Conover Hawley, Paul Hunt, and John Schwartz. Staff' Present: Patrick Reilly, City Administrator; Tim Ramis, Legal Counsel; and Catherine Wheatley, City Recorder. 1.5 R30L COMMUNICATIONS: Mayor Schwab noted that Councilors Hawley, City Recorder Wheatley, and he attended the Chamber Lunch meeting earlier in the day to listen to the two mayoral candidates for the City of Tigard. Ha reported that he thought both Councilor Fessler and Schwartz represented the City well. 2. DISCUSSION ITEMS: 2.1 Reimbur~ment District: Council reviewed a draft ordinance which outlined procedural changes but did not reflect substantial policy changes with regard to reimbursement district formation. The following includes some of the guidelines/policy decisions of Council: > Reimbursement District Guidaiines for all City departments (noting specifically the Water Department as well) will be consistent. > Councilor Hawley noted the current ordinance does not specify between a "developer" and an individual property owner as to whether they are eligible for participation in a reimbursement district. She advised there is an issue of fairness; if the reimbursement district is available, it should be available to everyone if they meet the qualifications set forth in the ordinance. > The requirement to oversize public facilities can be considered by Council for each application as to the amount (cost) to distribute throughout the zone of benent. City Attorney reminded that Council has ultimate discretion whether to form a district. The oversl ing policy will need to be reviawed to a..-sure compliance with Systems Development Charge (SDC) law. When the oversixing policy is re-viewed, a Comprehensive Plan Amendment (CPA) will be necessary and will require a public hearing process. > Zone of benefit City Attorney advised this is a legislative matter for which Council will have full discretion to determining criteria. > Council discussed "prior contributions" toward offsetting reimbursement district allocations. If prior contributions are allowed to offset a reimbursement district allocation (such as land dedication for an easement), then the contribution should match; i.e.: prior dedication for land for sewer easement to offset assessment for sewer reimbursement district costs... sewer-related contribution for sewer reimbursement district street-related contribution for street reimbursement district water-related contribution for water reimbursement district > City will be able to form a reimbursement district on its own behalf. > Ordinance prescribes procedural changes in the sequence of events for reimbursement district formation: 1) Preconstruction formation 2) Public hearing on district formation Construction 4) Adjust- rents to distribution of costs City Attorney cautioned this process will create additional procedural problems because initial distribution of cost figures will be estimates only. > If fee for collection and administratK,,q costs are to be a percentage of the costs plus interest, then this should be stated clearly in the ordinance. City Administrator advised reasonable expenses, to be collected up front, may be offered as an afternative for Council consideration. CITY COUNCIL MEETING MINUTES. - APRIL 19, 1994 - PAGE 2 > The fee charged to the applicant by the City for reimbursement district formation administrative costs will be set by resolution and will be ready for Council consideration on May 1® along with a proposed ordinance. > Notification - ample time for notification should be allowed for by the ordinance. It was noted that if notification of a reimbursement district was sent by mail at the ten day lim. r 7 i7 this may, not give Inso- le ° -r-- , enough notification. It was suggested that an extra three days be added if mailed. > Council consensus: Term of reimbursement district not to exceed fifteen years with no extensions. 2.2 Review of Council Priorities: City Administrative briefly reviewed the 93-94 Council priorities, a list of unfinished business, and a draft statement of 94- 95 priorities. City Administrator asked for Councilors to notify him it they think of an issue which should be included on the list. Annexation policy (rearranged from non-agenda list)... Council discussed an upcoming (4/26 meeting) agenda item dealing with annexation. Council will consider a resolution of intent to annex all unincorporated areas completely surrounded by the City using the "island method." The resolution also includes an outline of the Island Annexation. Notification of the new policy direction, if approved on April 26, will be sent to persons now on a mailing list when Council was considering a double majority annexation plan last year. 2.3 Status Repo t: - 1- / 217 City Administrator distributed an April 15, 1994 letter to Mr. Bruce Warner from Rece Bly which listed the members of the 1-5/1-lighway 217 task force. Mayor Schwab is a member of this task force. Also distributed was an April 14, 1994 letter from Rece Bly outlining his understanding of the outcome of a recent meeting with Bruce Warner (Legion 1 Manager, Oregon Department of Transportation) and business and community leaders (Tigard and Lake Oswego). Attached to the letter was an outline of the Community Task Force specifying membership, the "charge," and minimum expectations. The "Phoenix" proposal for the 1-5/217 interchange improvements as proposed by ODOT has caused concern on the part of business owners and community leaders in Tigard and Lake Oswego. CITY COUNCIL MEETING MINUTES - APRIL 19, 1994 - PAGE 3 t 111! 01 MEW I Still 11:11 City Administrator advised he has asked Bruce Warner to consider a joint ANIL meeting with the Tigard and Lake Oswego Councils in order to gain a better understanding of the traffic Impacts and the Phoenix project. This meeting would probably be set for mid-May. Council discussed options including advising of dissatisfaction of the offered solution(s) and then delay for the next six-year plan with the hope the 1- 5/217 interchange improvements would be listed. Council noted, on balance, that it would be better to wait for the improvements rather than go with something like the Phoenix project which would be detrimental to Tigard. 3. NON-AGENDA ITEMS: 3.1 Annexation Policy (See discussion under Item 2.2 above.) 3.2 Metro Greenspaces - City Administrator advised of receipt of correspondence from Metro advising of the Greenspaces program and a series of upcoming public hearings. The bond measure was originally put together for voters to approve $140 million. Metro has determined that this amount is too high and probably would not pass at the election. It appears now that a scale back of the bond measure is being crafted which might delete the local share (Tigard would have received $750,000). Council discussed. Of concern was whether Tigard voters would actually be getting anything for $750,000; for example, revenue from Tigard voters may exceed $750,000 plus Tigard would them be responsible for the maintenance and administrative expenses on an ongoing basis. One opinion expressed was that it would be better go out for a local park levy if it appears there is support for the purchase of more park land. City Administrator said three options were before Council with regard to the Metro Greenspaces public hearings: 1) Remain silent 2) Oppose 3) Support Council consensus: remain silent. 3.3 Erosion Control - Council, by consensus, authorized the City Administrator to contract for erosion control services through the Unified Sewerage Agency. Such an ordinance would allow would establish a formal procedure under which a developer (including the city) could install street, water and sewer improvements, and be reimbursed from property owners who utilize those improvements, when and if they ever do utilize the improvements. INFORMATION SUMMARY From time to time the City is requested to establish an administrative system, wherein developers may get reimbursed from adjacent benefitting property owners who utilize public improvements originally installed by the developer. These systems are usually established formally through a "latecomer's", or "advance sinancing" ordinance, essentially like the one attached. Currently the City has a system, but it is administered on a case-by-case basis. There is no overall "enabling" ordinance. The current method is cumbersome and obscure; there is no provision for an interest charge or ar. administrative charge; or the establishment of a prescribed time period. An ordinance has been prepared by the City Attorney's -office that would establish a formal system. _ ALTERNATIVES CONSIDERED 1. Adopt the attached ordinance as proposed. 2. Adopt the attached ordinance as modified by the City council. 3. Ask staff to do further analysis or research, and bring back a modified 'ordinance. 4. Do not adopt the ordinance. _o~---=- ' FISCAL IMPACT There may be two impacts: 1. Administration of the ordinance. The City would need to keep track of connections within the advance financing district, and reimburse the original developer. The proposed ordinance allows for a fee equal to 10% of the amount collected to be imposed to cover administrative costs. 2. The City may, on occasion, act as the "developer" itself, extending a street or sewer line and wishing to be reimbursed for that cost. This ordinance would establish the procedures under which the City may "front end" the costs of public improvements, and be reimbursed for those costs at a later date. Meadows Road Lake Oswego, Oregon 97035 Ladies and Gentlemen: As most of you know, at last Friday's meeting with the Oregon Department of Transportation regarding the I-5/Highway 217/72nd Avenue interchange and ramps, Director Bruce Warner proposed the formation of a small group of municipal and business leaders to undertake a-limited set of tasks. After last Friday's meeting, Mr. Warner informed Representative Tom Brian that ODOT;has placed the Phoenix proposal on hold, pending completion of the tasks assigned to the small group. Enclosed is a.--copy of the first draft of a document that was prepared by Mr. Warner after last Friday's meeting. The history of the failed $85 million EA Selected Alternative; 2. The inadequacy of the Phoenix proposal; and i 3. The need for adequate funding for the improvement of the I-5/highway 217 interchange, which traditionally has been regarded by ODOT and Metro as the No. 1 priority project for the entire metropolitan area. Tom and I propose that the task force consist of the six of you, Tom, me, and a representative from TVEDC who has not yet been selected. As soon. the membership of the task force is settled, I propose that/we old a telephone conference among the task force members to/discu strategy and the task force's charge. Minimum Expectations: Solve the existing unsafe freeway--to-freeway operation as soon as possible and obtain closure on plan to address local circulation and development needs- i
