The Tigard City Council received testimony on December 29, 1986 from
interested parties regarding the South Metzger Annexation Proposal. One
issue frequently addressed was that receipt of the hearing notice was
delayed through the heavy holiday sail. In order to ensure that all

Tigard City Council has called this Council hearing.
A request by the City of Tigard to forward an annexation proposal to the
Portland Metropolitan Area Local Government Boundary Commission. The area
to be annexed will be designated as an established area in conformance
with Chapter 18.138 of the Tigard Municipal Code. The Metzger-Progreas
Community Pian zoning and comprehensive plan designations as adopted by
the Washington County Board of Commissioners (Ordinance Nos. 278, 279, and
280, and subsequent amendments thereto) will be applied. The City will
assign City of Tigard planning and zoning designations in conformance with
the Tigard Municipal Code and Oregon Revised Statute requirements. The
property is located on the east side of Highway 217, i south of Hall

b. Councilor Eadon declared a conflict of interest on this agenda item
and, therefore, did not participate in Council discussion nor vote on
the issue.
C. Community Development Director summarized request history. He noted
that the item was for reaffirmation by Council on their intent to
forward to the Boundary Commission a zone change annexation of the
Albertson's property at the corner of Durham Road and Pacific
Highway. He advised that the annexation issue was the only issue to
be considered. The zoning had been dealt with by Council through a
Comprehensive Plan Amendment. He stated the NPOs' are studying the
issue of upzoning other property in the community to offset the
zoning displacement of residential units that occurred from the
Comprehensive Plan Amendment. There have been no changes to the
annexation proposal as presented at the December 29, 1986 Public
Hearing.

The Community Development Director further indicated that the request
was brought back before Council due to concerns raised regarding the
heavy holiday mail slowing down the receipt of hearing notice in
December.
d. Public Testimony
Proponents
o John Shonkwiler, 5750 S. W. Carman Drive, Lake Oswego, represented
Albertson's. He requested, on behalf of the interests of
Albertson's'and all of the individual lots within the annexation
area, that the City grant the proposal. Mr. Shonkwiler noted the
Annexation was within the urban growth boundary and the Comprehensive
Plan called for the area to be annexed. He concluded by noting
annexation would aid Tigard in obtaining more control of Durham Road.
Opponents
o Dave Atkinson, 10460 S.W. Century Oak Drive, Tigard, Oregon,
testified he did not object to the annexation but to the zoning issue
which was intermingled with the annexation issue. Mr. Atkinson was
very concerned with the possibility of Durham Road being expanded to
four or five lanes. He cautioned City Council that the residents of
Summerfield do not want Durham Road to be expanded.
Mayor Brian commented that, as far as he knew, the Council was 100%
supportive of the Comprehensive Pian which defines Durham Road as a
two—lane street with a third lane for turning.
o Eunice Day, 15940 S.W. Oak Meadow Lane, Tigard, Oregon, supported Mr.
Atkinson's comments. She reiterated that the residents in Summer—
field want to keep the road from being any wider than three lanes,
with one of the lanes being a turning lane. Ms. Day also commented
that she would want truck traffic eliminated along the road in order
to protract their community.
Q. City Administrator commented on the testimony concerning Durham Road
by stating jurisdiction of the road could transfer to the City.
However, the annexation proposal itself does not affect any of the
Comprehensive Plan elements as far as land use or transportation.
f. Community Development Director reported City Staff recommended the
annexation for Albertson's be forwarded to the Boundary Commission
with a favorable recommendation.

Option A: The area as originally approved on 12/29/86 by Council.
Option B: The area as approved on 12/29/86 with the deletion of
lots along the south side of SW Spruce Street between
Hall Blvd. and 71th Avenue. This was based on
comments received during testimony from citizens
regarding the unimproved portions of S.W. Spruce
Street in that area and staff service-delivery concern.
Option C: The area as approved on 12/29/86 with the northeast
boundary of the proposed annexation being moved south
to the Precinct #192 line. This was based on comments
received during testimony from citizens regarding the
failure of the vote in Precinct 027 at the 11/4/86
election. The line would follow the precinct line and
cuts through the middle of several properties which
would create some servic"elivery concerns.
The Community Services Director also reported there was an update to
the resolution forms Council originally received in the official
packet for Options A, 8, and C. She stated additional language was
added to note the clarification language which was added to the legal
description at the request of the Boundary Commission.
g. City Administrator added, for the record, that the amended packet in
the possession of the Councilors had the legal descriptions for the
alternatives in addition to the amended resolution as reported by the
City Recorder.
h. Public Testimony
Proponents
o Cynthia Iford, 9970 S.W. Greenburg Road (in the proposed
annexation area), testified that she was in favor of the
annexation of Tigard and deferred further comments to her son,
Reid Iford.
o Reid Iford, testified that he lived in Metzger outside of the
proposed annexation area. He commented that his son attended
Metzger Grade School, in the annexation area, and would like to
see sidewalk and paths in the school area and see the school
receive the benefits of being within Tigard. He further
testified to the strong support for annexation given by the area
in the last election. Mr. Iford further stated Washington Square
would use City services and enumerated those services.
Mr. Iford asked that the record show he would personally
circulate a petition for the proposal to be put to a vote. He
°\ asked that the Council "vote for a . vote" by forwarding a
favorable recommendation to the Boundary Commission.
o Thelma Martin, 7119 Taylors Ferry, Tigard, Oregon, testified that
she owns property in the area at 9450 S.W. Coral. Mrs. Martin
stated that she is in favor of annexation with a note that Mr.
Iford covered all of her points.

for the issue but did not wish to speak. 4
o Bonnie Lillian Drinkard, 9520 S.W. Coral (in the proposed
annexation area) testified that she was in favor of annexation.
o John Blomgren, 9460 S.W. Oak Street, (in the proposed annexation
area) testified that he was for annexation. He advised Council
that originally he opposed piecemal annexation but realized the
total area denied annexation in November. He cited the need for
City services including police protection and street
improvements. Mr. Blomgren commented that when Washington Square
opened in 1974, Metzger lost its identity as a small community.
o Kathleen Coffeen, 11216 S.W. 81st Street, (in the proposed
annexation area) testified that she was in favor of annexation
with the hope that Pfaffle would be improved with sidewalks and
better access onto Hall Boulevard. Increased police protection
was also cited as a reason for her favoring the proposal.
o Ray Coffeen, 11216 S.W. gist Street (in the proposed annexation
area) testified that he concurs with Mrs. Coffeen's testimony.
o Sheila Kasten, 9885 S.W. Ventura Court, Tigard (out of the
proposed area) testified that she lived within the Metzger
Elementary School District. She wished to see the area annexed
so that the school would receive the benefits offered to schools
within the city limits of Tigard. She expressed concern for the
lack of quick response to child abuse cases in the area.
o Marjorie Haglund, 11075 S.W. Hall Boulevard (in the proposed
annexation area) testified she favored annexation. Her comments
centered on traffic concerns and the need for improvements. Ms.
Haglund said residents south of Spruce Street sent their children
to schools within the Tigard area and, therefore, related more to
Tigard than to Metzger.
o Clara Haeffle, 10900 S.W. Hall Boulevard annexation.(in the proposed
annexation area), testified that she supported
o Leila Whitford, 11070 S.W. Hall Boulevard (in the proposed
annexation area) signed as a proponent on the issue but did not
wish to testify.
Opponents
o Paul A. Herberholz, 8400 S. W. Pfaffle (in the proposed
annexation area) testified he opposed the annexation proposal.
He said the police and streets were adequate and expressed
concern about the inability of many to afford any improvements if
annexed to the City of Tigard. Mr. Herberholz referred to the
November election results noting the annexation proposal for the
whole Metzger area was voted down.
Mr. Herberholz presented a petition with 65 signatures of persons
against the annexation proposal. Mayor Brian noted that the
petition is not an original document, but the copy would be
accepted into the public record.

o Frances Baynham, 10495 S.W. 71st (out of the proposed annexation
area) testified she opposed annexation. She cited the November
election results voting down the annexation of the whole Metzger
area. Ms . Baynham said she liked the area without street lights
and other improvements; the community had all of the services
needed. She commented on some recent street improvement work
done by Washington County and added that the County had future
plans for additional work. Ms. Baynham referred to the CPO 4
Plan approved through Washington County and commented that she
worked then for the community to stay as it is. Ms. Baynham
objected to annexation in a piecemeal fashion.
o Janet Thompson, 10151 S.W. Jefferson, (in the proposed annexation
area) testified that she did not prefer to go into the Tigard
area because the change would mean "double the cost." She
expressed concern that once annexed, the services would not be
provided. Ms. Thompson referred to the November election results
wherein the annexation of the whole Metzger area was voted down.
o Harry Luberto, 8080 S.W. Spruce (in the proposed annexation area)
did not wish to speak, but indicated he opposed annexation.
o Doris Underwood (no address given) stated she was out of the
proposed annexation area on the north side of Spruce Street and
did not wish to speak indicating opposition to annexation.
o Delores Luberto, 8080 S.W. Spruce, (in the proposed annexation
area) testified she was very opposed to Spruce Street going into
Tigard. Mayor Brian ascertained that Ms. Luberto's property was
on the south side of Spruce in the area which would be removed
from the annexation proposal if Option B were recommended by
Council. She indicated she could support Option B.
o Arlie R. Ott, 8500 S.W. Spruce, (in the proposed annexation area)
testified he was opposed to the annexation. He cited the recent
elect results wherein the annexation proposal on Metzger was
voted down. Mr. Ott stated Tigard had nothing to offer.
o Mary Anderegg, 8512 S.W. Spruce (in the proposed annexation area)
did not wish to speak but indicated she was in opposition to the
annexation. Ms. Anderegg said Option B would be better as it
would remove her from the annexation area.
o Pat Whiting, 8122 S.W. Spruce (in the proposed annexation area)
testified that she was representing herself and her husband. Ms.
Whiting had several letters to enter into the record:
1. Roy Collins, 10565 S.W. 71st; although out of the area, he
was within the CPO 4 area which is affected by the proposed
annexation. Ms. Whiting reported he was diametrically
6 opposed to the annexation.
A, 2. Karen Larson, 8311 S.W. Spruce; addressed concerned about
service duplication and did not want Spruce Street entered
into the annexation.

3. Dale Williamson, 8311 S.W. Spruce Street, was opposed to the
annexation in total and, specifically, opposed the inclusion
of Spruce Street.
Mrs. Whiting referred to the CPO plan which addressed the need
for zoning areas to allow for higher density and for
commercialization. She stated she was not opposed to change,
growth, or making room for others. She noted a city must take on
a different kind of philosophy for the maintenance of its growth
and its administration. She advised Council a reason citizens
opposed the annexation was that they do not want to be part of a
formal city structure and that they already have a plan which was
adopted by the County through the guidelines of LCDC. Ms.
Whiting said she was concerned about the quality of growth.
The drainage situation was also of concern to Ms. Whiting who did
not want a formal, cement covered type of drainage program. She
advised the natural runoff now supplies growth of greenery.
Mayor Brian asked if Ms. Whiting preferred any option discussed.
Ms. Whiting explained that due to tho Spruce configuration,
service delivery would be difficult. She concluded by saying
". .one of the alternatives, other than A, possibly should be
considered."
o Ray Baldwin, 11655 S.W. Pacific Highway, opposed the annexation.
He did not support piecemeal annexation and stated the proposal
should be presented again as one parcel to the entire Metzger
community for a vote.
o Steven Herd, 8085 S.W. Spruce Street (out of the proposed
annexation area), opposed annexation. He cited the recent
negative election results regarding annexation in the area. He
commented that it appeared there was not a great deal of thought
on the part of the City because of the presentation of the three
options.
o Sharon Herd, 8085 S.W. Spruce Street (out of the proposed
annexation area) did not wish to testify other than to have the
record show her opposition to annexation.
o Jay Waldron, an attorney representing Washington Square
interests, 1211 S.W. Fifth Avenue, questioned and commented as
follows:
1. Referred to the Staff Report as clarified by the City
Administrator and asked for the opportunity to address it at
a future hearing. He requested a copy of the addended Staff
Report dated January 8th.

The City Administrator stated a copy would be provided for the
s Washington Square representatives.
2. Mr. Waldron said he presumed the City would have a future
public hearing since the three options presented by staff
were not part of the public notice.

3. Mr. Waldron requested the source of figures referenced in the
12/29/86 hearing (he mentioned $174 and $113). He commented
Beaverton was using different figures and requested an
explanation of the difference.
4. Mr. Waldron stated he formally requested, at the 12/29/66
hearing, who the residents were that requested the
annexation. He said he had not received the information.
Mayor Brian commented he had received a variety of telephone
calls and citizens have also been quoted in the newspaper
regarding this issue.
5. Mr. Waldron said the notice he received stated the City would
provide sewer and storm drainage. He questioned whether the
City would provide sewer and storm drainage to Washington
Square.
City Administrator responded, for the record, that all of the
cost data used was referenced in the Staff Report as coming from
the County 2000 Study. He stated sewer service would be provided
by contract with the City through the Unified Sewerage Agency
(USA) for treatment and sewer line maintenance and billing would
be administered by the City. He advised Mr. Waldron that the
City had an agreement with USA regarding service delivery upon
annexation. The City Administrator noted storm drainage would be
handled through the City storm drainage utility. He further
advised Council that Washington Square currently impacts land
inside the city limits with storm drainage runoff.
Mr. Waldron requested the annexation be delayed. He said he
understands from Beaverton and other public records that the area
agreement, in which an arbitrary line to divide up the Washington
Square area between Beaverton and Tigard, expires March 31st. He
cautioned the City Council on the issue of gerrymandering. Mr.
Waldron concluded his remarks by saying, "I want you to
understand the legal ramifications of what you are doing."
i. Mayor Brian counted those who signed up for public testimony noting
those who were in or out of the area to be annexed. The count, less
written comments, indicated the following:
Proponents — 11 total with 9 living in the area, 2 living out
Opponents — 13 total with 8 living in the area, 5 living out
j . Mayor Brian referred to the letters received at, and previous to, the
meeting on this proposal. Ms. Whiting presented three letters in
opposition and were noted during her testimony. Mayor Brian received
a letter from Mr. Ken Rasmussen, 10010 S. W. Johnson, indicating his
support of the proposal.
The City Recorder entered the following letters into the record:

k. Community Development Director recommended Council forward the
annexation to the Boundary Commission for final action.
Mayor Brian asked the Community Development Director if he had a
recommendation on the three options. The Community Development
Director responded that any of the alternatives could work from the
standpoint of the Community Development Department servicing the area.
1. Council Comments/Discussion/Questions:
o Council commented on the differences between the options. City
Administrator clarified road jurisdiction by reporting that if
the road jurisdiction were transferred after the annexation to
the City, the City would then assume responsiblity for road
maintenance. He advised Council that the City policy was that
roads are maintained at the condition to which they were built;
i.e. , gravel roads are maintained as gravel roads and asphalt
roads are maintained through pothole patching. He stated
additional improvements would occur first to arterial and
collector streets and then to residential streets as funds are
available or as property owners initiate LID requests.
o Councilor Schwartz asked for clarification on funding of street
lighting. "The City Administrator responded that street lighting
would be included in the Cita street lighting budget for existing
street lights. He advised that Metzger residents, who have
street lights, are currently paying extra for street lights
through a County Service District and this payment would be
absorbed by Tigard upon annexation. The Administrator then
explained that new street lights in the City were added on a
priority basis by Council direction.
M. Legal Counsel stated he wished to respond to a comment made by Mr.
Waldron. He advised Council that it was appropriate, at this
hearing, to consider any of the three alternatives which were
proposed by staff and noted Council would be making a recommendation
to the Boundary Commission. Legal Counsel advised nothing was added
to the proposed district and that staff responded to a study of the
provision of services and hearing comments.

S. Motion by Councilor Johnson, seconded by Councilor Eadon, to
recommend adoption of Resolution No. 87-10 to request the Boundary
Commission to consider a modification of the annexation proposal.
Discussion on the motion included the City Administrator clarifying
that the amended document handed out to the Council at the meeting is
the document that is under consideration. Councilor Johnson advised
that the amended document was delivered to her that morning prior to
the public hearing. Councilor Schwartz asked for and received from
Council and staff clarification as to the difference between the
Resolution with Option B and the Resolution with Option C.
Mayor Brian noted that this was a two-step process. If Council
passed Proposal B, it would go to the Boundary Commission where it
could be rejected, modified or accepted. If the Boundary Commission
accepted the recommendation, a 45-day waiting period would occur
during which 10% of the registered voters could sign a petition to
get the issue before the voters in the area.
Councilor Eadon commented that her preference was for Proposal B due
to simplification of service delivery. This proposal would keep
service vehicles for the City within jurisdictional lines when
servicing the people on Spruce Street. Councilor Eadon said that
Option C would be detrimental to service delivery since it would
split property lots in and outside the City.
Motion passed by a unanimous vote of Council present.
t. Mayor Brian stated the Resolution would be forwarded to the Boundary
Commission for a February 12, 1987 hearing.

INFORMATION SUMMARY
The Tigard City Council adopted Resolution No. 86-93 on August 25, 1986 to
forward this annexation to the Boundary Commission as a triple majority
proposal. On December 11, 1986 the Boundary Commission denied the request
based on a recent Oregon Court of Appeals decision on triple majority
annexations. The Council then held a public hearing on December 29, 1986 to
consider initiating the annexation and adopted Resolution No. 86-139
forwarding the proposal to the Boundary Commission under a new status of
"Council initiated".
At the 12/29/86, meeting one issue frequently addressed during another public
hearing indicated the meeting notice was delayed due to heavy holiday mail and
citizens were vacationing and unable to respond adequately to the notice. The
Council has called for another public hearing to be held 1/14/87 to offer
additional opportunity for public testimony.
Staff has included all information submitted at the 12/29/86 hearing as the
record for this additional hearing. Please bring your information from that
meeting to save on a:.dditional copying costs. A signed copy of Resolution
86--139 is attached for your information and a new resolution which reaffirms
your 12/29/86 position.

2. LAW USE AND PLAI�MIM�
Vicinity Information:
The proposed area is bordered on the north by developed single family
units, on the west by Highway 217, on the south by the City of Tigard and
on the east by the City of Portland.

Most of the area consists of detached single-family dwellings. Major
commercial use is the Washington Square Mall and Lincoln Center. Also
located in the area is the Crescent Grove Cemetery and Metzger School.
The area contains approximately 11.75 acres of vacant land.

Washington County Planning:
The territory is designated Urban on the acknowledged County Comprehensive
Plan. The area is covered by the Metzger-Progress Community Plan. The
Community Plan (Element 22) discourages, but does not prohibit, annexation
of smaller portions within the larger Plan area. The County Plan
specifically defers to the County-City Urban Planning Area Agreements in
regard to "piecemeal" or small area annexations. This Plan, which covers
an area larger than the area proposed for annexation, was adopted by the
Board of County Commissioners on December 27, 1983. The Metzger-Progress
Community Plan has been reviewed by LCOC and found to be in compliance
with the state-wide planning goals. it is considered to be an element of
the County Comprehensive Plan (Exhibit 2.1).
City of Tigard Planning:
a. Urban Planning Area Agreement
The City of Tigard has an acknowledged City Limit plan. ORS 215.130
provides that "land use and zoning designations on areas annexed to
cities will continue in effect unless, or until the City has by
ordinance or provision provided otherwise." Furthermore the City of
Tigard and Washington County have entered into an Urban Planning Area
Agreement the effective date of which is September 9. 1986, The
Urban Planning Area Agreement (UPAA) is considered to be a part of
both the County's and the City's adopted Comprehensive Plans. The
UPAA sets out an "Active Planning Area" within which the City assumes
responsibility for land use planning, and an "Area of Interest" in
which the County agrees to coordinate its planning due to the
potential impacts on the adjacent City. The South Metzger proposal
falls within the rules for the Tigard "Area of Interest."
"4. The CITY may consider requests for annexations in the "Area
of Interest" subject to the following:
"A. The CITY shall not require annexation of lands in the
Area of Interest as a condition to the provision of
urban services for development.
"S. Annexations by the CITY within the Are► of Interest
shall not create islands unless the CITY declares its
intent to complete the island annexation.
"C. The CITY agrees in principle to a plebiscite or other
representative means for annexation in the
Metzger/Progress Community Planning Area, which
includes Washington Square, within the CITY Area of
Interest. NOT CONTRARY TO THE FOREGOING, THE CITY
RESERVES ALL OF ITS RIGHTS TO AMEX AND ACKNOWLEDGES
THE RIGHTS OF INDIVIDUAL PROPERTY OWNERS TO ANNEX TO
THE CITY PURSUANT TO OREGON REVISED STATUTES.

I'D. Upon annexation of land within the area of Interest to
the CITY, the CITY agrees to convert COUNTY plan
designations to CITY plan designations which most
closely approximate the density, use provisions and
standards of COUNTY designations. Furthermore, the
CITY agrees to maintain this designation for one year
after the effective date of annexation unless both the
CITY and COUNTY Planning Directors agree at the time
of annexation that the COUNTY designation is outdated
and an amendment may be initiated before the one year
period is over."
b. Municipal Urban Services Policy
The City of Tigard has conducted a Municipal Services Study covering
the area proposed for -Annexation. The study describes the area,
discusses annexation, service provision, expenditure requirements,
revenue projections, etc.
On July 14, 1986, the City of Tigard adopted an Urban Services Policy
declaring its willingness to plan and ultimately provide urban
services in an area around the current City limits. The area
proposed for annexation falls within the territory covered by this
policy (Exhibit 2.2).
3. SERVICES AND UTILITIES
Sanitary Sewers
The area to be annexed is within the Unified Sewerage Agency (USA) of
Washington County as is the City of Tigard. USA provides sewage treatment
and construction and maintenance of major transmission lines to the
Metzger area and the City. Within the unincorporated area of Metzger, the
Agency also maintains all smaller saw lines and bills the customers.
Inside the City of Tigard, the USA is responsible for all lines 24 inches
and larger while the City is responsible for all smaller lines and for
billing, hook-ups, etc.
The Unified Sewerage Agency bills once a year for a charge of $129 and its
hook-up fee is $975 for a single family dwelling. The City bills monthly
at $11.50 or '$136 per year (which includes a $.75 storm drainage
surcharge) and the hook-up fes for a single family dwelling is $975. USA
assesses a property tax, which goes towards payment of bonds sold to
construct district-wide, major improvements and regional treatment
plants. This tax, which for the 1995-86 tax year was 5.36 per $1,000 of
assessed value, would therefore remain the same.
Storm Drainage
The proposed area lies within the Ask Creek drainage basin. This basin
runs south and west into the City of Tigard where it joins Fanno Creek
(Exhibit 3.1).

There are three drainage systems within the area:

1) Washington Square, the commercial mall at the westernmost
section of the area, contains 137.35 acres of which 115.95 acres
is impervious surface. The area drains directly into the City
of Tigard through two culvert and pipe systems under Highway 217
to the Cascade Boulevard area (Exhibit 3.2).
2) The Ash Creek area consists of the area between Greenburg Road
and Hall Boulevard. This system drains south into Ash Creek and
then joins Fanno Creek in the City of Tigard.
3) The Ash Brook area consists of the residential area east of Hall
Boulevard and south of Spruce Street. This area drains south
and west through a pipe and open culvert system into Ash Creek
within the City of Tigard just north of Highway 217.
Washington County has recently completed the "Ash Creek Drainage Master a
Plan" which recommends seven projects within the area to improve storm
drainage and alleviate flooding problems (see Exhibit 3. 1). Costs within
the three areas are:

b. Ash Creek 299,60
C. Ash Brook 640,200
$971,900 (Exhibit 3.3)
The Plaster Plan has not identified a firm funding formula and to date
Washington County has not addressed the issue in detail.
Water Service
The territory to be annexed is entirely within the Metzger Water District
which also serves portions of the City of Tigard with the remainder of the
City within the Tigard Water District. The City does not provide water
service. Therefore no change in water service will occur as a result of
this annexation.
Fire_ Protoctiorr
The territory to be annexed is mostly within Washington County RFPD M1. A
small portion of the area lying between Pfaffle and Spruce Street is
within Tualatin RFPD. The City of Tigard is also entirely within these €
two rural fire protection districts. Fire service will therefore not
change as a result of this annexation.

Parks
The area is within the boundarisi of the Metzger Park LID. The LID was
formed to insure funding for operation of the park and bond retirement.
The LID assesses $.12 per $1,000 AV.

Metzger Park is north of the area and operation of the park and
participation in the LID will not be affected.
The City of Tigard operates a Park system funded through the property
tax. The system consists of one city-wide park, one community park, four
neighborhood parks, and three mini-parks.
Library
The City of Tigard maintains its own library and is currently a partner in
the Washington County Cooperative Library Service (WCCLS). Residents of
the proposed area currently use the Tigard Library under the current WCCL.S
levy which expires June 30. 1987. If annexed, residents would be able to
continue to use the Tigard Library free of charge, even if the WCCLS levy
is not extended and fees for out-of-City patrons are imposed.
Street Lighting
Currently, street lights in the area are provided through Washington
County Service District #I. Lighting in the district is dependent on
formation of Local Improvement Districts covering the area desiring
lighting and then sharing the costs of the lights through a yearly
assessment on each benefited lot. The assessments vary depending on when
the particular LID was formed, the type of light, etc. There are three
assessment districts within the proposed area. They are:
a. Ashbrook Farms $37.68 per year
b. Lehman 30.32 per year
C. Metzger Acres 45.75 per year
The City of Tigard pays for street lighting costs out of its Street Fund
which has as its primary source of revenue, State-shared gasoline tax
money. If the annexation is approved, property owners currently paying
street lighting assessments (these appear on the yearly tax bill from the
County even though they are not taxes) would be relieved of those
obligations. This change would take place on July 1, 1987 to coincide
with the time the City would be receiving State-shared revenues generated
by the annexed area.
Street
The City would take over jurisdiction of the majority of the streets in
the area to be annexed. (Taking over jurisdiction for the purpose of
assigning maintenance responsibility is a separate City-initiated action
which takes place subsequent to annexation.) Exceptions to this would be
Scholls Ferry Road and SW 80th Avenue which are major collectors/arterials
for the County and over which the County may wish to continue
jurisdiction. Hail Boulevard is still designated as a State Highway and
the State therefore retains maintenance responsibility for it as well as
for Highway 217.
Generally speaking the County has not had money in recent years for local
street maintenance and in fact has had to carefully prioritize its
expenditures on major thoroughfares. Local street improvement has been up
to local property owners willing to pay the entire cost of improvements

5. CONCLUSIONS
Boundary Commission Policy
Under Oregon Administrative Rules (OAR 193-05-00), the Boundary Commission
has developed and adopted three policies related to annexation
(Exhibit 5.1). They are:
a. Policy on incorporated status.
The Commission generally sees cities as the primary providers of
urban services.
b. Policy on mediation, coordination, and maintenance of financial
integrity.
The Commission recognizes that the growth of cities may create
financial difficulties for special districts and that jurisdiction
should mediate boundary disputes.
C. policy on long range government structure.
The Commission generally favors logical long term arrangements of
governmental structure which may dictate approval of irregular
boundaries in the short term.
Within the guidelines of the above policies, the following conclusions are
valid:
a. The City of Tigard is the logical provider of services for the urban
unincorporated area within this proposal.
b. 1) This annexation proposal will create no financial impact on the
special districts currently providing service within the
proposed area.
2) The City of Beaverton and the City of Tigard have agreed with
passage of the Annexation Planning Area Agreement that the City
of Tigard is the logical provider of services within this area.
C. The proposed area provides a more logical boundary than exists and
lies within the long range planning limits of the City of Tigard.

Sanitary sewer and stone drainage within the proposed area impact the City
of Tigard. Annexation of the area would provide single jurisdiction
control, maintenance, planning, and response to the needs of the proposed
area and the current residents of the city.

The property to the north across Durham Road is zoned C-G and medium
high density residential and is developed as the Summerfield commercial
and residential development. The property to the east is zoned medium
density and is underdeveloped as large lot single family housing. A
30 acre mobile home park lies to the south on property zoned medium
density. King City lies across Pacific Highway to the west.
4. Site Information and Proposal Description
The property slopes gently to the southeast and has second growth trees
scattered on the site. There are 6 single family homes on large lots
within the area proposed for annexation.
5. Agency and NPO Comments
No written comments had been received at the writing of this report.
B. FINDIMGS AND CONCLUSIONS
The relevant criteria in this case are Tigard Comprehensive Plan
Policies 2.1.1 and 10.1.2 and Chapter 18.136 and Chapter 18.138 of the
Community Development Code.
The Planning staff has determined that the proposal as submitted is
consistent with the relevant portions of the Comprehensive Plan based
upon the findings noted below:
a. Plan Policy 2.1.1 is satisfied because the Neighborhood Planning
Organization and surrounding property owners were given notice of
the hearing and an opportunity to comment on the applicant's
proposal.
b. Plan Policy 10.1.2 is satisfied because the Police Department has
been notified and the land is located within Tigard's Urban
Planning Area.
The Planning staff has determined that the proposal is consistent with
the relevant portions of the Community Development Code based upon
findings noted below:
a. Chapter 18.136 is met because the applicant has met all of the
approval standards for annexation of property.
b. Chapter 18.138 is met because the land meets the definition for
buildable lands as defined by OAR 660-07-000 and shall be
designated as "developing area" on the Development Standards Area
Map. 3

Based upon the findings and conclusions, the Planning Staff recommends

INFORMATION SUMMARY
The Tigard City Council held a public hearing on December 29, 1986 to receive
public testimony regarding the proposal South Metzger Annexation. At that
meeting much testimony was received that indicated the hearing notice was
delayed due to heavy holiday mail and citizens in the area were vacationing
and unable to respond adequately to the notice. Also, some residents along
Spruce Street (from Precinct #27) indicated that this area was not within
Precinct #192 (which precinct voted 2 to 1 to join the City at the 11/4/86
election). The Council passed Resolution No, 86-140 at the 12/29/86 meeting
forwarding the annexation proposal to the Boundary Commission for a hearing on
2/12/87. The Council also called for another public hearing to be held
1/14/87 to offer additional opportunity for public testimony.
ALTERNATIVES CONSIDERED
Staff has prepared three options for consideration which address various
concerns.
OPTION A: Should the Council wish to reaffirm the original annexation and
make no modification suggestions to the Boundary Commission, Option
A resolution should be adopted.
OPTION B: Should the Council wish to reaffirm the original annexation but
suggest a modification to the Boundary Commission to address
service delivery concerns, Option B resolution should be adopted.
As outlined in the staff reports, Spruce Street between SW Hall
Blvd. and SW 79th Avenue is fragmented into different sections of
road with limited improvement to the right-of-way. Substantial
improvements are seen on that portion east of SW 79th Avenue to SW
71st Avenue.
OPTION C: Should the Council wish to reaffirm the original annexation but
suggest a modification to the Boundary Commission to address
removal of Precinct #27 from the annexation proposal, Option C
resolution should be adopted.
Staff has researched the precinct boundaries along the Spruce
Street portion of the annexation area. Precinct #192 runs
basically along the back side of those homes on the south side of
Spruce Street.

RESOLUTION NO. 87-
A RESOLUTION REAFFIRMING THE INITIATION OF ANNEXATION TO THE CITY OF TIGARD OF
THE TERRITORY OUTLINED IN EXHIBIT "A" AND DESCRIBED IN EXHIBIT "B" ATTACHED
(SOUTH METZGER ZCA 20-86).
WHEREAS, the City Council held a public hearing on December 29, 1986 to
consider initiating annexation of the territory outlined on the attached map;
and
WHEREAS, the Council initiation process is being used since the triple-
majority annexation process was recently challenged in the Oregon Court of
Appeals and the triple-majority process is still being questioned; and
WHEREAS, the City Council adopted Resolution 86-140 on December 29, 1986 to
forward the proposal to the Portland Metropolitan Area Local Government
Boundary Commission for a hearing on 2/12/87; and
WHEREAS, at the December 29th meeting much testimony was received that
indicated the hearing notice was delayed due to heavy holiday mail and
citizens in the area were vacationing and unable to respond adequately to the
notice; and
WHEREAS, the City Council called a special meeting for January 14, 1987 to
allow for additional opportunity to receive testimony on this proposal; and
WHEREAS, the City Council further determined that the area to be annexed will
be designated as an established area in conformance with Chapter 18.138 of the
Tigard Municipal Code. The Metzger-Progress Community Plan zoning and
comprehensive plan designations as adopted by the Washington County Board of
Commissioners (Ordinance Nos. 278, 279, and 280, and subsequent amendments
thereto) will be applied. The City will assign City of Tigard planning and
zoning designations in conformance with the Tigard Municipal Code and Oregon
Revised Statute requirements.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Council hereby reaffirms Resolution 86-140, as it was amended
on January 14, 1987 by Resolution No. 87--08, initiating proceedings for
annexation of the territory as shown on Exhibit "A" and described in Exhibit
"B" (attached and made a part hereof) to the City.
SECTION 2: The Council hereby determines that the area to be annexed will be
designated as an established area in conformance with Chapter 18.138 of the
Tigard Municipal Code. The Metzger-Progress Community Plan zoning and

A RESOLUTION OF THE TIGARD CITY COUNCIL REAFFIRMING THE DECEMBER 29, 1986,
REQUEST TO THE PORTLAND METROPOLITAN AREA LOCAL GOVERNMENT BOUNDARY COMMISSION
TO ANNEX AN AREA REFERRED TO AS "SOUTH METZGER" AND FURTHER REQUESTING
CONSIDERATION OF A MODIFICATION TO THAT ANNEXATION --------
WHEREAS, the Tigard City Council held a public hearing on December 29, 1986 to
receive public testimony regarding the proposal South Metzger Annexation; and
WHEREAS, the Council initiation process is being used since the
triple-majority annexation process was recently challenged in the Oregon
Court of Appeals and the triple-majority process is still being questioned; and
WHEREAS, at that meeting much testimony was received that indicated the
hearing notice was delayed due to heavy holiday mail and citizens in the area
were vacationing and unable to respond adequately to the notice; and
WHEREAS, the Tigard City Council passed Resolution No. 86-140 at the 12/29/86
meeting forwarding the annexation proposal to the Boundary Commission for a
hearing on 2/12/87; and
WHEREAS the Tigard City Council also called for another public hearing to be
held 1/14/87 to offer additional opportunity for public testimony; and
WHEREAS, participants at the public hearing noted the different areas of
improved and unimproved street right-of-way along SW Spruce Street; and
WHEREAS, at the 1/14/87 hearing Council reconsidered the boundary of the
proposed annexation area along Spruce Street and voted to request the Boundary
Commission consider a modification to the original annexation request based on
service delivery concerns addressed by participants in the hearing.
WHEREAS, the City Council further determined that the area to be annexed will
be designated as an established area in conformance with Chapter 18. 138 of the
Tigard Municipal Code. The Metzger-Progress Community Plan zoning and
comprehensive plan designations as adopted by the Washington County Board of
Commissioners (Ordinance Nos. 278, 279, and 280, and subsequent amendments
thereto) will be applied. The City will assign City of Tigard planning and
zoning designations in conformance with the Tigard Municipal Code- and Oregon
Revised Statute requirements.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Council hereby reaffirms Resolution 86-140, <-as=,-t -was aWwnd

REQUEST TO THE PORTLAND METROPOLITAN AREA LOCAL GOVERNMENT BOUNDARY COMMISSION
TO ANNEX AN AREA REFERRED TO AS "SOUTH METZGER" AND FURTHER REQUESTING
CONSIDERATION OF A MODIFICATION TO THAT ANNEXATION PROPOSAL.
WHEREAS, the Tigard City Council held a public hearing on December 29, 1986 to
receive public testimony regarding the proposal South Metzger Annexation; and
WHEREAS, the Council initiation process is being used since the
triple—majority annexation process was recently challenged in the Oregon
Court of Appeals and the triple—majority process is still being questioned; and
WHEREAS, at that meeting much testimony was received that indicated the
hearing notice was delayed due to heavy holiday mail and citizens in the area
were vacationing and unable to respond adequately to the notice; and
WHEREAS, further noted by some residents along Spruce Street was the desire to
not be annexed with an indication that this area was not within Precinct 192;
said precinct voting to join the City at the 11/4/86 election; and
WHEREAS, the Tigard City Council passed Resolution No. 86-140 at the 12/29/86
meeting forwarding the annexation proposal to the Boundary Commission for a
hearing on 2/12/87; and
WHEREAS the Tigard City Council also called for another public hearing to be
held 1/14/87 to offer additional opportunity for public testimony; and
WHEREAS, at the 1/14/87 hearing Council reconsidered the boundary of the
proposed annexation area in the Spruce Street vicinity and voted to request
the Boundary Commission consider a modification to the original annexation
request. This request would be responsive to the negative comments received
from the citizens within Precinct #27 and would pull back the boundary in this
area to the Precinct #192 northerly boundary line.
WHEREAS, the City Council further determined that the area to be annexed will
be designated as an established area in conformance with Chapter 18.138 of the
Tigard Municipal Code. The Metzger—Progress Community Plan zoning and
comprehensive plan designations as adopted by the Washington County Board of
Commissioners (Ordinance Nos. 278, 279, and 280, and subsequent amendments
thereto) will be applied. The City will assign City of Tigard planning and
zoning designations in conformance with the Tigard Municipal Code and Oregon
Revised Statute requirements.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:

SUBJECT: Washington Square Drainage
The Washington Square area (aproximately 179 acres) drains toward the
southwest. The storm drainage from the Square passes under Highway 217 in
four large culv:;.rts and then flows through the Cascade Boulevard area of
Tigard. The dr&inage systems in the Cascade Boulevard area are poorly defined
and inadequate to carry the large volumes of storm runoff from Washington
Square during major storms. As a result, there has been frequent flooding of
some properties along Cascade Boulevard.
The Ash Creek Drainage Master Plan, prepared for Washington
County by Kramer, Chin and Maya, Inc. , in January, 1986, describes the history
of the problem as follows:
"When Washington Square was built, the County incorporated
the shopping center property into a special service
district, Drainage District Number 2. The purpose of the
District was to have been to construct a detention basin to
mitigate runoff impacts from Washington Square. The
Drainage District, though formed, has never been active.
The detention basin was never constructed. Analysis for
this project found that a detention basin downstream of
Washington Square would increase flooding in Fanno creek by
retarding flows from Washington Square to match peak flows
from upper Fanno Creek. Thus the Washington Square
detention basin was not considered in this plan and is not
recommended."
Instead of a detention basin, the Master Plan recommends some downstream
improvements as shown on Figure 7.1 of the Master Plan (copy attached). The
project shown as Number 19 would require construction of new culverts under
the railroad spur and the main railroad line along with construction of a new
drainage channel to Fanno Creek. The project shown as Number 12 would require
substantial regrading of the Ash Creek channel between Highway 217 and Fanno
Creek.
In addition, improvements are needed to the existing drainage ditches in the
Cascade Boulevard area in order to improve flow and reduce maintenance
problems. Replacing the open ditches with closed culverts is the preferred
solution.
A separate study ("Master Drainage Plan, City of Tigard" prepared by CH2M/Hill
in July, 1981), has identified over $4,000,000 of improvements required along
the Fanno Creek channel to accommodate the increased runoff resulting from
upstream development such as Washington Square.

If Washington Square is annexed to the City of Tigard, the property owners
will be required to pay the monthly drainage fee charged to all developed
properties in Tigard. At the current rates, the fee for Washington Square
would be approximately $1,500 per month. These fees are used to maintain and
to improve storm drainage systems. The fees from Washington Square could be
used to address the storm drainage problems which Drainage District No. 2 had
been intended to address, and to pay a share of the improvement and
maintenance costs for the Fanno Creek channel.

The following basic Police services will be provided to the South Metzger
neighborhood upon annexation:

Estimated Transition to City of Tigard Patrol and Emergency-Response:
Emergency Police services would begin following a positive annexation vote
as of May 1, 1987 and coordinate with the County Sheriff throughout the
transition period. The City of Tigard will recruit and hire additional
officers as fast as possible after necessary budgetary authority is
granted. The City will rotate experienced officers into the Metzger
community as new officers are brought into the Department. This assures a
balance of experienced personnel throughout the City. Additional
constraints to the immediate assumption of patrol duties are as follows:

As S.W. Spruce Street exists today, it is fragrrrented into four separate
sections between its intersections with S.W. Hall Blvd. on the west end and
S.W. 78th Avenue on the east end. Accessibility frau the south cannot be
made.
In order to reach any of the residents on the south side of S.W. Spruce right
of way, access can only be gained frau the north on S.W. Pine between S.W.
85th Avenue and S.W. 77th Avenue. This would create an increase in response
time to emergencies due to the fragmentation of S.W. Sprue Street.
Those residents that are adjacent to the south of the property lots along S.W.
Spruce between S.W. 85th on the west end and S.W. 78th on the east end can all
be accessed easily fran S.W. Pfaffle northward, and not increasing response
time to er+ergencies at all.

To the Tigard City Councils
the City of Tigard decides to annex a part of Metzger.
the Council net the 29th of December and voted in favor of
the anadzation.
Why should I believe that the vote would be different
this time. We know that the Council would not vote
against itself and what the City of Tigard waste.
I protest being forced into the City of Tigard. If I
an f ted into the city, I shall be forced in voting
against anything the City of Tigard proposes.

NOTE: The Tigard City Council received testimony on December 29. 1986 from interested
parties regarding the South Metzger Annexation Proposal. One issue frequently addressed
was that receipt of the hearing notice was delayed throuih the heavy holiday mail. In
order to ensure that all interested parties have received notice and had a chance to
testify, the Tigard City Council has called a special Council meeting for January 14,
1987 at 12:00 Noon at the above noted address.
REQUISTs The purpose of this special meeting is to hear the public hearing item noted
lov and forward an annexation proposal to the Portland Metropolitan Area Local
Government Boundary Commission. The Boundary Commission hearing is scheduled for
February 12, 1987'at 7s;0 pm at the Multnomah Courthouse. 1040 SW Stb, Portland, Oregon.
LOCATION: The area to be annexed will be designated as an established area in
c ormance with Chapter 18.136 of the Tigard Municipal Code. The Metzger-Progress
Community Plan zoning and comprehensive plan designations as adopted by the Washington
County Board of Commissioners (Ordinance Nos. 278, 279. and 280. and subsequent
amendments thereto) will be applied. The City will assign City of Tigard planning and
zoning designations in conforaancs with the Tigard Municipal Code and Oregon Revised

I attended the meeting December 29, 1986 to express my desire that we be annexed
to the City of Tigard. We have received another notice of a meeting on Jan. 14,
3987 regarding the South Metzger Annexation Proposal. I plan on attending this
meeting, but I am submitting this letter to reiterate my stand that we be annexed
to Tigard.
I was surprised at the group of people attending the Dec. 29th meeting, who are
not in the area of the proposed annexation and their determination to oppose
annexation regardless of the wishes of the residents of the proposal. As I
expressed in RV testimony at that time, I felt 3W area was not well represented
by the Metzger CPO. I offered to serve on committieso=but pie never

Traffic has increased dramatically on the streets leading to- the square, particularly
on my street, Yell Blvd. Other businesses have located in the area because
Washington Square is here. It would seem a criminal element Would be attracted by
the Square and this would effect the Metzger area, also. I am not against
Washington Square. I shop there frequently and belong to the Meridian Park
Hospital MIUng program at the Square and feel the Square is an asset to us.
However, they do have an obliSation to the residents of the area to help us
solve some of the problems that have evolved since Washington Square has been
built.

Dear City Council Members:
I am unable to attend your 12:00 meeting on January 14, and find it highly
annoying that such a meeting was scheduled in the middle of a working day.
However, as a five-year resident of Spruce St., I want to be counted as opposed
to the annexation of any portion of Metzger bordering on Spruce.
Metzger has already voted against annexation and I fail to see why we have
to keep repeating the process.

Dear Bill :
I'm writing to you in response to the attached hearing notice. I
have no reservations of the South Metzger Area being annexed to the
City of Tigard. However, if annexation succeeds it is my opinion
that the entire northwestern half (west of a north-south line parallel
to and along S. W. Lincoln St. and the east boundary above S. W. Locust
St. Area) be zoned either C-G or C-P. This would give a broader
consistent zoning to the area and would allow more commercial expansion
to occur with close proximity to a major shopping center, Hwy, 217 and
main collector streets such as Greenburg Rd. and Hall Blvd.
I also feel that with this zoning the area would meet all the stated
purposes of Section 18.62.010 and Section 18.64.010 per the City of
Tigard Planning Ordinances, and would benefit the surrounding community
and the City of Tigard.
