MEETING MINUTES - NOVEMBER 10, 1992
• Meeting was called to order at 6:32 p.m. by Mayor Edwards.
1. ROLL CALL z
Council Present: Mayor Jerry Edwards; Councilors Judy
Fessler, Valerie Johnson, Joe Kasten, and John Schwartz.

Lieutenant (present for Study Session only) and Randy Wooley,
City Engineer.
STUDY SESSION
a. Police Department
Report on FBI Academy Experience: Lt. Bob Wheeler, a
recent graduate of the FBI Academy, thanked the City
council for making it possible for him to attend this
schooling. Highlights of his reporte included the
following information:
• Academy is an 11-week course, and one earns 27
college credit hours.
• The program focuses on increasing workloads
and decreasing financial resources.
• The emphasis is on problem solving and
community policing.
• The program utilizes a holistic approach:
physical fitness, academics, and social
(developing a network for future resources).
• In U.S., Portland is the role model for
community policing.
• Community policing is not a "program" rather
it is a philosophy.
• Police Departments, including Tigard, are
changing their ways of doing things this is
difficult for some to adjust- More citizen
involvement and integration of the officers
into the community is foreseen.

Community Youth Services Gang Grant: Chief of Police Ron
Goodpaster advised of a four-phased program (beginning in
January) to assess, disseminate information, hold
workshops and then reassess anti-gang efforts. Tigard,
Tualatin and Sherwood will participate in this program
which is funded by a $7,500 grant through Washington
County Community Youth Services. Very few programs of
this type have been tried; however, preliminary results
from a similar effort in Phoenix, Arizona look promising.
It is hoped that elements of the program can be shared in
some manner during the Fanno Creek Conference in
February.
Oregon State Patrol 1 OSPZ: Chief Goodpaster reported
that an OSP representative contacted him recently about
assistance on portions of I-5 (south bound) and Highway
217 which run through Tigard. Assistance is requested
for "first response" by the Tigard Police Department
while the OSP cuts back their hours to two ten-hour
shifts each day. Tigard P.D. coverage would be from 2 to
6 a.m. In return OSP would be available to Tigard for
assistance at other times. The proposal is still being
developed; although, the OSP appears to want to implement
such an agreement sometime this month.
Chief Goodpaster noted this is probably the beginning of
a series of cutbacks for OSP because of the State's
financial situation.
Emergency Preparedness: Chief Goodpaster noted that an
emergency preparedness plan was adopted in 1983. It has
never been necessary to implement the plan. Emergencies
which Tigard may face include possible problems resulting
from failure of Scoggins Dam (flooding of several homes),
a mishap at a chlorine plant, or earthquake (to give an
idea of the magnitude of what Tigard may have to deal
with).
The plan is being updated. The needs of the community in
an emergency would be met with varying degrees of success
depending on the type of disaster. For example, is the
emergency self-contained (that is, only the Tigard area
is involved) or is the disaster is regional. A regional
disaster would mean comretition for the same equipment
and resources at the same time.
The Tualatin Valley Fire and Rescue District is the
primary planner for disaster plan-implementation. The
Police Department would assist with roles to be played by
the Public Works Department, Council, and City
Administration.

Mr. Goodpaster advised that the County applied for a
grant a couple of years ago for earthquake planning. An
intergovernmental agreement to participate in such
planning will be forwarded to City Council for approval.
Discussion followed on emergency preparedness and the
need for continued communication and work with other
agencies in the area.
b. Agenda Review
Council briefly reviewed the business meeting agenda.
Chief Goodpaster answered several questions about the
three police-related ordinances which were proposed for
council consideration. Most questions centered on the
police reserve officers, ordinance.
Mr. Goodpaster described the contributions by the reserve
officers. This ordinance would be implemented only if
the reserve officers were called to duty under an
emergency or if the City chose to subcontract to others
for security services. The Chief explained that he
would have control over the circumstances which would
necessitate the use of the provisions in the ordinance.
BUSINESS MEETING
2. PRESENTATION:
• Public Service Announcement Video - Libraries (Featuring

Jody Westerman of the Tigard Public Library (TPL)
introduced a public service announcement video featuring
Portland Trailblazer Terry Porter. This feature was
filmed in the TPL and will be shown nationwide over the
next several months.

to consider -Item 4.4 separately and to remove it from the

Associate Planner Duane Roberts explained that the Needs
Inventory was a compilation of potential projects identified
by staff and Council.
Motion by Councilor Johnson, seconded by Councilor Fessler, to
approve Consent Agenda Item 4.4 as submitted.
The motion was approved by a unanimous vote of Council
present.
Councilor Fessler noted that if more needs are identified
within the next day or so, Council should contact staff.

a. Public hearing was opened by Mayor Edwards.
b. Declarations or challenges:
Councilor Fessler advised that she had been contacted by
Mr. Lasselle who advised her about some of his concerns
with the process for the annexation.
c. Community Development Director Murphy reviewed the staff
report. He noted there was a correction to the legal
description which should be incorporated into the
approving documents. He advised that staff recommended
approval of the annexation.
d. Councilor Kasten noted, in reviewing the map of the area,
that a small portion of Bull Mountain Road, not
contiguous to the proposed annexation area, was not
included. He questioned why this road section was not
annexed at this time.
Councilor Fessler also questioned why the portion of Bull
Mountain Road was proposed for annexation which would
create an island of the Lasselle property.
These items were discussed. Community Development
Director Murphy responded that 'the reason the island was
created was due to staff's understanding of council's
direction to be proactive in their annexation of this
area. With regard to Councilor Kasten's question above,
staff did not consider any non-contiguous roadway for
this annexation proposal, although it would be possible
to do so .
e. Public testimony:
Lynette Garrett, 12040 S.W. Bull Mountain Road, Tigard,
OR 97224, noted that she was one of the property owners
of the subject annexation area. She said they wanted to
annex because of their desire for a sewer connection and
for future development of the property. Ms. Garrett said
she favored the annexation of the road as proposed as
well as the Lasselle's property in the future.
f. Council discussion followed. Councilor Fessler said she
agreed that both sides of the road should be annexed, but
noted she had concerns with the road being extended to

create the island. There was reference to a Council
workshop held earlier in the year (May) wherein Council
had decided to be more proactive in annexations.
There were questions concerning the portion of Bull
Mountain Road that Councilor Kasten identified. City
Attorney advised that if this particular piece of
property was placed with this annexation then additional
public notice and a new hearing would be necessary.
Councilor Johnson advised that she thought staff's
recommendation with regard to the annexation of that
portion of Bull Mountain Road which makes the Lasselle
property an island was what Council wanted staff to do
from their previous workshop discussions.
City Council requested staff to bring back, for future
consideration, annexation proposals for portions of Bull
Mountain Road which are contiguous to the City.
g. Public hearing was closed.
h. Staff recommended the proposed ordinance and resolution
be approved.
i. RESOLUTION NO. 92-53 - A RESOLUTION INITIATING ANNEXATION
TO THE CITY OF TIGARD OF THE TERRITORY AS OUTLINED IN
EXHIBIT "A" AND DESCRIBED IN EXHIBIT "B" ATTACHED. (ZCA
92-06) (GARRETT)
j. Motion by Councilor Schwartz, seconded by Councilor
Kasten, to approved Resolution No. 92-53.
The motion passed by unanimous vote of Council present.
k. ORDINANCE NO. 92-30 - AN ORDINANCE ADOPTING FINDINGS AND
CONCLUSIONS TO APPROVE A ZONE CHANGE (ZCA 92-06)
(GARRETT) AND DECLARING AN EFFECTIVE DATE.
1. Motion by Councilor Schwartz, seconded by Councilor
Kasten, to approve Ordinance No. 92-30.
The motion was approved by a unanimous vote of Council
present.
7. POLICE-RELATED ORDINANCES FOR COUNCIL CONSIDERATION (Police

7.1 Ordinance Regulating Parking of Large Vehicles (TMC

Council workshop scheduled for November 17, 1992.
7.2. Ordinance Regulating Removal of Abandoned Vehicles (TMC
7.60.030)
a. Police Chief Goodpaster summarized the staff report
noting that the proposed ordinance amendment will
give the City a definition of what a stored vehicle
is and will require movement of an abandoned
vehicle of at least 500 feet.
b. (City Recorder Note: A motion to approve Ordinance
92-31 was made by Councilor Johnson, seconded by
Councilor Fessler, and passed by a unanimous vote
of Council present. At a point later in the
meeting, it was noted that the Police Chief desired
to have this ordinance be declared an emergency in
order to address several problem areas in the City.
There was a motion by Councilor Kasten, seconded by
Councilor Johnson, to reconsider Item 7.2 which
contained Ordinance No. 92-31. The motion was
approved by a unanimous vote of Council present.
The following sequence of action reflects the
Council's amendment to the ordinance to include an
emergency clause.)
C. ORDINANCE NO. 92-31 - AN ORDINANCE TO AMEND SECTION
7.60.030 OF THE TIGARD MUNICIPAL CODE PERTAINING TO,
THE PROCEDURE FOR REMOVAL OF AN ABANDONED VEHICLE
AND DECLARING AN EMERGENCY.
d. Motion by Councilor Kasten, seconded by Councilor
Fessler, to approve the amended ordinance which
also contains the emergency clause wording.
The motion was approved by a unanimous vote of
Council present.
7.3 Ordinance Concerning Police Reserve Officers
a. Chief of Police Goodpaster reviewed the staff
report concerning the ordinance amendment
pertaining to the police reserve officers. He
advised that the reserve officers' duties are
regulated closely by the City Police Department.
b. In response to a question by Mayor Edwards
concerning the fiscal impact, Mr. Goodpaster
advised that the fiscal impact would be minimal
since the implementation of the payment to reserve

officers and worker's compensation insurance would
be done only in circumstances under the control of
the City. Any subcontracted work done by the
reserve officers would be sanctioned and
coordinated by and through the City.
Discussion followed on the reserve officers and the
services they provide the Police Department. Mr.
Goodpaster responded to a question from Councilor
Johnson and noted that the Tigard Police Officers
Association (police union) supports the reserve
officer program. He also noted that a large number
of officers, including himself, began their career
as a reserve officer. Often times, the reserve
officers are used as a hiring pool and a
cooperative relationship exists.
C. ORDINANCE NO. 92-32 - AN ORDINANCE AMENDING TIGARD
MUNICIPAL CODE CHAPTER 2.28 BY AMENDING SECTIONS OF
2.28.030 RELATING TO THE EQUIPMENT AND UNIFORM
REQUIREMENTS FOR POLICE RESERVES; AND 2.28.100
RELATING TO COMPENSATION FOR POLICE RESERVE
OFFICERS.
d. Motion by Councilor Kasten, seconded by Councilor
Fessler, to approve Ordinance No. 92-32.
The motion passed a unanimous vote of Council
present.
8. NON-AGENDA ITEMS: None
(council recessed and reconvened in the Town Hall Conference Room
at 8:40 p.m. Prior to exiting the Town Hall, Mayor Edwards
announced that Annexation/Growth Management would be discussed in
a workshop setting in the Town Hall Conference Room. The Mayor
also advised that the Council would hold an Executive Session as
outlined below.)
9. ADMINISTRATIVE REVIEW/UPDATE
Annexation/Growth Management Discussion (Community
Development Director Ed Murphy)
City Administrator Reilly advised that this discussion was a
follow-up to the September 22, 1992 Council meeting. During
the September meeting, council decided that the Walnut Island
would not be forced to annex to the City. Instead, it was
proposed that a double majority annexation be attempted.
j ("Double majority" means a majority of registered voters, plus
a majority of landowners must approve annexation.) The other
alternative would be to continue the current practice of
annexing in a piecemeal manner when individuals approach the

City to request annexation.
The Community Development Director reviewed the double
majority process. The City must declare their intent and then
the formal process would begin. Once the declaration of
intent is made, information would be disseminated throughout
the area. A door-to-door petition-signing campaign would be
conducted. It would be expected that this part of the process
would be implemented next fall. A public hearing would be
scheduled, probably, in 1994 to forward the issue to the
voters.
Councilor Kasten advised it would probably not be wise to
continue annexation by piecemeal while this double-majority
effort is occuring. He suggested a non-remonstrance type of
agreement could be entered into with those persons who needed
to hook up to sewer.
In response to a question from Councilor-elect Paul Hunt,
Community Development Director Murphy advised that there have
been no contacts by staff with the people in the area to
determine if there are great concerns or how they stand on the
annexation issue. Mayor Edwards advised that years ago, there
was a great deal of opposition to annexation.
Council Fessler suggested that once the declaration of intent
is made by the City that a survey be conducted to determine
the concerns of the people living in this area.
Councilor Schwartz noted that people were not coming in large
numbers to the City and requesting to be annexed. He said an
education program would be very important.
Staff advised that a proposed work program would be submitted
to Council in January with regard to the Walnut Island
annexation process utilizing the double majority method.
Councilor Johnson noted that the declaration of intent appears
to be an aggressive City stance but is required by state law
for a double majority annexation effort.
Mayor Edwards noted that in order for an annexation campaign
to be successful, the Council must be proactive and they must
be unified. Councilor Schwartz added that information must be
given to the community in a consistent fashion. He suggested
that a fact sheet be prepared for reference by those who will
give out information.
City Administrator Reilly advised that the double majority
process would be explained and the staff would return to the
Council with a package outlining procedures in January 1993.

Councilor-elect Hunt advised he did not think Council was
necessarily bound by a letter written by a previous Mayor or
Council. He said that he did not think one council could
limit the actions of a future Council. Councilor Schwartz
agreed with Mr. Hunt; however, in reviewing past annexations
which occurred where people were not willing to be annexed,
the situation was not good and it took years for the City to
recover from the negative results.
Councilor Johnson noted the importance of maintaining the
integrity of the City's word.
Discussion then turned to the area south of Bull Mountain Road
which was identified as an area which the City would like to
see annexed in the near future. It was noted that if Tigard's
active area of interest was extended, then these properties,
as they develop, would have to annex because of the need to
hook up to the sewer. It was noted that the City should be
talking to owners of "raw" land.
Community Development Director Murphy noted that if this area
was in Tigard's active area of interest the City could provide
planning, charge development fees to support the area, and
identify available open space.
Staff will pursue the extension of the active planning area
and meet with County staff.
10. EXECUTIVE SESSION: The Tigard City Council went into
Executive session at 9:20 p.m. under the provisions of ORS
192.660 (1) (d), (e), & (h) to discuss labor relations, real
property transactions, current and pending litigation issues.

AN ORDINANCE ADOPTING FINDINGS AND CONCLUSIONS TO APPROVE A ZONE CHANGE (ZCA 92-
06) (GARRETT) AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City has received a request for annexation signed by Nicholas and
Lynette Garrett, who are the owners of the subject parcel; and
WHEREAS, The City Council held a public hearing on November 10, 1992 to consider
the annexation request and to consider zoning designations for the properties;
and

WHEREAS, on September-, 1992 the City Council approved a resolution forwarding
the annexation to the Portland Metropolitan Area Local Government Boundary
Commission; and
WHEREAS, the zoning district designation as set forth in section 1 below is
consistent with the City of Tigard's Comprehensive Plan Map.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The recommendation of the planning staff as set forth below is
consistent with policy 10.1.2 and 10.1.3 of the City's
Comprehensive Plan (See attached Zone Change Exhibit).

AN ORDINANCE TO AMEND SECTION 7.60.030 OF THE TIGARD MUNICIPAL CODE
PERTAINING TO THE PROCEDURE FOR REMOVAL OF AN ABANDONED VEHICLE AND
DECLARING AN EMERGENCY.
WHEREAS, a police department request that an abandoned vehicle be
removed often results in the vehicle being moved a few feet, requiring
further police action; and
WHEREAS, the City Council finds it necessary to amend the Code to aid in
the removal of abandoned vehicles; now, therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Section 7.60.010(1) (c), (d), and (e) are amended to read
as follows:
(c) The vehicle appears to be wrecked, partially
dismantled or junked, or
(d) The vehicle appears to have been stored. For the
purpose of this section, "stored" is defined in
10.28.022(3) of this code, or
(e) The vehicle has remained in the same position, or
within the 500 foot radius of its earlier position, for
a period of 30 days.
SECTION 2: Section 7.60.030 is amended to read as follows:
Section 7.60.030 Removal--Procedure. An abandoned
vehicle which remains in the same position, or remains
within a 500 foot radius of its earlier position for a
period of five days (holidays, Saturdays, and Sundays not
included), after an owner has been requested to remove it
or after notice has been served as required by Section
7.60.020, shall be removed by the police department using
their own personnel, equipment or facilities or those of
others.
SECTION 3: Inasmuch as it is necessary that this ordinance be
adopted with the least possible delay in order to ensure
that reasonable safeguards for health, safety, and
welfare of the public are maintained, pursuant to the
removal of abandoned vehicles, an emergency is hereby
declared to exist, and this ordinance shall become
effective immediately upon passage and approval by the
council.

AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE CHAPTER 2.28 BY
AMENDING SECTIONS 2.28.030 RELATING TO THE EQUIPMENT AND UNIFORM
REQUIREMENTS FOR POLICE RESERVE; AND 2.28.100 RELATING TO
COMPENSATION FOR POLICE RESERVE OFFICERS
WHEREAS, the City Council wishes to provide and maintain uniforms
for the Police Reserve; and
WHEREAS, the City Council wishes to guarantee police officer base
rate of pay to reserve officers called to duty under an emergency;
and
WHEREAS, reserve officers are often called upon to perform duties
falling outside their regular duties, such as providing security
for athletic events and directing traffic for large gatherings; and
WHEREAS, The City Council wishes to allow the Police Department to
contract out the police reserve officers for such outside jobs at
the base police officer rate; and
WHEREAS, ORS 656.031 allows the City to elect to have municipal
volunteer personnel considered as subject workers for purposes of j
Workers' Compensation.; now, therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Section 2.28.030 of the Tigard Municipal Code is
amended to read as follows:
2.28.030 Equipment and uniform requirements.
The City shall furnish and maintain uniforms for
reserve officers. All reserves will be required to
purchase their own protection vest, weapon, duty
belt and equipment. The protection vest will be
replaced when needed, as determined by the chief of
police, at city expense.
SECTION 2: Section 2.28.100 of the Tigard Municipal Code is
amended to read as follows:
2.28.100 Compensation Provisions and Contract
Services.
A. Members of the police reserve shall receive no
compensation for their membership therein or while
on duty unless the chief of police declares an

emergency and then they would be paid based on
police officer rate. 1
B. However, Section (A) above shall not prohibit
C the City from contracting with public or private
entities for services provided by reserve police
officers including, but not limited to, providing
security and directing traffic, and shall charge
base police officer rate for such services. s
C. While on duty as a reserve officer, each
individual will be covered by the city workers'
compensation insurance for work related injuries
and under the city's liability policy as long as
they are acting within the scope and responsibility
of their position, unless prohibited by a separate
agreement.
SECTION 3: This ordinance shall be effective 30 days after its z
passage by the Council, approval by the Mayor, and
posting by the City Recorder.

STAFF RECOMMENDATION
Approval of the attached resolution.
INFORMATION SUMMARY
The State is preparing to make improvements on Scholls Ferry Road between the
railroad crossing and Highway 217. The improvements will include widening to
provide additional turn lanes, regrading the railroad crossing, improving and
interconnecting the traffic signals, and addition of pedestrian and bicycle
paths. All construction costs will be paid by the State.
The proposed agreement allows the State and its contractors to make 1
associated improvements within the right of way of Cascade Avenue. In
addition, the agreement provides that Beaverton and Tigard will pay all costs
of power to the signal at Cascade Avenue. It is standard practice for cities
to pay for the power to traffic signals on State highways at the
intersections with city streets.

COOPERATIVE IMPROVEMENT AGREEMENT
PRELIMINARY ENGINEERING AND CONSTRUCTION FINANCE
THIS AGREEMENT is made and entered into by and between the STATE
OF OREGON, acting by and through its Department of
Transportation, Highway Division, hereinafter referred to as
"State"; WASHINGTON COUNTY, a political subdivision of the State
of Oregon, acting by and through its Board of Commissioners,
hereinafter referred to as "County"; CITY OF BEAVERTON, a
municipal corporation of the State of Oregon, acting by and
through its City Officials, hereinafter referred to as
"Beaverton"; and CITY OF TIGARD, a municipal corporation of the
State of Oregon, acting by and through its City Officials,
hereinafter referred to as "Tigard".
W I T N E S S E T H '
RECITALS
1. Scholls Highway (State Highway No. 143), is part of the
State highway system under the jurisdiction and control of
the Oregon Transportation Commission, (a portion of which
passes through Tigard, Beaverton and Washington Co.
jurisdiction). Cascade Blvd. is a city street under the
jurisdiction of the City of Beaverton and Cascade Ave. is
a continuance of that same city street under the
jurisdiction of the City of Tigard.
2. By the authority granted in 366.770 and 366.775, State may
enter into cooperative agreements with the counties and cities
for the performance of work on certain types.of improvement
projects with the allocation of costs on terms and conditions
mutually agreeable to the contracting parties.
3. Under such authority, State is planning to construct the
SPRR X'ing - Beaverton/ Tigard Hwy. section of Scholls Highway.
The construction will include widening of Scholls Hwy., Cascade
Ave./Blvd, and the S.B. on and off ramps to Hwy. 217; upgrade
and interconnect the traffic signals at the intersections of
Cascade Blvd./Ave. and Scholls Hwy., and the 217 SB on and off
ramps at Scholls Hwy., hereinafter referred to as "Project".
The location of project is approximately as shown on the sketch
map att&,:.hEu hereto, warked Exhibit A, and by Lliii reference
made a part hereof. Project will be financed 100 percent by
State.

4. By authority granted in ORS 810.210, State is authorized to
determine the character or type of traffic control signals to be
used, and to place or erect them upon State highways at places
where State deems necessary for the safe and expeditious control
of traffic. No traffic control signals shall be erected or
maintained upon any State highway by any authority other than
State, except with its written approval. Traffic signal work on
the project shall conform to the current State standards and
specifications.
5. State and County have previously entered into agreement No.
6975, on April 20, 1979, covering construction, power costs, and
maintenance responsibilities. It has been determined that the
responsibilities for power and maintenance costs as previously
defined shall be superseded by this agreement. All other
provisions that previous agreement shall remain in full force
and effect.
6. State, County and City of Beaverton are currently entering
into agreement No. 10832 which transfers signal maintenance
responsibilities to City of Beaverton.
NOW THEREFORE, the premises being in general as stated in the
foregoing RECITALS, it is agreed by and between the parties
hereto as follows:
STATE OBLIGATIONS
1. State shall identify and obtain or issue the required
permits; perform all design work required to produce final
plans, specifications and estimates; advertise, let and award
the contract; furnish all construction engineering, material
testing, technical inspection and project manager services for
administration of the contract.
2. State shall annually reimburse Beaverton for 100 percent of
maintenance costs of traffic control signals in accordance with
agreement No. 10832 and will provide power at its own expense
for the signal at the intersection of Scholls Hwy. and the on
and off ramps to Hwy. 217.
3. State shall annually reimburse Beaverton for 100 percent of
the costs of maintaining the signals at the intersection of
Scholls Hwy. and Cascade Blvd./Ave. State will provide power
for this signal and will bill City of Beaverton annually for its
share (50 percent), and City of Tigard annually for its share
(50 percent).

percent), of all power necessary for the operation of traffic
signals at the intersection of Scholls Hwy. and Cascade
Blvd./Ave.
4. Beaverton shall provide the necessary right-of-way and
easements on Cascade Blvd. for any roadwork and for installation
and possible or emergency maintenance of the traffic signal
equipment, including advance detector loops.
5. Beaverton shall upon completion of project, continue to
maintain Cascade Blvd. and maintain the pavement surrounding the
vehicle detector loops installed in its city street in such a
manner ac tc -provlde adequate protection for said detector
loops, and shall adequately maintain the pavement markings and
signing installed on its right-of-way in accordance with the
plans and specifications.
6. Beaverton shall authorize execution of this agreement during
a regularly convened session of its City Council.
TIGARD OBLIGATIONS
1. Tigard hereby grants State and Beaverton the right to enter

COUNTY OBLIGATIONS

county right-of-way for the construction of the project.
2. County acknowledges the effect and scope of ORS 105.755 and
agrees that all acts necessary to complete construction of the
project which may alter or change the grade of existing County
roads are being accomplished at the direct request of the
County.
3. County shall provide the necessary county right-of-way and
easements for any roadwork for construction of the project.
4. County shall enter into and execute this agreement during a
duly authorized session of its Board of Commissioners.
GENERAL PROVISIONS
1. State, County, City of Beaverton and City of Tigard agree
and understand that a mutual review of the project plans and
specifications will be conducted prior to advertisement for
construction bid proposals.
2. The contractor, its subcontractors, if any, and all
employers working under this agreement are subject employers
under the Oregon Workers' Compensation Law and shall comply with
ORS 656.017, which requires them to provide workers compensation
coverage for all their subject workers.

IN WITNESS WHEREOF, the parties hereto have set their hands and
affixed their seals as of the day and year hereinafter written.
The SPRR Xing-Beaverton/Tigard Highway section of Scholls
Highway was approved by the Oregon Transportation Commission on
July 21, 1992 as part of the Six Year Transportation Improvement
Program.
The Oregon Transportation Commission, by a duly adopted
delegation order, authorized the State Highway Engineer to sign
this agreement for and on behalf of the Commission. Said
authority is set forth in the Minutes of the Oregon
Transportation Commission.

STAFF RECOMMENDATION
It is recommended that the City Council authorize submittal of the needs
inventory.
INFORMATION SUMMARY
The County is in the process of preparing the 1994-1997 CDBG Plan. The plan
will describe the community development needs of low and moderate income
residents. Project applications, to be submitted in fall 1993, must be based
on the needs identified in the 1994-1997 plan. Based on 1990 census block
group data, only one area within the City is pre-qualified in terms of 51% or
more of the residents having low or moderate incomes (see attached map).
Four potentially eligible capital improvement needs have been identified in
this area. These include construction of an eight foot-wide pedestrian
pathway along Fanno Creek through the area; overlaying of several area
streets; sidewalk, curb, and drainage improvements on Grant Ave; and various
improvements to Woodard Park. Additionally, improvements to two City-owned
facilities that house programs that serve an eligible clientele are
identified. One facility is the Tigard Youth Services, Center, which is
identified as needing renovation and expansion or replacement by a new
facility. The other facility need identified is for exterior improvements to
the Tigard Senior Center, including a gazebo, raised bed planters, and paved
parking near these improvements. Also proposed is the
acquisition/renovation of the Commercial St. fire station for use as a
community service center.
PROPOSED ALTERNATIVES
1. Not submit a needs statement.
2. Add or delete identified needs.
FISCAL NOTES
Authorizing the submittal of the needs assessment does not obligate the City
in any way. Submission of the needs assessments is equivalent to a
notification of an intent to apply for funds. Submission of an application
to address an identified need would require separate Council action.
Acceptance of a grant and appropriation of funds would require separate
Budget Committee action. In order to increase the chances for project
selection, match amounts in the form of in-kind or hard dollars will be
recommended for consideration later, when project proposals are submitted.

Grant Avenue is a walking route to two elementary scholls: C.F. Tigard
and St. Anthony's. At resent, because Grant Avenue lacks sidewalks,

STAFF RECOMMENDATION
Adopt the attached resolution and ordinance to forward the annexation to
the Boundary Commission including the right-of-way of S.W Bull Mountain Road,
and to assign a zoning designation of R-4.5 to the property.
INFORMATION SUMMARY
This annexation request consists of one parcel totaling 2.44 acres that is
contiguous to the City of Tigard on SW Bull Mountain Road. The owner of the
property requested annexation in order to partition the parcel and obtain
sanitary sewer service. The applicant requests annexation of his property via
the "expedited method". (The "expedited method" requires no public hearing by
the Boundary Commission, and will allow annexation approval within 28 days,
instead of the customary 45 days). Notices were given to property owners
.4ithin 250 feet of the subject property. There has been no response from
neighboring property owners.
Staff is recommending that approximately 420 feet of S.W. Bull Mountain
Road be included in the annexation. This is suggested to create a more
consistent boundary, aid in police patrol and enable the future annexation of
island property.
NOTE: The annexation of this property will result in the creation of a
two lot island on Bull Mountain Road, both lots being under the single
ownership of Mr. and Mrs. Lasselle. The Lasselles were contacted by mail, and
subsequently responded verbally they will not object to annexation into the
City of Tigard in the future, but are not interested in initiating annexation
of their properties at this time. Since the owners will be in an island, the
City can initiate annexation of the two lots at any time.
PROPOSED ALTERNATIVES
1. Adopt the attached resolution and ordinance to forward the annexation to
the Boundary Commission including the right-of-way of S.W. Bull Mountain
Road, and assign a zoning designation of R-4.5 to the property.
2. Deny the proposal.
FISCAL NOTES
The City will pay the Boundary Commission fee of $240 for annexation.
The current tax assessment is $243,750 The City could increase its tax base

to the west are single family lots in Washington County. Properties

4. Site Information and Proposal Description
The property to be annexed has one single family residence with the
remainder of the property undeveloped. The property is primarily
covered with some trees.
The applicants requested that their parcel be annexed into the City
of Tigard in order to partition the parcel and connect to sanitary

sewer line. An existing sewer line is located on the southerly
portion of the parcel to be annexed.
5. Agency and NPO Comments
Tigard Water District, Tualatin Valley Fire District, General
Telephone and Electronics, NW Natural Gas, Tigard School District '
23J, Portland General Electric, and Metro Area Communications have
reviewed the proposal and have offered no objections or comments.
6. Police Department Consideration
The Police Department has reviewed the proposal and have offered
the following comments.
The roadway on Bull Mountain Road north of the property
to be annexed should be included with this annexation so
as to promote effective police patrol of the area. The
owners of the two lots to the north should also be
approached for annexation. (Both issues have been
addressed by the planning staff).

The Engineering Department has reviewed the proposal and have
offered the following comments:
The Engineering Department suggests that a 420 foot
street right-of-way of S.W. Bull Mountain Road be
included with this annexation.
B. FINDINGS AND CONCLUSIONS
The relevant criteria in this case are Tigard Comprehensive Plan Policies
2.1.1, Citizen Involvement; 6.4.1, Developing Area; 10.1.1, Service
Delivery Capacity; and 10.1.2, Boundary Criteria and chapters 18.136, j
Annexations; and 18.138, Established/Developing Area Classification of the
Tigard Community Development Code. The planning staff has. determined that
the proposal is consistent with the relevant portions of the Tigard
Comprehensive Plan based upon the findings noted below:
1. Plan Policy 2.1.1 is satisfied because the Neighborhood Planning
Organization and Community Planning Organization as well as
surrounding property owners were given notice of the hearing and an
opportunity to comment on the request.
2. Plan Policy 6.4.1 is satisfied because the area to be annexed is
designated as a developing area on the development standards
map.
3. Plan Policy 10.1.1 is satisfied because the City has conducted the
Washington County Urban Services Study which includes the subject
property. This study indicates that adequate services are available
in the vicinity and may be extended to accommodate the subject
property.
4. Plan Policy 10.1.2 is satisfied because the annexation is a first
step in eliminating an island and an irregular boundary that makes
it difficult for the police in an emergency situation to respond in
a timely manner. Inclusion of the street right-of-way of Bull
Mountain Road will make police patrol more efficient and effective.

The land is located within Tigard's Active Planning Area, and
adequate service capacities can be made available to accommodate the
eventual development of the property as noted above. A two lot
Island will be created north of Bull Mountain Road, and northwest of
the property to be annexed. The City intends to annex both lots
sometime in the future.

The planning staff has determined that the proposal is consistent with the
relevant portions of the Community Development Code based upon the
findings noted below: 3
1. Section 18.136.030 of the Code is met because all facilities and
services can be made available, the applicable Comprehensive Plan
policies discussed above have been satisfied and the property has
been determined to be a developing area in accordance with the
criteria in Chapter 18.138 of the Code. .b

Since the property is within Tigard's Active Planning Area, the zone
designation shall follow the City's comprehensive plan map
designation for low density use. The most appropriate zone is R-4.5
with a minimum lot size of 7,500 square feet.

C. RECOMMENDATION
Based upon the findings noted above, the planning staff recommends

the properties in the island that will be created as a result of this
annexation.

INFORMATION SUMMARY
We currently do not have existing language that allows us to resolve
complaints of large vehicles (motor homes, boats, trailers, etc.) parked on
the street. These types of vehicles cause visibility and traffic flow
hazards. The amendments also give us the ability to deal with complaints we
receive regarding vehicles for sale on public streets and brings our
definitions in line with current state law.
This amendment will also eliminate several paragraphs in the ordinance
dealing with motor bus layovers that no longer apply because of the new
transit mall.
We will issue warnings and try to get as much publicity as we can regarding
this ordinance during the 30-day waiting period before it becomes effective
if passed by the Council.

AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE BY UPDATING DEFINITIONS;
REPEALING SECTION 10.28.020; SPECIFYING PROHIBITED PARKING; AND
REGULATING THE PARKING OF LARGE VEHICLES ON PUBLIC STREETS
WHEREAS, the Oregon Vehicle Code has been renumbered, and certain terms
re-defined; and
WHEREAS, the City Council finds offensive advertising or sales of
merchandise from vehicles parked on public streets; and
WHEREAS, the City Council finds that maintenance or storage of vehicles
on public streets is offensive and can create a traffic hazard; and
WHEREAS, the City Council finds that the parking of trailers, campers,
motor homes and other similar vehicles on public streets or public
property can create a traffic hazard and obstruction; and
WHEREAS, the Tigard Municipal Code must reflect all of the above
changes; now, therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Section 10.28.010 of the Tigard Municipal Code is amended
to read as follows:
10.28.010 Definitions.
(a) "Parking" or "parked" for purposes of the city motor
vehicle code, means the stopping or standing of any
vehicle upon any street or highway within the city,
except for the purpose of and while actually engaged in
loading or unloading passengers or freight, or in
obedience to traffic regulations or traffic signs or
signals.
(b) It is unlawful for any person to park or stop any
vehicle for a longer period of time than that designated
by official signs, parking meters, or other markings
placed by or under authority of the city. "Parking time
limit" includes the aggregate of time of all stopping or
standing of the same vehicle on the same side of the
street within a space of three hundred lineal feet
measured along the curb-line and between intersections;
and the parking, standing or stopping of any vehicle
within such expanse shall not exceed the designated time
limit during any three-hour period.
(c) For purposes of this chapter, the definitions of the
following terms as used herein shall conform to the
following ORS sections which by reference herein are made
a part of this chapter:

(1) "Camper" is defined as set forth in ORS Section
801.180.
(2) "Highway" or "street" is defined as set forth in ORS
Section 801.305.
(3) "Mobile home" is defined as set forth in ORS

forth in ORS 801.200.
(5) "Motor home" is defined as set forth in ORS Section
801.350.
(6) "Motor truck" is defined as set forth in ORS Section
801.355.
(7) "Recreational Vehicle" is defined as set forth in
ORS 446.003.
(8) "Trailer" is defined as set forth in ORS Section
801.560.
(9) "Travel Trailer" is defined as set forth in ORS
801.565.
(10) "Truck Tractor" is defined as set forth in ORS
Section 801.575.
SECTION 2: Section 10.28.020 of the Tigard Municipal Code,
specifying purposes for which parking is prohibited, is
hereby repealed.
SECTION 3: Chapter 10.28 is amended by adding Section 10.28.22 to
read as follows:
"Section 10.28.022 Purposes for which parking is
prohibited.
No person shall park a vehicle on the right-of-way of any
highway, or upon any public street or public way within
the city limits for any of the following purposes:
(1) Advertising, selling or offering merchandise for
sale;
(2) Washing, greasing or repairing such vehicle except
as may be necessitated by emergency;
(3) Storage, for any period of more than twenty-four
hours, except that this subsection shall be subject to
the limits elsewhere prescribed in the city motor vehicle
code or as may be prescribed by the Oregon State Motor
Vehicle Code. It shall constitute prima facie evidence
of storage of a vehicle if the same is not moved for a
period of twenty-four (24) hours. The continuity of the
time shall not be deemed broken by movement of the
vehicle elsewhere on the block unless the movement
removes the vehicle from the block where it was located
before it is returned. Any vehicle mentioned in this
subsection parked on the right-of-way of any highway, or
upon any public street or public way within the city in
violation of this subsection may be treated as an
abandoned vehicle and the provisions of Chapter 7.60
shall apply."

SECTION 4: Section 10.28.030 is amended to read as follows:
Section 10.28.030 Truck, trailer, bus, camper, motor
home recreational vehicle and boat restrictions
No person shall at any time park or leave standing a
house trailer, motor bus, motor truck, tractor trailer,
truck tractor, motor home, boat, vehicle with camper,
recreational vehicle, or trailer, as defined in section
10.28.010 (c), whether attended or unattended, on any
improved public highway, public street or other public
way within the city limits, for a period greater than
thirty (30) minutes, between the hours of one minute past
twelve a.m. and six a.m.
Tractor Trailer, Truck Trailer. No person shall at
any time park a tractor trailer or truck trailer as
described in Section 10.28.010(c) unattended on any
improved public highway, public street or other
public way within the city limits.
SECTION 5: This ordinance shall be effective 30 days after its
passage by the Council, approval by the Mayor, and posted
by the City Recorder.

procedure for removal of an abandoned vehicle.
STAFF RECOMMENDATION
Staff recommends approval.
INFORMATION SUMMARY
Frequently people will move their vehicles a short distance after it has been
tagged as abandoned and that then requires us to start our process over
again. This amendment will give us a definition of what a stored vehicle is
and will require movement of an abandoned vehicle 500 feet.

1. Do not accept amendment
2. Approve as proposed
FISCAL NOTES
This will save us considerable time. Processing an abandoned vehicle
requires several formal processes and time frames; and with this amendment,
we will be able to identify and remove abandoned vehicles quicker.

AN ORDINANCE TO AMEND SECTION 7.60.030 OF THE TIGARD MUNICIPAL CODE
PERTAINING TO THE PROCEDURE FOR REMOVAL OF AN ABANDONE

WHEREAS, a police department request that an abandoned vehicle be 3
removed often results in the vehicle being moved a few feet,
requiring further police action; and
WHEREAS, the City Council finds it necessary to amend the Code to
aid in the removal of abandoned vehicles; now, therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Section 7.60.010(1) (c), (d), and (e) are amended
to read as follows:
(c) The vehicle appears to be wrecked, partially
dismantled or junked, or
(d) The vehicle appears to have been stored. For
the purpose of this section, "stored" is defined in
10.28.022(3) of this code, or
(e) The vehicle has remained in the same position,
or within the 500 foot radius of its earlier
position, for a period of 30 days.
SECTION 2: Section 7.60.030 is amended to read as follows:
7.60.030 Removal--Procedure. An abandoned vehicle
which remains in the same position, or remains
within a 500 foot radius of its earlier position
for a period of five days (holidays, Saturdays, and
Sundays not included), after an owner has been
requested to remove it or after notice has been
served as required by Section 7.60.02.0, shall be
removed by the police department using their own
personnel, equipment or facilities or those of
others.
SECTION 3: This ordinance shall be effective 30 days after its
passage by the Council, approval by the Mayor, and
posting by the City Recorder.

Reserves.

Staff recommends amendment be approved.
INFORMATION SUMMARY
The amendment requires the City to furnish uniforms, which has been a common
practice for several years, allows compensation to be paid to reserve
C officers if called out by the Chief of Police for an emergency, and requires
the City to provide worker's compensation insurance for work related injuries
and have them covered under the City's liability policy, as long as they are
acting within the scope and responsibility of their position. ;
The amendment also allows the reserves to contract their services to public
or private entities for base police officer pay.

FISCAL NOTES
Fiscal impact would be minimal since old uniforms are given to the reserves.
Any additional money needed would come out of existing budget.
