ROLL CALL Council Present: Mayor Jerry Edwards; Councilors Carolyn Eadon, Valerie Johnson, Joe Kasten, and John Schwartz. Staff Present: Patrick Reilly, City Administrator; Ed Murphy, Community Development Director; Liz Newton, Community Relations Coordinator; Tim Ramis, City Attorney; Catherine Wheatley, City Recorder; and Randy Wooley, City Engineer. 2. STUDY SESSION Tax Base City Administrator reviewed the Tax Base Public Information Program. The following items were noted or discussed: > Over 200 people have heard the presentation on the tax base ballot measure to be decided by Tigard voters on November 6. Upcoming talks include a presentation at the Summerfield Clubhouse sponsored by the League of Women Voters and Chamber of Commerce Forum. > Two Town Halls are planned for October 23 (Town Hall) and October 30 (Senior Center). Flyers, announcing the Town Halls, will be given to elementary school children to take home. > Council consensus was to approve a door-to-door information distributing campaign. This will be a volunteer effort; information on the tax base will be given out in Tigard precincts. > Mayor advised Tigard representatives met with the Tigard Times Editorial Board. > Motion by Councilor Johnson, seconded by Councilor Eadon, endorsing a letter to the media urging favorable consideration of the tax base. The motion was approved by a unanimous vote of Council present. > Council consensus was to approve public information advertisements in the Oregonian and Tigard Times. l > Council consensus was to approve a phone bank for public information. Library Council consensus was for Yvonne Burgess to continue as the primary representative to the Cooperative Library Advisory Board. Councilor Eadon will serve as alternate. 3. CONSENT AGENDA: a. Council directed staff to obtain a new estimate for bridge without additional consultant work tying this into the Downtown Development Plan and the Fanno Creek Master Park Plan. Staff will present a new contract proposal on October 22, 1990. 4. INCREASE IN PARK SYSTEM DEVELOPMENT CHARGES a. Community Development Director reviewed the staff report as submitted to the City Council in their meeting packet. b. Discussion followed on the overall needs for Park System improvements within the City. c. RESOLUTION NO. 90-66 - A RESOLUTION MODIFYING RESOLUTION NO. 87-152 OF THE TIGARD CITY COUNCIL INCREASING THE TIGARD PARK SYSTEM DEVELOPMENT CHARGES. d. WHEREAS, the applicant has requested a Comprehensive Plan Amendment from light Industrial to Commercial General and a Zone Change from I-L (Light Industrial) to C-G (Commercial General) on approximately 6.6 acres; and WHEREAS, the Planning staff made recommendation of findings for denial to the City of Tigard Planning Commission at a public hearing on July 10, 1990; and WHEREAS, the Tigard City Council held a public hearing on the proposed changes on August 27, 1990 and September 17,1990 to review Planning staff recommendation, Planning Commission recommendation for approval, and public testimony. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: The proposal is consistent with all relevant criteria based upon the facts, findings, and conclusions noted below: A. FACTS 1. Box 69039 Portland, OR 97201-0039 LOCATION: Northwest quadrant of the intersection of Interstate 5 and Lower Boones Ferry Road at intersection with SW 72nd Avenue and Bridgeport Road. PROPERTY DESCRIPTION: WCTM 2S1 13AD, Tax Lot 1700 2. Background Information The property was annexed to the City of Tigard in 1976, and has been zoned I- L since that time. No land use or development applications for this parcel have been reviewed by the City since annexation. 3. Vicinity Information The subject acre site is bounded on the west by SW 72nd, on the east by I-5, on the north by the Oregon Business Park, and on the south by undeveloped right- of-way along Lower Boones Ferry Road. Surrounding uses and zoning designations are an industrial park zoned I-L to the north; the former Washington County quarry, which is zoned I-P (Industrial Park) and which is currently being filled in preparation for possible future development, is to the west; Tri-MeVs Park and Ride is to the south across Lower Boones Ferry Road within the City of Tualatin; and I-5 to the east. Industrial development is the predominant land use on the west side of the freeway interchange, whereas commercial development is the predominant use on the east side. 4. Site Information and Proposal Description The 6.6 acre undeveloped site is generally flat and is slightly below the grade of the freeway thereby providing substantial exposure to freeway traffic. There is a stand of large Douglas Fir trees on the site along with some smaller deciduous trees and low-lying brush. The applicant requests a Plan Map amendment from Light Industrial to General Commercial and a Zone Change from the I-L (Light Industrial) zoning district to the C-G (General Commercial) zoning district. The applicant has submitted a statement designated Narrative In Support of a Proposed Amendment to the City of Tigard Comprehensive Plan Map and Zoning Map. In addition, the applicant ORDINANCE NO. 90-_ Page 2 { has submitted a traffic study in tabular form. The traffic study is summarized within the Narrative. Although the proposed redesignation would make the subject property available for development of any of the permitted or conditional uses allowed in the C-G zoning district, the applicant's Narrative and traffic study focus on use of this site for a combined hotel and retail center. Hotels and retail sales are permitted uses in the C-G zone and are not either permitted or conditional uses in the present I-L zoning designation applied to the property. 5. Agency and NPO Comments The Engineering Division has reviewed the proposal and offers the following comments: As mentioned in the applicant's submittal, there are adequate storm and sanitary sewers in S.W. 72nd Avenue to serve the site. The Oregon State Highway Division has reviewed the revised traffic study provided by the applicant and has agreed that traffic concerns have been adequately addressed. The Engineering Division is in agreement with the conclusions of the Highway Division. The Oregon State Highway Division originally expressed concerns regarding the proposal. The applicant provided additional information to the Division and at the Planning Commission hearing, a representative from the Division indicated that satisfactory short and long range solutions were available to accommodate this plan and zone change. The Division had no objection to the proposal. The City of Durham has reviewed the proposal and has requested that every effort be made during development of the site to preserve as many trees as possible, in order to help preserve the air quality of our environment in this particular air shed. In addition, traffic controls should be provided in order to ensure coordinated use of 72nd and Lower Boones Ferry Road. The City of Tualatin Planning Department reviewed the proposal and offered comments regarding the applicant's traffic analysis report but made no recommendation regarding the proposed Plan Amendment/Zone Change. Tualatin questioned the traffic analysis' assumptions regarding the timing for the future extension of Durham Road to SW 72nd Avenue and for the addition of turn lanes at the I-5/1ower Boones Ferry Road interchange. In addition, Tualatin questions the validity of assumptions regarding the amount of traffic to the site that will result from drive-by traffic. The City of Tualatin agrees with the traffic analysis' statement that this interchange and the surrounding roadways and uses are a regional issue. Should the requested land use change be approved, the City of Tualatin encourages the City of Tigard to actively support future freeway and interchange improvement projects in this area. l' ORDINANCE NO. 90- 3y Page 3 The Building Division, Tigard Water District, Washington County Department of Land Use and Transportation, General Telephone, and PGE have reviewed the proposal and have issued no comments or objections. No other comments have been received. B. FINDINGS AND CONCLUSIONS The relevant criteria in this case are Statewide Planning Goals 1, 2, 9, and 12; Comprehensive Plan Policies 2.1.1, 4.2.1, 4.3.1, 5.1.1, 7.1.2, 7.2.1, 7.4.4, 7.6.1, 8.1.1, 8.13, and 12.2.1 (Locational Criteria for the General Commercial Use); and the change or mistake quasi-judicial Plan Map Amendment criteria of both the Comprehensive Plan and Community Development Code. The City Council concludes that the proposal is in compliance with the applicable Statewide Planning Goals based upon the following findings: 1. Goal #1 (Citizen Involvement) is satisfied because the City has adopted a citizen involvement program including review of all land use and development applications by neighborhood planning organizations (NPOs). In addition, all public notice requirements related to this application have been satisfieu. 2. Goal #2 (Land Use Planning) is satisfied because the City has applied all applicable Statewide Planning Goals, City of Tigard Comprehensive Plan Policies, and Community Development Code requirements to the review of this proposal. 3. Goal #9 (Economy of the State) is satisfied because the proposed redesignation would increase the City's inventory of developable commercial land although it would decrease the inventory of developable industrial land. No net impact on employment in the City is foreseen in the proposed redesignation. 4. Goal #12 (Transportation) is satisfied because the proposed redesignation will not adversely affect upon the remaining traffic capacity of adjacent streets and the I- 5 interchange. This is more thoroughly discussed under Plan Policy 8.1.1 below. The City Council has determined that the proposed Plan Map Amendment/Zone Change is consistent with the Comprehensive Plan based upon the findings below: 1. Plan Policy 2.1.1 is satisfied because Neighborhood Planning Organization #5 and surrounding property owners were given notice of public hearings related to the request and to their opportunity to comment on the proposal. 2. Plan Policy 4.2.1 will be satisfied through the development review and building permit processes at which time a development proposal for this site must be shown to comply with applicable Federal, State, and regional water quality requirements including preparation and implementation of a non-point source pollution control plan in compliance with the Oregon Environmental Quality ORDINANCE NO. 90- 30 Page 4 Commission's temporary rules for the Tualatin River Basin. The proposed redesignation does not by itself affect compliance with this Plan Policy. 3. Plan Policy 4.3.1 is implemented through the development review process in which building placement and landscaping are reviewed with respect to minimizing noise impacts of the developing use upon neighboring land uses. 4. Plan Policy 5.1.1 states that: The City shall promote activities aimed at the diversification of the economic opportunities available to Tigard residents with particular emphasis placed on the growth of the local job market. This policy is considered important to this application because the subject property is located within the largest industrial district in the City. Additional information was submitted for consideration at the September 17, 1990 hearing relating to the impact of this proposal upon Policy 5.1.1. The Council considered the following information to be relevant: a. Thirty-two percent (241 acres) of the City's I-L/1-P zoned land is vacant or underutilized, while 29 percent (128 acres) of the City's C-G land is vacant or underutilized. b. Forty-seven percent (166 acres) of the I-L/ I-P zoned land in the vicinity of the site is vacant or underutilized. C. The 6.6 acres represents 2.7 percent of the total vacant/underutilized I- L/I-P land in the City and 5.1 percent of the total vacant/underutilized C- G land in the City. j d. A letter from John Ingle, Economist, indicates that the 1990 Metro Employment Density Study shows that retail commercial projects typically produce about 25 employees per acre, while industrial projects produce about 20 employees per acre. e. Applying average wage rates to these employment figures shows that commercial projects generate about $201 per hour per acre, and industrial projects about $210 per hour per acre. These findings are the basis for the City Council's conclusion that the redesignation of the subject property from Industrial to Commercial complies with Policy 5.1.1. These findings indicate that industrial and commercial will have about the same economic impact in terms of employment and income for Tigard residents. Further, this 6.6 acre parcel represents a small percentage of the total vacant/underutilized I-L/1-P land in the City (2.7 percent). The Council concludes that a redesignation of this property for commercial ORDINANCE NO. 9o-30 F. Page 5 purposes will provide economic benefits to the citizens of Tigard at a minimum in a substantially similar manner as if the property retained its industrial designation and will provide immediate economic benefits as a commercial development inasmuch as the property has remained undeveloped as an industrial site. 5. Plan Policies 7.1.2, 7.2.1, 7.4.4, and 7.6.1 are satisfied because adequate public service capacities are available to serve future development of this site. Extension of necessary public facilities to serve the site are the responsibility of the developer. The City of Tigard notifies applicable public and private utility providers of pending development applications. 6. Plan Policy 8.1.1 states that: The City shall plan for a safe and efficient street and roadway system that meets current needs and anticipated future growth and development. This policy is of critical importance in this case because of the development which is occurring in the vicinity of the I-5/Boons Ferry Road interchange. An initial traffic study, in response to the proposed amendments, indicated the existence of heavy traffic conditions at the intersection of S.W. 72nd Avenue and S.W. Bridgeport Road. Since the Oregon Department of Transportation (ODOT) initially expressed concern that the proposed zone change would exacerbate the existing conditions, the applicant sponsored an additional study of the traffic conditions in the area which involved the ODOT, Tri-Met, the cities of Tualatin and Tigard, and Washington County. The study produced several alternatives, one which was a generally regarded as the best solution for the future improvement of the intersection of S.W. 72nd Avenue and S.W. Bridgeport Road. The Council finds that: a- The intersection of 72nd Avenue and Bridgeport Road, and of Bridgeport Road and I-5 ramp terminus both function at an acceptable level of service when independently analyzed. 3 b. The traffic problem evident at this location is the lack of adequate stacking distance for left turns, which results in traffic failing to clear the intersection during the green signal. C. Development of the site under the I-L zone will add about 74 P.M. peak hour trips to the intersection (2.9 percent of projected future total) while C-G zoning would add about 161 trips (63 percent of future total). d. Most of the site-related traffic under C-G zoning would be exiting the freeway and turning right from Bridgeport Road to 72nd Avenue, thus utilizing a noncritical movement in terms of intersection function and ORDINANCE NO. 90- 3 y Page 6 capacity. e. The southbound 72nd Avenue to eastbound Bridgeport Road and westbound Bridgeport Road to southbound 72nd Avenue vehicle stacking requirements are virtually the same for either industrial or commercial development on the subject property. L ODOT has a 1991 project to re-stripe and widen turn lanes to improve the critical intersection lanes. g. Washington County has expressed a willingness to work with the other affected jurisdictions and property owners to effectuate a long-term improvement to the intersection of 72nd Avenue and Bridgeport Road. h. Tom Schwab of ODOT testified before the Planning commission that the applicant's studies and conclusions were accurate, and, specifically, that the change to a commercial designation and subsequent development would not impact the affected intersection significantly or differently than T development under the existing I-L zone. As a result, the Council is in concurrence with ODOT's conclusion relative to traffic issues. Based on these findings, the City Council concludes that there is a unique traffic condition in the area, where the critical intersection will continue to function at an acceptable level. The Council has found that because of these unusual conditions, site development under the proposed C-G zone will not have a significantly different impact on the level of service than if the site were developed under the present I-L zone, and that the traffic associated with the C-G x designation can be accommodated by the street system. 7. Plan Policy 8.1.3 will be satisfied as a condition of approval of any future development of this site. Completion of necessary street improvements along the site's frontages would be required to be installed by the developer at the time of development. The Engineering Division, the Oregon State Highway Division, and the City of Tualatin would review any future development proposals for the site with regard to necessary road improvements. 8. The locational criteria for General Commercial uses specified in Chapter 12 of the Comprehensive Plan (Policy 12.2.1) are satisfied for the following reasons: A. The subject area is not surrounded by residential development on more than two sides. The closest residentially designated property is in excess of 1/2 mile away. B. As discussed above under Statewide Planning Goal #12 and Plan Policy 8.1.1, the proposed commercial redesignation will not substantially increase traffic on adjacent streets and intersections or lead to an unsatisfactory level of service. This conclusion is based largely upon the analysis and ORDINANCE NO. 9030 Page 7 t f e recommendations of the Oregon State Highway Division. C. The site is located at the intersection of an arterial (I-5) and several major collector streets. Access to the site for any future development will be determined in conjunction with the Oregon State Highway Division through the development review process. D. Public transportation is available across Lower Boones Ferry Road from the site at the Tri-Met Park and Ride. E. The 6.6 acre site is an adequate size to accommodate a variety of uses permitted in the C-G zoning district. F. This site is highly visible from the adjoining streets, especially I-5. G. Compatibility of this site with adjacent uses is difficult to ascertain without an actual development proposal. However, the City of Tigard's Site Development Review and Conditional Use review processes are intended to provide an opportunity for review of a potential development's relationship with adjacent existing uses. Because the site abuts only industrial property and major streets, compatibility issues regarding future development would be anticipated to minimal except with regard to traffic concerns. In order to approve a quasi-judicial amendment to the Plan and zoning maps, the City must also find that there is evidence of a change in the neighborhood or community which affects the parcel. Alternatively, the City must find that there has been a mistake or inconsistency with regard to the original designation of the parcel (Comprehensive Plan, Volume 2, Policy 1.1.1, Implementation Strategy 2; Community Development Code Section 18.22.040(A)). The applicant's Narrative asserts that there has been a change in the character of the area surrounding the site because of the substantial amount of commercial development that has occurred within the City of Tualatin in the interchange area thereby making the land uses in the area predominantly commercial in character. Adopted policies in the Tualatin Comprehensive Plan encourage commercial development in the other three quadrants of this interchange. The City Council finds that the Tigard land use designation of Light Industrial is inconsistent with those of the City of Tualatin and that circumstances have changed due to amendments of land use designations in Tualatin to commercial and the subsequent development of these and other properties. We kept our commitments to Tigard citizens over the past five years and we believe it is vitally important to continue the current level of City services into the 901s. We urge you to vote yes on Measure 34-6. In May 1986, the citizens of Tigard strongly supported a tax base measure which allowed the City to provide high-quality, essential services. As part of that effort, the City Council promised to engage in a financial plan which would fund improved services for five fiscal years. That plan included additional police officers; restored and improved maintenance of park facilities; increased library hours; expanded book collection and children's reading programs; and allowed improvements in the quality and consistency of general City service. The five-year financial plan was implemented and throughout this period we have, through the prudent management of your tax dollars, attained all of the commitments made in 1986. The City of Tigard has grown significantly since 1986: • Population increased from 20,765 to 28,335, and • Over 3,300 new single and multifamily housing units have been built, along with over $140,000,000 in commercial C_. construction. Due to the Oregon property tax system, the City receives no new property tax revenues from new development, yet new development places demands upon City services. Measure 34-6, establishing an updated tax base for the City of Tigard, was placed on the ballot by unanimous vote of the City Council and the Budget Committee. This measure requests an increase in property tax funding of $860,000 and is estimated to increase the tax-base rate from $1.67 per thousand currently to $2.19 in 1991/92. Measure 34-6 will provide adequate funding to continue the service levels for police, library, and park-facility maintenance. In addition, approval of this measure will allow the City to maintain its commitment to the Tigard Senior Center and allow the City the resources necessary to strengthen control of growth and development. Please forward this message to the Council. If the recommendation is accepted, staff will select an architectural firm to develop an appropriate design. The new restroom could then be designed and constructed during the winter and early spring of 1991. This would make it possible for the facility to be available about the time Cook Park opens in the spring. The Parks Board's decision was based on the following: It would be difficult and expensive to remodel the existing facilities. Park levy funds would be better used to construct new restrooms. New restrooms are a better long term solution. Cook Park's image is important. New restrooms would contribute substantially towards enhancing the public's enjoyment of the park. New restrooms would enhance the cost-effectiveness of maintenance. It is important to have sanitary and maintainable facilities to accommodate the thousands of people who visit the park every year. The Parks Board discussed portable facilities as an option. However portable restrooms were determined to be inappropriate because of the high expense of maintenance, the potential for vandalism, and the poor image they would impart to the park. Also, it was mentioned that some people have an aversion to using them. The Board suggested that for very large events, sponsors be required to provide portable facilities. The Board directed staff to use the following criteria in the process of selecting a restroom design for their review: Cost: Staff was asked to get as much as possible for a price between $60,000 and $80,000. Durability and Maintenance: The facility should be a vandal proof and maintainable as possible. Concrete and steel materials were identified as being most appropriate to meet this criteria. Architectural 4uality: Even though durability was identified as being very important, the structure must also have aesthetic quality to be consistent with the other new improvements at Cook Park and to impart a positive image. The TIF Ordinance allows a city to administer the Ordinance within its boundaries upon adoption of a resolution assuring that the city will comply with the provisions of the ordinance. Passage of the attached resolution will allow the City to administer the TIF Ordinance in Tigard and to retain 100% of the TIF monies collected in Tigard. If no resolution is adopted, the TIF fees will be collected by the County and retained by the County. Administration by the City allows the TIF revenues to be used for improvement of certain City streets. If administration is by the County, the revenues would be used only on County roads within the City until all County road needs had been met. In addition, administration by the City will simplify the process for permit applicants. REQUESTED BY: Ed Murphy P ICY ZSSUE Should the City Council increase Tigard's Park System Development Charges to: a) $500 for a single family residence (including manufactured homes on individual lots of record), up from $250 per unit; b) $300 for a multi-family unit, up from $150 per unit, and; C) $250 per manufactured home park space, up from $125 per space. - - INFORMATION SUMMARY One of the City Council goals set in June of 1990 was to direct the Park Board to "research and recommend a system Development Charge to support park development and land acquisition." This goal was based on the Council's concern that the current system development charge (SDC) for parks is inadequate to meet the needs created by new development for park and recreation facilities. Preliminary research by the staff indicates that the current fee is indeed not nearly adequate to meet the demands on the parks system caused by increased growth. That same staff review indicates that the current Park SDC ordinance will not meet the requirements of a new state law (HB 3224), and will have to be modified by July 1, 1991. The proposal in front of the City Council is intended to be an interim measure to begin to generate additional revenue for park facilities immediately. It is proposed that the new charges be effective for the period from January 1, 1991 until a new ordinance is adopted, which will be not later than July 1, 1991. That new ordinance must comply with HB 3224, which means that it must: - Establish a specific methodology for collecting SDC's which considers the cost of existing facilities, prior contributions by existing users, rate making principals, etc. - Be based upon capital improvement plans or master plans that list improvements that would be eligible for SDC's. The work needed to comply with the SDC Act (HB3224) has already been initiated. Also, the City Council has already directed the Parks Board to develop a "Year 2000 Parka Action Plan". The new state law and the Parks Action Plan will both be taken into account as the staff develops a new Parks SDC ordinance for City Council consideration. In the meanwhile, the action in front of the City Council at this time would significantly increase the parks SDC charges and substantially increase the amount of revenue available for land acquisition and capital construction. However, it will still be far below what the need appears to be. Therefore, it is unlikely that further analysis or refinement over the next few months will reveal that the charges being proposed now should be reduced. The Parke Board reviewed this issue at their August 21, 1990 meeting and unanimously passed a motion that the Park SDC's be increased as described above. ALTERNATIVES CONSIDERED 1) Not to increase the Park SDC'e and wait until the work is done to comply with the state SDC Act to consider new fees. 2) Raise Park SDC's even higher to provide additional revenue. FISCAL IMPACT Raising the Park SDC's would substantially increase the amount of revenue available for park land acquisition and development. The actual amount will be dependent on development activity. Based on building permit projections, it is speculated that this action will generate $70,000 in additional revenue during the six-month period that it would be in effect. INFORMATION SUMMARY During the summer, staff received numerous complaints from citizens about parking along SW 72nd Avenue near the Tigard Cinemas, especially on weekends. The citizens complained that the parked vehicles were a safety hazard, as they caused a restriction in sight distance at the entrance to 72nd from the theater parking lot and at the intersections of Baylor Street and Duvall Street. In August, NPO #4 recommended that parking be prohibited along 72nd near the theater. The Police Chief also recommended parking restrictions in the area. TMC 10.32.025 allows the City Engineer to post parking restrictions on a temporary basis. Under this authority, parking was prohibited along both sides of SW 72nd Avenue between Duvall Street and the north boundary of the Cinemas property. The signs were installed on August 17, 1990. This action was taken due to the urgent need to resolve the safety problem created by the frequent parking. Currently, permanent ordinances cover only a portion of the area where signs have been posted. The attached ordinance would extend the permanent restrictions to include all of the area which is now posted for no parking. If a permanent ordinance is not adopted, the signs will need to be removed within six months. ALTERNATIVES CONSIDERED 1. Adopt the attached ordinance. 2. INFORMATION SUMMARY Traffic congestion has been a problem for some time on Nimbus Avenue near Scholls Ferry Road. The problem has been most severe at midday, with traffic from the drive-up window of the Burger King Restaurant often backing up into Nimbus Avenue. Parked vehicles of customers have also restricted traffic on both sides of Nimbus. The problem became especially severe this summer, with traffic frequently backing up into the Scholls Ferry intersection. This created both traffic delays and safety problems. To resolve the problem, parking was prohibited on both sides of Nimbus between Scholls Ferry Road and the entrance to the commercial center housing the Burger King. With parking prohibited, an exclusive turn lane was marked for the driveway. The separate turn lane allows through traffic to pass the waiting vehicles and reduces congestion. The parking restrictions were imposed under the authority of TMC 10.32.025, which allows the City Engineer to prohibit parking on a temporary basis. INFORMATION SUMMARY Some '.:ime ago, residents of SW 76th Avenue south of Bonita Road complained that pa::Y.:ng along SW 76th Avenue was creating traffic problems. Increased on- street parking by tenants of the adjoining apartments was the concern. Of particular concern was parking near the Bonita Road intersection. With vehicles parked on both sides of 76th, it was difficult for a vehicle to turn into 76th when another vehicle was waiting to pull out of 76th. To resolve this problem, parking was prohibited along the east side of 76th from Bonita Road to the first driveway. The "no parking" signs were installed under the temporary authority granted to the City Engineer by TMC 10.32.025. The attached ordinance would make the parking restrictions permanent. Otherwise, the "no parking" signs will need to be removed. Requests have been received to extend the parking prohibitions. Some property owners have recommended that parking be prohibited along the entire east side of 76th Avenue. Others have recommended that all parking be prohibited on 76th Avenue. At the same time, tenants of the adjoining apartments have complained that there is not adequate parking available. These older apartment complexes have only limited off-street parking. The City Engineer recommends against any additional parking restrictions on 76th due to the limited parking availability in the area. The concern is that additional parking restrictions on 76th will simply increase the number of parked vehicles on other nearby streets, such as Bonita and 74th, or possibly the unauthorized use of nearby private parking lots. The parking restrictions now in place appear to have resolved the most severe safety concerns. Routine removal of abandoned vehicles by the Police has also helped. Adoption of the attached ordinance will ratify the existing parking restrictions on 76th but will not extend the restrictions. ALTERNATIVES CONSIDERED 1. Adopt the attached ordinance. 2. Adopt additional parking restrictions. 3. Direct that the existing signs be removed. DATE SUBMITTED: ISSUE/AGENDA TITLE: Truck PREVIOUS ACTION: restrictions on Park Street Sch o St. and Canter ur Lane / PREPARED BY: City Engineer DEPT HEAD OK CITY ADMIN OK~ / REQUESTED BY: POLICY ISSUE i Shall through trucks be prohibited on Park Street, Schools Street, and Canterbury Lane. i INFORMATION SUMMARY j Park and School Streets Residents of the area have complained that large trucks from Pacific Highway are using the loop formed by Park Street, Grant Avenue, and Schc::.: as a turnaround route. These streets are mostly narrow residential streets, not suitable for large truck traffic. The street pavements are not designed to support frequent truck traffic. On several occasions, trucks have hit a power pole while trying to negotiate the tight corner at Grant and School Street. The residents have requested that truck restrictions be established. Canterbury Lane When truck restrictions were established on Durham Road, the Council also established restrictions on parallel streets such as Sattler and McDonald, to assure that the parallel residential streets did not become truck by-pass routes. Staff suggests that Canterbury Lane should be added to this list of restricted streets. Currently, a traffic signal is being installed at the intersection of Canterbury Lane and Pacific Highway. This signalization may make Canterbury look like a through street to motorists unfamiliar with the area, including a truck driver seeking an unrestricted route to Hall Boulevard. To prevent through trucks from entering the residential area, staff is recommending that Canterbury be added to the list of restricted streets. ALTERNATIVES CONSIDERED 1. Adopt the attached ordinance. 2. Reject that additional restrictions. FISCAL IMPACT Approximately $300 for signing. SUGGESTED ACTION Staff recommends adoption of the attached ordinance. dj/ss-ps&c.RW
