2. NON—AGENDA ITEMS '
a. Civic Center Remodeling
Councilor Eadon advised it would cost approximately $2,800 to
complete the bid plans which would incorporate the changes Council .
agreed to at their last meeting. She noted additional interior
design costs would be incurred and outlined several options for
Council consideration. After Council discussion, it was the
consensus that quotes be obtained for the interior design work.
Council consensus was that the $2,800.00 fee for the change in the

blueprints was acceptable.

3. EXECUTIVE SESSION: The Tigard City Council went into Executive
Session at 7:20 PM under the provisions of ORS 192.660 (1) (e), & (h)
to discuss real property transactions and current and pe riding
litigation issues.
A. JOINT WORKSHOP WITH THE TRANSPORTATION ADVISORY COMMITTEE. (Called to
order at 7:50 p.m.)
Present from the Transportation Advisory Committee were:

R. Joe Kasten, Ron Holland, and Dick Walker.
a. Workshop discussion was centered on the request from residents
participating in the 135th Local Improvement District (LID) that a
portion of the LID assessment be funded by the Transportation Safety
Bond Measure if approved at the November 8 election.
b. City Engineer reviewed the chronology of the SW 135th Avenue LID
formation.

City Engineer referred to several maps on display. One of the
maps illustrated where there were waivers of nun—remonstrance
throughout the City with relationship to the projects identified
in the bond measure.
City Engineer outlined several options the City could consider
for expanded LID participation. These options included the
following:
1. City would pay for the bridge only (current ordinance);
2. City would pay for all improvement costs (but not
right—of—way) — approximately $1,125,000;
3. City would pay a percentage of LID costs;
4. Capital Improvement Program (CIP) would pay a share of LID
costs.
City Engineer outlined existing CIP projects that would fit
within the scope of bond projects:
Greenburg/Tiedeman signal $ 30,000
Hall/McDonald signal $ 25,000
Greenburg/Tiedeman turn lane $ 15,000
Durham/Hall turn lane $ 15,000
Greenburg/Ash Creek Bridge widening $150,000
Greenburg/Center Street25 000
Total $260,000
Discussion followed on all of the options.
Ron Holland, Transportation Advisory Committee (TAC) member,
advised that the TAC reviewed several priorities when considering
the project list for the proposed bond measure. Items of concern
included safety, congestion, volume, and whether there was any
other funding available. Since there was funding available for
the 135th Avenue project, it had not been considered by the TAC.
He noted that the process in establishing the priority list of
projects had taken a year. Mr. Holland expressed concern that
the whole process may be jeopardized because of the problem which
surfaced with regard to the 135th Avenue LID funding.

Mayor noted a timing issue -- the 135th Avenue LID ma-.y well have
been a project which would have been considered as a high
priority on the TAC project list had the LID not already been
formed. Discussion followed on this issue.
Mayor recalled that this was the first time he had seen an LID in
a residential area. However, he also noted that the property
owners, in a majority of the area, had signed non--remonstrance
agreements for future street improvements.
Bob Tinsman, resident in the LID area, advised that when the
neighbors became aware of the the transportation bond issue, they
started to question the fairness of their participation in the
LID while also being asked to participate in a City—wide
transportation funding measure.
Council discussed the amount of participation that would be
appropriate for the City to consider. Councilor Schwartz
suggested that 50 percent of the assessment cost remain in the
LID with the remaining (approximately $560,000) be considered for
funding by the City. Councilor Schwartz noted he would want this
to be accomplished without jeopardizing any projects now
scheduled in the Transportation Safety Bond Measure.
Gary Hoffman, resident in the LID area, rioted that increased
through traffic would likely occur once the LID was completed
135th Avenue would become a main thoroughfare.
There was further discussion which included the question: Should
the City participate in the cost of the LID after it had been
formed? Unusual circumstances, including the fact that this was
a residential LID, were also discussed.
Council consensus was to ask the TAC and City staff- to review the
Transportation Safety Bond Measure project list to determine if
there was any way to reduce costs without changing the general
project descriptions. Council requested the TAC's
recommendations prior to the October 10, 1988 Council meeting.
Council requested Legal Counsel review any recommendations to
assure that the Bond Measure would not be jeopardized.

regarding the LID. I thought you'd want to take a look at the language in
advance of our October 10 meeting where we understand about 300-400 of these
petitions will be delivered. Staff will be prepared with basic data regarding
the LID (N participants, city participation, etc.)

135th Avenue to be included in the proposed general levy for
street and road improvements to be placed on the ballot this
fall_ Not to do so would be placing an unequal and unfair E
financial burden on selected residents within the S.W. 135th
Avenue L.I.D. We would not only bear, unassisted, approximately
$1,000.00 per home owner assessment, but would ALSO be required
to pay a pro rata share for comparable road improvements for the w
rest of the city if the levy passes. If it does not, then we are
still obligated for the L.I .D. assessment.

SUBJECT: New Developments Regarding the Road Bond
I've become aware that citizens in the 135th Street area are very unset and
angry about L-he fact that their road improvements are riot included in the
city—wide bond. Their feeling is that there are many similarities between
135th and the pr•ojecL-s listed For completion with passage of the Road Bond.
We as a committee never considered 135th because an LID in that area was
already well under• way by the time we began the process.
My concern is that we could lose the entire bond vote because of a petition
now being cir•culaL••ed if we cannoL come up with an equitable compromise. After
discussions with Mayor Toni Brian, Randy Wooley and Jill Monley, I feel that
the committee ought to consider reallocation of some monies in order to be
fair to these citizens. At this time it strikes me that Gr•eenbu;^g Road and,
if necessary, Main Str•oeL access, could be considered for this adjustment. In
doing so these two projects would riot totally lose because the current
downtown cir•ct.ilai:ion/tr•anspor•taLi.on study is presenting new information. I
feel that- side„lalks and curbs may riot be necessary on Greenbur•g, but the
importance of safe Ly at intersections would be preserved.
Randy Wooley will have a report for your consideration which will provide more
information on options to consider.
