MEETING MINUTES - JUNE 14, 1994
Meeting was called to order at 6:34 p.m. by Council President
Hunt.
1. ROLL CALL
Council Present: Cou_ncil President Paul Hunt; Councilors
Wendi Conover Hawley, Bob Rohlf, and Ken Scheckla. Staff
Present: Patrick Reilly, City Administrator; Dick
Bewersdorff, Senior Planner; Mary Gruss, Accounting
Supervisor; Wayne Lowry, Finance Director; Tim Ramis, Legal
Counsel; Catherine Wheatley, City Recorder; Randy Volk,
Operations Manager; and Randy Wooley, City Engineer.
STUDY SESSION
Review of consolidated billing of water and sewer services.
Finance Director Lowry updated Council on the history of the
billing process as a transition between the Tigard Water
District over to the City of Tigard. City of Tigard is now in
the stage of merging from the old Tigard Water District into
a consolidated billing with City of Tigard sewer and water
services. Changes are proposed to be implemented on July 1,
1994, which would mean customers will be receiving a
consolidated billing of water and storm sewer and sanitary
sewer services after that date. Mr. Lowry also reviewed the
fact that the City is billing for water services for King
City, Durham, and unincorporated areas. It was noted that
there is an area of the City of Tigard which is being serviced
by the Tualatin Valley Water District. The Tualatin Valley
Water District residents receive billings from Tigard for
sanitary and storm sewer services only. Key changes for
customers as of July 1 include the following:
- Type of bill - letter-size/return envelope versus
postcard.
- Bill frequency - bi-monthly, versus monthly.
- Pro-rated solid waste storm sewer calculations will be by
the day versus the month.
- Storm water and sanitary sewer consumption rate will be
based on winter-average water usage versus flat fee.

Entity billed may change based on who pays for water.
Limited control over sewer charge.
Finance Director Lowry reviewed the consumption based sewer
charges (see Council packet for material distributed, which
explains this item in more detail). There was discussion on
impacts to customers and questions and answers by Council to
staff for clarification on customer service related concerns.
Finance Directory Lowry advised two temporary employsem will
be hired for July through September to help with customer
service .issues.
Accounting Supervisor Gruss reviewed the billing process.
(For highlights of her presentation, please see material
distributed to Council which has been filed with the council
meeting packet).
Review of quasi-judicial and legislative public hearing
process.
Legal Counsel Ramis reviewed two types of land use procedures
legislative and quasi-judicial. Mr. Ramis highlighted the
differences between the two types of hearings. In a quasi-
judicial hearing, Council acts in a capacity as "judge." In
a legislative public hearing process, council procedure is
different in that the action they take will have a broad-
based, general effect for the entire City; Councilors may be
approached by persons lobbying for a particular ideal. It
would be inappropriate for people to lobby Councilors on a
quasi-judicial matter; however, if this should happen, it
would not necessarily prohibit a Councilor from participating
in deliberations. The Councilor, if he or she should
encounter ex parte contact, should declare the nature of the
contact and advise whether he or she can deliberate the matter
without bias. If the Councilor feels he or she has a bias in
a quasi-judicial matter, he or she should remove themselves
from the deliberations.
Discussion followed with Council questions and comments. It
was noted that on the Public Hearing under Item No. 4 for this
agenda, it would be more clear to remove the word "comments"
in Item F of the public hearing script. Council comments
should be held until after close of the public hearing during
Council Consideration. Legal Counsel Ramis advised a video
tape of the land use hearing process is available in the
Administration office for use by Council members.
Legal Counsel Ramis also reviewed the definition of a conflict
of interest.

2. VISITOR'S AGM4DA•
Bert Black, 13410 SW Village Glen Court, Tigard, Oregon,
97223. Mr. Black spoke in support of the funding for the
arts, specifically Broadway Rose Theater. He noted the
benefits his family has received from participating in
the theater during the summer. He advised this provides
children with summer jobs and noted it also gave an
opportunity to showcase Tigard talent.
• Tianna Hubbenette, 960 Travis Court, Sherwood, Oregon,
97140. Ms. Hubbenette advised she also participated in
the Broadway Rose community theater; this has been very
beneficial to her personally. She recounted her
successes including friendships formed and personal
recognition and honors which she attributed, in part, to
her involvement in the arts.
• Sharon Maroney advised she donated her time to Matthew
Ryan to speak during the Visitor's Agenda.
Matthew Ryan, 15960 SW Roshak Road, Tigard, Oregon, 97224
advised he was the producer of the Broadway Rose Theater.
He appealed to the Tigard City Council to fund the arts
in Tigard. He related two stories, including his own
personal story, of how this participation was
instrumental in helping young people to become
productive, stay in school, and out of trouble. Mr. Ryan
also read a letter from a student of the theater who
related how the theater had helped him personally. He
noted summer programs such, as sports and arts help keep
kids busy and off the streets.

• Marge Johnson, 11156 SW 130th, Tigard, Oregon, 97223.
Ms. Johnson thanked the City for the recently-constructed
footbridge in the. Summerlake Park area. Ms. Johnson then
noted her concerns with proposed transportation
improvements for flow-through traffic by connecting 130th
and Winterlake Drive. She said the connection of this
road will magnify problems and increase traffic through
this neighborhood. She urged City Council to review the
validity of such a connection and the $40,000 specified
for design of this connection.
Council Discussion - Councilor Hawley requested clarification of
the status of the arts policy. After discussion, it was agreed
Council would look through the brochures distributed to them at the
meeting last week. Council would let staff know their ideas to
help formulate a proposed policy. This item will be placed on an
agenda for a Council goal setting session. In response to a
question from Councilor Scheckla, Mr. Ryan advised that in order to
obtain a .matching grant, they would need to know whether they would
receive any funding from Tigard by July 7.
With regard to the 130th traffic study, City Administrator Reilly
advised the traffic study would be completed in July.

Motion was approved by unanimous vote of Council present.
City Administrator Reilly noted for the record that the
council Orientation meeting is scheduled for June 22, 6:30
p.m. at the Tigard Water Building.

A. Public hearing was opened.
B. Declarations or challenges:
Council President Hunt asked whether any members of
Council wished to report any, ex parte Contact or
information gained outside the hearing, including any
site visits. There were none. All Council members
indicated they had familiarized themselves with the
application.

There were no challenges from the audience pertaining to
Council°s jurisdiction to hear this matter, nor were
there any challenges on the participation of any member
of Council.
C. Staff report - Note: Just prior to the Staff Report,
Council President Hunt advised the following:
- For all those wishing to testify, please be aware
that failure to raise an issue with sufficient
specificity to afford the Council and parties an
opportunity to respond to the issue will preclude
an appeal to the Land Use Board of Appeals on this
issue. Testimony and evidence must be directed
toward the criteria that staff will describe or
other criteria in the plan, or land use regulation
which you believe apply to the decision.
Senior Planner Bewersdorff summarized the staff report.
He reviewed a map of the area on the overhead projector.
Council asked clarifying questions of the staff report,
with the following items noted:
• The decision on the Dolan case could affect some of
the requirements on this particular land use with
regard to bicycle and pedestrian improvements.
• The Oregon Department of Transportation is
requiring shoulder pathways at this time, not bike
pathways.
• It was noted there is a service road which runs
parallel to SW Pacific. Highway, also on this
property. Traffic from future development of this
property would exit onto Bull Mountain Road, not to
Pacific Highway.
• When the type of development is known, drainage
issues will have to be reviewed and dealt with.
• Legal Counsel Ramis, in response to concerns by
Councilor Scheckla, noted the City could attached
conditions to access and egress, depending on
whether the evidence shows this should be done.
• In response to a question from Councilor Hunt,
Senior Planner Bewersdorff advised a civic building
is a conditional use in a multi-family zoning
district. (includes lodges and fraternal
organizations).

D. Public testimony.

Mark Whitlow, 222 SW Columbia, Portland, Oregon,
testified as Legal Counsel on behalf of the applicant.
Mr. Whitlow reviewed what he thought were the most
pertinent issues before Council. Mr. Whitlow distributed
the following items to City Council:
• A map of the area, showing the current zoning.
• Chapter 18.22 of the TMC.
• Chapter 18.62 of the TMC.
• Chapter 18.64 of the TMC.
Mr. Whitlow advised there will be another public hearing
for site development review. He requested Council wait
for the development proposal before conditions were
imposed. Mr. Whitlow requested he be given rebuttal
time.
In response to a question from Councilor Hawley, Senior
Planner Bewersdorff advised he was not sure if the area
included a state highway right-of-way which would
encompass the frontage road.
Mr. Whitlow advised that ODOT may have plans for closure
of the frontage road.
Mr. Rick Givens, Planning Resources, Inc., and Mr.
Whitlow, Legal Counsel for applicant, advised they relied
on the staff report for matters of content with regard to
this application.
Mr. Givens reviewed the history of the zoning for this
area. He advised that because of the slope, professional
offices would be difficult to develop. He noted that
multi-family zoning seems to fit well with the market and
character of the area. Mr. Givens referred to a map and
described possible transportation configurations.
Mr. Givens advised this use would not significantly
impact nearby single-family residential areas. He noted
that public facilities were available, including sanitary
sewers and water. He described the storm drainage
problems; however, he said storm drainage should not be
a limiting factor. He noted that a certain amount of
open space for drainage will be included.

Mr. Givens, advised this location was convenient to
Amok transit park and ride facilities.
There is a need for apartments in this area. A
Washington County study noted a low multi-family vacancy
rate which indicates there is a need for rental housing.
This will, he advised, increase as single-family home
prices escalate-and affordable housing is needed.
Mr. Givens advised there is' a metro requirement to
provide a mix of housing of 50% multi-family and 50%
single-family. He also advised the City is currently
meeting their overall density requirements of ten units
per acre, with a current figure of 10.2 units per acre.
This change to multi-family units will provide a little
extra cushion in that number.
With regard to public comments, Mr. Givens advised two
neighborhood meetings were held on this issue. The
comments were mixed. The predominant concern was
traffic. He advised this project does not have as much
traffic impact as would a development farther up Bull
Mountain Road.
Mr. Givens referred to the traffic engineer study
performed by Robert Keech (a copy of this traffic study
is on file with the Council packet material). Mr. Givens
noted the traffic generated for the proposed use would be
30 to 50 percent less than comparable commercial offices
as it is currently zoned. The change will result in an
improvement with regard to volume of traffic from what
could be expected if developed as a commercial site.
James Nicoli, 9025 SW Center Street, Tigard, Oregon,
advised he was testifying on behalf of the Chamber of
Commerce. Mr. Nicoli advised the chamber was interested
in property next to that owned by National Mortgage
Company. The Chamber of Commerce was in favor of the
proposed change. He advised traffic was the biggest
concern in the immediate area, Mr. Nicoli referred to
the traffic report, which shows that a commercial office
complex would draw far more traffic than a multi-family
use. Mr. Nicoli advised the property slope is excessive
and it would be difficult to develop commercial property
to meet the new ADA requirements.

Mark Padgett, 11270 SW 95th, Tigard, Oregon, testified on
behalf of the Chamber of Commerce. He has reviewed the
ordinance and felt that all applicable State goals had
been met. He noted he felt there had been a substantial
change in conditions. Mr. Padgett also noted traffic
generation would be reduced, should the property be
developed multi-family versus commercial.
Bev Froude, 12200 SW Bull Mountain Road, advised she
would rather not have this property developed, but
realized this would not be possible. She noted all of
the traffic would be exiting onto Bull Mountain Road. At
the present time, there is no use of the right turn lane
during rush hour because of stacking up of long lines of
traffic. She requested careful planning be done to make
sure exits are placed for safety and that roads
interconnect. She noted the different uses at this
location, and advised that with the Chamber using the
building, this would cause additional traffic. She
advised that this was the time to put in conditions to
assure safety.
• Betty Polson, 14400 SW McFarland, Tigard, Oregon, advised
she opposed any impacts on schools. She said more
apartments would mean more children and the schools would
be more overcrowded. She advised the recent bond measure
proposal from the Tigard/Tualatin School District did not
pass. There will be no new school for the area. She
noted more tenants would further impact community
services, such as police and fire. Ms. Polson advised
tenants in apartment buildings do not pay real estate
taxes. Rents collected from apartment buildings do not
cover the cost of education of the children.
In response to a question by Councilor Hunt, Legal
Counsel Ramis explained the state legislation which
requires coordination with school districts and local
governments. School districts are required to submit
plans and cooperate in developing local government
Comprehensive Plans. This is an element of long-term
planning and would not be applicable in a situation such
as this. With regard to service delivery, services for
such things as fire and police follow development and are
not a pre-condition to development. It is the
responsibility of the local government to make sure
services are adequate. Sewer, water, and streets must be
adequate before approval of development.

• Larry Choruby, 16060 SW Colony Place, Tigard, Oregon,
said he had lived in the Bull Mountain area for 16 years
and has lived. in the Tigard area for 26 years. He
advised development at this point on Bull Mountain Road
would be a tremendous burden on traffic and noted his
concerns. He also advised of his concerns on,the impact
to schools and the worsening situation for dollars and
classroom space. He urged Council to reject the proposal
because of these issues.
Rebuttal:
Mark Whitlow advised traffic studies have shown there is
capacity at the intersection. He urged Council to impose
conditions at the next step when it is known what the
development would be, how many buildings, etc.
The maximum number of units for this site would be 93,
based on estimates. He advised the impacts would be less
than what a commercial development would create. He said
those who wished that Council deny this application hope
that nothing would come by way of development or that a
moratorium be placed on building on this area
• Mr. Bob Keech, Engineer, testified on specifics of the
traffic study. Mr. Keech advised the study reviewed the
projected figures for proposed zoning and current zoning.
He noted that for the proposed zoning there is ample
capacity, as well as ample capacity available should a
commercial development occur. Mr. Keech advised his
analysis is general, because there was no site plan yet
developed. He also took other issues into consideration,
such as future growth. Mr. Keech noted a left turn lane
would be necessary at the access point. 85% of the
existing traffic flow exiting out of the residential
areas go east to Pacific Highway.
Legal Counsel Ramis, in response to a question from
Councilor Hunt with regard to procedure, advised that
public testimony ends with applicant rebuttal. Mr. Ramis
said that if either side feels there is new evidence
presented, they may ask the record be left open for seven
days, or to ask for a continuance of the hearing.
E. Staff recommendation:
Senior Planner Bewersdorff said staff recommended
approval, noting the application met all review criteria
and standards.

Following comments were noted by Council:
Councilor Scheckla questioned whether the light at the
foot of Bull Mountain Road could remain green longer, to
help with traffic flow. Senior Planner Bewersdorff noted
ODOT, as part of the review process, would be notified
with recommendations.
Councilor Scheckla questioned whether there would be
adequate buffer between the development and Pacific
Highway, and also whether there would be a park in the
area for young people. Senior Planner Bewersdorff noted
the development will have to include a certain amount of
open space. There is no public park plans in the
vicinity. Two to three hundred feet of open space is
required, plus 20% of the area must be landscaped.
Senior Planner Bewersdorff advised ODOT has not suggested
a widening of Pacific Highway at this vicinity at this
time.
F. Public hearing was closed.
G. Council consideration:
• Councilor Hawley noted the applicants had met. the
Comprehensive Plan policies and requirements, and
she would vote in favor of the zone change. She
said she would like to reserve, in some way, an
option for further consideration of traffic issues.
She also noted concerns with schools, but advised
she as a Councilor was not allowed to refuse
development, based on school capacity.
Councilor Rohlf advised that the applicant had done
a good job of meeting the Code requirements. He
was concerned about traffic; however, conditions
can be imposed during the review of the land use
application to.address the traffic issues. Based
on the evidence, he advised that he felt he must
vote to approve the zone change.
Councilor Scheckla advised there was no way he felt
he could deny this application for the zone change.
He noted the traffic is a concern. He expressed
further concern that the Chamber of Commerce was
hoping to locate at this site because it would
generate more traffic. He stated that when the
site development review stage was before Council,
traffic concerns would be addressed at that time.

He said further traffic surveys should be
completed, but there was no reason not to allow the
Comprehensive Plan Amendment to go forward at this
time.
Council President Hunt advised his concerns were
much the same as those expressed by his fellow
Councilors. He noted the traffic engineer was
hired by the applicant and thus, there was some
possibility the figures could be interpreted to
their advantage. He noted he would go along with
the rest of Council and vote for approval. He
cautioned the developer that he would look hard at
what the traffic situation would be on the site
development plan.
Councilor Hawley advised that in response to
concerns expressed by Councilor Scheckla and
Council President Hunt, she did not believe there
was a great deal of traffic generated by the
persons who were using the Chamber of Commerce
building.
• Legal Counsel Ramis noted that during the site
development process, traffic capacity and safety
criterion must be met.
Councilor Hawley also advised she thought the
change in circumstances had been shown.
H. Motion by Councilor Hawley, seconded by Councilor Rohlf,
to adopt Ordinance No. 94-12:
ORDINANCE NO. 94-12 - AN ORDINANCE ADOPTING FINDINGS AND
CONCLUSIONS TO APPROVE A COMPREHENSIVE PLAN AMENDMENT AND
ZONING MAP AMENDMENT REQUESTED BY THE NATIONAL MORTGAGE
COMPANY (CPA 94-0001, ZON 94-0001)
Motion passed by unanimous vote of Council present
(Council President Hunt and Councilors Hawley, Rohlf, and
Scheckla voted "yes.")
5. NON-AGENDA ITEMS
5.1 City Administrator Reilly summarized the staff report.
Councilor Hawley made the declaration that she knew the
owners of Kerr Contractors, but that she had no bias with
regard to this agenda item. `

Scheckla, to accept the staff recommendation to award the
construction contract to the lowest responsible bidder,
Kerr Contractors, Inc. for the Park/Watkins shoulder
improvements project.
Notion was approved by a unanimous vote of Council
present.

For many months now the Unified Sewerage
Agency (USA) and the 12 cities within urban
Washington County have been notifying then
customers of the change to "Consumption Based
Sewer Rates." This means that instead of paying
a flat fee, your sanitary sewer bill will more
closely reflect the amount of wastewater that goes
down your drains.
Why the Change?
The goal is fairness. Many customers have
requested this change in order to have more
control over their sewer bill. This method is more
fair because it ties customers' usage of the sani-
tary sewer system to their bills. Customers can
control a portion of their bills by lowering their
usage of the system. You pay for what you use.

After July 1, 1994, your sanitary sewer
charge will be broken into two categories: a base
charge and a sanitary sewer use charge. The base
charge is a fee to cover some of the system's fixed
costs. The use charge is based on winter water
usage.

redesignate a 4.13 acre parcel and a .53 acre parcel from
Commercial Professional and General Commercial to Medium High
Density Residential with an R-25 zoning designation?
INFORMATION SUMMARY
The proposed amendment is for two parcels which are the second and
third parcels south and west of the intersection of SW Bull
Mountain Road and SW Pacific Highway. The applicant previously
held a neighborhood meeting on this request on March 17, 1994. The
40 Planning Commission recommended approval of the application at its
April 18, 1994 meeting. The attached ordinance and findings
incorporates that decision. The City Development Code requires that
the City Council hold a public hearing prior to making a final
decision.
The proposed amendment is to allow the property to ultimately be
developed for multiple family purposes. The property has not
developed with the existing zoning designation. The change adds
area for additional housing without adversely affecting the City's
commercial land inventory. The existing restaurant building may be
incorporated into a multi-family development or be redeveloped for
a civic use such as the Chamber of Commerce. An itemized list of
the applicant's submittals is attached. The material is available
at the public hearing or upon request.

Attached is a trip generation comparison of a 4.67 acre site zoned for office,
use with a proposed 93-unit multi-family use.
The proposed multi-family use would have a lower trip generation in all cases,
as compared to more general office use and the more intensive medical office.

The peak hour rates for the multi-family use would be about 50 percent of the
general office use and less than 30 percent of the medical office use.
In my opinion, this proposed change would significantly lower the potential trip
generation to about 30 to 40 percent of what it could currently be used for.
This is based on the assumption that medical professionals would finch this
location attractive because of the nearness to King City.

0 I. INTRODUCTION:
This application seeks approval of a Comprehensive Plan Amendment and Zone Change
for 4.67 acres of land located on Bull Mountain Road at its intersection with Highway 99W.
The subject property is described as Tax Lots 1100 and 1200 of Assessor's Map 2S 1 10 AC.
Tax Lot 1200 is zoned C-P, Professional Commercial. Tax Lot 1100 is zoned CG, General
Commercial. The applicant is requesting that the City's Medium-High Density Residential
comprehensive plan designation be applied to both of these lots and that they be zoned
R-25.
This report has been prepared on the behalf of the owner/applicant, National Mortgage
Company. We will demonstrate that the proposed Comprehensive Plan Amendment and
Zone Change are consistent with applicable Statewide Planning Goals and the policies of
the City of Tigard Comprehensive Plan, and the applicable approval criteria of the City of
Tigard Community Development Code.
II. PHYSICAL FEATURES:
The subject property is located at the foot of Bull Mountain. Bull Mountain Road forms the
northerly boundary of this site, and a frontage road along Pacific Highway forms the eastern
border. Existing vegetation consists largely of open field, with a few trees near Bull Moun-
tain Road. The site slopes to the south and east with moderate grades predominantly less
than ten percent.
A vacant commercial structure is sited on Tax Lot 1100. This building was used in the past
as a restaurant, but has been vacant for several years. Tax Lot 1200 is vacant.
III. EXISTING LAND USE:
East: Tax Lot 1101, a .94 acre parcel, is zoned General Commercial and is developed
with a service station and car wash. Across Pacific Highway properties are zoned
for multi-family residential development.
North: Christ the Icing Lutheran Church is located on the north side of Bull Mountain
Road across from the subject property. A single-family home and vacant residen,
tial lot are also located on the north side of Bull Mountain Road, to the west of
Lutheran Church.
West: The area to the west of the subject property is zoned R-25 and is presently in the
plan review process for development of an apartment project. This area was the
subject of a Comprehensive Plan Amendment from Professional Commercial to
Medium High Density Residential in 1992 (File No. CPA 92-0002/ZON 92-0002).

South: Property to the south of this site, at the intersection of Beef Bend Road and Pacific
Highway, is zoned R-40, High Density Residential. This parcel is developed with
the Wellington Estates apartment complex. Helm Heights, a recently developed
subdivision, is located to the west of this apartment complex. Lots in this develop-
ment are presently vacant.
ICJ. PUBLIC FACILITIES:
A. Sewer: Sanitary sewer service is available to this site from two sewer lines. An eight
inch sewer line in Bull Mountain Road provides service to the northerly portion of the
site. The southerly portion of the property will be served from an existing 8 inch sewer
line located in an easement on the Wellington Estates apartment site to the south of
the subject property.
B. Water Service: Tigard Water District provides water service to the Bull Mountain
area. A twelve inch water main is located in the frontage road on the east border of
this property. The existing water line in Bull Mountain Road along the street frontage
of the subject property is six inches in size.
C. Storm Sewer: Storm drainage in this area is provided via roadside ditches along the
frontage road parallel with Highway 99W. As mentioned previously, the subject
property slopes to the southeast, towards King City. A storm water detention system
may be required in order to limit the rate of runoff to pre-development levels and
mitigate potential impacts upon downstream properties. The most likely means of
accomplishing this detention would be to install an oversized storm pipe in one portion
of the on-site system and, through the use of a restricted outlet pipe, use this storage
capacity in the pipe to detain storm water during peak rainfall periods. This issue
would be addressed in detail at the time of development.
D. Streets: Bull Mountain Road is a paved two lane street along the project frontage. Its
intersection with Pacific Highway is fully signalized. Frontage improvements to the
roadway are planned to be installed at the time of development to improve Bull
Mountain Road to full City standards. A second access point to the subject property is
available from the frontage road along the eastern border of this site. This roadway
provides access to Beef Bend Road.
E. Police and Fire Protection: Police and fire protection are provided to the subject
property by the City of Tigard. Service levels are adequate to meet the future needs of
this site for multi-family development.

V. COMPLIANCE WITH TIGARD COMMUNITY DEVELOPMENT CODE:
Chapter 18.22 of the Community Development Code for the City of Tigard (the "Code")
sets forth the applicable standards for amendments to the Comprehensive Plan Map and
the Zoning District Map. Specifically, Code Section 18.22.010 (Purpose) provides that:
A. Tfte purpose of this chapter is to set forth the standard and propose governing legislative
and quasi-judicial amendments to this title and the zoning district map.
B. Amendments maybe necessary from time to time to reflect changing community condi-
tions, needs and desires, to correct mistakes or to address changes in the law. (Ord 89-06;
Ord 83-52)
Code Section 18.22.040 (Quasi-Judicial Amendments and Standards for Making the Deci-
sion) further provide:
A. A recommendation or a decision to approve, approve with. conditions or to deny all appli-
cation for quasi-judicial amendment shall be based on all of the following standards.
1. The applicable comprehensive plait policies and map designation and, the change
will not adversely affect the health, safety and welfare of the community;
2 The statewide planning goals adopted under Oregon Revised Statutes Chapter 197,
until acknowledgement of the comprehensive plan and ordinances;
3. The applicable standards of any provision of this code or other applicable imple-
»nentittg ordinance, and
4. Evidence of change in the neighborhood or community or a mistake or inconsisten-
cy in the comprehensive plan or zoning map as it relates to the property which is the
subject of the development application. (Ord 89-06; Ord. 83-52)
Proposed Findings: The application satisfies the Code's standards pursuant to Section
18.22.04A for a quasi-judicial amendment to the Comprehensive Plan
map and concurrent zone change as follows:
1. The application complies with the City of Tigard Comprehensive
Plan policies (discussed in section VII at page 6 below
COMPLIANCE WITH COMPREHENSIVE PLAN POLI-
CIES), because the application complies with and supports
applicable comprehensive plan policies and because it reflects
changes in community conditions and present needs for multi-
family housing in this area. The application for amendment of
the Comprehensive Plan Map and zone change from commercial
to multi-family residential will enhance and not adversely affect

the health, safety and welfare of the community. Accordingly, the
standards of Code Section 18.22.040A.1. have been satisfied.
2. The City of Tigard Comprehensive Plan and implementing
ordinances have been acknowledged by LCDC and, therefore,
the statewide planning goals adopted under ORS Chapter 197
need not be specifically addressed. However, the application
complies with the statewide planning goals (discussed in Section
VI at page 5 below - "COMPLIANCE WITH STATEWIDE
PLANNING GOALS"). Accordingly, the standards of Code
Section 18.22.040A.2. have been satisfied.
3. The application complies with the applicable standards of the
Code in the following particulars:
(a) It complies with the Purpose statement under Section
18.22.01013 of the Code as explained in paragraph 4 of this
section below.
(b) The application is not coupled with a specific request for
development and, accordingly, the Code's various devel-
opment approval standards need not be addressed by the
application, but will be addressed at the time a specific
development plan is proposed under Chapter 18.120 (Site
Development Review) of the Code.
Accordingly, the standards of Code Section 18.22.040A.3. have
been satisfied.
4. The proposed Comprehensive Plan Map and Zoning Map
amendments are necessary to reflect changing community condi-
tions, needs and desires. Specifically, the commercial designa-
tion of the subject property was never realized by commercial
development due to the absence of an appropriate community
need and other market conditions. At the same time, a commu-
nity need and market for multi-family housing in this area has
been identified and presently exists. The pattern of land use on
the Comprehensive Plan Map and Zoning Map has shifted from
commercial to multi-family residential since the subject property
was originally designated as commercial. The further specifics of
the changing community conditions and needs are more fully set
out in Section VII at page 7 below (COMPLIANCE WITH
COMPREHENSIVE PLAN POLICYAMPLEMENTATION
STRATEGY II, page II-8). Accordingly, the standards of Code
Section 18.22.040A.4. have been satisfied.

VI. COMPLIANCE WITH STATEWIDE PLANNING GOALS:
The following LCDC Statewide Planning Goals are applicable to this proposed Zone
Change and Comprehensive Plan Amendment Application:
Goal #1: Citizen Involvement
Proposed Findings: The City's citizen involvement program includes opportunity for input
from interested citizens and the CIT. Public notice of all hearings is
provided in accordance with adopted City procedures.'
Goal #2: Land Use Planning
Proposed Findings: This goal is satisfied because the City applies all relevant Statewide
Planning Goals and Tigard Comprehensive Plan polices to the review
of Comprehensive Plan Amendment and Zone Change proposals.
City procedures include provision for notification and comment from
other units of government, including Washington County, the Oregon
Department of Transportation, and the Department of Land Conser-
vation and Development.
0 Goal #9: Economy of the State
Proposed Findings: This application will remove 4.67 acres of land from the City's supply
of vacant commercial land. However, this amount of land is not large
compared to the total supply of such lands. Additionally, this property
has been available for development since the adoption of the Compre-
hensive Plan in 1980 and has had no interest expressed for develop-
ment under the existing designation. The hillside slopes on this
property (8 to 15 percent grades) make development of commercial
uses difficult. For this reason, the conversion of this site to multi-
family residential use will have no negative impact upon the economy
of Tigard or the State. Construction activities relating to the develop-
ment of this property for residential use will add short-term construc-
tion jabs and will positively affect the economy through the reed for
building materials.
Goal #10: Housing.
Proposed FindinM: This proposal would increase the potential for providing adequate
housing to meet projected needs in the City of Tigard. The proposed
R-25 zoning would provide for a potential density of development of
about 93 units.

The Metropolitan Housing Rule (O.A.R. 660-07) interprets Goal 10
for the Portland Metropolitan Area. This Rule requires that the City
of Tigard maintain a vacant land inventory which averages 10 housing
units per acre and maintains a 50-50 mix of single-family to multi-
family development. According to staff, this requirement is currently
met by the City, but is very close. If the City is to have flexibility to
consider Plan Amendment proposals from residential to other plan
designations or from higher to lower residential designations, a cushion
is needed which will provide for continued compliance with this stand-
ard. The proposed Plan Amendment will assist the City in its contin-
ued compliance with the Metropolitan Housing Rule.
Goal #11: Public Facilities and Services.
Proposed Findings: At issue under this Goal is whether the proposed multi-family residen-
tial designation is consistent with the level of public facilities and serv-
ices which are presently available to the site or which can be made
available at the time of development. As discussed in the preceding
section of this report, adequatemater, sanitary sewer, storm sewer, and
transportation facilities can be made available to service the proposed
R-25 zoning for this property. Thus, the proposal is consistent with the
0 requirements of Goal 11.
Goal #12: Transportation.
Proposed Findings: The designation of this site for Medium-High Density Residential
development is consistent with Goal 12. Bull ]Mountain Road is a
major collector street and is, thus, suited for providing access to R-25
zoned properties. The site is in close proximity to Pacific Highway, a
major arterial, and has quick access to shopping and employment
areas. Tri-Met bus service is available at the intersection of Pacific
Highway with Bull Mountain Road.
VII. COMPLIANCE WITH COMPREHENSIVE PLAN POLICIES
Policy 1.1.2. Pale 11-7
The Comprehensive Plan and each of its elements shall be opened for amendments that consid-
er compliance with the plans of the Metropolitan Service District (MSD) or its successor on an
annual basis, and may be so amended or revised if deemed necessary by the City Council.
Annual amendment and revision for compliance with the above regional goals, objectives and
plans shall be consistent with any schedule for reopening of local plans approved by the Lad
Conservation and Development Commission (LCDC).

This provision is not to be construed as waiving any legal rights which the City may have to
challenge the legality of a regional goa4 objective, or plan provision.
Proposed Findings: The proposed amendment is not related to regional goals and, there-
fore, the annual review requiremertF is not applicable to this proposal.

The Community Development Code (C.D.C.) shall provide quasi-judicial changes to the
Comprehensive Plan Map which may be initiated by affected parties on a semi-annual basis
and approved if the City Council fuels:
a. The change is consistent with applicable plan policies,
b. A change of physical circumstances has occurred since the origutal designatioh; or
c. A. mistake was made in the origiutal land use designation.
Proposed Findings: The proposed Plan Map Amendment is being submitted in accordance
OB with the City's schedule for semi-annual reviews. The consistency of
this application with applicable policies of the comprehensive plan will
be demonstrated in this section of this report.
The applicant is not aware of any mistake in the original land use
designation of this property. However, many changes have occurred in
this area which warrant a change in the designation of this site. Specif-
ically, the majority of those properties which had been designated in
the Plan for office commercial development, have been converted to
multi-family residential designations and are developing for residential
use. The most recent of these changes was the approval of a Plan
Amendment/Zone Change to R-25 for the adjoining property to the
west. This change had the affect of changing 3.19 acres of vacant C-P
to a multi-family residential designation and leaving Tax Lot 1200 as
an isolated site for office commercial development. Additionally, the
Wellington Estates project was developed along the southern bound-
ary of the subject property and introduced High Density Residential
development in this area of the city. A review of the Zoning District
Map dated May 9,1783 (As revised November 1983) indicates that this
parcel was also originally designated C-P, Professional Office. Since
that time, the City has amended the zoning to R-40.
The elimination of these adjacent sites for potential office develop-
ment seriously erodes the ability of developing an office park enAron-

ment in this area. The applicant's property which is zoned C-G is less
than five acres in size, is too small to attract this type of development
in an area considerably removed from other office uses. The introduc-
tion of apartment development to the west and on the Wellington
Estates site has served to establish multi-family residential as the
appropriate land use in this area of the city.

multi-family residential use would increase the availability of afford-
able housing.in the city and would assist the City in continued compli-
ance with the Metropolitan Housing Rule.

Proposed Findings: These policies are satisfied because adequate public water, sewer,
storm sewer, fire and police services are available to serve potential
multi-family development on this site. The availability of all required
utilities has been addressed earlier in this report.

The City shall plan for a safe and efficient street and roadway system that meets current needs
and anticipated future growth and development.
Proposed Findings: This policy is met because the subject property has access to the arte-
rial street system via signalized intersections at Bull Mountain Road
and Beef Bend Road. Additionally, the site has convenient access to
TriMet bus service at the intersection of Pacific Highway and Bull
Mountain Road.

a. Locating land intensive uses in close proximity to transitways;
b. Incorporating provisions into the Community Development Code which require develop-
ment proposals to provide transit facilities; and
c. Supporting efforts by Vi-Met and other groups to provide for the needs of the transporta-
tion disadvantaged and

The City shall encourage a reduction in energy consumption by increased opportunities for
energy conservation and the production of energy from altemative sources.
Proposed Findings: The location of a land intensive use such as Medium-High Density
Residential in close proximity to the existing transit line on Pacific
Highway is consistent with these policies. Access to transit will assist in
reducing energy consumption by promoting alternative modes of

transportation. Tri-Met Route 12 operates on Pacific Highway within
250 feet of the subject property. Route 12 provides weekday service
on a 30 minute interval basis, providing excellent commuting opportu-
nities to and from work in Tigard, Portland and Sherwood.

77te City shall encourage land use development which emphasizes sound energy conservation,
design and construction.
Proposed Findings: The subject property is located on a south facing slope which affords
opportunities for use of passive solar energy in the design of the future
development. The designation of this site for multi-family develop-
ment would allow the most efficient utilization of this energy source.

Proposed Findings: The applicable plan policies are discussed in this section of this report.
The proposed R-25 zoning is consistent with these policies. The loca-
tional criteria for the Medium High Density Residential designation
are discussed below. The future development of this site will be de-
signed to comply with applicable Community Development Code
provisions regarding density.
,Locational Criterion 3. Medium-Hielt and High Density Residential Pa e~ 11-79
A. 77te following factors will be the determinants of the areas designated for high density on
the plan map:
'(1) Areas which are not committed to low density development.
Proposed Findings: The subject property is not located in an area committed to low density
development. As discussed previously, abutting properties to the west
and south are zoned for multi-family residential use, as are properties
to the east, across Highway 99W. Tax Lot 1101 is zoned C-G and is
developed with a service station. A church is located across Bull
Mountain Road from the subject property.

(2) Areas which can be buffered from low density residential areas in order to maximize
the privacy of established low density residential areas.
Proposed Findings: As discussed above, surrounding properties are committed to multi-
family residential and other non-residential uses. These abutting
properties serve to buffer this site from low density residential areas.
(3) Areas which have direct access from a major collector or arterial street.
Proposed Findings: This site has direct access from Bull Mountain Road, a designated
major collector street.
(4) Areas which are not subject to development limitations.
Proposed Findings: The subject property is not located in a flood plain, area of high water
table, or known geological hazard area. The subject property is locat-
ed on a moderate slope which should pose no limitations to the safe
development of this site.
(S) Areas where the existing facilities have the capacity for additional development.
Proposed Findings: As indicated earlier in this report, all necessary public facilities are
available in adequate capacity to service the.proposed Medium-High
Density Residential development on the property. * -
(6) Areas within one quarter mile of public transit.
Proposed Findings: Transit is immediately available to this site at the intersection of Bull
Mountain Road and Pacific Highway. The parking lot for the Christ
the King Lutheran Church at that intersection serves as a park and
ride station.
(7) Areas within one quarter mule from neighborhood and-commercial shopping centers
or business and office centers
Proposed Findings:. This property is located within on-quarter mile of shopping facilities in
the Canterbury Square shopping center to the north of this site. Addi-
tionally, automobile service and limited convenience items are avail-
able from the Texaco site contiguous to the subject property.
(g) Areas adjacent to eitlrerprivate orpublic permanent open space.

Proposed Findings: There is no public or private open space in the immediate vicinity of
this site. Open space can be provided on-site in developing the site
plan for the future multi-family development.
VIII. CONCLUSION
The proposed amendments to the Plan Map and Zoning Map are necessary to meet
changes in community conditions, deeds and desires by providing affordable housing within
close proximity to public transit and supportive retail services. All necessary public facilities
and services are available to serve the proposed Medium-High Density designation. The
proposed R-25 zoning will allow for greater energy conservation and will provide needed
affordable housing. The specific locational criteria for the Medium-High Density designa-
tion list eight factors to be considered in siting this land use. The subject site complies with
all of these factors.
The proposed Plan Map Amendment and Zone Change have been demonstrated to be
consistent with the purpose and approval criteria contained in the City of Tigard Communi-
ty Development Code for the review of zone change applications. Further, the application
has been demonstrated to conform with applicable Statewide Planning Goals and policies of
the Tigard Comprehensive Plan. Thus, this application complies with all relevant criteria
and approval is hereby requested.

Introduction:
This report examines a proposed zoning request that would allow for 93
units of multi-family housing. The current zoning allows for about 68,000
square feet of professional office use. The site is located south of Bull
Mountain Road near the intersection of Pacific Highway. One driveway onto
Bull Mountain Road is assumed. A detailed site plan has not been prepared.
Area of Analysis:
This report investigates Bull Mountain Road from McFarland Boulevard
to Pacific Highway.
Circulation Alternatives:
Only direct access to Bull Mountain Road was reviewed.

The trip generation for the proposed multi-family use of the site is
estimated at about 605 trip ends per day (93 multi-family units). This can be
compared to an estimated 1,544 trip ends per day under the existing zoning of
68,000 square feet of mixed professional and medical office use.
All the intersections within the area of analysis currently operate at an
acceptable Level of Service (LOS), "D" or better. It is anticipated that under
Total Traffic conditions (existing +site+future traffic growth) will not drop the
LOS to unacceptable limits. The left turn traffic out of the proposed site, the
movement most subject to delay, would operate at a "B" LOS with a minimal
2 to 6 vehicles per hour. Bull Mountain Road at Pacific Highway currently

operates at a "C" LOS. The existing two west-to-north left turn lanes on the
Bull Mountain Road approach moderate the impact of the site-generated traffic.
Either site use would generate sufficient left turn traffic into the site from
Bull Mountain Road to warrant a left turn refuge on Bull Mountain Road.
Conclusion:
The traffic impact of the proposed zoning change would be less than that
which would occur under existing zoning. Ample capacity is available for either
zoning.
Consideration should be given to providing a left turn refuge on Bull
Mountain Road. This should be reviewed in more detail during the design phase
of this project.

Traffic Growth
The traffic growth was assumed at a 10% increase in existing traffic on
Pacific Highway and Bull Mountain Road, plus the traffic from a proposed 194
unit multi-family development directly to the west of the subject site. This
increase is used to provide a level of service comparison for the immediate
future.

LEVEL OF SERVICE CRITERIA
FOR
SIGNALIZED 1 INTERSECTION
Level of service A
Describes operations with very low delay, i.e., less than 5.0 sec per vehicle. This
occurs when progression is extremely favorable, and most vehicles arrive during the
green phase. Most vehicles do not stop at all. Short cycle lengths may also contribute
to low delay. .
Level of service R

generally occurs with good progression and/or short cycle lengths. More vehicles stop
than for LOS A, causing higher levels of average delay.
Level of service C
Describes operations with delay in the range of 15.1 to 25.0 sec per vehicle. These
higher delays may result from fair progression and/or longer cycle lengths. Individual
cycle failures may begin to appear in this level. The number of vehicles stopping is
significant at this level, although many still pass throught the intersection without
stopping.
Level of service D
Describes operations with delay in the range of 25.1 to 40.0 sec per vehicle. At level
D, the influence of congestion becomes more noticeable. Longer delays may result
from some combination of unfavorable progression, long cycle lengths, or high v/C
ratios. Many vehicles stop, and the proportion of vehicles not stopping declines.
Individual cycle failures are noticeable.
Level of service E
Descibes operations with delay in the range of 40.1 to 60.0 sec per vehicle. This is
considered to be the limit of acceptable delay. These high delay values generally
indicate poor progression, long cycle lengths, and high v/c ratios. Individual cycle
failures are frequent occurrences.
Level of Service F
Describes operations with delay in excess of 60.0 sec per vehicle. This is considered
to be unacceptable to most drivers. This condition often occurs with oversaturation,
i.e., when arrival flow rates exceed the capacity of the intersection. It may also occur
at high v/c ratios below 1.00 with many individual cycle failures. Poor progression and
long cycle lengths may also be major contributing causes to such delay levels.

A. The purpose of the C-P zoning district is:
1. To provide for groups of businesses and offices in centers;
2. To accommodate the location of intermediate uses between residential.
districts and areas of more intense development;
3. To provide opportunities for employment and for business and
professional services in close proximity to residential neighborhoods
and major transportation facilities;
4. To expand the City's economic potential;
5. To provide a range of compatible and supportive uses; and
6. To locate office employment where it can support other commercial uses.
B. The trade area will vary and may extend outside the community. This zone is
intended to implement the policies and criteria set forth in the
comprehensive plan. (Ord. 89-06; Ord. 83-52)
18.64.020 Procedures and Approval Process
A. A permitted use, Section 18.64.030, is a use which is allowed outright, but
is subject to all applicable provisions of this title. If a use is not
listed as a permitted use outright, it may be held to be a similar unlisted
use under the provisions of Chapter 18.43, Unlisted Use.
B. A conditional use, Section 18.64.040, is a use the approval of which is
discretionary with the Hearings Officer. The approval process and criteria
for approval are set forth in Chapter 18.130, Conditional Use. If a use is
not listed as a conditional use, it may be held to be a similar unlisted use

A. Dimensional requirements in the C-P district are as follows:
1. The minimum lot area shall be 6,000 square feet;
2. The average minimum lot width shall be 50 feet;
3. Except as otherwise provided in Chapter 18.96 and Section 18.100.130,
the minimum setback requirements are as follows:
a. There shall be _no minimum front yard setback requirement;
however, conditions in Chapters 18.100 and 18.102 must be met;

setback requirement; however, the provisions or Chapter 18.102

required where the C-P zone abuts a residential zoning district;

e. All building separations shall meet all Uniform Building Code

18.22.010 Purpose
A. The purpose of this chapter is to set forth the standard and propose
governing legislative and quasi-judicial amendments to this title
and the zoning district map. I 1.
B. Amendments may be necessary from time to time to refract- changing
community conditions, needs and desires, to correct mistakes or to
address changes in the law. (Ord. 89-06; Ord. 83-52)
18.22.020 Legislative Amendments to this Title and Hap
A. Legislative amendments to this title and to the map shall be in
accordance with the procedures and standards set forth in Chapter
18.30. .(Ord. 89-06; Ord. 83-52)
18.22.030 Quasi-Judicial Amendments and Procedures
A. Quasi-judicial amendments to this title and to the map shall be in
accordance with the procedures set forth in this title and the
following:
1. The Commission shall decide zone change applications which do
not involver comprehensive plan map amendments as provided by
Section 18.32.090.0.3. A petition for review by the Council
may be filed as provided by Section 18.32.310.B;
2. The Commission shall make a recommendation to the Council on an
application for a comprehensive plan map amendment; and
3. The Commission shall make a recommendation to the Council on a
zone change application which also involves a concurrent
application for a comprehensive plan map amendment. The
Council shall decide the applications on the record as provided
by Section 18.32.320.B. (Ord. 89-06; Ord. 83-52)
18_._22_.040 -Quasi-Judicial Amendments and Standards for Making the Decision
A. A recommendation or a decision to approve, approve with conditions
or to deny an application for a quasi-judicial amendment shall be
based on all of the following standards:

1. The applicable comprehensive plan policies and map designation
and; the change will not adversely affect the health, safety
and welfare of the community;
2. The statewide planning goals adopted under Oregon Revised
Statutes Chapter 197, until acknowledgment of the comprehensive
plan and ordinances;
3. The applicable standards o£ any provision of this code or, other
applicable implementing ordinance; and
4. Evidence of change in the neighborhood or community or a
mistake or inconsistency in the comprehensive plan or zoning
map as it relates to the property which is the subject of the

18.22.050 Conditions of Approval
A. A quasi-judicial decision may be for denial, approval, or approval
with conditions as provided by Section 18.32.250.p.

ISSUE BEFORE THE COUNCIL
Award the construction contract to the lowest responsible bidder, Kerr
Contractors, Inc..for the Park / Watkins Shoulder Improvements project.
STAFF RECOMMENDATION
Award the contract to Kerr Contractors, Inc. and authorize the City
Administrator to sign the contract. Kerr Contractors has been in the
construction business for several years and is qualified to construct this
project. They have completed previous projects for the City.
INFORMATION SUMMARY
The project will construct a paved shoulder by widening the existing pavement
0 on the north side of Park Street, from Grant Avenue to Watkins Avenue, and on
the east side of Watkins, from Park Street to Fairhaven Street. The paved
shoulder will provide a 5' wide pedestrian/bike path, striped off from the
two travel lanes.
Seven bids were open on June 7, 1994 for the project. The bid results are as
follows:

On May 10, 1994 the Council approved funding of $51,000 for this project and
authorized advertising the project for bids.
