STUDY SESSION E a. Citye-A-dim—inistrator distributed revised consideration schedule for thelmeeting and walked through the agenda issues with Council. (Councilor Johnson arrived — 6:52 p.m. ) i b. Sign Code Workplan — After brief discussion, consensus of Council � was to discuss the Workplan at the May 18, 1987 Council meeting. Councilor Johnson advised the Chamber of Commerce would like to be involved in the Sign Code implementation. C. 135th Avenue LID — City Engineer distributed a memorandum from the City Attorney regarding assessments for the right—of—way = acquisition. City Engineer also advised Council there was a problem with the notice which was mailed with about 33 out of 200 not being mailed. He advised Council that staff hand delivered the notices to those 33 property owners on this date. Recessed: 7:04 p.m. Reconvened: 7:08 p.m. 3. CALL TO STAFF FOR NON—AGENDA ITEMS a. City Administrator recommended Council table Item 6.2 for further discussion at the May 18, 1987 Council meeting. 4. VISITOR'S AGENDA a. Phil Pasteris, NPO #6 Chairman, discussed the street lighting needs of the Pinebrook neighborhood. He noted an increase in crime in the area within the last few months. Mr. Pasteris suggested since Pinebrook was classified as a minor collector, it would be most appropriate to have street lights installed. City Administrator reported the Police Department has been giving heavier patrol to the area. (Chief of Police arrived 7:10 p.m. ) Page 1 — COUNCIL MINUTES — MAY 11, 1987 I Councilor Johnson requested staff research the history of the f area to determine whether or not street lights were promised in the past to the neighborhood and this item be set for future discussion. Councilor Edwards suggested other areas could be similar within the City limits and expressed concerned with setting a precedent. Mayor Brian noted it is not the City's intent to install street lights throughout the South Metzger annexation as reported in the past. The .City is now looking to set up criteria and standards for a priority list for street lights. He directed staff to research any promises made to the Pinebrook area in the past and to report to Council. b. Frances B. Tousey, 14660 S.W. 89th Avenue, presented a petition of residents requesting street lights be installed in the Pinebrook neighborhood. City Administrator stated he would send a letter to all of the citizens who signed the petition advising them staff is researching the issue. He will report back to City Council regarding the particulars on the Pinebrook issue and also discuss a future date of the Street Lighting Policy for Council Review. 5. NON—AGENDA ITEMS — None were discussed. 6. CONSENT AGENDA 6.1 Receive and File a. Block Grant Needs Statement — South Metzger Area b. Council Meeting Calendar Update 6.2 Approve Sign Code Workplan Motion by Councilor Johnson, seconded by Councilor Johnson, to approve with Item 6.2 being tabled to May 18, 1987. Approved by unanimous vote of Council present. t Recessed: 7:26 p.m. Reconvened: 7:31 p.m. 7. 135th/MURRAY ROAD LID DISCUSSION a. Mayor Brian noted the history of this issue, stating it was originally heard in March 1987. At that time, there was concern expressed by citizens that the suggested design for the road improvements was inappropriate for the area. He advised this meeting was for open discussion. Presentation of information from the City Engineer and a formal hearing would be held June 8. b. City Engineer apologized for approximately 33 late notices which ( were hand carried on this date, noting the computer mailing list inadvertently ommitted 33 names. Page 2 — COUNCIL MINUTES — MAY 11, 1987 f City Engineer outlined the history of the issue and defined terminology which had may have been misunderstood in the past. i He also highlighted the differences for Council and citizens between minor collector, local and rural street standards. 1 City Engineer outlined assessment method alternatives for right—of—way purchases as highlighted in the attorney's f, memorandum dated April 3, 1987. i City Engineer noted there had been a suggestion that System Development Charge (SDC) monies be spent to offset the cost of a 'c portion of the LID improvements. He reported through April 3, 1987, the following monies had been received by the City from within the LID boundaries since the inception of the SDC fees. Street Systems SDC's $147,100 Storm Drainage SDC's 47,750 Parks SDC's 40,400 Total of All SDC's $235,250 City Engineer distributed a proposal for various alternatives and estimated costs for those improvements. He noted all costs were estimates and actual costs charged through the Bancrofting assessment method would be based on the actual cost occurring at the time of development. City Engineer highlighted each of the options noting the project cost estimates, the typical assessment for those alternatives, and the percentage of assessment as compared to the March 1987 proposal. (See attached proposed street LID cost spreadsheet — Exhibit A). C. Lengthy discussion followed between staff, Council and citizens. Some issues discussed in detail were the requirements for a bridge versus a conduit system in the 100 year floodplain area; the options of joining Murray and 135th in the LID versus improving 135th Avenue only at this time; and the type of improvements the City Engineer could support. City Engineer noted he could not favor Alternative No. 5 which would develop 135th Avenue to Interim Rural Roadway Designation. d. Public Comment o Dave Klingle, 12900 S.W. 132nd Avenue, Tigard, Oregon 97223, expressed concern regarding the connection of 135th Avenue with Murray. He noted the extension of Walnut over Bull Mountain Road needed to be resolved since as soon as the connection was made, traffic would impact the area. a f ( Page 3 — COUNCIL MINUTES — MAY 11, 1987 i City Engineer reported the Murray to Walnut Street extension is defined in a written agreement. City staff is working with Washington County now to address the diversion of some of that traffic over to Bull Mountain Road. o Russ Krueger, 1335 S.W. 66th Avenue, Portland, Oregon 97225, stated he was opposed to including Murray Boulevard in the LID. He said with the development of his large parcel on the proposed Murray Extension, he could contract that work at a lesser rate than what the City could develop the property for. o Mike Kruse, 12220 S.W. Morning Hill, Tigard, Oregon 97223, stated he was in favor of the development. He understood that no matter which option was selected, it would cost an average of about $1,000 per homeowner. He noted he could not support Options No. 4 or 5, but could support Options No. 1, 2b or 3a. o Joan Johansson, 13535 S.W. Walnut Street, stated she was not { in the LID at this time, but addressed concerns regarding the widening which would need to be accomplished along 135th Avenue with the existing close setbacks. Since she resides at the corner of Walnut and 135th Avenue, she did question the intersection treatment at that location. o Roger Anderson, 10120 S.W. Kable Street, Tigard, Oregon, stated he was not in the LID area, but had been involved with the project off and on, even when it was being considered by Washington County. He noted he favored Options No. 4 or 5. o Charles Halverson, 10525 S.W. Clydesdale Place, Tigard, Oregon 97223, suggested an Option No. 6 be added which would delay the project. He felt until Beaverton built Murray Road, the cost of this improvement would not be needed. He also addressed concerns regarding the intersections of Walnut at 121st and Walnut at Tiedeman and Fonner which are presently unable to handle the existing traffic. He noted the additional heavy impact from the Murray Extension would make Walnut Street extremely hazardous. o Dan Dugan, 11035 S.W. 135th Avenue, Tigard, Oregon 97223, stated he was concerned for property owners in the area who owned small acreage parcels which were too small to sell to 1 developers, yet, so large that the assessment on the property was prohibitive. He noted he owned 1.36 acres and his assessment, under the original Alternative No. 1 proposal, was $18,000. He requested some relief for the smaller acreage parcels in the area. i e. Mayor Brian requested discussion from Council regarding options they would consider. C Page 4 — COUNCIL MINUTES — MAY 11, 1987 o Councilor Johnson requested both sidewalks, street lights, and undergrounding of utilities be deleted. She expressed interest in acquiring 60 feet of right-of-way, even with Option 4 or 5, noting that she leaned towards Option 4 with a 60-foot right-of-way and the City paying for the bridge improvements. o Councilor Schwartz requested only one sidewalk be deleted. He supported street lights and favored Option 1 with Murray Road due to the cost effectiveness of doing both projects at the same time. He suggested the City look at a culvert system rather than bridge in the 100-year floodplain area. He requested deleting undergrounding of utilities and suggested SDC charges be used to offset the City's participation in the cost of the bridge or culvert. o Councilor Edwards noted support of Options No. 2, 3 or 4. He stated he could not support Option No. 5. He advised 60 feet of right-of-way did not seem necessary; 50 feet is sufficient. He noted street lights would need to be installed for him to support any project. Undergrounding of utilities was not an issue to him. He felt a bike path was necessary, but perhaps not a sidewalk. However, he did note preference for at least one sidewalk to remain in the project. Regarding the bridge versus culvert issue, Councilor Edwards said whichever could be done for the least amount of money would be the option he could support. o Mayor Brian suggested the following would meet with Council concerns which had been expressed: Option 4a with one sidewalk, street lights, undergrounding of utilities plus 2g. He advised that alternative would be basically 4a minus 2d (deletion of one sidewalk) and 2g (addition of Cotswald No. 3). He noted at final engineering, Council would need to look at the bridge versus culvert option and go with the less cost { still leaving the road free from flooding. Lengthy discussion followed. f. Council consensus was to consider Option No. 3, with 60 feet of right-of-way, one sidewalk, undergrounding of utilities and a portion of Cotswald No. 3 Subdivision being included in the assessment area, noting the three lots south of Morning Hill Drive as the most southerly point of the inclusion area of Cotswald No. 3. Street light inclusion in the LID was recommended by a 3-1 vote of the Council; Councilor Johnson voting nay. r 't Page 5 - COUNCIL MINUTES - MAY 11, 1987 (Jill Monley arrived: 10:05 p.m.) t, g. Council consensus was to hear Alternative 1 at the June 8 public hearing which was already scheduled and recommended a mailing be delivered to the LID area, noting Option 3 as outlined by Council and Option 1 with the total project cost and the typical estimated assessment. City Administrator suggested if Alternative 1 was not approved at the June 8 meeting Council could adopt a resolution of intent to consider Option 3 which would tentatively be scheduled for July 13. h. Councilor Edwards stated he could not support the inclusion of Murray Road after the overwhelming support of excluding that from the LID area at the March 1987 Council hearing. i. Mayor Brian noted assessment methods and right—of—way treatment could be addressed at a future meeting by Council. j . Monahan, Director, 'f + Community Development SUBJECT: Don Jenkins, 10675 SW Hall Blvd. A resident of the newly annexed South Metzger area, Don Jenkins, visited with the Planning Division Friday, May 8, 1987. He has an issue which he may bring to the Council tonight. He has operated an auto sales business from his home in an R-9 zone for the past three years. To continue operating under DMV regulations, he needs a sign-off by the City that the use is allowed. Tigard's zoning, and I believe the County's as well, does not allow this type of use without strict conditions and a home occupation permit. With no proof of a hoiae occupation permit issued by the County, I have instructed my staff that businesses such as this have no legal basis. Following are the facts related to Mr. Jenkin's concern: o His land is zoned R-9, we would make the zoning R-12. o He has no County permits. o His earlier DMV business license was signed by the County, by a representative of the Sheriff's office. We do not know whether land use concerns were raised at the time. c The business has operated for over three years. c He has 6 - 8 cars on his property, all are in his name, three are used by the family. My recommendation is that he apply for a home occupation permit under our code provisions. Any permit will not, however, allow him to store the vehicles at his property or have customers visit the site. Our code would allow him to base his business in his home only if he located the autos on a property in a commercial zone. The hearing was continued to June 8th and a workshop meeting was scheduled for May 11th. At the May 11th meeting, staff and the consultant will be prepared to present information on alternatives as directed by the Council. Due to the short time schedule, no written report has been prepared. We expect to make an oral presentation supplemented with wall displays and handouts as appropriate. Attached is a copy of the meeting notice which has been mailed to property owners. ALTERNATIVES CONSIDERED Attached memo of April 20th describes the alternatives being reviewed. With this information, we should also be prepared to discuss various combinations of alternatives, if desired. l FISCAL IMPACT I { {i SUGGESTED ACTION This is a workshop discussion. Formal action is not required. However, if there is a consensus on a revised LID proposal, Council may wish to direct staff to prepare a new resolution of intent and to prepare to send new hearing notices. Hall Boulevard In March, the City Council held a public hearing to consider formation of a local improvement district (LID) for construction of improvements to SW 135th Avenue and a portion of the proposed Murray Boulevard extension. Following receipt of public testimony, the Council voted to continue the hearing until June to allow time for discussion of additional alternatives. The meeting on May 11th will be a workshop meeting of the Council. It is not a formal hearing. Instead, it will be an opportunity to discuss alternative LID options. It will be a public meeting. Owners of property within the proposed LID are encouraged to attend and participate in the workshop meeting. This notice is being mailed to the property owners who received notice of the March hearing. If you know of new property owners in your neighborhood, please share this information with them. INFORMATION SUMMARY The City's Community Development Block Grant needs inventory for the 1988-90 funding cycle was submitted to the county Community Development Office in mid—February 1987. The inventory included facility needs identified by three nonprofit service organizations. As indicated in the attached memo from H. J. Manch of the Office of Community Development, two CDB6 need statements were submitted to the county by CPO 4 in Metzger. Both needs assessment questionnaires identify needs that occur within the portion of Metzger recently annexed to Tigard. The two identified needs include Ash Creek drainage improvements near 87th and Hall and sidewalk construction in the vicinity of Metzger School. Because of the change in jurisdiction, the county advises that these statements will need to be re—submitted through the City. By including the two statements as part of its needs inventory, the City is ` merely acknowledging that these needs have been identified within its area. At the later stage of proposal development, to occur during the period July — Nov. 1987, the City will have the opportunity to review and comment on proposals that address needs that are geographically located within its area. FISCAL IMPACT Grant funds for sidewalk improvements costing approximately $160,000 and stream improvements costing approximately $148,000 are requested. No City contributions would be required. As alluded to above, this statement identifies a single portion of a system wide drainage problOn. According to the Ash Creek Drainage Master Plan, the replacement of the Hall Blvd. culvert is one of eleven culvert and bridge improvement and eight related projects that are needed for storm drainage management. In view of this, it is important to mention that treating this improvement as a separate project is consistent with the implementation schedule set forth in the master plan. More specifically, replacement of the Hall culvert is the second of the nineteen capital projects included in the plan's proposed schedule. The first project was completed by the county this year. Thus, the proposed improvement follows an over-all plan, and it j is clear that improving the hydrolics at this site would not create the possibility of making problems worse in other areas. r !
