MEETING MINUTES - AUGUST 28, 1991
• Meeting was called to order at 6:30 p.m. by Mayor Edwards.
1. ROLL CALL
Council Present: Mayor Jerry Edwards; Councilors Carolyn
Eadon, Joe Kasten and John Schwartz. Staff Present: Patrick
Reilly, City Administrator; Dick Bewersdorff, Senior Planner;
Ken Elliott, Legal Counsel; Ron Goodpastr, Chief of Police;
Liz Newton, Community Relations Coordinator; Cliff Scott,
Operations Manager; and Catherine Wheatley, City Recorder.
STUDY SESSION
Closure of Oregon State Patrol Office (OSP) at Denney Road
Chief Goodpaster reported to Council that the OSP office in Beaverton on Denney Road
will be closing effective December 1, 1991. Troopers from this office will be distributed
throughout the OSP organization with a designated number being relocated to the Portland
area or the Banks/Vernonia office for Highway 26 patrol. This decision concerns Tigard
because of I-5 and 217 coverage and impact on the Tigard Police Department.
After discussion, Council consensus was to direct written contact with OSP requesting
information on plans to provide current level maintenance of service and protection to
Washington County taxpayers. City Attorney's office will also research legal obligation of
the City to assume first-respondent role for incidents on I-5 and 217.
Police Department Management Training (2 Lieutenants)
Council, by consensus, gave approval to a training request at the Southern Police Institute
in Louisville, Kentucky. This three-month course offers advanced instruction in leadership,
planning, research and decision making. Council approval was contingent upon a contract
for a three-year commitment from the candidate once the training has been completed.
Council also gave approval to efforts to send a Lieutenant to training at the FBI Academy.
Traffic Safety Commission Grant
Tigard has been awarded a $65,000 grant from the Traffic Safety Commission to place an
additional person on DUI enforcement patrol in the evenings. Grant duration is October -
October. The City is expected to match with another officer and car. The expectation is

that the officer will be picked up by the City after the one year. City Administrator advised
that the match and continuation of the DUI patrol after the first year is within the five-year
financial plan projections and within the City's fiscal bounds.
30th Birthday Celebration
Community Relations Coordinator updated Council on the planning of the 30th Birthday.
This celebration will occur September 6, 7 and 8. Activities planned include:
• Cake cutting at Washington Square Nordstrom Court
• Carnival, all three days, at the Payless Parking Lot - Main Street
• Free - Music featuring Dan Balmer Trio (7-10 p.m.)
• Parade on Saturday at 10 a.m. (from Food Connection to Main and
Commercial)
• Community Talent Show - Scoffins & Main
• "Over 30 Olympics"
• Free - No Alcohol Street Dance featuring the Warlocks (7-10 p.m. on Main
Street)
• 8k Run, 6k Walk on Sunday
• Free - Music by Back Porch Blues
Metro Regional Growth Goals
After discussion with City Administrator, Council consensus was to forward a letter the
Metro Council urging that the Regional Growth Goals not be considered or adopted until
the Charter has been established.
Regional Governance
Mayor Edwards advised of a Regional Governance Committee consisting of membership
of cities and county officials from Clackamas and Washington County. The purpose of this
group is to formulate ideas and a philosophy outlining services which would work better if
done on a regional basis yet allow continued involvement of local governance. He advised
that he and Councilor Johnson are serving on an ad hoc committee of this group to work
out details for formation (i.e., budget, membership) of the Regional Governance Committee.
Conversation with the Governor
City Administrator explained that Governor Roberts is holding a series of "conversations"
throughout the State for the purpose of determining of what Oregonians want in
governmental services and their expectations in the taxing structure. The League of Oregon
Cities and Association of Oregon Counties are asking for support of the cities and counties
by participating in these "conversations." A training session for participation at these
sessions with the Governor is being planned for the tri-county area on September 11. LOC
and AOC are asking for two representatives from each County and City consisting of an
elected official and an executive staff person. After discussion, City Administrator advised
he would contact Councilor Johnson to serve as the City's elected official representative.

Focus III
City Administrator advised that a Focus III meeting will be held on September 11 at 3:00
p.m. to discuss major issues within the metropolitan area. This group is considering the
formation of a Metropolitan League of Cities.
Council Retreat
Tentative dates for a Council retreat are November 2 and 3. Staff will confirm dates and
advise.

AN ORDINANCE CONCERNING THE VACATION OF A PORTION OF SW 135TH
AVENUE LOCATED NEAR SW SCHOLLS FERRY ROAD, IN THE CITY OF TIGARD,
WASHINGTON COUNTY, OREGON.
WHEREAS, the Tigard City Council initiated this vacation request on
May 21, 1991 in accordance with Section 15.08.040 of the Tigard
Municipal Code; and
WHEREAS, this portion of SW 135th Avenue is a dedicated public
right-of-way, giving the public rights over the land for street and
utility improvements; and
WHEREAS, the purpose of this vacation is to vacate an unimproved
portion of SW 135th Avenue that is no longer needed because
SW 135th Avenue has been realigned and fully improved; and
WHEREAS, the property owner E. Aleen Gross and representative Bill
Gross support the vacation; and
WHEREAS, the City of Tigard Engineering Department requests that a
right-of-way be provided to a distance of 30 feet from centerline;
and the public storm drain line on the west side of the right-of-
way become a private line and that the property owner of the
western parcel (tax lot 100) shall be responsible for the storm
drain line; and
WHEREAS, Portland General Electric and GTE Northwest, Inc. have
requested that an easement be provided for all existing utilities
in the right-of-way; and
WHEREAS, all other affected service providers, including utility
companies and emergency services, have reviewed the vacation
proposal and have no objections to it; and
WHEREAS, in accordance with ORS 271.100 and TMC 15.08.110, the City
Council fixed a time and place for the public hearing and the City
Recorder published notice and posted notice in the area to be
vacated; and
WHEREAS, notice has been mailed to all property owners abutting
said vacation area and all owners in the affected area, as
described by ORS 271.080; and

WHEREAS, the City Council, having held a hearing on July 19, 1991,
finds the public interest will not be prejudiced by the vacation as
provided by ORS 271.120 and TMC 15.08.130; and
WHEREAS, the City Council finds it is in the public interest to
approve the request to vacate the unimproved portion of SW 135th
Avenue located immediately south of the intersection of SW 135th
Avenue and SW Scholls Ferry Road.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: The Tigard City Council hereby orders the vacation
of the unimproved portion of SW 135th Avenue
located immediately south of the intersection of
SW 135th Avenue and SW Scholls Ferry Road, as
described on the attached "Exhibit A" and shown on
the attached "Exhibit B" and "Exhibit C" and by
reference made part hereof.
SECTION 2: The Tigard City Council further orders that the
vacation be subject to the following conditions:
1. The right-of-way for SW 135th Avenue shall be
60 feet, 30 feet each side of center line.

2. That the public storm drain line, as shown on
the "as-builts", page 7, between station 33+60
to 32+72 on the left side of the right-of-way,
for the SW 135th Avenue LID become a private
line and the property owner of
T.L. 100 1S1 33CA shall be responsible for the
storm drain line.
3. The applicant shall be responsible for
providing an easement for all existing
utilities within that portion of the right-of-
way to be vacated.
SECTION 3: This ordinance shall be effective on the 31st day
after enactment by the City Council, approval by
the Mayor, and after a certified copy has been
recorded with the Washington County Clerk,
Assessor, and Surveyor.

South, Range 1..West, Willamette Meridian, City of Tigard, County of

INFORMATION SUMMARY
1C There is an existing sewer easement across the Amber Foods

Hall and Burnham. The sewer line was abandoned at the time that the
City's sewage treatment plant was replaced by the USA Durham plant. The
City has no further need for the easement. Amber Foods has requested
that the unused easement be extinguished.
The attached resolution will allow the easement to be legally
extinguished.

purchase a large rotary mower to replace an existing piece of
equipment. The equipment being replaced is a 1987 Ransoms 7211
Rotary Mower which has outlived its useful life and is scheduled
for replacement this year. Replacement cost for a comparable piece
of equipment would be approximately $20,000.00. The equipment
requested is a Tri-Deck Rotary Mower that has 16 feet (19011) mowing
width capacity. The following are some areas we considered when we
wrote the specifications for the mower:
- Labor savings. This equipment will allow large turf
areas now being mowed by two Parks personnel to be mowed
by one person. The labor savings can be utilized to
enhance other areas of park maintenance. (i.e. gardening,
planting, sweeping pedestrian paths and provide for
greater utilization of volunteers and community service
personnel). This is an investment in equipment rather
than personnel.
- Increased Productivity. Areas that are now mowed in
four days with two pieces of equipment and two personnel
can be mowed in the same amount of time, or less, with
one person and a single piece of equipment.
- Durability. This equipment is built better and
stronger than existing equipment. This mower has a
history of lasting 8-10 years in our type of mowing
operation. Some of the reasons are: Heavier gauge
material used in the frame and deck (reinforced at stress
points) and built with shock absorbing devices. There is
less down time due to equipment failure and breakage due
to metal fatigue and general wear and tear.
- Safety and Health of Operator. The larger piece of
equipment is equipped with suspension shock absorbers
resulting in more operator comfort and safety. It has a
cutting unit break away feature that moves away from
objects accidently struck by the mower deck. It also has
better visibility to the rear for transporting on City
sT~eets.

- Versatility. Unlike present equipment, this equipment
can be utilized for rough mowing as well as finish type
mowing. This unit is also the only mower of this size
capable of near zero turning radius. What this means is,
the operator can mow close to buildings, trees and other
objects without utilizing another piece of equipment.
- Cost Ef f icient. Because of more of f icient use of
equipment and personnel, the Parks division has cut
$4,000.00 from their materials and services budget and an
additional $15,000.00 or one half of a full time employee
from their personnel budget.
In addition the Parks Division, over the past several months, has 1
demonstrated several of these tractor mower units from different
manufacturers (Toro, Jacobsen, Nunes, Deweze). In combination with
the demonstrations and talking with present users (Portland,
Ashland, Willamalane Parks in Eugene) of these different types of
equipment, we have found the Toro 580D to be superior in most
areas. Portland for instance has nine Toro's in service at this
time and they have utilized Nunes and Jacobsen in the past and
recommend Toro over the other brands.
The Parks Division is anxious to and are looking forward to putting
this equipment to work. '

Should the City Council vacate a portion of the west side of SW 135th Avenue
located just south of SW Scholls Ferry Road?
STAFF RECOMMENDATION
It is recommended that Council approve the vacation with conditions by
adopting the attached ordinance.
INFORMATION SUMMARY
Council initiated this vacation at a meeting held on May 21, 1991.
Mr. Bill Gross, acting as agent for property owner E. Aleen Gross, requests
City Council approval to vacate an approximately 36.5 foot wide portion of
.he SW 135th Avenue right-of-way adjacent to property located on the west
side of the corner of SW 135th Avenue and Scholls Ferry Road (see
accompanying map). A 1988 realignment of SW 135th Avenue at this location
eliminated the City's need for this portion of the right-of-way. Appropriate
agencies have been contacted for comments. The area proposed to be vacated
will be converted to an easement to accommodate existing utilities as a
condition of approval.
Portland General Electric, and GTE Northwest, Inc. have requested that an
easement be provided for all existing utilities in the right-of-way. The
City of Tigard Engineering Staff has offered no objections to the vacation
subject to the following conditions:
1. The right-of-way for S.W. 135th Avenue shall be 60 feet, 30 feet
each side of center line.
2. That the public storm drain line, as shown on the "as-builts', page 7,
between station 33+60 to 32+72 on the left side of the right of way (on
the southwest portion of the site), for the S.W. 135th Avenue L.I.D.
become a private line and the property owner of T.L. 100 1S1 33CA shall
be responsible for the storm drain line.
The Planning Commission recommended approval of the proposed vacation after
reviewing the proposal at its August 19, 1991 meeting.

WASHINGTON COUNTY, OREGON.
WHEREAS, a vacation request has been received and filed with the
City Recorder for vacation of a portion of S.W. 135th Avenue; and
WHEREAS, this portion of S.W. 135th Avenue is a dedicated public
right-of-way, giving the public rights over the land for street and
utility improvements; and
WHEREAS, the property owners Bill Gross and E. Aleen Gross.support
the vacation; and
WHEREAS, S.W. 135th Avenue in the vicinity of the area proposed for
vacation has been realigned so that the portion of the right-of-way
being considered for vacation is not.needed; and

INFORMATION SUMMARY
Comprehensive Plan Transportation Map amendments, including Note #9, were
discussed at a Council hearing on June 11, 1991. Note #9 was removed from the
transportation map amendment proposal. The hearing was continued, for Note #9
only, until August 27. This action was taken at the City Attorney's
recommendation because of ongoing litigation involving road improvements serving
the Tigard Triangle area.
There has been no clear resolution of the transportation issues in the triangle
area at this time.
PROPOSED ALTERNATIVES
Close the hearing and deny the proposal to add Note #9 on the Comprehensive Plan
Transportation Map.
Close the hearing and approve the proposal to add Note #9 to the Comprehensive

FISCAL NOTES
If Note #9 is included on the Comprehensive Plan Transportation Map there would
