OATH OF NEWLY ELECTED MAYOR AND COUNCIL MEMBERS a. City Recorder administered oath of office to Mayor Thomas M. Brian. Mayor Brian then administered oaths of office to Councilor Carolyn Eadon (position #3) and Councilor John Schwartz (position #4). 4. ELECTION OF COUNCIL PRESIDENT a. Mayor Brian opened the election of Council President noting that every January of the odd numbered years Council selects a new President. b. Motion by Councilor Eadon, seconded by Councilor Johnson to nominate Councilor Gerald Edwards as Council President. Approved by unanimous vote of Council present. 5. EMPLOYEE OF THE YEAR A. Mayor Brian stated the City had begun an employee recognition program. One part of this program is the selection, by City employees, of an Employee Of The Month. This selection is based on job knowledge, team work, and attitude towards customer service. He noted for the record that the Council had joined the employees of the month from 1986 for an informal reception prior to the meeting. Mayor Brian stated that all employees of the City were asked to vote for the Employee Of The Year. The first vote resulted in a tie between Laura McLellan and Bob Landis. Upon holding a tie breaking vote, Laura McLellan was selected as the 1986 Employee Of The Year. Mayor Brian presented Laura with a plaque and thanked her for her efforts for the City. Since Bob Landis was unable to attend the meeting, the Community Development Director received the plaque presented by Mayor Brian. 6. PRESENTATION OF KEYS TO THE CITY a. Mayor Brian presented keys to the City to the following board and committee members in recognition of their service to the City. Mark Padgett for serving on the Transportation Committee Elizabeth Golden for serving on the Parks and Recreation Committee Phil Edin for serving as an "Ex-Officio" member of the Utilities and Franchises Committee Richard Cochran for serving on the Economic Development Committee 7. VISITOR'S AGENDA (2 Minutes or Less Per Issue, Please) a. Mr. Hal Lyster, 15625 SW Alderbrook Circle, presented information and concerns regarding the City Administrator's travel expenses. He further noted that he requested a meeting with the Mayor and City Council to study this issue further. b. Mayor Brian stated the record had been checked and the Council was satisfied that everything was documented properly. He noted they would continue to monitor the matter. Mayor Brian further invited Mr. Lyster to participate in the Budget Committee meetings and hearings scheduled later. C. City Administrator stated that Mr Lyster had previously received any and all information requested. The Administrator advised Council that he requested the City's auditors, Coopers and Lybrand, to look into the travel expense records and report directly to Council. 8. ANNUAL REPORT i SERVICE LEVEL REPORT a. City Administrator stated the report before Council was in draft form and should be in final copy during February so that the Mayor's State of the City address could be included. City Administrator synopsized the report and noted resources were being utilized efficiently and that standards and measures for decision making were included in the report. These would assist Council and staff in judging future efforts. He further stated his belief that the City could stay on the current trend of keeping expenditures below inflation and population increases. Page 2 - COUNCIL MINUTES - JANUARY 12, 1987 - The Administrator highlighted progress on the major City goals: 9 tax base and 5-year financial plan; civic center completion; employee involvement program; increase of community information and involvement; economic development; intergovernmental relations; annexation and municipal services; and transportation and capital improvements programs. The Administrator then presented the following departmental highlights for 1986. Police Department: A 24% staffing increase was experienced while population increased 35%. The Department also added new programs and expanded services such as the School Resource Officers, Neighborhood Crime Prevention, Durham Police Services contract, and Tualatin and King City dispatch contracts. Community Services Department: The direct sevices services prow sed by other departments were impacted by the support in records, word processing, accounting, purchasing, and personnel assistance in the department. Upcoming issues would be the Records Management Study, Court Study, and expanded community information and involvement. Library Department: The opening of the new Library has generated a 35% circulation increase. The Library also increased the hours open tahsed t eic, had a well received Summer use of volunteers from 2500 hours a to 5400ding o and increased over the last year. Community Development: Planning, Engineering, and Building were the first to receive the direct impact of the City'sraphe id growth. Tasks ahead were Codes Enforcement, updating Comprehensive Plan, completion of Summer Lake Park, Downtown Fanno Creek Park, and the determining of the City's role, if any, in a recreation program. The City Administrator concluded by costing were down.e City yHe ervices states were up and comparative operating that with the new Tax Base, City services have been restored and even expanded in several cases. Operating costs were noted as 25-33% lower over the last to 6d years.high H and vis staff that the City's productivity e continually seeking new ways to get the job done while keeping the cost down and productivity up. The Administrator then suggested continued commitment to community involvement, improved productivity, and quality growth- management with quality municipal services. He suggested a renewed commitment and expanded emphasis in capital improvement projects, traffic and transportation system improvements, and intergovernmental relations would become more important in the future. ORDINANCE M0, ��7 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 9 _,. 10.28, OF THE TIGARD MUNICIPAL CODE BY ADDING TO SECTION 10.28.130 TO PROHIBIT PARKING ON PORTIONS OF SW 92ND AVENUE, DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. Page 3 - COUNCIL MINUTES - JANUARY 12, 1987 a. Mayor Brian stated this ordinance was presented for a second reading as it did not pass by unanimous vote on December 15, 1986 at the first reading. b. Motion by Councilor Edwards, seconded by Councilor Eadon to adopt. C. Lengthy discussion followed regarding the history of the request. Councilor Schwartz requested additional information on the proposal noting concerns that limiting parking along 92nd Avenue may cause an impact on neighborhood streets in the area. d. Mayor Brian stated this was a difficult issue to address adequately and explained the proposal. He stated residents in the area of Martha Street and Millen Drive requested the action to help eliminate a hazardous condition along 92nd Avenue with site obstruction. e. Councilor Edwards stated he would try this approach since he was concerned with liability issues stemming from the safety issues presented alone 92nd Avenue. He further noted that if this proposal did not work Council could change the ordinance. f. Councilor Johnson stated she could support the request from Durham Road to the south of Millen Drive, however, expressed her concerns regarding the proposal on the south end of 92nd going to Cook Park. She noted, though she would vote against the ordinance since the whole portion of 92nd Avenue was involved, she still supported the citizens request for no parking from Durham Road past Millen Drive. g. Councilor Eadon stated she supported the ordinance based on the safety concerns not only near Durham Road but at the southerly end of 92nd Avenue near Cook Park. h. Chief of Police acknowledged the concerns regarding cars going into the neighborhood but recommended adoption of the ordinance to address the public safety concerns along 92nd Avenue. The notion to adopt Ordinance No. 86--67 was approved by a 3-2 majority vote of Council present. Councilors Johnson and Schwartz voting nay. 10. PUBLIC HEARING — TEMPORARY USE TU 12-86 — PAC WEST SALES — NPO 03 Request for a Temporary Use Permit to allow used car lot on a .15 acre site for one year. The property is zoned C--G (General Commercial) and is located at 12895 SW Pacific Highway (WCTM 2S1 260, Lot 2101) . A. Public Hearing Opened b. No declarations or challenges were filed. C. Community Development Director summarized the request noting that a similar use had been allowed for 1 year to another applicant at the same location. The applicant was proposing- to place 8-10 ' vehicles on the site and would provide for 4 customer parking spaces. Public Testimony: Proponents o Jeff Newville, 6825 SW Briarcliff Circle, Beaverton, requested Council approve the request for 1 year. o David Newville, 11905 NW Marylee Court, Portland, supported the request and stated he was available to answer questions. e. Communit. —Ivelopment Director stated staff would recommend approval for 1 year based on prior Council action for the same lot in 1985. f. Public Hearing Closed g. Council expressed concern about the location of the car lot on Pacific Highway and noted that there wasn't sufficient customer parking on the lot. Community Development Director stated that the temporary use was required since the lot was not improved to City standards with pavement, driveway apron, sidewalks, etc. Additional discussion occurred regarding the length of time for the use being limited to 6 months and a limit of display vehicles being added to the resolution. h. Resolution No. 87-01 A FINAL ORDER IN THE MATTER OF THE APPLICATION FOR TEMPORARY USE APPROVAL REQUESTED BY PAC WEST ',ALES, FILE NUMBER TU 12-86, APPROVING THE APPLICATION WITH CONDITIONS, ENTERING FINDINGS AND CONCLUSIONS. i. Motion by Councilor Edwards, seconded by Councilor Johnson to approve Resolution No. 87-01 with the following amendments: Section 2 (1) reflect approval being valid until July 12, 1987. Section 2 (5) add the following language: "There shall be allowed no more than 8 vehicles on display at any one time." Motion to adopt Resolution No. 87-01 was approved by a 4-1 majority vote of Council present. Councilor Eadon voting nay. RECESS COUNCIL MEETING: 8:18 PM 11. Page 5 - COUNCIL MINUTES - JANUARY 12, 1987 11.2 APPROVAL OF CONTRACT - TIGARD TRIANGLE TRAFFIC STUDY CONSULTANT City Engineer Wooley reported Associated Transportation Engineering & Planning, Inc. (ATEP) had requested $3,600 additional payment for traffic engineering services performed in the Tigard Traffic Circulation Study which were not covered under the contract with the City. If the additional funds were approved, it would make the total contract payment exceed the $15,000 limit and thus required Contract Review Board action. Lengthy discussion followed with Board Members expressing concern that this type of request should be handled prior to expenditure of the funds. City Engineer stated the City had benefited from the work, and the consultant was charging only for time spent and not overhead costs, thus he would recommend approval. Councilor Johnson stated this was not handled in a professional manner. Councilors Eadon, Edwards, and Schwartz expressed concern about the City's position in upholding the contract, the work accomplished, and the desire to maintain a future working relationship with ATEP. Motion by Councilor Eadon, seconded by Councilor Schwartz to approve the additional cost of $3600. Councilor Johnson expressed her respect for the City Engineer and his work but wanted the record clear she could not support this type of business method. Motion to approve was passed by a 4-1 majority vote of Council present. Councilor Johnson voted nay. 11.3 ADJOURNMENT: 8:34 PM RECONVENE COUNCIL MEETING 12. ADVANCE REFUNDING DISCUSSION a. City Administrator introduced Rebecca Marshall of Government Finance Associates Inc. and stated Council had requested additional information regarding the bond sale process. b. Rebecca Marshall introduced Patrick Clancy and noted he was also from Government Finance Associates. Ms. Marshall detailed the advantages of advance refunding of the bonds which were originally sold at an interest rate of over 12%. She stated the City could expect to receive a cost savings of over $100,000 by selling bonds at a lower rate of interest at this time. She further explained the process and impact of federal tax and bond regulations. Patrick Clancy advised Council that Government Finance Associates is currently working on a proposal to increase Tigard's bond rating with Moody's from "A" to "A-111. Tally of those votes resulted in a tie for the following. Laura McClellan. Laura has a complete knowledge of her job. She has con- stantly maintained a pace which her supervisor finds impossible to schedule. Her work is thorough and accurate. Her work has also been a benefit to the public and has made it much easier for us to provide information to the public. She is extremely organized and has saved the City money. Bob Landis. Bob was cited fo_ his improved attitude, teamwork and high quality of work. In particular, work performed as part of the Capital Improvement Progra:^ at Cook Park was singled out as excellent. He helped to keep that job on schedule and filled in when the Crew Chief was unavailable. A subsequent memo was circulated and tie breaking votes were cast for the above. The results will be announced at the Council Meeting on January 12, 1986. Wooley, City Engineer SUBJECT: Tigard Triangle Traffic Circulation Study In November of 1985, a contract was approved with Associated Transportation Engineering and Planning, Inc. (ATEP) for professional services on the Tigard Triangle Traffic Circulation Study. The contract provided for a lump-sum fee of $14,198.25. As the study progressed, it became clear that some additional work was required to assure that the study adequately addressed traffic on the three State highways which form the Triangle boundary. Because the State highways serve regional traffic as wall as local traffic, it was necessary to consider traffic patterns beyond the Triangle limits in order to adequately project future traffic in the Triangle area. The State and Metro assisted with the regional traffic review. However, it << was also necessary for ATEP to do additional traffic analysis and to provide considerable coordination with the State. The attached letter indicates that the additional work amounted to 100 hours. ATEP has completed the work. They did not request any amendment to the original contract prior to undertaking the additional work. Therefore, the City is not obligated to pay the additional costs. { However, the additional work was performed. The City did benefit from the additional work, as it led to a more thorough traffic analysis which will be helpful in planning ar{d designing the traffic improvements needed as the Triangle develops. ATEP has requested payment at their direct cost rate of $36 per hour (salaries plus benefits). Consultant rates are usually in the range of $50 to $60 per hour (or more) to cover their overhead costs and profits. Dear Randys As you are well aware, Associated Transportation Engineering & ' Planning, (ATEP) has over the past year and halt conducted the traffic circulation study for the Tigard Triangle. The original study scope and contract were based on the premise outlined in our proposal to the City in August of 1985. Since that time, the study scope was widened considerably when ODOT decided to participate in the overall application of the METRO modeling for the corridor. While this participation by ODOT has provided much needed information for use in the study, the extra time involved to produce the document has been, what I feel , over and above the original scope. ATEP has incurred an additional 100 hours of work, directly due to ODOT involvement. I would request that you and the city council consider reimbursing that expense to ATEP. This reimbursement would be at ATEP's direct cost rate, not at ATEP's normal billing rate. Attached is an invoice for $3,600.00 which is ATEP's direct cost rate for 100 hours without overhead. 1 believe that ODOT's participation in the study provided the City with a more comprehensive analysis of the Triangle and was a big benefit to us in the preparation of the report. The training program is going as well as can be expected, but future goals will include a complete overhaul of the field training officer program. During September a dialogue began with school district and high school neighborhood residents to attempt to find a solution to the high school area parking problems. The Tigard Police Department hosted a Tigard Chamber of Commerce TGIF. A tour s; of the Police facilities for participants was conducted. Later feedback from the Chamber was positive. The Department participated in the fall Town Hall meetings with staff and Council. Turnout was light, but participants reported that they found the meetings beneficial. Goals for October include my attendance at a 2-week B.P.S.T. training course for career officers coming into the State from out of state, Police wVloyment, and the completion of the redesign of squad cars. It is the intent that the new highly visible police cars and their lights represent a new spirit of visibility of openness for the Department. I feel that many of the barriers that have existed between P.D. staff and City staff and P.D. staff and citizens have been torn down. There is a new sense of openness developing in the department. The School Lunch Program is back in operation and officers are still parking and walking in residential areas. I anticipate that there will be a tailing off of walk and talk activity with colder wW wetter weather in November on. I spent two weeks at the B.P.S.T. Academy in a supplemental course for =' officers coming in from out of state employment. The course concentrated on Oregon criminal and traffic lase and shooting and drawing skills. I have to complete one day of the training sometime in January, as I missed one day to be in Tigard. The most significant event occurring in October was an anti-war demonstration geld by an anti-alar coalition from Portland against FLIR Industries, Tigard. The Department spent at least 50 hours in planning with FLIR officials and other law enforcement agencies. The demonstration occurred on the 23rd and resulted in 39 arrests for trespass. The handling of the demonstration occurred without incident or injury to anyone. The Department incurred approximately $11900 in overtime expenses. Departments participating Included: Tigard P.D., Washington County S.O., O.S.P. , Portland P.O. (Horse Patrol) and Tualatin Fire (standby ambulance). Monahan, Director,, Community Development SUBJECT: Monthly Report - November, 1986 During November, the Department of Community Development was involved in each of the following areas: Building permit activity was down from November of 1985 both in terms of number of permits and valuation. Year-to-date comparisons, as well as fiscal year trends, continue to illustrate the strength of 1986 activity. Through the initial five months of this fiscal year, activity is substantially higher than the comparable period in 1985. Codes enforcement activity slowed as the number of citizen complaints decreased. The Codes Enforcement Officer was able to close several cases which had been pending. = Planning activity continued on the Downtown project, Park Plan, and Albertson's proposal. This information will be an integral factor in seeking a new structure/governance model for WCCLS. On October 23 the ad hoc Structure and Governance Committee presented a revised report. Following discussion involving city managers, CAB members, librarians and committee members, it was decided to send the report to CAB. It is anticipated that CAB will meet with the Washington County Board of Commissioners for further discussion. Oigcovery Day: October 11 the library presented a special 4—hour program called "Discovery Day." Various persons from the community displayed and gave demonstrations related to their area of interest or expertise. These activities were rolated to materials held by the library. More than 40 exhibitors participated; attendance was estimated at 450 to 550. Automation: Staff began entering items into the data base which had not been part of the MARC record. Registration for the automated system has begun, but new cards will not be distributed until the system is on—line. Delinquent users (those who have books out and/or have not paid fines) will also be entered. Detection System: Kriesgo (cabinet makers) have begun the remodel to enable the detection system to perform at optimum. Books are still being stripped by volunteers and part—time aides. Voluteeers: Ninety—four (94) volunteers are registered to do various tasks. Two volunteers have taken over the composition and publishing of TYPELINE as a bi-monthly. Forty—two (42) volunteers gave 433 hours; daily average, 17.3 hours. Community assignees worked 42 hours; daily average 1.68 hours. Library Board gave 12 hours. Personnel: Valerie Yunker was promoted to the newly authorized position of Library Assistant I, technical services. The Library Assistant III, youth services, was recruited and filled from 77 applicants. To meet demand two Toddler Times were scheduled and filled. There is a waiting list for the next sessions which begin in January. 1987. Storytime (3-6 year old) attendance has increased considerably (see work indicators). The Homework Tours were offered Wednesday evenings with ten }' families participating. The annual Halloween party was held on October 31. If adopted, this resolution would show the continued support for the engineering and final construction of the by-pass project, namely, Tualatin-Sherwood Road and Edy Road. Also included is a request that the County assure that the $4.1 million earmarked for this project is dedicated and reserved, and not used for other County road priorities prior to the actual construction of this project. Besides some minor wording changes, the major modification is the inclusion of the City of Wilsonville in the resolution, at Mayor Stark's request. WHEREAS, Tualatin-Sherwood/Edy Road presently supports extremely heavy loads of automobile and truck traffic accessing the six cities of southeastern Washington County and traveling between Interstate Highway S and State Highway 99W, and absorbs the movement of goods and people well beyond its origins or capacity as a rural roadway; and WHEREAS, Tualatin-Sherwood/Edy Road functions as a regional-level traffic arterial, despite consisting of only two- lanes for most of its four mile length, having essentially no shoulders or turning lanes, extremely poor intersections and sight lines, a deteriorating road bed and surface, and experiences extreme congestion, particularly at the "Six Corners" Intersection with Highway 99W, and between Teton Avenue and Boones Ferry Road; and WHEREAS, rapid industrial and commercial expansion has occurred along Tualatin-Sherwood/Edy Road in the last few years, further overstepping the ability of the roadway to safely and efficiently meet traffic demands, with the result that passenger and commercial vehicle traffic is shifting to other streets within the six cities; and WHEREAS, the six cities have repeatedly identified Tualatin- Sherwood/Edy Road as the southeast county's first priority for Improvements to existing roadways, confirming this support through the MSTIP, the County Transportation Coordinating Committee, testimony before the Oregon Transportation Commission, prior individual City resolutions, and in numerous meetings that have included both appointed and elected officials; and WHEREAS, the six cities recognize the County's efforts to upgrade Tualatin-Sherwood/Edy Road, including a recent asphaltic overlay, the inclusion of $4.1 million in the successful County Road Levy for this roadway's reconstruction, the allocation of funds to start preliminary engineering immediately, and continuing efforts to secure match funding from State and Federal sources; and Page 1 - Resolution 87-0_� Y�h F 4 F WHEREAS, the six cities also recognize that planning for this project is complicated in that State and Federal participation will vary given the eventual status of the proposed "Western Bypass", that certain sections of Tualatin-Sherwood/Edy Road, particulary the Six Corners intersection, are clearly more a State than local responsibility, and that the $4.1 million currently three-lane dis roadway andlallorequiredient to pay or the intersection work; minimum threallocated and WHEREAS, with or without the Bypass, actual work on upgrading Tualatin-Sherwood/Edy Road should begin within eighteen .to thirty-six months in order to satiety rthe commitments izens to made the by City and County officials in urging County Road Levy, and to avoid the acceleration of traffic congestion in the southeastern county; and NOW, THEREFORE BE IT RESOLVED BY THE COUNCILS OF THE SIX CITIES: Section 1. INFORMATION SUMMARY The Washington County Gas Tax was repealed at the 11/4/86 general election. This funded the City's $200,000 street lighting funds and funded $100,000 to $150,000 per year of the City's street overlay program. With the elimination of these funds State Gas Tax fund is absorbing the street lighting needs and reduces the basic street maintenance monies available from that fund. Also the street overlay program must be eliminated due to lack of revenue. Based on the voters strong mandate to retain the Gas Tax at the May, 1986 election, the marginal defeat of the same tax just six months later reflects more an uncertainty on the part of the voters as to the intent and scope of the tax, than an objection to the tax itself. Staff has prepared a resolution which would encourage Washington County Commissoners to resubmit a County Gas Tax measure at the 3/31/87 election. Upon passage of this resolution, a copy will be forwarded to the Commissioners for their consideration. ALTERNATIVES CONSIDERED 1. Encourage Washington County Commissioners to place the County Gas Tax measure back on the 3/31/87 election ballot. 2. Look for other revenue sources. 3. Do nothing at this time. 5 FISCAL IMPACT 1. Would create about $300,000 revenue per year through County Gas Tax and allow continuance of the Tigard street maintenance and overlay programs. 2. Study options of local, regional, and state revenue sources. John and tiank are requesting a $2646.00 Systems development charge credit against building permit fees (see attached engineers estimate) collected on the property both now and in the future. ALTERNATIVES CONSIDERED 1. Approve the above request for a $2646.00 credit to be applied towards Street System Development charges collected with building permits both now and in the future (Approx. 4.5 permits at the current rate). When the property is fully developed, nine permits could be realized.
