing body in - meetings open to the public in which there has been an opportunity for public comment. 192.660 (2) . Meeting of 9 oc CITY OF TIGARD PUBLIC TESTIMONY GUIDELINES FOR CITY COUNCIL MEETINGS Citizen Communications • Time Limit: 2 minutes or less* o Topics: Items not on the agenda. *Longer matters can be set for a future Agenda by contacting either the Mayor or the City Manager. Non -Public Hearing Agenda Items * If no sign -up sheet is available, ask to be recognized by the Mayor at the beginning of that agenda item. • If the Mayor allows comments, a time limit may be imposed. Public Hearing Agenda Items • Oral Testimony: o Time limit for applicant and /or applicant's representative(s): 20 minutes, total o Time limit (per person) for all other oral testimony: 5 minutes o Timer will be used for all public hearing testimony: • Green light will come on after the person has stated his /her name and address for the record. • Yellow will light come on when one minute remains. • Red light will come on when testimony time is up. o City Council and staff should hold questions until after delivery of testimony to avoid complications determining if the testifier has had the ability to comment the full 5 minutes. • Written Testimony: o For the initial hearing, testimony should be submitted as early as possible. The public is encouraged to deliver written testimony to the City Recorder 24 hours prior to the public hearing. o Deadlines for submitting written testimony can be imposed for continued hearings. o Scope of testimony limits can be imposed for continued public hearings. ® Public Notice on Hearing Procedures: o Hearing procedures will be described in the hearing notice, on the public agenda posted online and at City Hall. o A hearing procedures handout will be available at the entrance to the meeting room. o Hearing procedures are reviewed by the City Attorney at the beginning of quasi - judicial (land use) and legislative hearings. ® Rebuttal o Applicant will have an opportunity to rebut testimony at the hearing following oral public testimony from the proponents and opponents. STAFF RECOMMENDATION Staff recommends' that the Local Contract Review Board, by motion, approve a contract award to Signal Construction Group in the amount of $91 for construction of the project. KEY FACTS AND INFORMATION SUMMARY Y A pedestrian crosswalk to provide safe crossing for Fanno Creek trail users is proposed to be installed on Hall Blvd north of the Fanno Creek Bridge. O The crosswalk will include flashing beacons, at and in advance of, the crosswalk; pavement marking, and permanent signing. The beacons, which operate on solar power, will flash for a predetermined amount of time when activated by 'a pushbutton on either side of the crosswalk. a Completion of the crosswalk will connect the existing Fanno Creek trail west of Hall Blvd to a new trail on the east side of the street, to be constructed concurrently with the crosswalk under a separate project. • Because Hall . Blvd is a state route, a permit has been obtained from ODOT for installation of the crosswalk. © The project was advertised for bids August 18, 2009 in the Daily Journal of Commerce and August 20, 2009 in the Times. A project addendum was issued to modify the size of an electrical conduit. Bids were publicly opened September 3, 2009 and the bid results are: EC Company Portland, OR $81,451.00 Signal Construction Group Woodburn, OR $91,903.00 Engineer's Estimate Range $89,000 to $98,000 ® Although EC Company submitted the lowest bid, it did not acknowledge Addendum No.1. EC Company's bid is therefore not responsive and does not meet the requirement for contract award. Staff recommends the contract be awarded to the next responsive and responsible bidder, Signal Construction Group. ® The construction is tentatively scheduled to begin in early October 2009 and to be completed by late February 2010. OTHER ALTERNATIVES CONSIDERED None CITY COUNCIL GOALS This project meets goal No. 12, "Transportation," of the Comprehensive Plan, by providing a safe and secure route for pedestrians as specified by the Plan. STAFF RECOMMENDATION Staff recommends: that the Local Contract Review Board, by motion, approve a contract award to Civil Construction in• the amount of $139,130.00' for construction of the project, KEY FACTS AND INFORMATION SUMMARY . ® The new trail will begin on the east side of. Hall Blvd, then southward to just north of Fanno Creek. A timber pedestrian bridge will be installed in conjunction with the project to connect the new trail to the existing trail behind the Library. * A new crosswalk light will be installed under a separate contract at approximately the same time with this project to provide safe crossing for Fanno Creek trail users. • To minin»e potential negative impact to the wildlife habitat, the trail's alignment is confined to the southwest corner df the open field north of Fanno Creek and rather than a paved path, an elevated boardwalk will be installed .for the trail. ® The project was advertised for bids on August 18, 2009 in the Daily Journal of Commerce and on August 20, 2009 in the Times. Ten bids were opened on September 3, 2009 and the bid results are: Civil Construction The Danes, OR $139,130.00 CR Woods Trucking Newberg, OR $143,489.90 Parsons Excavating Portland, OR $145,215.50 GVS Contracting Newberg, OR $154,210.00 Somona Pacific Construction Happy Valley, OR $163,945.50* 2KG Contractors Milwaukee; OR $173,090.00 PCR Inc. Beavercreek, OR $179,350.00 Columbia- Cascade Construction Boring, OR $183,311.50 Brant Construction Vancouver, WA $189,390.00* Rutan Construction Hillsboro, OR $199,715.71 Engineer's Estimate Range $100,000 to $110,000 * Somona Pacific Construction's and Brant Construction's bids were disqualified due to their failure to sign and acknowledge Addendum No. 1. • The lowest bid submitted by Civil Construction is higher than the Engineer's estimate range but relatively close to the next two lowest bids. This indicates that the project was underestimated. • Staff has reviewed Civil Construction's bid and recommends the contract be awarded to this responsive and responsible bidder. • Upon Council approval of the contract and after the Notice to Proceed has been issued, the contractor will have 120 days to complete the project. The construction is tentatively scheduled to begin in early October 2009. OTHER ALTERNATIVES CONSIDERED None CITY COUNCIL GOALS This project meets goal No. 8, "Parks, Recreation, Trails, and Open Space," of the Comprehensive Plan, by creating a Citywide network of interconnected on- and -off road pedestrian and bicycle trails as specified by the Plan. ATTACHMENT LIST Project location map FISCAL NOTES Costs related to the project are described as follows: - Construction: $139,130.00 - Bridge engineering: $6,000.00 - Bridge material treatment: $3,000.00 Total project cost: $148,130.00 This project is funded in the amount of $110,000 through Washington County's MSTIP 3 Bike /Pedestrian Fund in FY 2009 -10 and local funds. This memo is intended to explain your options as it relates to the project. LED street light technology is rapidly emerging and city staff have attended several briefings over the last few years. The technology is noted for its energy savings and pure color characteristics. Literature searches indicate several installations nation wide and more in the planning stages. Our current system of street light procurement has been to choose equipment from a list which is supported for maintenance by our franchised provider, Portland General Electric (PGE).Currently PGE does not support any LED street lighting products, but has installed a pilot demonstration in a subdivision in the Gresham area. PGE has scheduled a discussion with municipalities in November to further explore this area. The City could choose to alter its current plan of using PGE supported high pressure sodium fixtures, it would result in the City owning and being responsible for future maintenance of the units. This is a common model and referred to as "Schedule C in industry terms. The city would most likely enter into a maintenance agreement with an electrical contractor to accomplish this work. Process wise, staff recommends you award the. Burnham Street Construction contract as is, and in a separate discussion direct the City Manager to provide more detailed information on this matter. Staff will confirm where PGE is in the process and also determine what costs would be associated with such a change. If Council concurs this change can be implemented via the change order process. Bottom line, we can address many of these issues through the change order process, so we do not need to hold up contract approval. But it seems likely that it is profitable for them. Equally important, the color rendition of LED light is a natural white. The HPS lamps that are proposed emit a pinkish- amber light. In an area that we hope will have an active street life — including at night do we really want orange light from our street lights? Also the fixtures that we are using are not cut -off fixtures. They shine not only downward but also up and in all directions. We hope to have a downtown with dense housing. Do we want light shining upward into bedrooms? Finally our specs allow a half dozen vendors who make similar but not identical aluminum poles to qualify. Different vendors make castings of variable quality. Would it not be better to select a single manufacturer's fixture so that they would always be the same and of high quality. As it is, we will get the least expensive of the lot. Tomorrow night we are scheduled to approve the contract for construction for Burnham. As we move ahead with this project, this is perhaps our last chance to make minor changes. I am not suggesting holding up the contract but I think we should take one more look at this before the fixtures are ordered. The decisions we make now will be with us for a long time. I don't think this got the careful review that it should have. The City intends to conduct a survey every two years to track changes and trends in resident attitudes. 2007 SURVEY DETAILS Campbell Delong Resources, Inc conducted a telephone survey with a random sample of 400 residents of Tigard. Survey results were compared with similar surveys in Lake Oswego, Gresham, and Washington County. Traffic, public safety, growth, parks and taxes were listed by respondents as the most important issues the City Council needs to address. 2009 PROJECT STATUS Three consultants submitted quotes to work on the survey. Staff is in the process of reviewing quotes and will select a consultant in mid- September. Staff will work with the selected consultant firm to recommend questions which will be included in the actual survey. The City expects the selected consultant firm to provide expertise on the topics of interest and an appropriate length for the survey. POTENTIAL NEW TOPICS FOR 2009 SURVEY Staff reviewed the 2007 Community Attitudes Survey and determined most of the survey questions need to be retained to maintain a baseline. There is space available to replace two or three questions on key issues. The beacons, which operate on solar power, will flash for a predetermined amount of time when activated by a pushbutton on either side of the crosswalk. • Completion of the crosswalk will connect the existing Fanno Creek trail west of Hall Blvd to a new trail on the east side of the street, to be constructed concurrently with the crosswalk under a separate project. • Because Hall Blvd is a state route, a has been obtained from ODOT for installation of the crosswalk. • • The project was adyertised for bids August 18, 2009 in the Daily Journal of Commerce and August 20, 2009 in the Times. A project addendum was issued to modify the size of an electrical conduit. Bids were publicly opened September 3, 2009 and the bid results are: EC Company Portland, OR $81,451.00 Signal Construction Group Woodburn, OR $91,903.00 Engineer's Estimate Range $89,000 to $98,000 • Although EC Company submitted the lowest bid, it did not acknowledge Addendum No.1. EC Company's bid is therefore not responsive and does not meet the requirement for contract award. KEY FACTS AND INFORMATION SUMMARY • On August 11, 2009 Council approved the formation of Sewer Reimbursement District No. 46. • The project will result in approximately 3,100 lineal feet of 8 -inch sanitary sewer main and 900 lineal feet of service laterals to provide sewer service to 38 lots on 72n Ave, Clinton St, 70 Ave and Baylor St. • The project was advertised for bids on August 18, 2009 in the Daily Journal of Commerce and on August 20, 2009 in the Times. Two project addenda were issued. Thirteen bids were received at the bid opening conducted at 2:15 PM on September 1, 2009. Walk, hike, bike, bird, paddle, play — whatever you love to do and wherever you love to do it — if you're doing it in the Portland / Vancouver area, you are already using The Intertwine. The Intertwine brings the region's parks providers, nonprofits, government agencies and private firms together behind a unifying name and brand — and we need your help! How Do I Participate? On Park(ing) Day 2009, we want the residents of the Portland / Vancouver metropolitan area to wake up to discover The Intertwine — created in parking places throughout the region! Ideally, we would have Park(ing) Day parks to represent every park and natural area in the region. While we are likely to fall short of this ideal, we are asking nonprofits, friends groups, private firms, parks providers and creative, fun - loving residents to create mo AIL kk parks on Park(ing) Day. The more parks we have, the more fun and impactful Park(ing) Day will be. Choose a parking space that will get high foot traffic and be easily visible and call us. We will help with parking permits (if needed, check local requirements) and can answer any questions you may have. Also, we'll supply an Intertwine sign and a handout that will include all of The Intertwine sites for Park(ing) Day as well as information about The Intertwine. How Do I Get a Parking Permit? We are very fortunate to have great support from The Portland Bureau of Transportation and are available to assist you in getting parking permits for sites in the City of Portland (required). Vancouver will require a street use permit, but will not charge for it. Check to see if your city does or call us for help finding out what is required for your Park(ing) Day location. How Do I Create a Park? You can make your park look pretty much any way that you want, the more creative the better. Make your space inviting so that passers -by will want to stop and visit. A basic park design includes sod, a bench or two, a tree, some safety cones, and an Intertwine sign. You must create a buffer to separate the pedestrians from the road. Determine beforehand what you will do with your materials at the end of the day. Donating them to local organizations or groups is a great idea. If you get materials donated to you, please be sure to thank the donors and give them recognition for their generosity (some places may not want publicity, so please check first). You must leave your parking space as clean as or cleaner than you found it. Sod is messy but if you lay tarps down first you will protect the sod and make the clean up easier. Brooms and dustpans also help. The City of Portland can charge you if the space is dirty /messy when you leave. What Happens on Park(ing) Day? Create your site first thing in the morning on September 18 Intertwine sites should be ready between 8:30 and 10 a.m. and stay open until 3 or 4 p.m. The permit for your parking space should be for the whole day. Pickup trucks are helpful but Park(ing) Day parks have been transported many ways, including exclusively or partially by bicycle! 1111 .r 1111 kkikr N Ai 11 11 Setup and break down is easier than it may seem. A team of 4 -6 people is sufficient, depending on the scale and complexity of the design. Potted trees are heavy and require at least two strong people to lift and move. There is generally a lot of downtime after the park is set up, so bring something to do! Games are also a great way to attract visitors to your park. Can I Promote My Organization on Park(ing) Day? You can have information available about your nonprofit or friends group — or just about The Intertwine. Park(ing) Day is designed as a celebration of parks, trails and natural areas and is not intended to be a vehicle for advertising and promotion. The Intertwine Alliance will be contacting the media and will have a press conference at one of the Park(ing) Day sites at 10 a.m. on Friday, Sept. 18. STAFF RECOMMENDATION Adopt the Revised Building Fees Schedule. KEY FACTS AND INFORMATION SUMMARY The Building Fund is a self - supported dedicated fund in which all inspections, plans review and building support services are paid with revenues obtained through the purchase of permits. The purpose of the increase in fees is to allow the City to continue to offer a full service Building Division to the Tigard community. The Division has incurred a dramatic decrease in revenues within the last year and a half due to the economic downturn nationwide. As a result, in December 2008, the Building staff was reduced from 17.8 to 6.2 F1'E. At the end of FY 2008 -09, it was evident that a $550,000 shortfall still existed within the Building Fund. Subsequently, the budget committee recommended and Council approved, as part of the FY 2009 -10 budget, a $300,000 transfer from General Fund. This was accompanied with direction to propose an increase in building fees to yield the additional $250,000 in revenue to offset future budget shortfalls. In June 2009, a comparable fee study was conducted with neighboring jurisdictions including Beaverton, Tualatin, Wilsonville, Sherwood, Lake Oswego, West Linn, Gresham, and Hillsboro. It is proposed to adopt various parts of Beaverton's, Hillsboro's, and Wilsonville's fee schedules plus a 6% across the board increase to generate the additional $250,000 of revenue. OTHER ALTERNATIVES CONSIDERED Do not pursue an increase in Building fees. The City will continue to experience a $250,000 shortfall in Building Division revenues. STAFF RECOMMENDATION Approval, by motion, of the attached resolution endorsing submittal of the applications. KEY FACTS AND INFORMATION SUMMARY Periodically, cities and counties are required to evaluate their comprehensive plans and land use regulations through a process called periodic review (ORS 197.628 -644 and OAR 660, Division 25). On May 20, 2008, the Oregon Department of Land Conservation and Development (DLCD) notified the City of the commencement of periodic review for Tigard. Based on the City's evaluation and comments submitted by citizens and state agencies, staff developed a periodic review work program, which was presented to City Council on January 27, 2009. At the meeting, Council approved the work program (see Attachment 2) and directed staff to submit the documents to DLCD. The next step in the process was for DLCD approval of the work program. However, based on the uncertainty of budget appropriations for periodic review grants, DLCD temporarily suspended approving any additional work programs in March 2009. This included the City of Tigard work program. In the meantime, the state budget was adopted with adequate appropriations for periodic review grants and DLCD has once again begun the process of reviewing work programs for approval. More importantly, applications for periodic review grants have been distributed and the deadline for submission is November 1, 2009. Although the City of Tigard work program has not yet been approved, DLCD staff recommended submitting grant applications in anticipation of work plan approval. Two City of Tigard work program tasks (see Attachment 2) identify periodic review grants as the funding source. City staff is seeking Council approval to submit two grant applications, one to perform an Economic Opportunities Analysis, and the second to develop a Wellhead Protection Plan. Timely submission of the grant applications will provide the opportunity to utilize available state funds, as opposed to City funds, to perform these tasks. STAFF RECOMMENDATION Adopt the attached resolution authorizing submittal of the application. KEY FACTS AND INFORMATION SUMMARY The CDBG is a federal program that annually provides more than two million dollars to Washington County to fund activities that benefit low and moderate income persons. The County distributes the money to local jurisdictions and nonprofit agencies based on project applications submitted by sponsors. It currently is accepting project proposals for the 09 -10 funding year. The application deadline is 10/09/09. Last year, the City requested and was awarded CDBG funds to infill sidewalk gaps along SW Garrett Street. During this cycle, the City proposes to partner with Community Partners for Affordable Housing (CPAH) on the submittal of a CDBG proposal to partially finance sidewalk and associated public improvements along the street frontages of the Knoll senior housing project. There is a documented need in Tigard for affordable units for seniors. The entire project will target seniors earning less than 50% of area median income. As presently proposed, CPAH would receive and administer any CDBG grant funds awarded. CPAH's Knoll funding partners would provide a substantial local dollar match for the CDBG funds. The City's role would be one of project supporter, encourager, and facilitator, but would not include providing any hard dollar contribution or grant administration. Active support for the Knoll is consistent with the City's stance regarding this project up to now. Direct City financial assistance has included two Fee Assistance awards and, in future, will include property tax exemption. OTHER ALTERNATIVES CONSIDERED Simply endorse a CPAH - originated grant proposal. Grant funds are awarded on a competitive basis. Co- sponsorship implies the highest degree of City support for the senior project. It is intended to strengthen the chances of the application being selected for funding. The senior housing project is located within the urban renewal area and may activate other development within the area. FISCAL NOTES A grant request in the $250,000 range is proposed. No City dollars would be involved. Any grant funds awarded would be administered by CPAH directly and would not be passed through the City. The City would not be a signatory to the IGA for the receipt of any grant dollars and would assume no liability for their use.
