• Meeting was called to order at 6:30 p.m. by Mayor Edwards.
1. ROLL CALL
Council Present: Mayor Jerry Edwards; Councilors Valerie
Johnson, Joe Kasten and John Schwartz. Staff Present:
Patrick Reilly, City Administrator; and Catherine Wheatley,
City Recorder.
SPECIAL MEETING
2. INTERIM COUNCILOR (POSITION NO. 3) INTERVIEWS
Council interviewed candidates interested in Position No. 3
which became vacant October 1, 1991. The Council, at their
September 30, 1991, Council meeting selected the following
candidates for interviews:
John L. Cook
• Jon Kvistad
• John (Jack) E. Schwab
a. Council Discussion on Process: There was lengthy
discussion on process. Consensus was to conduct the
interviews alternating questions from the Council and
answers from the candidates. At the conclusion of the
interviews, nominees for the position would be selected
through a balloting process if necessary.
b. Interviews (7:00 p.m.): Mayor Edwards welcomed the
candidates noting how fortunate the City was to have
three very qualified candidates applying for the
position. Mayor reviewed the interview process.
Listed below are most of the Council's questions and a
summary of the responses.
Question - Councilor Schwartz: What do you feel are the
most important issues facing Tigard?
- Mr. Schwab: Money - Measure 5 implications;
Regionalization - Metro; Concerns over loss of
( local control.

- Mr. Kvistad: Transportation i.e., bypass
alternatives - expansion of Murray Boulevard, Hwy
99; Developments i.e., Naeve, Albertsons; Metro
issues.
Mr. Cook: Agreed with Mr. Schwab and Mr. Cook on
transportation issues (infrastructure) and the need
for movement of traffic. I
Question - Councilor Johnson: The current City
Boundaries are erratic. Do you know where the ultimate
City boundaries are, and what are your feelings on
annexation?
- Mr. Cook: Recalled times of forced annexation, but
noted problems with this method. Advised caution
with piecemeal annexation because of service
delivery problems.
- Mr. Kvistad: City should move fairly aggressively
on annexation - the City can better plans for
growth. The County is making few if little plans
for area just outside Tigard. He recommended
approaching individuals in "islands" to determine
if they have interest in annexation.
- Mr. Schwab: Advised not in favor of forced
annexation; problems outside city limits can
sometimes be handled through intergovernmental
agreements, and, if appropriate, consolidation of
services. Noted he favored an education campaign
to point out benefits of annexation.
Question - Mayor Edwards: Who established the Urban
Growth Boundary; what does "area of interest" mean?
- Mr. Kvistad: The Legislature granted the UGB
through statutes; planning was done by different
agencies of government within each area under the
State land use plan. The boundaries are set in
order to concentrate development within certain
areas to lessen the demand on farm land. The
boundaries were done through intergovernmental
coordination and by legislative mandate.
- Mr. Schwab: The Legislature created the authority
to established the UGB. Metro established the UGB
and it would go back to Metro at such time as there
is a push to expand the UGB. The City has planning
responsibilities for areas adjacent and inside the
f UGB in a limited sense. Recounted his experiences

with planning responsibilities in UGB when a
Planning Commissioner for the City of Tualatin.
Planning can be accomplished through interagency
agreements; if Tigard does not have authority to
plan in UGB, they should try to get it at the
earliest opportunity.
Mr. Cook: It would be greatly of our interest to
expand; noting problems with zoning and the need to
change zoning when property is annexed. Also noted
density issues.
Question - Councilor Kasten: How much time does it take
to serve on City Council?
- Mr. Cook: Minimum of about 10 hours and upward to
20 or 30 depending on whether it is budget time; he
advised he was prepared to commit to the time
required.
- Mr. Kvistad: Noted is business was cyclical and he
now would have time to devote to Council. He
advised he would probably not have the time to run
for the office because of his business. He advised
he would be available for the next 6 to 7 months.
- Mr. Schwab: Noted additional responsibilities of
council including task forces and committees and
surrounding network Councilor could be involved in.
He advised he was self-employed and is interested
and willing to commit the time necessary as interim
Councilor.
Question - Mayor Edwards: What is your understanding of
Mayor/Administrator form of government?
- Mr. Cook: The council is elected; the
Administrator runs the City and is schooled in
management. The Administrator reports to the
Council.
- Mr. Kvistad: Agreed with Mr. Cook.
- Mr. Schwab: Added that Council is elected body of
policy makers.
Question - Councilor Johnson: Who would you select as
interim Councilor and why?
Mr. Kvistad: Noted all three were qualified and
referred to their unique individual blend of skills +

and abilities. He said he would pick himself
first, Mr. Schwab second, and Mr. Cook third.
Mr. Schwab: Said he would select himself but noted
his respect for the other candidates. He said he
had the best experience with issues relating to
city government. He said he could "hit the ground
running" on a lot of the issues.
Mr. Cook: Said he would not pick himself, but only
because he had not ruled out the possibility of
running for the position in March.
Question - Councilor Schwartz: Why do you want to serve
on the Council?
- Mr. Schwab: Described himself as a "volunteer
junkie" and noted his service on the Chamber of
Commerce, Tualatin Planning Advisory commission,
and I-5 Corridor Association (founder). He advised
he enjoys public issues and the political process.
- Mr. Cook: Noted he wanted the experience and that
he grew up with his father being active in
politics. He said he wanted to give back to the
community some of the benefits he has received.
- Mr. Kvistad: Advised this was something he wanted
to do for a long period of time. He said he, grew
up just outside of the city limits and has a well-
developed sense 6f community services. This
appointment would provide the opportunity to serve
with only a 6-month commitment.
Question - Councilor Schwartz: How can the City improve
itself?
- Mr. Kvistad: Noted the need for the City to expand
parks and opportunity for recreation. He said he
would like to see a series of linear parks
(connections) - and that the City should be looking
to -purchase park land for development. He noted
the need for planning for future growth.
- Mr. Cook: "Flex muscle" - do not let Metro or
State Transportation Board come in and take over.
City should just not be told what to do.
- Mr. Schwab: Move aggressively now and improve
triangle area in Tigard; diversify tax base.

Question - Councilor Johnson: Reviewed Westside Bypass
and the requirement to explore all options per State Land
Use mandates. One of the options is to improve and widen
existing arterials and this could result in a "battle."
What are your feelings on this issue?
- Mr. Schwab: Reviewed his knowledge of the Bypass
issue and said it is inappropriate to put a
transportation corridor through a well-developed
residential area. Crucial for southwest Washington
County that this road be created.
- Mr. Cook: Arterial development not rational;
agrees Bypass should be built. The longer it is
delayed, the more expensive. Alternative may be to
expand 217.
- Mr. Kvistad: Advised the Bypass has been talked
about for 20 years and noted new rules and players
(i.e, 1000 Friends). Noted the widening of Murray
is the easiest out for a lot of people and it may
be hard to stop. He stressed Tigard must remain
proactive and protect what is good for the
community.
Question - Mayor Edwards: The City of Tigard is studying
whether to deliver service and concern itself with water
source. He asked the panelists to comment on this issue.
- Mr. Cook: Said he thought the City should be
aggressive on this issue. He noted water is
becoming a scarce commodity.
- Mr. Schwab: Agreed with Mr. Cook and noted the
City should protect water interests. He referred
to recent activity with district consolidation and
the need to be major player with influence in the
future. He advised costs must be shown to "pencil
out" in the study.
- Mr. Kvistad: Said he believes the City should
provide the water services. He noted half of the
water service was lost to another City. He said it
makes good sense for the City to provide the water
services within the Tigard area. He referred to
improved relationship between the City and the
Water District.

Question - Councilor Kasten: Noted that Ballot Measure
5 has been blamed for many of problems in the last year
and one-half. What did the people intend with their
approval of Ballot Measure 5?

- Mr. Cook: Ballot Measure 5 was a call for
consolidation and restructure of delivery of
current services.
- Mr. Kvistad: Voters wanted to send a message for
tax relief, but didn't realize it represented the
complete dismantling of structure and definitions.
Outside landowners are the major recipients of
benefits created by Ballot Measure 5. Voters were
frustrated; perception of "fat and waste-.11
- Mr. Schwab: People wanted less government which
was more efficient. He noted the voters approved a
new tax base for Tigard at the same time they voted
for Ballot Measure 5.
Question - Mayor Edwards asked for each candidate to give
insight as to what it will take for them to make some
tough decisions.
- Mr. Schwab: Noted his hero was John Adams and
referred to an example of Mr. Adams' character in a
situation during Revolutionary War. Despite
tremendous pressure, Mr. Adams represented three
British soldiers because he felt an obligation to
assure they received a fair trial. Mr. Schwab
advised he would not be afraid to make a tough
decision for the ultimate good that must be served.
- Mr. Kvistad: Referred to his father who was a
school principal. Mr. Kvistad saw times when his
father dealt with rooms full of angry parents and
made tough decisions keeping in mind the welfare of
the children. Mr. Kvistad said if one is make a
difference, one must make decisions; he would not
be afraid to say what he believes in.
- Mr. Cook: Advised he saw no problem with ability
to make a decision even though they may affect
friends or family. He said he must say what he
thinks is right.
Question - Mayor Edwards asked the panelists to described
TIF, approved by County voters.
Mr. Kvistad: Said TIF was a traffic impact fee
levied through the gas tax and collected by the

County. The impact fees are used for local road
improvements and distributed based on a percentage
of population to fund projects in different areas.
Mr. Cook: Said TIF was a fee and therefore not
affected by Ballot Measure 5 as a source of
revenue. He noted construction contractors have
been disputing the TIF because they feel the burden
is too heavy on them; the fee needs to be fair.
Mr. Schwab: Noted this is a type of systems
development charge collected from developers based
on the amount of traffic impact created by their
projects. Whether or not this is a major revenue
source for the City will depend on how fees will be
governed under the interpretation of implementation
of Ballot Measure S.
Mr. Kvistad was asked if his service on the Water Board
would affect his ability to serve on the Council as well.
He responded that he doubted if a conflict of interest
would occur and that he, by being elected to the Water
Board, felt he had the credentials to serve the people
and represent their interests.
In response to a question from Councilor Schwartz on the
western Bypass alternatives, Mr. Schwab advised he
doubted if this issue would be resolved within the next
few months. If an alternative was selected which would
affect him personally, he said he believed if he thought
it was truly the best option, then he would be able to do
the right thing and vote for that alternative. Mr.
Kvistad agreed that they would have to look at what is
best for the City.
Mayor Edwards expressed his appreciation for the
candidates comments and their interest in the Councilor
position.

3. INTERIM COUNCILOR SELECTION
a. Motion by Councilor Kasten, seconded by Councilor
Schwartz, to nominate Jack Schwab for appointment to
Council Position No. 3.
The motion was approved by a unanimous vote of Council
present.

b. Each Council member thanked the candidates, noting the
{ decision was difficult, if not the most difficult one
` they have ever had to make in their experience on the
City Council. They urged Mr. Cook and Mr. Kvistad to
consider running for the City Council in either March or
November 1992. 1

Notices were displayed in both the Tigard Times and the Oregonian
newspapers advising of council's process for selection of an
interim Councilor. Also, I sent a letter to those individuals who
had previously telephoned advising of their interest. Requirements
for consideration as an appointee were stated as:
1. A person must be a qualified elector of the State of
Oregon and a Tigard resident during the 12 months
immediately preceding appointment.
2. Interested applicants were requested to submit a letter
of interest along with a statement of qualifications.
3. Deadline for submittal of the letter of interest was set

I would like you to consider my interest in being appointed to
Council Position #3, vacated by Councilor Eadon as of October 1,
1991, until the next-available election can be held for this
position. I am aware that the appointee to this position is not
allowed to be a candidate at the vacancy-filling election for this
position, and I have no intent of running during that election.
My wife and I currently reside within the city limits, and have
lived at the above address since May of 1988. I have lived in the
City of Tigard my entire life and have a strong bond to it. I grew
up involved in the creation and helped work on such projects as
Cook Park, Woodard Park, Mayor's Pancake Breakfast, Tigard Town and
Country Days, Crusin Tigard, Tigard's 30th Birthday, and various
other projects.

in Tigard as a manager working for The.Kingsland Company; PC,
.CPA's. I have worked in accounting for-over nine years. I am a
member'of Oregon Association of Independent Accountants and the
National Society of Public Accountants.
I am very active in the Tigard Chamber of'Commerce now serving in
the position of President Elect,. and have been on the board of
directors for over two years. Last.year I received the Bert Tousy
award for devotion and time..donated to the Tigard Chamber.
I am also. var., active in our • church, St. Anthony'a in-Tigard, and
have served as Chairman of. the Pastoral Council there for the last
two years. I-am also a member of the:Portland Jaycees (past

I would like to officially express my interest to you and
the city council in being considered for the vacant city council
position.
As someone who is quite active in the Tigard community I
feel that I could make an immediate and positive contribution to
my city. My experience with our city government and services
combined with my background in state and local government would
allow me to step quickly into Carolyn's position with a limited
learning curve.
This opportunity is of great interest to me and I will
assure both you and the city council that I have no plans to run
for this city council seat next year or have any plans to run for

I wish formally to apply for appointment as interim City
Councilor for the City of Tigard. I have been a Tigard resident
for the required time period, I am not interested in running for
election to the position in the special election next Spring, and
I believe I am very well qualified to serve.
My wife, Katie, and I and our sons have lived in the city
since November 1989. We lived in Tualatin for seven years prior
to that. I am a lawyer in private practice and my business has
been located in Tigard for more than 10 years.
I have long been involved in local civic affairs as follows:
- 4 year member of the Tualatin Planning Advisory
Committee (1983-1987) (2 years as Chairman).
- Long time board member and President (1987-1988) of
the Tigard Area Chamber of Commerce.
- Member of Mayor Edwards' Blue Ribbon Task Force
(1990-1991).
- Co-founder and first President (1985-1986) of the I-5
Corridor Association.
- 3 year board member (1986-1989) of the Tualatin Valley
Economic Development Corporation (TVEDC).
- 8 year member of Rotary Club of Tigard.
In addition, I have appeared before both the Council and
Planning Commission on land use matters and have a good
relationship with several key city officials.

The timing of this opening is perfect for me. I want to
serve, but I have been unwilling to make a long-term committment s;
to elective office. I am no longer on the boards listed above and
I now can give the City of Tigard six months of my time and energy.
I am confident I am as qualified as anyone who applies for
this appointment. The Council will be looking at some important
issues soon, such as whether to withdraw city territory from the
Tigard Water District and how best to shape transportation
improvements along Pacific Highway. I would not assume the office
with any particular agenda, but I am ready to participate and help
make tough choices.

This letter is to confirm my interest in obtaining the interim
position on the Tigard City Council.
I feel that my interest in, and contribution to, public service
would make my 6 month term as the interim council member very
productive. Although I have only lived in Tigard for 16 months, I have a
strong understanding of the issues the City is facing. My greatest concern
is the rapid population growth and land density that is increasing the
demand on the current infrastructure. The City needs to develop an
extensive master plan that specifically addresses the current issues and
establishes an agenda for the next 5-10 years. The currently proposed
solution to the traffic problems appear feasible on the surface, yet seems
very cost prohibitive. In the face of measure 5, will the state have the
available funding to undertake an enormous project like the Western By-
Pass? I feel that there may be better solution to this problem but it will take
hard work on the part of the local government and an open mind of the
people who are affected by this issue on a daily basis.
The following experience and qualifications will make me an
effective interim councilor:
• An active member of the Southside Neighborhood Association
for Eugene for 10 years
• A strong interest and understanding in community affairs
• A understanding of the political process. I worked for David
Frohnmeyer and his campaigns since 1974
• 1 have worked with several cities on various issues as a
consultant with Vern Ho and Associates
• I have a strong understanding of public finances and business
These qualifications in addition to my genuine concern for the
future of the City of Tigard, would make me a• very effective council
member. I look forward to hearing from the council very soon.
