o Meeting was called to order at 6:30 p.m. by Council President Valerie
Johnson.
1. ROLL CALL: Present: Council President Valerie Johnson; Councilors
Carolyn Eadon, Joe Kasten, and John Schwartz. Staff Present: Patrick
Reilly, City Administrator; Gary Alfson, Transportation Engineer; Ron
Bunch, Senior Planner; Ron Goodpaster, Chief of Police; Ed Murphy,
Community Development Director; Tim Ramis, City Attorney; Catherine
Wheatley, City Recorder; and Randy Wooley, City Engineer.
2. STUDY SESSION
a. Community Development Director reviewed facts, figures and commonly
asked questions with city council. Major topics reviewed included:
o Description or area contained in the urban renewal district,
along with current assessed valuation and miscellaneous facts
and figures.
o Tax increment financing-what it is; how it works.
o Prior to any construction, should the Development Plan be
approved by the voters, the Master Plan will be in place.
o Public funding will be limited to the minimum necessary to
make the project work.
o The City is not financially at risk.
o Franchise fees, from new development (assuming Development
Plan is approved by the voters) will not be consider part of
the "tax increment." Said funds will go to the general fund.
b. City Engineer reviewed the construction schedule for Street Bond
Projects (see chart filed with meeting material).
C. Ted Kesey of the Oregon Department of Transportation reviewed two
options for improvement to Highway 99 from Pfaffle Street to
Commercial Street. The proposal is to widen the highway to 6 lanes
(3 lanes each direction) plus a turning lane.
Funding for the project would come from "Access Oregon" resources
with $5.5 million as the estimated construction costs. Right-of-way
acquisition would be funded through other sources.
The schedule for the project calls for environmental assessment,
public hearings, option selection, right-of-way acquisition, and,
finally, construction in FY 1995.

a. Bill Gross, 3019 S.W. Hampshire, Portland, Oregon, presented a
petition signed by Bill Gross, Cal Woolery, Dan Anderson DBA
Meadowbrook Development, Fred Moyer and Harry Schukart. The
petitioners request Council to consider calling up a Director's
Decision, Temporary Use Permit TUP 90-0002, for review or waive the
appeal fee of $235. The Director approved a request for temporary
use approval to allow spaces for parking of motor homes to house
workers for the construction of Our Redeemer Lutheran Church from
May 1, 1990 to October 31, 1990. The petitioners asserted that
staff's approval did not reflect the intent of the Community
Development Code's Chapter 18.140; Temporary Uses.
b. Cal Woolery, Morning Hill Homeowners Association Board of Directors,
stated that the homeowners association had filed a complaint with
the Staff alleging that the Director's Decision was a violation of
the C C and Rs. He requested that Council review this matter.
Community Development Director reviewed for Council the Director's
Decision approving the the use of RVs to house temporary workers
during the construction of the church. He stated that an
interpretation of the code had been requested by Nancy Robins. He
noted that the necessary criteria required, such as safety issues
and limited duration, were met. He reviewed a similar decision in
1985, which established a precedent for the same type of decision.
He suggested that an appeal to the Planning Commission could be made
and stated that the appeal period runs out at 3:30 on May 8th.
After discussion, Council consensus was for Mr. Woolery and
Mr. Gross to select one of two options:
1. Because NPO 7 had not been holding regular, quorum-
attended meetings, the petitioners could approach
another NPO to represent them on this issue. The Code
makes provision for granting of a fee waiver by Council
to an NPO.
2. Petitioners could submit their appeal with the required
fee for a Planning Commission review. Should the
Planning Commission overturn the Director's Decision,
Council would waive the fee.

Motion by Councilor Eadon, seconded by Councilor Kasten to approve the
Consent Agenda.

b. Declarations or chanllenges: Councilors Kasten and Eadon noted they
had had conversations with citizens concerning this matter. Both i
Councilors indicated that they felt they could be impartial in
considering the issue and would participate in the hearing process.

C. City Attorney stated that there is currently no procedure for
temporary street closures. He advised that Council direct staff to
develop an ordinance for temporary street closure, and that this
particular street closure be processed through the hearing process
established by the new ordinance.
g
City Engineer summarized the issue. He referred to a map showing
the subject area where the temporary street closure is being
proposed. The residents in the Anton Park area submitted a petition
in February requesting that the Council schedule a time to again
consider the closure of S. W. North Dakota Street. The petition k'
requests that the temporary street closure be in effect until t
Scholls Ferry Road is improved. He stated that the subject of
reducing traffic in Anton Park Subdivision was brought up a year
ago, with the decision to work on alternative procedures, resulting
in temporary traffic islands. The measurements of speed and traffic
volume indicated that the short islands did not have significant `
benefits.
He reported that the City of Beaverton plans to align 125th Avenue k
with 121st. The Scholls Ferry Road project is still in the '
completion of design and right-of--way acquisition stage and is
scheduled to go to bid in Autumn of 1990, with construction expected
to occur in 1991. He mentioned that a letter (provided in the

Council packet) from the fire district indicated concerns about the s
safety of a street closure which would impede access by emergency
vehicles.

d. Public Testimony
Proponents:
o Jean Rohlf, 12430 S.W. North Dakota, reviewed past efforts by
citizens in the Anton Park neighborhood to limit traffic
volume, which in 1988 was measured at 2750 vehicles per day
and which presently is measured at 3500 vehicles per day. She
stated that Council concerns in the past involved: 1) support i
by surrounding neighborhoods beyond Anton Park for the
temporary street closure; 2) emergency access; and 3) traffic
rerouting. She reported that neighborhood support for the
closure has grown. She referred to the Conprehensive Plan
which states that the minor collector is intended to receive f
local traffic and deliver it onto major collector streets.
She stated that S.W. North Dakota is not serving this
function, but is acting as a connector between an arterial and
a major collector resulting in a high percentage of cut
through traffic in the neighborhoods.

o Tan Hunt, 11105 S.W. 123rd Place, addressed the subject of
emergency vehicle access if the street is closed. He stated
that sidewalks and curbs, along with proper signage, could be
designed to alleviate this problem.
o Ward Coburn, 12280 S.W. North Dakota, and Marsha Smythe, 11185
S.W. 125th Place, presented a video tape and statistics x
demonstrating traffic volumes on S.W. North Dakota. Mr.
Coburn stated that the videos were taken during weekdays
between 5 PM and 7PM. Ms. Smythe reported statistics of
hourly volumes, stating that at peak times, 8 vehicles per
minute or one car every 7 seconds is not in keeping with the
neighborhood minor collector standards. She noted that 80% of the vehicles are speeding. She narrated as the video showed
the poor visibility when a driver approaches the blind curve,
and pointed out the dangerous situation where drivers coming
around the curve cannot see a car pulling out of the driveway.
o Jane Hunt, 11105 S.W. 123rd Place, expressed concern over loss
in property values which she said has occurred because of poor
planning.
o Dave Overstreet, 11665 N.W. Dakota, requested the temporary
closure be considered; and he advised that the impact of the F
closure could be studied to determine whether a permanent
closure would be feasible. He expressed concern that property
values are being adversely affected as a direct result of the
decline in liveability brought about by the increase in
traffic.

o Debbie Johnson 11100 S.W. Tony Court
spoke about her concern
for the safety of children crossing the street in the area.
The blind curve causes poor visibility for drivers and
pedestrians, and lack of sidewalks adds to the unsafe
situation.
o Tray Canaday, 12320 S.W. North Dakota, pointed out the high
volume of traffic which does not originate in the Tigard area.
o Tryg Waage, 11105 S.W. Tony Court, cited an instance where the
City of Beaverton closed a street without public hearing after
a pedestrian was killed in a traffic accident. He stated that
he would like to see S.W. Dakota Street closed before a
pedestrian accident occurs.
o Estes Snedecor, 11150 S.W. 123rd Place, represented group of
Anton Park neighbors. He recommended closing North Dakota
Street because the senior citizens who frequently cross the
street are not able to move as quickly as younger pedestrians.
o Lynn Williams, 12398 S.W. Millview Court, stated her concern
for the children playing and crossing the street to their
school bus.
o Mark Johnson, 11100 S.W. Tony Court, spoke about safety and
liveability of the Anton Park area. He recounted the various
meetings and discussions about the traffic problems on North
Dakota, and asked Council to take action in favor of the 200
plus citizens who are in favor of closing the street.
o Mary S. Lynn, 12360 S.W. S~mmiercrest, advised that the current
situation is dangerous for the children in the area due to the
high percentage of traffic exceeding the posted 25 mph.
Opponents:
o Bob Larsell, 12040 N.W. North Dakota, requested that Council
disregard the temporary closure arguments, stating that the
street was designed to be a through-street at the time the
subdivision was developed. He pointed out that the closure of
this street would set a precedent which would require Council
consideration for closure of other streets in the City. He
commented that the traffic levels currently fall well within
the minor collector designation. He brought up the need for
easy access for police and other emergency vehicles.

o Jerry Coursolle, 12215 S.W. Summer Street, agreed with the City
Attorney that it is important to establish a policy regarding
the closing of streets. He pointed out that there are traffic
problems in all areas of Tigard, noting that Anton Park is not
an exception. He suggested looking at some of the other
options which have not been tried in the Anton Park area. For
example, he mentioned stop signs, cross walks and other
traffic control measures.
o Paul Bloom, 12530 Glacier Lilly Circle, Tigard, presented a
petition signed by the residents of Summer Lake Development
opposing the closure of North Dakota. He expressed his
personal concern about the importance of access for emergency
vehicles. He also noted that the high rate of property sales
in the area indicates that the values are not being adversely
affected by the through-street traffic.
o Charles Bodford, 12045 S.W. North Dakota, said traffic
problems make it difficult at times to back out of his
driveway, but stated he is opposed to closing North Dakota.
o Richard L. Ross, 12055 S.W. Hillhouse Drive, opposes the
closing of North Dakota because he will lose 670 square feet
of his property to make a turn lane at the time 121st is
widened. He said that closing the street would not make the
traffic situation better.
o Marianne Bither, 11135 S.W. Tony Court, carmnented that she was
misquoted concerning information she attributed to Chief
Goodpaster.
e. coma pity Development Director advised that staff is opposed to
closure of North Dakota. He stated the inprovements planned on some
other streets will help the situation on North Dakota Street. He
explained Staff's reconmendation not to close North Dakota Street
due to concern over access by emergency vehicles; and he also
advised that closure would only shift the traffic to other
residential streets. He referred to the Comprehensive Plan which
designates North Dakota as a minor collector.
f. City Recorder read a letter from Valerie Pappas, 11375 S.W. North
Dakota, stating her desire to have North Dakota closed because of
traffic problems.
City Recorder read a letter from H. Fehrenbacher, 11685 S.W. North
Dakota Street, cited traffic danger to bikers and pollution from
vehicles as primary reasons he would like to see the street closed
temporarily until inprovements to Scholls Ferry Road are made.

g. Chief of Police recounted his participation in the study of traffic
safety and volume problems on North Dakota, noting that he believes
the neighborhood has a significant problem. The volume is of
concern, but the need for access by emergency vehicles is of greater
importance. Police response to either Summer lake or North Dakota
could be delayed because of the closed street. He reported that he
surveyed other police chiefs in the areas around Portland, and only
three out of twenty-three indicated that they would consider a road
closure as a means of solving this type of problem.
h. Councilor Schwartz questioned the traffic volume figures. City
Engineer advised that last fall the volume was measured at 3700 cars
per day. He indicated that a study was made to estimate traffic
volume assuming tie street were closed, stating that just under a
thousand cars a day might use that intersection.
i. Public Hearing closed.
j. Consideration by Council:
o Councilor Eadon asked City Engineer whether or not there were
other options to relieve traffic problems in the subject area.
k. Council President re-opened public hearing for discussion.
o City Engineer outlined several options including extending the
islands, stating that the short islands did not significantly
reduce speed. He discussed other ideas for using traffic
buttons and narrow lanes to reduce speeds.
Councilor Schwartz asked about the possibility of stop signs
in several key locations. City Engineer explained several
reasons why stop signs don't work for speed control, citing a
high number of violations and drivers who speed up in between
stop signs.
Council President asked City Engineer if there was a similar 4
type of major street along Scholls Ferry taking traffic from
Beaverton and emptying directly onto a street on the Tigard:
side of Schools Ferry. City Engineer advised that the
proposed Murray Road extension is intended to carry this
traffic, according to the master plan.

Councilor Eadon and City Engineer discussed the proposed
street, S. W. Anton Drive, which has not yet been constructed,
and considered Anton Drive as a possibility in the future to
intersect with S.W. 121st to offset traffic volume.

M. Consideration by Council:
o Councilor Eadon asked City Attorney to clarify the
Council's authority to amend the policy concerning
temporary closure of a street. City Attorney advised
drafting an ordinance and holding public hearings and
review of comprehensive Transportation Plan were all
within Council's authority.
Councilor Schwartz expressed concern that a decision to
close the street would inevitably invite other requests
fran neighborhoods who have similar traffic problems.
He reFcnmended developing a policy prior to making any
decisions to close the street.
o Councilor Kasten reviewed the safety issues brought up
by proponents and opponents. He also expressed concern
about re-routing traffic volume to other neighborhoods.
He suggested that Ash Street is a good example of a
permanent closure that isn't working. He referenced
testimony and stated that renters and home owners have
equal rights.
o Councilor Eadon advised she did not believe it would be
possible to close a street temporarily and re-open it
later. If closed, the street should remain closed and
alternatives selected. She also agreed that closing
North Dakota would automatically push traffic onto other
routes which are not designed to accommodate heavier
traffic. She recommended not permitting further
development in this area until good planning of traffic
routes has taken place. She stated her primary concern
was to get the Anton Park traffic speed problems under
control.
She further recommended developing a policy to address
better transportation planning within internal
subdivision streets. '

o Council President discussed the reasons she favored
temporarily closing S.W. North Dakota. She observed
that the intersection at Scholls Ferry and North Dakota f
is unique. She pointed out the ill-conceived traffic
pattern and said it represents poor planning. She
referred to the connection as a mistake. The street
will continue to take far more traffic than it was
designed for until the City of Beaverton establishes a
street that connects 121st to Sorrento. She expressed
concern about the safety issues.

uphold staff's recommendation; S.W. North Dakota should not be
temporarily closed.
The motion carried by a 3-1 vote; Councilor Johnson voted
"No."

A request to restrict parking during certain hours on additional portions
of Garrett Street.
a. City Engineer reviewed parking restrictions currently prohibiting
parking on Garrett Street near Pacific Highway from 7 a.m. to 6 p.m.
He stated that the petition (see Council packet) requests that the s.
parking restrictions be extended to other portions of Garrett
Street. He referred to a map of the subject area. He explained the
need for restriction due to new building construction of the Tigard
Medical Center which has displaced employee parking; and the t.
employees are now using Garrett Street to park their vehicles. He
rimed approval of the ordinance.
b. Council discussion followed. Councilor Schwartz asked city Engineer
if there were sidewalks along the portion of Garrett where parking
is to be restricted. City Engineer confirmed that no sidewalks
exist in the subject area.

C. Council President asked for comments from interested citizens.
o Laurie Jensen, 9995 S.W. Garrett Street, reported that the s
street is not receiving increased traffic volume. She stated
that there are alternatives which can be used by the medical
Center employees, but they are not using the alternative
spaces-
0 Discussion of code requirements for parking followed.
Community Development Director provided background of code and
stated that in 1983 the standard was changed to one space for
every 200 square feet; and the new building was evaluated
under the new code. The medical center has 101 spaces, which
should be adequate, but would not support the entire complex.
o Steve Jensen, 9995 S.W. Garrett Street, referred to a City
Council meeting several years ago during which the parking
problems around the medical center were discussed. He
expressed concern that putting the signs up in the subject
area would only result in people parking farther up the
street.

d. Council comments were made. Councilor Eadon, having previously
lived in the subject area, stated she has been familiar with the
Garrett Street parking problems for some time. She asked Community
Development Director whether street parking was considered as part
of the spaces required by code. Ccmmmity Development Director
stated that street parking does not count. Councilor Eadon
expressed concern over whether the original building met code for
parking spaces. She agreed that the parking will most likely move
farther up the street, once the parking restriction signs are
posted-
e. Motion by Councilor Kasten, seconded by Councilor Schwartz, calling
for the reading of the ordinance:

Discussion followed clarifying the area being considered.
The motion was approved by a unanimous vote of Council present.

AN ORDINANCE AMENDING T.M.C. 10.28.125, PROHIBITING PARKING DURING CERTAIN
HOURS ON A PORTION OF S.W. GARRETT STREET, AND DECLARING AN EMERGENCY.

WHEREAS, T.M.C. 10.28.125 prohibits parking between the hours of seven a.m. and r
six p.m. on portions of SW Garrett Street within 400 feet of Pacific Highway;
and,
WHEREAS, -the City Council has received a
petition from residents of the Garrett
Street area requesting that the parking restrictions be extended eastward along
Garrett Street to the intersection of Cresmer Drive: and,
WHEREAS, the city council heard a recommendation from the City Engineer that
parking be restricted on Garrett Street west of Creamer Drive in order to
improve traffic safety and traffic operations.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1. T.M.C. 10.28.125, designating the portions of public streets where
parking is prohibited during certain hours, is hereby amended by
adding the following:
"(4) Between the hours of seven a.m. and six p.m., except Saturday
and Sunday, within the right of way of S.W. Garrett Street between
Cresmer Drive and a point 400 feet southeasterly from Pacific
Highway, except along the southwest side of Garrett Street within
240 feet of Cresmer Drive.-
Section 2. An emergency is hereby declared to exist inasmuch as it is
necessary for the health and safety of the people of the City that
the parking restrictions of Section 1 be implemented as soon as
possible; therefore, this ordinance shall become effective
immediately upon passage by the Council, approval by the Mayor, and
posting by the City Recorder.

Following are some facts and figures that may be of help to you as you talk to
citizens about the proposed President's Parkway Development Plan.
AREA: The area included in the urban renewal district encompasses 186 gross
acres. About 121 acres are buildable. About 40 acres are vacant, including
about 13 acres in the flood plain.
ASSESSED VALUE: The true cash value on January 1, 1989 was $74,791,568. The
Plan states that the non-developed portion of the area has a current property
base of less than $5 million.
PERCENTAGE VALUE TO CITY AS A WHOLE: The value within the district equals
5.26% of the assessed value of the City as a whole.
PERCENTAGE VALUE COMPARED TO SCHOOL DISTRICT AS A WHOLE: The value within the
proposed district is 3.52% of the value of School District 23J as a whole.
EXISTING HOUSING: There are currently 84 single family houses, and 178 multi-
family units, within the proposed district.
EXPECTED INCREASE IN ASSESSED VALUE: It is projected that the assessed value
will increase to approximately $475,428,000 by 2001, an increase of about
$400,000,000.

SUBJECT: President's Parkway - Questions and Answers
We have received many questions regarding the President's Parkway Development
Plan from interested citizens. Following is a list of the twelve most often
asked questions, and what I feel is an appropriate response to each:
1. Why is it necessary to create an urban renewal district? Couldn't this
area be developed without it?
It was determined by the City Council that this area would not develop to
anywhere near its full potential using conventional zoning and financing
techniques. It would be very difficult to have private developers pay for
all of the necessary and desired public improvements in the area, including
Highway 217 improvements, Greenburg/217 interchange improvements, the
creation of a large public park, as well as the interior street and
utility improvements. In addition, the Council decided that the area
should be planned and developed in a comprehensive manner, rather than have
it developed in a piecemeal fashion.
So, in order to attract high quality private development, accomplish many
of the public objectives for the area, and make sure that the area is
developed under a detailed master plan, the Council created an Urban
Renewal District.
2. What happens after the election?
After the election, the more detailed planning process begins. Studies of
the traffic impacts, the development proposals and timelines, the wetlands
and flooding issues, the design guidelines and development standards and
many other aspects need to be analyzed, reviewed by citizens and elected
officials and finalized. In addition, negotiations with the developer(s)
and the school district, as well as other agencies, must take place. No
private development activity is to occur until the master planning process
is completed.
3. now will citizens be involved in the process after the election?
Citizen involvement in the planning process is absolutely essential to
ensure a finished product that will be sensitive to the surrounding
neighborhood, encourage the type of development that will be a showcase for
the City, and create the public amenities that are environmentally
C sensitive as well as being enjoyable for the general public.
Citizens may be involved in a variety of ways. In addition to the Planning
Commission and the President's Parkway Advisory Commission, citizens may be
involved through their Neighborhood Planning Organization or Community
Planning organization, or by serving on special task forces that w4,Li.
likely be established.
Further, any adoption of any of the components of the master plan, or any
change in the zone, will take place at public hearings. 4-
4. What are the boundaries - are the current Lincoln Center buildings included
ni
in the district?
The boundaries are generally Highway 217, Greenburg Road, Locust Street and
Hall Boulevard. The current Lincoln Center buildings are included in the
district.
5. Where will the new school be located?
The School District has not identified a site for the relocation of
Metzger Grade School. The School District has stated that it will be
located in another part of the Metzger attendance area.
If the School District decides for some reason not to move that school,
then the Master Plan for the President's Parkway development area will
- accommodate the school in its present location.
6. Who will pay for improvements?
The improvements will be paid for by a combination of funds. The Urban
Renewal Agency, using tax increment funds, will pay for a significant
proportion of the necessary public improvements. However, it is
anticipated that funds will be requested of other agencies (Federal, State
and County) to assist with a portion of the public improvements. In
addition, it is likely that private sector developer(s) will pay for a
portion of the public improvements.
7. How does Tax Increment Financing work?
Tax Increment Financing works as follows: Property taxes paid on any newly
created assessed value within the urban renewal area are used to pay for
improvements within that area for a period of time. Urban renewal agencies
are able to borrow money to pay for the public improvements, pledging the
future tax revenue to re-pay the debt. The lender takes the full risk on
the loan, not the property owners within the City. Since the lender takes
the full risk, they will not loan any funds to the Urban Renewal Agency
unless private development is certain to take place once the public
improvements are made.
At the end of the prescribed time period, the newly created assessed value
becomes available to all the normal taxing agencies, thereby allowing them
to reduce their individual tax rates at that time. The more assessed value
that is created, the greater the tax rate reduction at the end of the
! program.
8. Will my taxes go up?
The urban renewal district is not a taxing authority, and does not have the
authority to levy property taxes. How much your taxes are in any given
year is a function of two factors: 1. The authorized levies or tax bases
of each of the taxing agencies; 2. The assessed value of each of the taxing
agencies.
Under the assumption that the new assessed value created by the urban
renewal program would not have been there without the program, there is no
impact on the tax rate as a result of this program until the end of the
program, at which time the newly created value will become available to all
the taxing agencies, causing a reduction in the over-all tax rate.
9. Will property that is purchased in the area be given to Trammell Crow by
the City?
It is anticipated that Trammell-Crow (and perhaps other developers) will
purchase whatever land they need for private development themselves.
Should the Urban Renewal Agency be asked to acquire land for private
redevelopment by a developer, and the Agency is agreeable to that, then the
urban renewal plan will have to be formally amended in a public hearing,
and the plans for the acquisition and disposition of the property made
publically known.
10. If I own property in the urban Renewal District and am forced to sell,
will I be paid for commercial or residential value?
It is anticipated that private developers will acquire whatever land they
need through private negotiations with individual property owners. It is
also anticipated that the City would acquire whatever land it may need for
public purposes (such as streets and parkland) through negotiations with
individual property owners.
Should the City be unable to reach a settlement with a property owner
through negotiations, the City does have the authority to acquire property
through "Eminent Domain", in which case the City is required to pay the
fair market value for the property. "Fair market value" is determined at
the time of purchase, through an appraisal of the property. The appraiser
would review other similar recent sales in the area, and would determine
fair market value based on those sales, and probable use of the property.
If the probable use is commercial, and other recent properties have sold
for commercial values, the appraisal would reflect that.
11. W11.1 the zoning be changed if the Urban Renewal District is not formed?
The City has already changed the Comprehensive Plan designation to
"Commercial-Professional", except for those properties already designated
as General Commercial, Neighborhood Commercial or Medium Density
Residential. No rezoning of any of the properties within Urban Renewal
District (with a few minor exceptions) may take place until a master plan

is completed and adopted by the city Council. If the Urban Renewal
District is not formed, the city Council will hold a public hearing to
determine what the Comprehensive Plan Map and text pertaining to this area
should be. No rezoning of any of this property would take place until the
public hearing on the Comprehensive Plan took place.
12. When will the Urban Renewal District be terminated?
The President's Parkway Development Plan limits the authority to initiate
projects to sixteen years from the effective date of the plan. As soon as
the projects are completed, and the debts incurred to complete those
projects have been retired, then the District will come to an end.

Petitioners assert that staff's approval of TUP 90-OWZ does
not reflect the intent of the Community Development Code's

Shall S.W. North Dakota Street be closed temporarily at the north boundary of
Anton Park Subdivision?
INFORMATION SUMMARY
In February, residents of the Anton Park area submitted a petition requesting
that the Council schedule a time to again consider the closure of SW North
Dakota Street at the north boundary of Anton Park Subdivision. The petition
suggests that the temporary closure would continue until widening of Scholls
Ferry Road is completed. The widening of Scholls Ferry is scheduled to be
completed in 1991.
April 30 is the date set for a Council hearing on the requested street closure.
Notices of the hearing have been sent to petitioners and to others who have
indicated an interest in the proposal.
In recent weeks, the Council has received numerous letters both in support of
the street closure and in opposition to closure. The authors of these letters
have been notified of the hearing.
Attached is a brief history of North Dakota Street at Anton Park and previous
actions regarding traffic concerns in that neighborhood.
The City Attorney's office advises that legal procedure for a temporary closure
of a public street is not well defined. A temporary closure for an extended
period, as proposed,. could be considered to be a lanrl-use action. If the
street is to be closed, the attorneys suggest that ordinances be prepared to
clarify the process. Additional legal research may be required.
ALTERNATIVES CONSIDERED
1. Direct City Attorney to prepare ordinance necessary for street closure.
2. Deny the request for closure.
FISCAL IMPACT
There would be a small cost (approximately $500) for installation of barricades
and signing if the street is closed.
SUGGESTED ACTION
After extensive review and discussion of the issues, the City Engineer and the
Police Chief recommend that the street not be closed. This recommendation is
based on concern about emergency access to Anton Park and adjoining
neighborhoods, the attached letter from the Fire Marshall, concern that closure
would divert traffic to other residential collector streets (such as Walnut,
121st, and Springwood), and the fact that North Dakota Street is designated as
a collector street and constructed to collector street standards (i.e.,
designed to carry somewhat higher traffic volumes and traffic speeds than a
local residential street).

HISTORY OF SW NORTH DAKOTA STREET
AT ANTON PARK SUBDIVISION
In 1984 applications were approved for construction of the Meadowcreek
Apartments and for Anton Park Subdivision. On both projects, conditions of
approval required the construction of an extension of SW North Dakota Street to
connect to Scholls Ferry Road. Aerial photo records indicate that the road was
open to through traffic by March of 1986. In 1986 a traffic signal was
installed at the North Dakota/Scholls Ferry intersection under an agreement
between Tigard, Beaverton, and the State Highway Division.
In February, 1988, the City Engineer and Police Chief met with Anton Park
residents regarding traffic concerns. As a result of that meeting, directed
police patrols were implemented, additional signing was installed, a
Neighborhood Watch program was begun, and truck restrictions were adopted.
In April, 1988, the Council received a petition requesting that the street be
closed at the north boundary of Anton Park. After receiving a staff report
reviewing the history of the street and possible options, the Council requested
review by the Planning Commission, the Transportation Advisory Committee, and
NPO V. Upon receipt of the recommendations of these advisory groups, the t
Council held a hearing in February, 1989. Following the hearing, the Council
voted (4-1) to deny the request for street closure. The Council directed that !
other methods of reducing the volume and speed of traffic be tried.
Last spring, several meetings were held to explore methods that might be tried.
After considerable discussion, it appeared that some of the options (such as
additional signing) would not be effective. Other options (such as pavement
markings) were not acceptable to the residents. The only option that survived
as a possibility was the idea of installing traffic islands to better control
traffic and restrict the number of lanes available at the 121st Avenue
intersection.
In April the decision was made to install some traffic islands on a temporary
trial basis. The Anton Park residents felt strongly that the temporary islands
should not be formed with barrels, barricades or similar devices. Therefore,
the islands were constructed of extruded curbs on top of the existing asphalt
pavement. To reduce costs, the islands were restricted to a few trial areas.
All costs of installing the trial islands were paid by the City.
Based on traffic and speed counts made before and after installation of the
islands, the islands to not appear to have caused any significant changes in
the volume or speed of traffic on North Dakota Street. More extensive islands
might lead to greater reductions in traffic speeds but would be unlikely to
result in much change in traffic volumes.
The effectiveness of the islands and other traffic issues were discussed at a
neighborhood meeting in November 1989. Following that meeting, the residents
of Anton Park requested that the temporary islands remain in place.
Improvements on other streets may reduce traffic problems in Anton Park.
Completion of improvements to 121st Avenue in 1990 and to Scholls Ferry Road in
1991 are expected to reduce the amount of traffic using North Dakota Street.
The City of Beaverton continues to explore a proposal to realign 125th Avenue
to intersect Scholls Ferry Road at 121st Avenue, rather than its current
intersection at North Dakota Street.

Dear Chief Goodpaster:
In responding to your request which we appreciate very much regarding
closure of above captioned street, the fire department's position is that
streets not be closed to circulating and through traffic. Fire department
personnel and emergency vehicles respond from many locations, not just
from the fire station, as engine company and emergency medical crews have
other responsibilities when not on a emergency response call. It is
difficult at times to tell where the emergency equipment will be in order
to respond into a particular area. Placing barricades across streets or
closure of streets could increase emergency response times significantly.
When dealing with a medical emergency situation such as heart attacks,
this could be the balance between life and death for the patient.
In conclusion, this department highly recommends that through streets are
not closed to traffic.

I am writing this letter to you regarding a petition that is being circulated
by Mary Ann Bither requesting residences in the NW Tigard area to support a
street closure for the Anton Park portion of SW North Dakota St. Mrs. Bither
discussed this issue with me on Saturday April 14th and based on what she told
me, I believe she is misrepresenting the facts and misleading the residences
that she has talked to outside the Anton Park development.
The statements she made to me are as follows:
1. She claims that the newer portion of SW North Dakota St. was intended to
be a closed street and that it was not opened until after homes construction
was started. I had an opportunity to talk with Nancy Robbins, an active member
of NPO 7 and Liz Newton of the Planning Department and both of them relayed to
me that SW North Dakota was never a closed street nor was it ever intended as
such.
2. She claims that SW North Dakota St. as a "minor collector" street was only
intended to accommodate 2,000 vehicle trips per day. According to the City of
Tigard's Comprehensive Plan "minor collector" streets are designed to
accommodated 3,000 vehicle trips per day.
3. She also claims that the Police Chief was "supporting and encouraging the
residences of Anton Park to request a street closure." Again, I spoke with Liz
Newton this morning and she told me that the Police Chief was sympathetic to
their concerns, but was not supportive of closing SW North Dakota St. It is
very feasible for people to sign a petition regarding traffic if they are told
that the Police Chief is supporting the matter: especially if these residences
are relying on a person with some standing within the City's governmental
structure.
Obviously, the issue of closing SW North Dakota St. has become a heated
emotional issue, however, I find it intolerable that many residences have
become mislead based on Mary Ann Bither's attempts to falsify the facts. It Is
my recommendation to the City Council that this petition not be allowed as
permisable evidence during the public hearing because of Mary Ann Bither's
presentations to the residences outside Anton Park that signed this petition.

DIFFERENT THAN ANY OTHER NEIGHBORHOOD. THE NEED OF HAVING A
NETWORK OF ROUTES SO THAT ALL PEOPLE SHARE IN MOVING TRAFFIC
THROUGH THE CITY IS IMPORTANT TO THE LIVABILTY OF THE CITY
AS A WHOLE.
TO CLOSE NORTH DOKATA STREET WOULD CUT OFF SOME OF THE
NETWORK OF ROADS THAT HAVE BEEN PUT IN PLACE TO PROVIDE
ACCESS TO THE CITY CENTER. NORTH DOKATA CONECTS WITH TIGARD
STREET WHICH LEADS STRAIGHT TO THE CENTRAL BUSSINESS
DISTRICT.
TO CLOSE NORTH DOKATA WOULD CAUSE OTHER NEIGHBORHOODS TO
WANT TO DO THE SAME THING. THIS IS NOT GOOD FOR THE COMMON
GOOD OF THE CITY BECAUSE THE PLAN TO PROVIDE GOOD ACCESS FOR
ALL IS BASED ON A NETWORK OF THROUGH STREETS.
TO CLOSE NORTH DOKATA WOULD PUT A STRAIN UPON LOCAL ACCESS

This letter was intended to reach you before this, but we were
called out of town due to a family illness.
At several meetings regarding traffic on SW North Dakota Street,
it has been stated that no traffic accidents have been reported
where the police have been called. We wish to correct this
impression.
In 1987 a car was rear-ended across from our residence, 12240 SW
North Dakota and the police were called. It involved a drunk
driver.
There have been four mailbox units hit and knocked out of their
cement anchors. Incidentally, the mailperson on our route has
kept a list of speeders' license plate numbers in the course of
his deliveries. He expresses concern for the safety of children
whom he sees crossing the street.
There have been three accidents at Tony Court, all duly reported.
In November, 1988, a motorcyclist travelling at a high rate of
speed collided with a car. He suffered a broken leg and emerg-
ency/police vehicles responded as the enclosed pictures show.
This same cyclist could be identified by residents as having
caused concern over his frequent use of SW North Dakota at high
rates of speed, particularly as he negotiated the curve at Tony
Court. Needless to say, the noise of his cycle was very object-
ionable.
Unreported incidents such as thirty feet of skid marks in front
of our home when a child on a bicycle was narrowly missed by a
car, the near-misses involving children, and animals killed by
passing cars give rise to the concern that someday we will see a
fatality on this street.

We wanted to bring those incidents to your attention as part of
our continuing concern for the safety and livability of this and
surrounding neighborhoods. We join the many residents of Anton
Park and adjoining neighborhoods in asking for a temporary
closure of SW North Dakota south of Springwood Drive until such
time as planned improvements have been made to Scholls Ferry
Road.

Garrett Street?

INFORMATION SUMMARY
Currently, parking is prohibited on Garrett Street near Pacific Highway between
the hours of 7 a.m. and 6 p.m. The attached petition requests that the parking
restrictions be extended to other portions of Garrett Street.
Most of Garrett Street is a narrow two-lane residential street. When vehicles
are parked on both sides of the street, there is only one narrow lane available
for moving traffic. A hill crest west of Creamer Drive makes it difficult to
see oncoming traffic in the narrow lane. Prohibition of parking would improve
traffic operations and traffic safety.

In the area where new parking regulations are proposed, all of the residences
abutting Garrett Street are represented by signatures on the petition.
Recent weekday parking along Garrett Street appears to be mostly by employees
of the Tigard Medical Center. A Medical Center representative has indicated
that alternative off-street parking is available for the employees through
agreements between the Medical Center and other nearby property owners.

ALTERNATIVES CONSIDERED
1. Approve the attached ordinance prohibiting parking as requested in the
petition.
2. Amend the ordinance.
3. Allow parking to continue.
FISCAL IMPACT
$250 estimated cost for installation of signs.
SUGGESTED ACTION
Staff recommends approval of the attached ordinance.

We would like to request that the City of Tigard post NO PARKING between the
hours of 7:00 AM and 6:00 PM on Garrett Street from the existing NO PARKING
sign (from Pacific highway) east to Cresmer Street or to a location where
parked cars will not create a safety hazard (as determined by the City
Engineer) for pedestrians and two way traffic.
This request is being made because the Tigard Family Medical Center is
constructing a new building which has displaced their employee parking. These
employees are now using Garrett Street (a local residential street) to park
their cars. This makes it impossible for two-way traffic to use this portion
of Garrett Street and because of the grade it is difficult to see approaching
vehicles. Also, this has created a safety hazard for the large number of
pedestrians who walk this area including the children who are let off the bus
at Barnum Drive who walk this area to reach their homes.
It is also our understanding that even when construction is completed there
will not be enough parking spaces to accommodate all of their employees even
though they have met Code requirements for parking. WE FURTHER REQUEST THAT
PARKING REQUIREMENTS IN THE COMMUNITY DEVELOPMENT CODE BE REVIEWED TO PREVENT
THIS TYPE OF PROBLEM IN THE FUTURE.
