Councilor Brian stated that this filing ;assures a vote of the citizens and it meets the Council goal of annexation, is; consistent with the Comprehensive Plan, is cost effective, and is similar to past practices of waiving fees of our own NPO's f. The intersection sight distance shall•'be:based on an eye height of 3.5 feet and an object height ( of 4.25 feet above the road, and shall be measured from the center of 108th Avenue at a point 10 feet south oil the edge, of the Durham -Road pavement, 18. Storm 'drainage from streets and: other public improvements shall be conveyed in closed conduits ;and discharged at points within the flood plain area. All storm drainage conduits shall be located in public rights-of—tray or in easements dedicated to the public. 19. Any on-site or off—site sanitary and storm sewer easement, which may be necessary for provision of service, shall be on City forms and approved by :he Engineering Section; on-.site : easements ;should be denoted on the subdivision plat. k 20. The existing (access--egress) easement across the north end of Tax Lots ¢100--#400 shall be vacated; the cost thereof to be borne by the applicant. 21. The lands which are within the 100 year flood plain shall be dedicated to the public for greenway purposes. The flood plain boundary shall be surveyed and clearly marred. ' Said markers shall be maintained' throughout the course of development. 9 22. The Lot Line Adjustment documents shall be recorded by the 'City and a' copy shall be forwarded to the applicant. In addition to the requirements of Sect ionl8.162.080 of the Code (copy enclosed), the applicant shall provide information illustrating the location of all utility facilities in the vicinity of the property line(s) to be adjusted. B. A registered engineer shall certify that each final lot line adjustment will not have an adverse impact upon the utility services within the subdivision and the service available to individual lots. C. Any relocation of utilities shall be >approved by the appropriate utility company. All cost incurred: shall be borne .by the developer or lot owner. i D. The proposed development will have an adverse impact on the use of 'this property. I 've just purchased property on 108th. Major considerations i n' my decision to purchase' this property were' the uncrowded and rural character of this section of ; Tigard. The sistent with this proposed Planned Unit Development is not con current use of the property. Minimum lot sizes should be maintained at or above 7500 sq feet E` to allow the area to maintain this rural appeal . If high density housing is allowed in the proposed development, • both 108th Street and Durham Road should receive major modifications. The intersection of_Durham and 108th should be widened to allow for left turn lanes and better visibility. A traffic light should be installed to accommodate the increased traffic thatwill be carried on 108th onto Durham. Both Durham Road and 108th Street should be widened to handle the increased traffic. Durham Road is especially hazardous due to the "rolling hill" type of construction. This does , not allow for good visibility around the intersection of 108th and Durham. 108th Street would also need to be widened to allow for bike paths and foot traffic that would have to compete with the increased, traffic. I am not in favor of approving the new development and urge each member of the council to consider the above concerns very carefully before making a decision. The Council item is a policy issue relating to the repeal of systems development charge credits for developers who provide public improvements which are more than the standard local streets system. No� . RECYCLING REPORT I INTRODUCTION This report has been prepared in response to SB 405 _ Opportunity to Recycle Act. The City of Tigard intends to comply fully with this legislation as illustrated by the programs described below. This report contains background information regarding City characteristics. A ' summary; of SS 405, the recycling programs which are currently in place, and additional programs that will be operational on` or before July 1, 1986. Il. REQUIRM ENTS OF SB 405 The main thrust of this legislation which was passed on August 4, 1984 is to reduce the amount f solid waste which is deposited in landfills statewide. The bill establishes priorities for dealing with solid waste. In order of preference, the solid waste problems confronting the state are to be addressed in the following' manner: 1. REDUCE the amount of waste generated. 2 REUSE items when possible. 3. RECYCLE all items that cannot be recycled. 4. ENERGY RECOVERY of all combustible wastes which are not reusable or recyclable. 5. DISPOSAL of remaining material in a landfill. The bill states that the "opportunity to recycle" mast be made available to all persons in the state including households, businesses, and industry. The "opportunity to recycle" includes at a minimum: 1. A recycling depot located either at a disposal site or at another site more convenient to the people being served. 2. Monthlyon route collection of source separated recyclable material within urban growth boundaries in cities with populations of 4,000 or more. 3. A public education and promotion program that encourages participation in recycling and notifies each person about the recycling program available to thea. The method by which the recycling program is implemented and by whom is not specified in the act. It is envisioned to be a cooperative 'effort involving local governments, waste hauling companies, nonprofit organizations, and citizens. s The State Department of Environmental Quality (DEQ) is _responsible to {� ensure that the provisions of the act will be implemented by July 1, III 1986. The state has been divided' into "wasteshed" for the purpose of 3 reporting 'local programs to DEQ ,for review. Tigard is within the I i y a, r Washington County wasteshed. The Washington County health Department will be responsible for assembling the reports submitted by the local jurisdictions into the wasteshed report which will in turn be submitted to DEQ. DEQ recommends that at a minimum, the "opportunity to recycle" should be provided in Tigard for the following materials: 1. Residential uses - used gator, oil, newspaper, container glass, aluminum, corrugated cardboard, and tin cans. 2. Commercial uses ferrous metal, nonferrous metal, used motor oil, container glass, corrugated' cardboard, tin ,cans,; and high-grade (ledger) paper. III. PRESENT RECYCLING OPPORTUNITIES AND PROGRAMS The 'City of Tigard is a' community of approximately 20,000 persons located in the 'southwest portion of the Portland metropolitan area. The City is served by three 'waste hauling franchises which are Frank's Disposal Service, Filler's Sanitary Service, and Schmidt's Sanitary Service (see Appendix A). At the present time, Miller's and Schmidt's are providing curbside recycling for glass, tin, aluminum, ;newspaperil corrugated cardboard, and motor oil. Newspaper is collected daily and the remaining items are gathered once per month. Nonprofit *" organizations such as the Lions Club and Boy Scouts also provide recycling services, particularly for newspaper. Commercial accounts for Miller's have the 'opportunity to recycle the materials identified in the above chart. The customer is charged for hauling the material and a rebate is given once a month depending upon the money received for the recycled material. Schmidt's offers weekly service at no charge for recyclable material Reminders are sent with each bill and new customers are notified that recyclable materials will be collected at no charge. Presently, corrugated cardboard is the only material that is recycled in any significant Quantity. Educational and promotional work is currently being conducted by the waste haulers and the Tigard and Beaverton School' Districts.. Miller's and Schmidt's have been sending information to residential and commercial customers regarding the curbside program and how to prepare recyclable materials Examples of the materials distributed are attached (Appendix B) The Tigard and Beaverton School Districts provide educational services for the City of Tigard. Both districts do include coursework related to recycling but there is no standardized approach for educating 'students. Representatives from both districts indicated a willingness to include more recycling information in the curriculum, particularly if the educational materials or other assistance is provided. The City of ,Tigard formed the Utilities and Franchise Committee in December, 1985 to work with the three waste hauling franchises to review rates and to develop the City's recycling program. This eight member committee was appointed , by the City Council along with the 'three waste '. 5 as ex off members. The message is Simple, let the county know you support reviewing this request, developing a proposal, and determining exactly where and hod these tax dollars should be allocated. Our request for $72,000 is less than 6% of the $1.5 million hotel/motel tax dollars collected. It isless than the increased hotel/motel tax revenue anticipated for. this year. Given the fact that private industry is responsible for more than 80% of the hotel/motel business in the county, and that the dollars were orginally said to be designated for "economic development", the TVEDC request is extremely logical and practical, not to mention timely. I don't want you to commit to a program you don't feel totally comfortable with. However, you must let the county knom you are willing to examine the allocation of these designated tags dollars to 'a program that will truly see results. However, we may have a great "opportunity" now. Business and political leaders from Portland have scheduled a vote on the regionalconvention center for this November. To gain passage for the S65 million proposal, they need •the united support of Washington County business and political;leaders. The proposal, to build a convention center to serve this region, is a positive, well thought _. out initiative. It is this proposal that creates the leverage we couldn't generate on our own. The issue is clear. The economic structure and future of Washington County is tied directly to our transportation, system. That system now is inadequate. improving the transportation system must be our first, second and third priority, and we must work together to see it get done. I have spoken to many business leaders and politicans in Washington County. To a person they agree that our support of the Convention Center must be tied to commitments made by the City of Portland. These commitments are three fold. First,; recognition, that Washington County needs a major, North/South transportation system. This, by the way, will have di.rect,and positive effects on Portland. Second, there must be a commitment that Washington County receive its appropriate allocation of money to provide- funding levels necessary to salve our transportation problems beyond the North/South issues. Finally a long term issue, that we all work to change the gas tax allocation formula for transportation dollars that currently works against our• county. We have in fact reduced our Department structure from six Departments in 1981 to four in 1986. The success of the Community Development Department created from the former Building, Planning and Engi,neeringjPublic Works Departments shows how organizational streamlining' can control costs and improve services, all at the same time. The City and related orkloads 'have now grown to the point where I, feel ,that the final organizational' consolidation in our streamliningplan may now be appropriate. ; An additional part of our operating strategy has been to design and change City wide' systems in the City Administrator's Office and then assign them,to a ;specific �x. line Department for day-to-day operation. The size of the City Administrator's Office and related overload costs can then be kept to a minimum. I believe the Council 's commitment to an cp_q2in2 Community Involvement and Public information program is not_just_a one time goal and now should be transferred as an operating Department responsibility. i recorfmiend that the Library Department and the Finance and Services Department be consolidated into one new Department of Community Services. I further recom mend that the Community Involvement/Public Information programs in the City Administrator's Office be transferred to the Community Services Department. if implemented July 1, 1986, with the start of the FY 1986-87 Budget, the .fiscal impact is marginal since all positions but the Director's position can be hand- led by andled>by existing personnel transferred into the new structure. The Budget Com mittee`s Recommended Operating'Budget had 100.5 FTE and this proposal involves 101:FTE for 1986-87, or less than 12% in Personnel Services costs. I believe this marginal cost can easily ,be recovered by improved productivity and effective- ness, just has been the case in Community Development. SUGGESTED ACTION: That Council move to direct the City Administrator to imple meet the Community Services Department within the FY-1986-87-Budget. Monahan, Director, Community Development- SUBJECT: Staffing Request — Building;Inspector "B" The staffing budgeted for the Building Section of Community Development is as � follows: Building (Official — Ed Malden Inspector 'A — Brad Roast Inspector A — Tom Plescher Office Assistant II --'Julie Ouelette As you are aware, building activityhas been at a -five year high since January. Single family residential development is trending at 159% of 1985, our previous high year since the 1970's. Building inspections, plan checks, 71, and permit processing have been keeping the four 'regular employees more than busy. The present regular; staffing has been in place since March. Prior to that staff size fluctuated from 'a, low of two, following resignations, to a high;of four last summer. Development for the remainder of 1986 is expected to trend at a rate of 25-30 single gamily permits a month, or a total of 356 to 400 units. Multi—family and .commercial permit activity is anticipated also. So far, commercial activity is running almost double for comparable time last year, whale no multi—family permits have been issued. A one hundred unit complex is, however, ready for permit issuance. The increased building activity has resulted in lack of resource for codes enforcement. To remedy this, T hired George Steele as a temporary Inspector, B Level, to enforce civil infractions violations and pursue unpaid business taxes. So far, George has been very effective. lie has resolved a number of nuisance complaints since May, 14th. Forty seven complaints have been investigated, twenty seven complaints have been resolved. Some significant violations viere resolved which would not have been easily disposed of without George's assistance. In addition, George has been making calls to businesses which are delinquent in payment of business taxes. Eighty-two such calls were made in May. Those still in business will receive a follow-up letter and 3 "application. Revenues have begun to arrive from this effort ' n 'i 1 memo to City Council June 12, 1986 't } Page 2 i t I propose to add the position of Inspector B level as a regular position for FY 1987!88." The position would have primary responsibility for civil infraction enforcement, business tax enforcement, and some building inspection responsibility. George recently received his certification as an A level structural 'inspector from the State. He is qualified to perform some of the same functions as our other inspectors in cases of heavy inspection volume, vacations, or other circumstances requiring him to fill in. The area of civil infraction codes enforcement is not a revenue producing area, but 'instead, a public information and publicrelations area. So far, George has tt'ept up with the increased summer complaint volume. Given Tigard's new tax base; continued uniform enforcement is very `important. Implementation Of the new, infractions ordinance, which went into effect on May 14th, will havea significant effect on the appearance and livability of Tigard. Business Tax revenues are another prime concern of this position. As of July 1 the Department of Community ;Development will assume full responsibility for implementing, the program. For- the first time, one department will have total control. This should help to increase the uniform application of the tax. Without consistent field check, monitoring of compliance, and notification by an inspector, the program cannot gain full acceptance by the community or reach its revenue;potential. I propose that the position of Inspector B Level be funded out of contingency .:. funds for FY 1986/87. The position would be a regular position at a salary, of $1,698/per month. ' Benefits and potential cost of living and merit raise could briny the total ,cost to approximately $26,000. A further consideration` is that George was referred to us following his rehabilitation from a work—related accident. It is possible that should we have George in a regular position that one half of his 'salary for six, months, or $5,100 would be reimbursed to the City. Given this arrangement, the reimbursement would cover the costs of all benefits, thus bringing the cost to the City down to $20,500, the cost of a temporary employee with no benefits at the same salary rate. I recommend that we have George as a regular employee to establish him in the position and allow us to maintain some continuity in our civil infraction ordinance enforcement and business tax enforcement. I estimate that business tax revenues, estimated to be only $56,000 for thr year ending June 30, 1986, can be raised to $80-$90,000 with a concerted enforcement effort. The cost of funding the position can be recovered with this position funded and the other allocations of staff time which we have planned for. Assistance from department secretarial support and planners will be needed to revamp the system. Wehaveset this process in motion and expect to have recommendations for you this fall. That the selected officer's role would include education, counseling and involvement with student and faculty activities. The selected d individual would be treated by the District as a full-time faculty E member in terms of'his/her involvement in school activities. The selected individual' would act in a liaison role representing 'law enforcement to district students, faculty and staff. The SRO would not conduct investigations him/herself, but would coordinate investigative -efforts of the District and appropriate law enforcement agencies in criminal/drug investigations. The SRO would make arrests s as appropriate in on view situations. 2. That the SRO would be a sworn Tigard Police Officer selected from a pool of; eligible Tigard Police Officers who apply for the position. 1 Final selection would be based on the recommendation of an assessment center process, Assessors would be composed of representatives of the School District and the City of Tigard. That funding for the first year would be on a 50/50 basis for salary, benefits and equipment for a replacement officer and that continued funding would be on a year-to-year basis subject to approval of the Tigard City Council and -the Tigard School District Board of Directors. i 4. That selection of the individual should be completed before September i 1, 1986, so that the SRO would be in place by that date. The SRO would attend all faculty inservice conducted during the last week of August. 5, That the selected individual be afforded the opportunity of a formal i SRO Training Program at a credible institution providing such training. This will allow for an initial hearing on July 24, 1986,; and an additional hearing on August 21, 1986, if needed. Reid Iford, Chairman of CPO #4 will be the individual filing the 'annexation 'petition. Staff has been assisting Mr. Iford as much as possible to insure that all ` legal requirements are "met with on a timely basis. The only unresolved ques- tion is that of the $840.00 filing fee. It appearsthat the residents of Metzger do not have sufficient resources for the filing fee and have asked' v for our assistance in complying with this portion of the filing process.
