Councilor Eadon asked for and received consensus from the remaining Council members on the following two statements in the Park Plan: "The main purpose of the Park Plan is to serve as a guide and provide recommendations that the City of Tigard can use in providing parks and recreational facilities for the next 10 years or until the year 2000." Community Development Director summarized. The Historic Overlay District (HD) section of Tigard's Community Development Code storical structures within the City provides protection for hi identified earlier when the City was involved with the Land Conservation and Development Commission's (LCDC) acknowledgment process. Included in properties identified as historically significant, required by LCDC prior to final acknowledgment, was the Tigard Farmhouse and Windmill. Despite opposition from property owners, the HD designation was placed on properties containing identified historic structures. However, the Planning Commission recommended and the City Council agreed that such a designation could be removed at the request of the property owner. Forrest Cowgill, owner of the Tigard Farmhouse and Windmill, had requested such a removal of the designation from his property . The property is disrepair. If Council approves this designation removal, staff will notify the County Museum so they can initiate a pictorial history if they choose. d. Public Testimony Proponent ' t o Forrest Cowgill, 11335 S.W. River Road, Hillsboro, { testified in favor of the removal of the Historic District designation as trustee to this property. He noted the windmill is in disrepair. O Richard Boberg, 10660 S.W. North Dakota, Tigard, OR 97223 Ct testified he is an abutting property owner on the s northwest corner. Mr. Boberg is not opposed to having the [ designation removed but is concerned about a change in density designation. Mayor noted there is no proposal to change the density at this time. ` e. Community Development Director recommended Council approval of the Zone Change allowing removal of the Historic Overlay District and adoption of an ordinance ratifying this decision. f. Public Hearing Opened b. There were no declarations or challenges. C. Senior Planner Newton summarized this agenda item. On January 14, 1987, the Tigard City Council adopted Resolution No. 87-10 reaffirming a December 29, 1986 request to the Portland Metropolitan Area Local Government Boundary Commission to annex the "South Metzger" area. On March 31, 1987, the residents of the ( South Metzger area voted to approve the annexation. Staff is recommending adoption of an Ordinance which will change the zoning designations from the Washington County designations to the equivalent City of Tigard designations. Senior Planner noted receipt of three letters: 1. Metzger Tax Service, 10125 S.W. Hall Boulevard, Portland, Oregon 97223, signed by Rebecca L. Stardig who asked that property she owns on the northwest corner of Hall and Locust be reconsidered for a C-G rather than C-N zoning. Senior Planner noted this property is not within the annexation area being discussed at this public hearing. However, she advised if the City should do any further annexations in Metzger, this letter will be retained on file. 2) Burger King Restaurant Management Northwest, Inc. , 1410 S.W. Jefferson Street, Portland, Oregon 97201. Letter was written by Joseph W. Angel, President expressing concern because City is proposing to zone the property Commercial Professional (C-P). Senior Planner advised C-P is the closest comparable zone to the County' s zone of O-C. In Washington County, restaurants such as the Burger King with drive-through facilities, are allowed in an Office-Commercial zone but not allowed in the City of Tigard comparable zone. Page 5 - COUNCIL MINUTES - MAY 18, 1987 Senior Planner advised City staff is comparing the County code against the City code to determine situations where non—conforming uses will be created. Senior Planner advised staff would like to zone Burger King to the closest comparable zone at this time (which is C—P), and then, within the next month or two, submit to Council an ordinance to bringing non—conforming uses into appropriate City zones. 3) Ken Rassmussen, (no address given) expressed concerns over the appropriateness of annexations in the Tigard area: whether or not properties on Lincoln Street should be C—G or C—P; whether the area bounded by Lincoln, Locust, Oak and 87th should be R-12 with R-25 adjacent to C••-P and whether each side of Hall Boulevard should be C—N, C—P, R-25 or R-12. Senior Planner advised these are zone changes which do not speak to the issue of the nearest comparable zone; therefore this is another letter staff should take under advisement to determine if the City of Tigard feels these suggestions are appropriate. There was discussion on the advisability of rezoning these properties now or waiting until all properties can be zoned in one action at a later time. Community Development Director advised staff would prefer to have properties rezoned at this time. Any applications which now come C in for Home Occupations, Site Development Reviews, Zone Changes, etc. , County zoning must be applied. Community Development Director noted there are subtle differences within the two sets of regulations. The proposed Ordinance represents staff' s attempt to bring the closest possible zoning into line now so that Staff is administering one plan and not two. After discussion, consensus of Council was for staff to provide a list in early to mid—June for the Consent Agenda which would identify properties in this area which are non—conforming uses due to the differences between the County and City zoning plans. Property owners would be noticed and given an opportunity to address Council and subsequent Ordinances submitted to Council for consideration at a Public Hearing which could be scheduled in July. Opponents o Mr. William Dunn, property manager for the Burger King Restaurant and the Pacific Terrace Shopping Center, testified he is against the zoning designations. In addition to the Burger King, there is another store front in the shopping center which had been previously used as a restaurant and is now for rent. Mr. Dunn was advised by the Mayor this zoning change would not be intended to preclude any uses presently in existence. o Mr. Steven Royce, 10905 S.W. 83rd Avenue, expressed concern in the differences in the Tigard Plan as opposed to those designated in the Metzger/Progress Community Plan. Page 6 — COUNCIL MINUTES — MAY 18, 1987 Mr. Royce lives near Area of Special Concern 15 and said the zoning change of R-9 to R-12 is too high. After discussion ' with Council and Staff, Senior Planner Newton advised she would meet with Washington County to determine if R-7 would be acceptable. o Edie Martinelli, 10905 S.W. 83rd, expressed concern in maintaining the transition zone between the single property dwellings and the more dense area. d. Community Development Director advised staff recommends adoption of the Zone Change Amendments as presented. A list will be forthcoming approximately the middle of June to set a public of hearing for certain adjustments where people have been "caught" in the non-conforming use situation. Also staff will report to Council on the results of a meeting to be held with the County concerning the former zone designation of R-9 being R-7 in Area of Special Concern 15. e. Councilor Schwartz expressed concern over property owners in the area being rezoned into the City and not knowing their City zone designation. He recommended a letter of understanding be sent to each property owner advising them of their zone designation. Community Development Director added that a breakdown of what uses are allowed in the City for each zone designation could be attached to this letter. f. Public Hearing Closed. g. ORDINANCE 87-22 AN ORDINANCE ADOPTING FINDINGS AND CONCLUSIONS TO APPROVE A ZONE CHANGE AND PLAN AMENDMENT (ZCA 20-86) (SOUTH METZGER) AND DECLARING AN EFFECTIVE DATE. h. Motion by Councilor Johnson, seconded by Councilor Eadon, to adopt Ordinance No. 87-22. Adopted by a unanimous vote of Council present. 7. DURHAM ROAD WEIGHT LIMIT a. City Engineer summarized this item as outlined in his Council Agenda Item Summary and memorandum of May 8, 1987. Currently through trucks over 20,000 pounds are prohibited from using Durham Road between Hall Boulevard and Pacific Highway between the hours of 3 p.m. and 9 a.m. On several occasions, Summerfield residents have requested that the truck prohibition be extended to all hours of the day. Council has indicated that the request would be considered after all of Durham Road was transferred to City jurisdiction. The transfer of road jurisdiction was completed April 14, 1987. City Engineer recommended that continuation of the existing 3 p.m. 9 a.m. truck restrictions until Durham Road is improved between Hall and Pacific Highway and to continue to pursue funding for safety improvements on Durham Road. Page 7 - COUNCIL MINUTES - MAY 18, 1987 b. Mayor called for public input: o Dave Atkinson, 10460 S.W. Century Oak Drive testified against truck traffic on Durham Road. He asked the Council to consider quality of life issues in the neighborhoods over commercial factors. There was discussion with Mr. Atkinson between Council and City Engineer concerning where this traffic will go if not allowed on Durham Road. Mr. Atkinson contended that compliance with present restrictions have not been complied with due to lack of enforcement. Mr. Atkinson warned the stage is set for an accident because of the surrounding commercial, residential and High School along Durham Road. Mr. Atkinson recommended a 24—hour ban against truck traffic for vehicles over 20,000 pounds. o Eunice Day, 15940 S.W. Oak Meadow Lane, agreed that trucks over 20,000 pounds should be prohibited. She said trucks larger than this are not compatible with the residential character of the neighborhood; the noise and disruption affects property values as well. o Jane Miller, 10209 S.W. Century Oak Drive, testified against truck traffic on Durham and noted the present restrictions have not been enforced by the City. He expressed an interest to work with the Council to resolve this problem. o Grant Perry, 10515 S.W. Century Oak Drive also testified against truck traffic on Durham Road. He noted the County assured residents that passage of a bond issue would solve many of these problems with construction of a bypass. Mr. Perry advised he would oppose all bond issues if this truck traffic is allowed on Durham Road. Mayor advised that staff is not proposing to lift the present restrictions or extend hours for truck traffic. o Edgar Taylor, 10110 Summerfield Drive, concurred with the arguments presented by the residents who testified. o Russ Ripley, 15665 S.W. Old Orchard Place, testified he believes the 20,000—pound weight limit is a good limit. This suggestion may be of interest to you as you form the special CIP committee. Al Dickman of the Wastewater crew observed that a .18 acre site on Steve Street exists as a common detention area for storm runoff. By placing the flow into a culvert, the land could become useful for a small tot lot. The Parks Crew estimates that $11,000 would be needed to install the culvert and rock and $4,200 would be needed for a full scale play area. For a capital outlay of $15.200, a small useable neighborhood park could be installed in an area with many small children. The City would also benefit from the elimination of a maintenance concern shared by the Wastewater and Street crews. Please let me know if this proposal is of interest to you or the CIP committee. Included in properties identified as historically significant, required by LCDC prior to final acknowledgment, was the Tigard Farmhouse and Windmill. Despite opposition from property owners, the HD designation was placed on properties containing identified historic structures. However, the Planning Commission recommended and the City Council agreed that such a designation could be removed at the request of the property owner. Background Information During the City of Tigard's Comprehensive Plan process, 8 sites were identified as having significant historical value to the City. Late in 1984, the City placed the Historic District overlay designation on 3 sites, the Durham Elementary School, the John F. Tigard House and the Windmill at 121st and Katherine. Letters were mailed to the owners of the five additional sites regarding the designation of the Historic Overlay District on their properties. At that time, the property owners of those sites indicated that they did not wish to have the historic overlay designation placed on their property. In October of 1984, the City of Tigard Planning Commission voted to recommend to the City Council that the Historic District Overlay designation be placed on property only with the property owner's consent. Further, the Planning Commission recommended that owners of property under consideration for the Historic District designation be encouraged to participate. On October 22, 1984, the City Council adopted Ordinance 84-62 which initiated an informal policy that the Council would place the Historic District designation on sites only with the support of the property owner. In addition, the City Council adopted Chapter 18.82 to apply to all sites within the City's Urban Growth Boundary which are designated as historic sites. Chapter 18.82 required sites designated as historic to be reviewed by the Hearings Officer prior to demolition or exterior alteration of historic sites. There were specific criteria set forth in Chapter 18.82 for approval of demolition or exterior alteration of a historic site. Tigard used information provided by the Washington County Museum which conducted inventories to identify historic sites throughout Washington and Windmill was identified in that County. The Tigard Street House inventory as a site of historic importance. On November 25, 1985, the City Council held a discussion regarding the Historic Overlay Designation. A presentation was made by Mr. Dick Matthews, Director of the Washington County Museum. In order to comply with LCDC requirements, consensus of the City Council at that meeting was to modify Chapter 18.82 of the Community Development Code dan as historic to designate with remaining sites identified in the Comprehensive the Historic District Overlay. The City of Tigard Planning Staff prepared an ordinance which modified roperty Chapter 18.82 to make therequirements less stringent for overlay. Both supported the notion that the designation would reduce the value of the property and the restoration of the Windmill would be costly. Such a designation would put the property owner in a position to assume the burden of financial hardship for maintaining and protecting the structure. The Zone Change was subseqently approved by the City Council. 3. Vicinity Information The subject property is zoned on all sides by R-12 zoning except to the south (across Tigard Avenue) which is zoned R-4.5 (Single Family Residentia,4.5 units per acre). Development in the immediate area is generally single family residences on both small and large lots. The Fanno Creek floodplain forms the eastern boundary of the site and is used as a pasture. Agency and NPO Comments No comments were received concerning this proposal. B. FINDINGS AND CONCLUSIONS The situation here presented regarding the expectations of the Historic District (HD) overlay are contradictory and uncertain. Clearly, the acknowledgment of LCDC specified the need to include the original o8der sito tes identified as having significant historic value to the City comply with Goal #5. This was achieved by Zone Ordinance Amendment ZOA 6-85 which applied the HD designation to the identified properties which include e the Tigard Street Farmhouse and Windmill. LCDC cited a then architectural Plan as stating that the City intended to preserve character of historic structures through the review standards of the HD overlay. Since the HD overlay was opposed by several of the affected property owners, the Planning Commission a recommended that request Bmoval of an HD and fees would beewaivedlforesuch be initiated at a property owner's removal. This provision seriously alters the original commitment an direction the City pursued in gaining LCDC acknowledgment. (4) The Historic Overlay District designation is causing the property owner to bear an unfair economic burden to maintain the property as a historic or cultural resource. 18.82.050 (c) If demolition of the historic resource is intended, a condition of approval shall be that insofar as feasible and as funds are available, the Washington County Museum shall obtain (1) a pictorial and graphic history of the resource, and (2) artifacts from the resource it deems worthy of preservation. Mr. Cowgill testified to the Planning Commission that the restoration of the windmill would be costly. The present condition of the structure is doubtless the result of neglect. Any restoration effort would require costly renovation and costs would accelerate if the windmill was restored to its original functional and operational use rather than simply applying cosmetic treatment. In this instance it is reasonable to assume that an unfair economic burden falls on the property owner to maintain this site as an historic resource. In an effort to preserve this structure options should be explored, particularly acquisition and relocation, and acted upon. Therefore, a minimum of three months should be allowed from the time of this approval to when the overlay on this site is actually removed. This will provide time to consider whether the windmill can be restored, if it can be relocated, where financing for the project will come from, and how to obtain a graphic history and secure artifacts were it to be demolished. C. RECOMMENDATION Based upon the above findings and conclusions, the Planning Staff recommends APPROVAL of ZC 87-03 to remove the Historic District (HD) overlay on this property. I do object to the random piecemeal zone classification. Is it so hard to simplify boundaries and draw straight lines thru streets and arterials than lot lines?? And as far as boundaries are concerned with adjacent cities/countys future street improvement cost's should be shared right down the center line. The recent annexations between the City of Beaverton and City of Tigard proved that common sense prevails (e.g. Hall Blvd and Scholl 's Ferry). Why not use prudent judgement with zoning classifications? Thus, it is my opinion that: 1. Every lot west of S. W. Lincoln St. and the east boundary should be C-G or C-P (The boundary should have been S. W. 92nd). 2. The area bounded by S. W. Lincoln St. , S. W. Locust St. , S. W. Oak St. , and S. W. 87th Avenue should be R-12 with R-25 adjacent to C-P. 3. INFORMATION SUMMARY Currently, through trucks over 20,000 pounds are prohibited from using Durham Road between Hall Boulevard and Pacific Highway between the hours of 3 p.m. and 9 a.m. On several occasions, Summerfield residents have requested that the truck prohibition be extended to all hours of the day. Council has indicated that the request would be considered after all of Durham Road was transferred to City jurisdiction. The transfer of road jurisdiction was completed on April 14, 1987. Attached is the City Engineer's report and recommendation. If the Council wishes to modify the existing truck restrictions, it would be appropriate to direct staff to prepare the necessary ordinance for consideration by the Council in June. ALTERNATIVES CONSIDERED 1. Extend truck restrictions as requested. 2. Maintain existing restrictions. 3. Repeal existing restrictions. FISCAL IMPACT Minor costs for sign revisions if the current restrictions are amended. SUGGESTED ACTION The City Engineer recommends alternative #2 as detailed below: a. Wooley, City Engineer SUBJECT: Truck Restrictions on Durham Road It has been requested that all through trucks be prohibited on Durham Road between Hall Boulevard and Pacific Highway in order to improve traffic safety and reduce noise along Durham Road. OBSERVATIONS: In reviewing the request, I have made the following observations: 1. Pacific Highway, Highway 217, and I-5 are the principal truck access routes to Tigard. 2. Tigard's Comprehensive Plan provides for substantial industrial development between I-5 and Fanno Creek. There is a need for access between the industrial area and Pacific Highway. 3. There is substantial commercial development along Pacific Highway both in Tigard and in King City. There is a need for truck access to the commercial developments from I-5. 4. The development abutting Durham Road is primarily residential and includes two schools. 5. Since the limited truck restrictions were posted on Durham Road, the City has received complaints of truck traffic on other streets in south Tigard, particularly in the McDonald Street area. 6. The State Highway Division has designated Durham Road as the route from I-5 to King City by installation of signing at the I-5 exit and along Durham Road. 7. If Durham Road and McDonald Street are closed to truck traffic, there will be no east-west truck access in the area south of downtown Tigard and north of Tualatin-Sherwood Road, a distance of approximately 3.6 miles. 8. Truck traffic is considered undesirable along Durham Road. An alternate route from I-5 to the King City/Willowbrook area is along Pacific Highway, where traffic congestion and 18 signalized intersections also create an undesirable route for trucks. But truck access is important to the economic vitality of our city. Memo to Mayor and City Council May 8, 1987 Page 2 9. The Southwest Corridor Study recommends a new highway connection between I-5 and Pacific Highway in the Tualatin-Sherwood area. The proposed highway would be expected to reduce the amount of through traffic on Pacific Highway and Durham Road in Tigard. If this new highway is approved, actual construction would likely not occur for several years. 10. The safety concerns on Durham Road could be greatly reduced by adding turn lanes, curbs, and sidewalks. Truck noise could be reduced by improving the vertical alignment to reduce the steep grades in the western portions of Durham Road. West of 113th Avenue, such improvements are proposed for this summer in conjunction with the Albertson's development. The Council, staff, and the Transportation Advisory Committee will all be working this next year to try to identify funding for improvement of the remainder of Durham Road. 11. Durham Road is designated as a major collector street. Development along Durham Road has been planned with no direct driveway access to Durham Road, adequate right-of-way has been dedicated to accommodate the needed turn lanes, a pedestrian path is available, and Durham Road appears to have an adequate pavement section for truck traffic. Such is not the case on other Tigard streets where trucks are prohibited nor on any other east-west connector in south Tigard. 12. The existing limited truck restriction was a decision made by the County in 1984. It is a compromise between the needs of the trucking industry and the concerns of the Summerfield residents. Compliance with the posted restrictions is reported to be generally satisfactory. CONCLUSIONS I conclude that an east-west truck access between I-5 and Pacific Highway is needed in south Tigard as a part of our transportation plan. Durham Road is the best available route for this east-west connection. Improvements are needed on Durham Road to enhance safety. The new roadway proposed by the Southwest Corridor Study would reduce through traffic on Durham Road but would not eliminate the need for Durham Road as an east-west connection. RECOMMENDATIONS I recommend that the existing truck restrictions on Durham Road be retained until the street can be improved to major collector standards. I recommend that we continue to diligently pursue funding for safety improvements on Durham Road. And I recommend that the City continue to support implementation of the Southwest Corridor Study recommendations in order to reduce the impacts of through traffic in the south Tigard area. i RRW:sb/1435W i MEMORANDUM �. I concur in Mr. Wooley Is observations and conclusions and will not rehash his memo. I do wish to specifically address the issue of re-routing truck traffic onto Pacific Highway. Every truck re-routed is subject to the signalization on Pacific Highway and the route is significantly longer. From a traffic safety stand point the increased truck traffic dealing with increased signalization and a longer route will most certainly result in an increase in accidents. Secondly, if weight limitations are put on Durham Road, there will be a need for increased enforcement as drivers try to circumvent the route they would be forced to take. Therefore, the Police Department staff does not support the proposal to put additional weight limits on Durham Road. Wooley, City Engineer 60 SUBJECT: Proposed 135th Avenue LID Following discussions on May 11th, the Council decided to pursue two LID options further. Here is some additional information on those options. COST ESTIMATES Both options assume that streets will be constructed to City collector street standards with storm drainage, street lighting and undergrounding of utilities. Sidewalks will be built on only one side of the street. During final design, Council would decide whether to raise the road grade at Summer Creek to keep the roadway above the 100-year flood. Any additional costs associated with raising the road (e.g. , bridge costs) would be paid from SDC funds and not charged to the LID. Any intersection improvement costs at Scholls Ferry Road would also be paid from SDC funds or ODOT/County funds. Option No. 1 would provide for the improvement of 135th Avenue and construction of the Murray Boulevard extension as originally proposed in March. Option No. 3 would provide for improvement of 135th Avenue north of the Krueger property. The remainder of the project would be built by developers as development occurs. In this option, the LID boundary would be redefined to delete the undeveloped Krueger and BenjFran properties and to add the north portion of Cotswald #3 subdivision to the 135th LID. Honorary Friends of the Library memberships have been sent to all volunteers. The Friends are discussing fund raising projects for book purchases.. Computer Policy: George Anne Miller, Assistant Librarian, reviewed the proposed policy for the public use of the Library's personal computers. Some minor revisions were made, with the overall philosophy being to keep the policy as unrestrictive as possible for the user and non-burdensome for the staff. The policy will be submitted to the City Administrator. Budget, FY 1987-88: Librarian reviewed the requested budget ($456,935 and 14 FTE) and the proposed budget ($370,0000 and 12 FTE), explaining that only the proposed budget, which fits into the 5-Year Plan, will be considered by the Budget Committee. The Board unanimously expressed concern that the book budget does not answer community needs throughout the 5-Year Plan. Goals/Work Plan: De Bernardis led the discussion regarding goals for the Library Board. In reflecting on the budget discussion the Board decided by consensus that increasing the book budget, by whatever means, was the overriding concern. They discussed working w;Lth_the Friends .of the Library and building support from established community groups. In conjunction with the approval, the Council requested that staff investigate the following: 1. Whether or not the subject easement for gist Avenue should be relocated or realigned. 2. Determine whether or not any parcels of land are currently dependant on gist Avenue for access. 3. Whether or not the Covenants, Conditions and Restrictions for Bond Park No. 3 can be applied to the additional area in question (Council consensus was a desire to prohibit possible future development of "flag lots" in the area in question) . The attached assessor's map indicates that there are no parcels which are dependant upon the SW gist Avenue easement for access. Since the City has no legal interest in the easement, it can be relinguished if all benefiting property owners agree. A document should be signed by all affected parties and recorded. Staff recommends that the easement simply be removed and not relocated. A proper access (public street or private drive) can be provided at the time Tax Lot 200 is developed. Article II of the "Declaration of Covenants, Conditions, and Restrictions for Bond Park No. 3" allows for the annexation of additional property (section attached). In the settlement, the bonding company paid the City $40,000 and the City assumed responsibility for completing the improvements. We are now preparing documents to advertise for bids for the required work.
