ADJOURNMENT h:\recorder\cca\cca1217.91 t i COUNCIL AGENDA - DECEMBER 17, 1991 - PAGE 2 e i Council Agenda Item i T I G A R D C I T Y C O U N C I L MEETING MINUTES - DECEMBER 17, 1991 • Mayor Edwards and Councilor Kasten met and held interviews for prosepective Board and Committee appointees. • Meeting was called to order at 6:30 p.m. by Mayor Edwards. 1. ROLL CALL Council Present: Mayor Jerry Edwards; Councilors Valerie Johnson, Joe Kasten, Jack Schwab, and John Schwartz. Staff Present: Patrick Reilly, City Administrator; Loreen Edin, Administrative Services/Risk Manager; Ken Elliott, Legal Counsel; Ed Murphy, Community Development Director; Liz Newton, Community Relations Coordinator/Deputy City Recorder and Randy Wooley, City Engineer. STUDY SESSION • Agenda Review - There was lengthy discussion on whether to hear additional testimony on the Solid Waste Ordinance. Staff reminded Council that the Ordinance also represented a contract between the City and the franchise haulers. Mr. Lee Kell, legal counsel for the franchise haulers, asked for an opportunity to discuss some items contained in the ordinance. The haulers have 30 days, from date of passage, to approve and sign-off on the contract. City Legal Counsel advised that changes to the ordinance, at this point, would mean that the hearing would have to be reopened. Council consensus was to take action on the proposed Solid Waste Ordinance during the business meeting without further testimony.- Request for Change in Hearing Date - Council reviewed written request from Marge Davenport for rescheduling the Triad appeal hearing from February 25, 1992, to another date. Council consensus was to leave the date on the 25th because of notification issues. i i • News coverage - Community Relations Coordinator and Council discussed sparse news coverage on Tigard activity in the Oregonian. Consensus of Council was to ask Tigard Citizens (in an upcoming Cityscape article) to let the Oregonian know, through letters, that they want more coverage of Tigard news. • Tigard Triangle - Community Development Director Ed Murphy and Acting Senior Planner John Acker overviewed the Triangle Project process. It is expected that this project will be ready for public hearing before the Planning Commission in February and before the Council in March. • Council Calendar - The January 21, 1992, meeting was cancelled. The Council will meet with the School Board on January 23 at 6:30 at the School District offices. At 8:00 p.m. on that evening the council will meet in the City Hall Town Hall to discuss water issues. BUSINESS MEETING KEY TO THE CITY - Mayor Edwards presented to Karl White a Key to the City to recognize his attentiveness and interest in local issues. Mr. White has regularly attended the Council meetings over the last six months. 2. VISITOR'S AGENDA a. Mr. Bob Burness explained his current cash flow dilemma preventing him from being able to provide a bond (as required in the Code) on property he wants to develop. Mr. Burness asked if he could offer property in lieu of the bond. City Engineer explained the code requirements. After discussion, council asked staff to visit with the County to see whether their deadline could be extended to ease Mr. Burness' situation. 3. Motion by Councilor Johnson, seconded by Councilor Kasten, to approve Ordinance No. 91-36 with special acknowledgement of their hard work to the Solid Waste Advisor;. Committee and their staff liaison, Loreen Edin. The motion passed by a unanimous vote of Council present. d. WHEREAS, the Solid Waste Management Ordinance has not been substantially amended since 19783 and WHEREAS, there have been major changes in the solid waste industry as well as in Oregon law and Metro regulations; and WHEREAS, the Tigard City Council requested the Solid Waste Advisory Committee (formerly Utility & Franchise Committee) and staff to review and recommend necessary language modifications in response to the above noted changes; and WHEREAS, the franchised haulers served as ex-officio members of the Solid Waste Advisory Committee and were fully involved, while represented by their legal counsel, throughout a cooperative and deliberative amendment process; and WHEREAS, the Tigard City Council began public hearings on June 25, 1991 to allow public testimony on the proposed amendments. THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Tigard Municipal Code chapter 11.04, Solid Waste Management, is hereby amended as set forth in the attached EXHIBIT "A", which by this reference is made a part hereof. SECTION 2: Integration. The provisions of this ordinance were developed and considered as an integrated document. The council's determination to enact this ordinance is predicated upon this concept and therefore the provisions of this ordinance are not severable. If any provision of the ordinance is determined to be invalid, the effect of the other provisions shall be suspended and of no effect until the Council has considered and taken action upon an amendment or amendments it deems necessary and advisable in-response to the determination of invalidity. SECTION 3: Acceptance: Miller's Sanitary Service, Pride Disposal, and Schmidt's Sanitary Service shall file with the City Recorder a written acceptance of the franchise no later than January 16, 1992, as granted by this ordinance. Such fees shall be computed on a quarterly basis and paid within thirty days following the end of each quarter calendar year period. Each franchisee shall maintain an adequate bookkeeping system showing the gross cash receipts resulting from the solid waste services conducted under the franchise. The purpose of this subsection is to prevent the added cost from being assessed against otW6r ratepayers if the customer later withdraws from service. 11.04.080 Franchise--Transfer. suspension. modification or revocation--Conditions. The franchisees shall not transfer this franchise or any portion thereof to other persons without sixty days prior written notice of intent and the subsequent written approval of city council, which consent shall not be unreasonably withheld. The city council shall approve the transfer if the transferee meets all applicable requirements met by the original franchisees. A pledge of this franchise as financial security shall be considered as a transfer for the purposes of this subsection.. The city council may attach whatever conditions it deems appropriate to guarantee maintenance of service and compliance with this chapter. After written notice from the city council that such grounds exist, franchisee shall have thirty days from the date of mailing of the notice in which to comply or to request a public hearing before the city council. +a4glIf franchisee fails to comply within the specific time or fails to comply with the order of the city council entered upon the basis of written findings at the public hearing, the city council may suspend, modify or revoke the franchise or make such action contingent upon continued noncompliance. rY {3}st At a public hearing, franchisee and other interested persons shall have an opportunity to present oral, written or documentary evidence to the city council. The city administrator shall report to the council by April 1st on the franchisee reports and propose rate adjustments if any. Nonscheduled services shall be charged at the reasonable cost of providing the service taking into consideration the factors in subsection B1FzasAG of this section and as determined by franchisee. {3~x< In establishing rates, the council may set uniform rates, uniform rates by zone and different rates for collectors where there is a service and cost justification. No person shall have waste on property that is offensive or hazardous to the health or safety of others or which creates offensive odors or a condition of unsightliness.' am. 11.04.120 Unauthorized deposits prohibited. No person shall, without authorization and compliance with the disposal site requirements of this chapter, deposit waste on public property or the private property of another. Streets and other public places are not authorized as places to deposit waste except as specific provisions for containers have been made. 11.04.130 Interruption of franchisee's service. The franchisee agrees, as a condition of a franchise, that whenever the city council finds that the failure of service or threatened failure of service would result in creation of an immediate and serious health hazard or serious public nuisance, the city council may, after a minimum of twenty-four hours' actual notice to the franchisee and a public hearing if the franchisee requests it, provide or authorize another person to temporarily provide the service or to use and operate the land, facilities and equipment of a franchisee to provide emergency service. te €t.erkb:.le:.=.>::f .:}}::>,<ti:<> ancha ae..:::. Revised 11/25/91 Page 17 J ,11.04.140 Termination of service by franchisee. A`. The franchisee shall not terminate service to all or a portion of h}•s customers unless: 1. The street or road access is blocked and there is no alternate route and provided that the franchisee shall restore service not later than twenty- four hours after street or road access is opened; 2. As determined by the franchisee, excessive weather conditions render providing service unduly hazardous to persons providing service or to the public or such termination is caused by accidents or casualties caused by an act of God, a public enemy, or a vandal, or road access is blocked; 3. A customer has not paid for provided service after a regular billing and after a seven-day written notice from the date of mailing, which notice shall aet be sent Xt< less than fifteen days after the first regular billing; or 4. Ninety days written notice is given to the city council and to affected customers and written approval is obtained from the city council; 5. The customer does not comply with the service standards of Section 11.04.100 of -the t chapter. 11.04.150 Subcontracts. y The franchisees may subcontract with others to provide a portion of the service where the franchisees do not have the necessary equipment or service capability. After an analysis of several space alternatives, it has been determined that the acquired building should be used to house City staff. In order to occupy this facility, certain improvements to the building and to the site must be made. It was also determined that the modular unit should be purchased to avoid further lease payments, and that the walkway between City Hall and the modular unit should be covered. INFORMATION SUMMARY Council adopted the Intergovernmental Agreement outlining the procedures to be followed during the conduct of the Western Bypass Study. There are three key phases (from most general to specific): strategies; alternatives; draft environmental study. Current procedures specify that the City endorse any strategy that would be carried forward as an alternative for further study but do not require the City's endorsement to carry forward an alternative into the environmental impact analysis phase. Staff believes it is important for the City to endorse any alternative carried forward into the environmental impact analysis phase and thus argued for the proposed procedural modification. Staff also believes there is insufficient information about` strategies to endorse their continuation into the alternatives phase and that the analyses during the alternative study phase will produce important and useful information/data. The study's Steering Committee discussed this proposal at length and voted unanimously in its, support. PROPOSED ALTERNATIVES 1. Reject the proposed modification, continuing the current process. C H:\login\pat\bypass PROPOSED FINDINGS IN SUPPORT OF AMENDMENTS TO WESTERN BYPASS STUDY PLANNING COORDINATION AGREEMENT The Oregon Department of Transportation is proposing amendments to the Western Bypass Study Planning Coordination Agreement (Agreement). ODOT's proposals would amend Sections III and IV and Exhibit "C" of the Agreement and add a new Section IIIA. The thrust of the proposed amendments is to split the current process governing the recommendation of strategies for elimination or for further study into two separate steps. Presently, JPACT and Metro consider both the elimination of strategies and the recommendation of strategies for further study following completion of the strategies stage of the Study. Under the proposed amendments, JPACT and Metro would consider only the elimination of strategies at the completion of the strategies stage. JPACT and Metro review of strategies recommended for further study by ODOT's staff would be postponed until after ODOT's staff has developed, refined and recommended alternatives for evaluation in the Draft Environmental Impact Statement (DEIS). Following action by JPACT and Metro on the alternatives recommended for evaluation -in the DEIS, each City and County would consider adopting a resolution either endorsing or rejecting the alternatives recommended by JPACT and Metro for DEIS evaluation. This amendment is justified for several reasons. First, there is sufficient information available at the completion of the f strategies stage of this Study to eliminate certain strategies from further review. It is reasonable not to consider these strategies further, or to spend additional funds studying these strategies, when adequate information already is available to demonstrate that those strategies cannot reasonably meet the purposes and needs identified in the Purpose and Need Statement. Accordingly, the provisions regarding action by JPACT and Metro to eliminate these strategies from further study following completion of strategies are unchanged. Second, several local government and citizen representatives on the Technical Advisory Committee, Citizens Advisory Committee and the Steering Committee have stated that the level of detail provided in the strategies stage is not sufficient to enable them to determine whether the strategies recommended for further study are reasonable. These representatives have requested more detailed information on these strategies to obtain a better understanding of what each strategy would look like and how the strategies would achieve the identified purposes and needs. Because the Study process already provides for development and refinement of alternatives before commencing with evaluation in the Draft Environmental Impact Statement, it is reasonable to postpone, until completion of the alternatives stage, (1) consideration by JPACT and Metro of alternatives recommended by ODOT's staff for evaluation in the DEIS; and (2) endorsement or rejection of those alternatives by the Cities and County. Through this postponement, JPACT, Metro, and the Cities and County will be better able to assess the reasonableness of the alternatives proposed for DEIS evaluation. In summary, with these amendments, JPACT, Metro, and the Cities and County would not be asked to endorse or reject strategies proposed for further study by ODOT's staff, but instead would be asked to endorse or reject more detailed and refined alternatives proposed for evaluation in the DEIS. JPACT, Metro, the Cities and Counties would review and endorse or reject the alternatives before work commences on the DEIS. Their review would be aided by the more detailed information gathered by ODOT's staff during the alternatives stage of the Study. With this more detailed information, JPACT, Metro, each City and the County will be better able to judge whether the alternatives recommended for evaluation in the DEIS are reasonable. • ti .r ODOT'S PROPOSED AMENDMENTS TO WESTERN BYPASS STUDY PLANNING COORDINATION AGREEMENT Note: Additions are underlined; deletions are [bracketed]. i I. Each City and the County hereby agree to provide staff assistance to Metro in the development of findings demonstrating compliance with applicable statewide planning goals to support an RTP amendment eliminating strategies considered unreasonable to meet the purposes and needs set forth in the Statement. Upon completion of the activities described in subsection B above, Metro shall transmit correspondence to each City and the County identifying the strategies [approved for further study and those] recommended to be eliminated from further study. This would require the City to receive the registration applications, collect a $300.00 fee, and distribute the permit as well as review plans, respond to complaints, and submit periodic reports to the DEQ. INFORMATION SUMMARY At its November 26, 1991 meeting, the City Council held a public hearing to hear an appeal by NPO 3 of the Planning Commission's decision to approve the Mt. Highland subdivision/planned development. The NPO's concern was that options listed under Note 2 on the City's Transportation Plan Map were not being maintained. The NPO was concerned that the approval of the subdivision precluded an indirect connection of minor collectors. The City Council found that, in the absence of an approved, specific road alignment, the Planning Commission can approve a subdivision within a study area tht precludes a transportation option that they do not believe is viable. Further, the City Council agreed with the Planning commission's determination that because of topographical reasons, that connection of a minor collector through this subdivision was not viable but that other options were available _ to meet the needs expressed in the Transportation Plan. DATE: December 5, 1991 SUBJECT: Solid Waste Franchisee Amendment On November 19, 1991 the City council gave staff policy direction for amendments to the Solid Waste Ordinance. The attached Ordinance reflects the changes the Council directed that evening. Council requested staff negotiate with the Joy Theater owner regarding sunset provisions for the use of vehicles over the 10,000 pound, weight limit. The sunset language is included on pages 4 and 5 of the Ordinance. Should Council adopt this language, staff is prepared to contact City businesses to advise them of a filing deadline of January 31, 1992 to determine if there are any other businesses which should be authorized or allowed use of vehicles under this sunset clause. Attached is a letter from Lee Kell, who is the haulers' legal representative. You will note that the haulers have some concern regarding one amendment in the Agreement which is construction contractors hauling garbage or "mixed waste." Since this Ordinance is unique in that it is a contractual agreement between the City Council and the haulers, Attorney Kell has requested an opportunity to meet and negotiate the construction contractor hauling exemption with the City Council. We respectfully request the opportunity to negotiate this issue with you. The Solid Waste Management Ordinance is unique. It is a contract between the garbage haulers and the City Council. It is ultimately the product of negotiation. Most of that negotiation took place with the Solid Waste Advisory Committee and your staff. Your Committee and staff did an excellent job representing the city's position in solid waste management. It was a long process, but valuable for both your franchisees and the City. The City Council has had the opportunity to review it's committee's work, and after hearing and thorough discussion, has given policy direction. With one exception, the solid waste haulers are comfortable with the policy direction and will accept the revised Ordinance. The big issue is "construction contractors" hauling garbage. This is a major issue because the City Council will effectively permit another garbage company to operate inside the City limits. The existing construction waste hauler, heretofore illegal, has been serving individual small contractors building individual ; homes. The Homebuilder's Association of Metropolitan Portland represents these small contractors. As worded, this waste hauler L KELL, ALTERMAN & RUNSTEIN City Council December 4, 1991 Page 2 can now offer his services to all other builders, including developers, apartment house contractors and commercial contractors. That entire level of business has been effectively cut out from the franchise. 'The apparent intent of the City Council was to give the independent home builder a break in his overall cost. The result is to put the construction waste hauler into the garbage business in a big way. In addition, this new garbage hauler would not have to operate under any of the restrictions set forth in the Tigard Solid Waste Ordinance. Even with the exemption in the Ordinance, the construction waste hauler will still operate illegally. If he does not haul source separated waste, he has to take the waste to another location and separate it. This separation procedure is illegal. There is no site authorized by Metro or DEQ for this operation. For the individual home builder, source separation at the site is cost prohibitive. The individual home builder cannot afford the cost of several drop boxes on site during the construction period. The construction waste hauler separates that waste at another location. If the construction project is large, then multiple containers for source separation are feasible. This operation is already undertaken by your franchised hauler. Heretofore, the individual construction waste hauler could not afford the equipment. If the material were source separated at the construction site, this exemption would not be needed. The amount of mixed waste remaining would be minor and the cost of hauling it would also be minor. If the waste were source separated at the construction site, the construction site hauler could haul the lion's share of the waste, legally, under the current Ordinance. The result of the proposed amendment is to put another company into the garbage business in the City of Tigard outside of the current regulatory system. This is unnecessary and unduly hampers the efficiency of Tigard's solid waste management system. Compactors We would like to make one final point on the new compactor provisions of the Ordinance. The only issues concerning your franchised collectors are the safety and legality of the compaction equipment. If a compactor is oversold to a customer or if a customer misuses the equipment, the safety of the collector's employees, equipment and the general public are jeopardized. Customers purchase compactors because many customers are unaware of the additional responsibilities and legal requirements that accompany compactor operation. These include maintenance responsibility, protection of the public from unauthorized operation, accessibility to collection trucks, compatibility with collection trucks, state laws requiring putrescible waste be collected weekly, street and highway weight regulations, and environmental pollution including air, odor and cleanliness. The compactors are owned by the customer. All other collection equipment and containers are owned by the franchisee and subject to this Ordinance. Your franchisees often recommend compactors to their customers and refer customers to equipment dealers when customers request information. In summary, compaction is an appropriate technology in the waste collection system. It also requires additional responsibilities by customers who use them. This is the purpose of the compaction amendments to the Ordinance: to recognize these responsibilities. It appears special interest groups are continuing to come out of the woodwork with their own special concerns. i The committee has worked 18 months to develop and clarify this ordinance. We have conducted hearings whereby the public has had the opportunity to provide input. Various members of City Staff, the Haulers and even the City Council have participated in the development of this ordinance. We offer the following solution to deal with all the exceptions for your consideration: 1. The Council has given the committee Quasi Judicial status similar to Planning to deal with complaints, infractions and inter- pretations of the ordinance. 2. The Ordinance provides for accompanying administrative rules to handle the daily operating procedures, interpretation and exceptions. These rules are developed by the Committee, Staff and Administrator with approval of Council. 3. Allow the committee, through the Quasi Judicial process, to address the exceptions with an amendment process. The committee would hear the request and after research provide recom- mendations to the City Administrator for adoption. The City Administrator would take the amendment to the Council. If the applicant disagreed with the Committee and Administrator, they could appeal to the Council. i Solid Waste Ordinance 12-17-91 i. I HAVE REVIEWED THE ENTIRE ORDINANCE AND AIM CONVINCED THAT WITH A LITTLE MORE EFFORT YOU CAN AVOID ADDITIONAL AND COSTLY OBJECTIONS FROM LOCAL BUSINESSES. SOLID WASTE M'%. AGEMEN'T POLICY MUST BE A COLLABORATIVE EFFORT WITH THE GENERATOR OF THE WASTE. IT IS OBVIOUS FROM THE PROPOSED POLICY THAT THE PROTEEC;TION OF THE FRANCHISED HAULERS CONFLICT WITH THE NEEDS OF THE COMMERCIAL WASTE GENERATORS. THE IN'VE'NT OF THE PROPOSED ORDINANCE REFLECTS A LOT OF GOOD WORE: nICD DESERVES THE BENEFIT THAT WOULD COME WITH A LITTLE MORE CONSIDERATION. I UNDERSTAND THAT THE BUSINESS COMMUNITY WAS POLLED 4ff THROUGH A CHAMBER OF COMMERCE MEMBERSHIP LETTER, PUBLIC ACCESS T.V. = AND LOCAL MEDIA. UNFORTUNATELY, ONLY A VERY SMALL PERCENTAGE OF HIGH VOLUME WASTE GENERATORS BELONG TO THE CHAMBER. THE ONLY PROPE:i~. WAY TO COMMUNICATE WITH THE IMPACTED BUSINESSES IS DIRECTLY. IN THE INTEREST OF KEEPING THIS BRIEF, I WILL REFER ONLY 'TO THE FOLLOWING SPECIFIC POINTS WHICH REQUIRE: -FURTHER CONSIDERATION. 1. THIS ORDINANCE WILL PROHIBIT A PROPERTY MANAGER FROM USING PORTABLE WASTE CARTS TO TRANSPORT ADD COLLECT HIS TENANT WASTE O A SINGLE CONTROLLED AND SANITARY LOCATION. THIS PROVISIO, IS OBJECTIONABLE AND A SOURCE OF CE;R'TAIN CONTROVERSY. a. HIGHER HAULER FEES WILL BE PASSED ONTO TENANTS. IN SHOPPING CENTERS THIS MEANS HIGHER PRICES. IN APARTMENTS, INCREASED PENT. THIS IS CERTAINLY NOT THE TNTENT OF THE ORDINANCE. THIS PROVISION BENEFITS NO ONE EXCEPT THE HAULER. IT IS CLEARLY A SPECIAL INTEREST PROVISION WHICH WILL NOT SURVIVE UNDER SCRUTINY. THE PROGRESSIVE TREND IN THIS AREA IS TO MINIMIZE HAULER INVOLVEMENT WITH MANAGED PROPERTIES. LOUD, ,NOISY. DESTRUCTIVE AND DIRTY TRUCES ARE NOT DESIRABLE. LARGE" GENERATORS OF SOLID WASTES, INCLUDING PROPERTY MANAGERS, HAVE ALREADY INITIATED SOURCE RECOVERY OF RECYCLABLE :MATERIALS INCLUDING CARDBOARD, NEWSPAPER, ?,L•L'M'i VG'M A\A OFFICE PAPER. MOST OF THESE GENERATORS EMPLOY ThE USE OF A BALER FOR THESE PURPOSE'S, AND HAVE SUCCESSFULLY REDUCED THE VOLUME OF WASTE REMAINING FOR THE HAULER TO REMOVE. COMPACTORS SELL FOR $5,000 TO $20,000 EACH. THE RETURN ON THIS INVESTMENT IS REALIZED THROUGH REDUCED HAULER INVOLVEMENT. THE APPROVAL OF COMPACTOR EQUIPMENT IS ENTIRELY IN THE HANDS OF THE HAULER. I MANUFACTURE EQUIPMENT BE:INO USED BY OVER 350 HAULERS NATIONWIDE. WE HAVE MANY INS'I.AL•LATIONS IN TIGARD BEING SERVICED WITHOUT ANY PROBLEMS. WE MAINTAIN CURRENT HAULER REQUIREMENT SHEETS FOR THE ENTIRE UNITED SPATES. WHY ARE FRANCHISED HAULERS GIVEN TEN YEAR CONTRACTS TO OFFSET INVESTMENTS AGAIN, THIS APPEARS TO 3E SPECIAL INTEREST TREATMENT WITH NO BENEFIT TO THE CITY IN EVIDENCE. IN SUMMARY, I. BELIEVE A LITTLE MORE WORK NOW WILL PREVENT A LOT OF ' RE-WRITE AND AMENDMENTS LATER. THERE IS NO OBVIOUS REASON WHY THIS PROPOSED ORDINANCE CANNOT BE PERFECTED.
