3. PRESENTATION OF KEYS TO THE CITY - The Mayor read the proclamation for
Miss Neva Root and declared July 15, 1985 as Neva Root day.
A. CODES ENFORCEMENT PRIORITY DISCUSSION--Bill Monahan discussed the
priority schedule with council. The consensus was the priority schedule
is appropriate.
2. VISITOR'S AGENDA---JB Bishop discussed the maintenance of the right of
way at the South entrance of Main Street. It is to be maintained by the
State.
5 CAPITAL PROJECT/LID REPORT -Frank Currie discussed the local improvement
districts currently in ,the initiation an request stages. Council
directed Mr. Currie to pursue interests of other property owners in the
following projects: Greenburg/North Dakota, Cherry Street Sewer LID and
Little Bull Mtn/100th Sewer. A resolution of intent for the Hall
Blvd/Burnham Street LID will be before council July 15, 1985. 109th
Cantebury to be pursued by developer without City local improvement
district. Discussion regarding a traffic signal at 99W and Canterbury
followed.
6. SCHOLLS FERRY ROAD PLAN DISCUSSION--a map with three alternate routes
for a connection between Murray Blvd. and 135th was shown and discussed
with Council. Russ Krueger informed Council that his project near 135th
has been redlined by Washington County until something is done about
135th. He requested Council's assistance in getting his project back in
production. Staff suggested that with the Transportation Committee
concurrence the City pass a resolution July 15, 1985 accepting all of
the County Roads within the City as City streets. This would solve the
" problem for Russ Krueger and other property owners. Bob Jean stated
there were actually four things going on: 1. Resolution accepting 135th
as a City street. 2. Develop standards and conditions. 3. Area of
dispute - annexations/alignment and A. Actual intersection and
extension are in the City already and are being planned up front with
the City of Beaverton and Washington County.
7. PERFORMANCE AUDITING DISCUSSION--Bob Jean stated there were three
options to be considered: 1. Comprehensive plan as outlined
previously, 2. operations audit only and 3. able to Spring. After
much discussionit was the consensus that this fall the City would
organize the Committee and -then begin the audit process in the spring.

The attached memo on Codes Enforcement was included in Council mail at your last
meeting. The memo discusses the progress which the Department of community
Development has made in addressing City Council priorities during the fiscal year.
The Council should review the priorities and determine if the samepriorities are
. proper for the next year, given the increased resources now available in %he
person of the City's new Codes Enforcement officer, Dan Blanchard.
The revisions to the Civil Infractions ordinance will be ready for your review
shortly.

1. Review the report and set Council priorities for code enforcement for
FY 85-86.
2. Review the report and maintain the same priorities for the next fiscal-year.
SUGGESTED ACTION
The staff suggests that the City Council review the priorities for codes enforcement

SUBJECT: Codes Enforcement Report
The Council has several issues to deal with relative to Codes Enforcement.
They:are:
1. Civil Infraction Ordinances - pending revisions to the process
which we follow to enforce zoning. building, nuisance and other
codes.
2. Codes Enforcement Report — progress to date during FY 1985,
3. Green River Ordinance — the adequacy of our existing ordinance
which was recently challenged by Colleen Fulton, Case No. 84-2253,
Following is my analysis of codes enforcement which is intended to stimulate
your thoughts and suggestions:
i. Civil Infractions Ordinance — On May 20, 1985, the Council
received a copy of a proposed civil infraction ordinance which
will allow codes enforcement personnel to serve notice to code
violators in a more efficient and timely manner. The Council was
asked to review the ordinance and provide input. The staff has
slowed down the adoption at the request of the ordinance author,
Attorney Adrianne Brockman. Adrianne feels that the City
Attorney's staff litigators should provide input before adoption.
The input should be provided shortly. Therefore, at this time,
the staff requests that the City Council provide input to the
ordinance with the knowledge that the staff will come back at a
later date to discuss with you the ordinance adoption process. We
hope to be back before you in early July for adoption.
2. Codes Enforcement Report — In August, 1984, the City Council set
the following Codes Enforcement Priorities:

As a result of this discussion, the Council determined that the Building
Division should devote one half of a full time equivalent employee to codes
` enforcement. In addition, the Finance Department would devote one half of an
employee to provide the clerical services to the business tax program.
Following the priority setting session, the Building Division allocated eight
hours per week of Brad Roast's time (A Level Inspector); eight hours per week
of Ed Walden's time (Building Official), and four (4) hours per t-leek of
Colleen Zielinski'stime (Office Assistant I). The Division did Lois by
setting aside one full day per week to codes enforcement for both Brad and
Ed. Colleen provided support by taking complaints over the phone, sending out
requests for code compliance, scheduling, and secretarial support to the
program
The process worked well in September and October, however, in November, the
system began to break down. Other demands such as vacation leave, sick leave,
maternity leave, and a higher than expected level of building activity began
to take their toll. The impact was a cut back in service where the emphasis
was switched to notification to potential code violators by letter, instead of
personal site'visits.
From November through May, the level of service fluctuated depending on
available time and the seriousness of code complaints. During this period,
much more of my own time was devoted to the codes enforcement program than I
would have liked. More issues came to my attention due to our inability to
address complaints at a lower level.
Here is an estimate of the time spent by the building inspectors during the
subject period. The time spent by the Office Assistant and the Director
exceeded those anticipated and are not shown.

Due to the resources available, our cods enforcement program from September
through" May has been limited to handling citizen initiated complaints'. Much
of our response to complains has involved the sending of a form letter to a
property owner informing him of the possible violations and requesting
voluntary _ compliance. This year we have had great success in getting the
_attention of , property owners who then call us and outline how they will
comply. In many cases, we need to educate the public that a code exists which
prohibits zertain activity. Voluntary compliance is our goal.
In May we hired a new C Level Building Inspector to assist in the large volume
of building activity and to coordinate our codes enforcement program. Dan
Blanchard, formerly a building inspector in Newburg, was hired and began work
on May 28, 1985. Dan is now concentrating 100% of his time to codes
enforcement. He is working with Colleen Zielinski, Building Division
Secretary, to develop a better codes enforcement system. We have received
assistance through the City of Beaverton and it's Codes Enforcement Officer,
Bruce ;Cleeton. We intend to adopt many of the procedures and techniques
employed in Beaverton.
Dan has directed his attention at cleaning up the complaints which were
outstanding at the time of his arrival. Among those complaints were some long
standing issues which required constant follow—through. To date, Dan has had
verygood success in compelling voluntary compliance concerning issues of
signs, abandoned houses, and temporary uses. He has also initiated systems of
identifying problems which have not been reported to the City.
I expect that over the summer, we will see a much improved codes enforcement
system. While Dan devotes 100% of his time to codes enforcement, Brad Roast
and Ed Walden are no longer involved in codes enforcement except to the extent
of reporting violations to Dan; providing codes interpretations and training
to Dan, and in the case of Ed, supervisory assistance.

Brad and Ed are now free to spend more time on building plan reviews and
_inspections. Eventually, once the codes enforcement system is running
inspectiDan will devote a portion of his time to building inspections. ` Much

3. Green River Ordinance - A challenge has been issued to our Green River _
Ordinance which prohibits door-to-door sales. The City Attorney s

whether or not a future review of the need for such an ordinance is
necessary. We presently interpret the ordinance to prohibit the sale of
goods on a door-to-door -basis where the property occupant has not

Are there sufficient warrants to cause the installation of a traffic signal, and
are these warrants sufficient to cause the creation of an L.I.D. to improve this
intersectionand adjacent property frontages to City standard.
INFORMATION SUMMARY
Considerable traffic congestion at the intersection of S.W. Greenburg Road and
S.W. North Dakota and the apparent need for street improvements as a condition
of development prompted Council to ask that a traffic study be initiated for
this intersection and on Greenburg Road, particularly as related to S.W. Cascade
Road
r The report indicates that warrants for a traffic are met due to volume and due
( to interruption of continuous traffic. The report states that on a scale of
A through F. the level of service for this intersection is "E". (Congestion and
intolerable delays.)
The report recommends installation of a multi—phased traffic signal, a need for
350 feet of right turn stacking distance from Tiedeman on to Greenburg; a need
for a separate right turn lane and 400 feet of stacking distance for traffic
turning right from Greenburg onto Tiedeman and future improvements to 5 lanes on
Greenburg at this location.
The report further indicates no negative impacts on the traffic at Cascade and
Greenburg due to the signal, and in fact indicate 40 — 12 second gaps will be
created for northbound traffic turning from Cascade.
A conflict with stacking distance for left turns both east and west off
Greenburg was observed.
ALTERNATIVES CONSIDERED
1. Authorize a preliminary Engineer's Report for the formation of a L.I.D.
to improve this intersection to City standards in all three directions.
(See approximate district boundary on attached map).
2. Install only a traffic signal and make interim improvements for a minimum
storage including curbs, sidewalks and drainage, and a traffic signal.
3. Do nothing.
SUGGESTED ACTION
Staff recommends Council initiate a Local Improvement District for the purpose
of improving street frontage on all properties affected by the need for
stand ard'-improvements as indicated by engineer's report.

INTRODUCTION
This report represents the findings of a traffic signal warrant
evaluation for the intersection of Greenburg Road and Tiedeman
Avenue located in the City of Tigard, Washington County, Or. I
The purpose of this transportation analysis is to determine if a
traffic signal is warranted as dictated by the Manual on- Uniform
Traffic Control Devices as adopted by the StateofOregon.

SW Greenburg , road is a two (2) lane arterial roadway running
between SW Hall Blvd and SW Pacific Highway in Tigard. The
existing roadway at Tiedeman is approximately 38 feet in width
with little or no shoulders except for a lu foot wide bikeway on
the east side of the street.
Tiedeman Ave is a 'two (2) lane collector street approximately 38
feet in width with a designated bike path located on the south
side of the street.
Greenburg road at Tiedeman Ave. is currently striped for one lane
northbound, one lane southbound and a left turn pocket.- Tiedeman
Ave is currently striped for right and loft turn lanes with one
westbound travel lane.
WARRANTEVALUATION
The Manual on Uniform Traffic Control Devices in Part IV, Section
C outlines the warrants required to install a traffic signal at
an intersection.
Traffic control signals should not be installed unless one or
more of the following signal warrants are met:
Warrant 1 - Minimum Vehicular volume
Warrant 2 - Interruption of continuous traffic
Warrant 3 - Minimum Pedestrian volume
Warrant 4 - School Crossing
Warrant 5 - Progressive movement
Warrant b - Accident experience
Warrant 7 - Systems
Warrant 8 - Combination of Warrants
The intersection of Greenburg Road and Tiedeman was evaluated
according to the above warrants and as shown on Exhibit 1 meets
the minimum warrants 1 and 2
CAPACITY ANALYSIS
The measurement of a roadway's ability to process the demand of
vehicles is expressed as Levels of Service(LOS) . The maximum LOS
"E" is known, as Capacity. The Capacity of a roadway is measured
at th= ICLation of least capacity such as an intersection. The
Transportation Research Circular i#212 was used in determination
of the Levels of Service on the 2- way stop streets as outlined
by the Oregon Department of Transportation (ODOT) . See Exhibit 2
Capacity calculations were done on the intersection of Greenburg
Road and Tiedeman Avenue using two (2) scenario's

limited to approximately 400 feet north of the intersection and
Cascade Drive is approximately 950 north of Tiedeman, Cascade
Drive will not be affected by the stacking at Tiedeman.
The problem as it exists at Cascade Drive cannot be eliminated
without the installation of a, traffic signal that is
interconnected to the freeway system. This would allow adequate
gaps in traffic for exiting traffic.

Feasibility Study
SCOPE OF PROJECT
At the City of Tigard's request, kpff consulting engineers has conducted a
feasibility study for a proposed street LID on S.W. Hall Blvd. and S.W.
Burnham Street near the Tigard Civic Center. Both full-street and
half-street improvements were evaluated. The proposed half-street street
improvements would begin on the south side of Burnham Street at the
northwest corner of Tax- Lot 200, Tax Map 2S12DA, which is presently
occupied by Tigard Electric Co,, and run along the south side of Burnham
Street east to Hall Blvd. and then along the west side of Hall Blvd. to the
centerline of S.W. O'Mara Street. South of the Fanno Creek bridge
approximately 160 feet of street mould be cut to accommodate a vertical
curve. The full street width would be improved through the cut area. Ebr
the full-street improvement the east side of Hall Blvd. between the
Burlington Northern Railroad crossing and O'Mara would also be included.
Existing conditions have been defined on S.W. Hall Blvd. and Burnham
Street; alternatives have been evaluated for two street alignnents, and for
street improvement and right--of-way widths; construction quantitites have
been estimated and cost estimates prepared for half- and full-street
improvements; alternative recamTendations have been made; and ownership and
land values for property abutting the improved sections of Burnham Street
and Hall Blvd. have been determined and a method of assessment proposed.
Boundaries have been proposed for the LID and are shown in Appendix A.
Runoff calculations have been performed for an area covering O'Mara and
Edgewood Streets that may be tributary to a proposed storm drain along the
west side of Hall Blvd. Zhey are summarized in Appendix B.

RECOMMUMATIONS
It is recommended that the S.W. Hall Blvd. Street LID include:
o A new centerline alignment through the reverse curves at the intersection
of Hall and Burnham, flattening the curves by increasing the radii to 240
feet.
o A half-street improvement along the west side of Hall Blvd. and the south
side of Burnham Street.
o A basic street improvement along Hall Blvd. consisting of a 28-foot wide
street section from centerline to curb in a 40-foot wide right-of-way
from centerline, which is within City of Tigard standards for an arterial
street.
o A street improvement along Burnham Street consisting of a 22-foot wide
street section from centerline to curb in a 30-foot wide right-of-way
from centerline, which is within City of Tigard standards for a major
collector.
o An assessment method based 50 percent on front footage and 50 percent on
the area within 200 feet of the proposed right-of-way.
o A traffic signal installation at the intersection of Hall Blvd. and
Burnham Street.

crossing and O'Mara Street with two traffic lanes.

up Burnham to join a storm drain along the north side of Burnham, crosses
Burnham to join a storm drain on the south side of Burnham, then returns to
Hall Blvd., where it outfalls in a ditch near the proposed driveway to the
Civic Center.
Burnham Street
improvements are currently 30 feet wide and consist of two
traffic lanes and a bike lane on the south side of the street.
Problems with the existingstreet

distance available at the intersection of Hall and Burnham, the Lack of
turning lanes, narrow traffic lanes, and inadequate surface and storm
drainage facilities.
PRWBCT ALTERNATIVES
A1i��ment
TWO street alignments were evaluated along Hall Blvd.
The alignments vary at the reverse curve in the vicinity of the
intersection with S.W. Burnham Street. The first alignment would follow
the centerline of the existing right-of--way. this alignment allows 6 feet `
Of clearance between the corner of the Amber Foods building on Tax Lot 100
and the curb of the proposed improvements.

Inprovements
Me proposed full-street improvements along Hall Blvd. consist of new
Pavement, curbs, sidewalks, and storm sewers. The basic bpro,,Mment south
Of Burnham Street would be 56 feet curb to curb and would provide a 14-foot
traffic and 6-foot bike lane each way and a 16-fit wide cmnnan turn lane.
Eight-foot wide sidewalks would be constructed along bath sides of the
street.
Zhe propos improvements on the east half of Hall between the railroad and
S.W. Burnham Street would be 22 feet wide from centerline to curb and would
Provide for a 14-foot traffic lane and 8 feet of a 16-foot
common turn
lane. There would be a transition in the northbound direction from 28 feet
to 22 feet from centerline to garb at the intersection with Burnham Street.
Bicycle traffic from south of Burnham Street would be directed to the west
side of Hall Blvd. at Burnham.
The proposed improvements along the south side of Burnham Street would
include sidewalk, curbs, storm drains and new paving to centerline. the
Proposed improvement would be 22 feet wide from centerline to curb which
would allow for a: 4-foot bike lane, a 12-foot traffic lane, and 8 feet of a
16-foot c=Wn turn lane. Zhe sidewalks would be five feet wide.
The Hall Blvd. bridge over Fanno Creek would rot be included in the street
improvements. It would not be economically feasible to replace the bridge
at this time and because Hall Blvd. is an arterial, the benefits of
replacing ac'
ng the bridge would accrue to a much larger area than the proposed
LID.

The Tigard Water District is 'planning on providing half-street improvements
for the west half of S.W. Hall Blvd. and east half of S.W. Burnham across
F' from Tax Tats 200 (Tigard Electric) and 100 (Amber Foods), when they deve-
lop their new office site. If the full-street improvement option were
chosen, Ball Blvd. would then be completely improved from the railroad to
O'Mara.
Right-of-Way
The basic right-of-way for the proposed improvements would be 80 feet wide
from side to side or 40 feet to the centerline. The 80-foot right-of-way
width would allow for a 56-foot wide street, curb to curb, and 8-foot
sia;:Iks and 4-foot planting strips on both sides. It also would allow
for future upgrading of the street to four traffic lanes when the oommon
turn lane and planting strips are eliminated.
The right-of-way would be increased to 46 feet to centerline at the bus
turnout for the Civic Center.
North of Burnham on the east side of Hall Blvd. the right-of-way would be
maintained at 30 feet from the existing centerline so that the existing
Amber Foods building on Tax lot 100 remains outside the right-of-way. This
allows for a 22-foot street improvement from centerline to curb from the
building north to the railroad. Going south through the reverse curve at
the intersection with Burnham, the street improvement gradually increases
to 28 feet for both the existing and flattened alignments. For the
existing alignment the street improvement would be 24 feet wide at the
building corner leaving room for a 6-foot sidewalk. For the flattened
alignment, the proposed centerline has been shifted approximately 1 foot
west of the existing centerline at the building corner and the proposed
street improvement is 23 feet wide there. This leaves room for an 8-foot
sidewalk. 7he right-of-way from the proposed centerline would be 31 feet.
On the west side of Hall Blvd. between Burnham Street and the Civic Center
property, the right-of-may would be 30 feet to centerline for the new
( alignment across Tax Lot 200 (Tigard Electric) and across Tax lot 400
(Sturgis). Zhe right-of-way across Tax Trots 200 and 400 would be two feet
back -foot sidewalk easement would be required

across the property for sidewalk construction. The reduced right-of-way
width would give Sturgis and Tigard Electric Co. more latitude in improving
property._ - their rt This is a major concern of Tigard Electric Co. especially
since they will have - to dedicate additional right-of-way for the S.W.
Burnham Street improvements.
The right-of-way for the proposed improvements on Burnham Street would be
30 feet to centerline, which will take 10 feet off the north side of Tigard
Electric Company's property.
The right-of-way acquisition requirements for the two street aligns are
shown in Table 1,
A typical street improvement detail is shown in Figure 1. Variations in
right-of-way arra street widths are shown in Figure 2.
CONSTRUCTION COST ESTIMATE
Since the two centerline alignments evaluated only varied at most 7 feet
through the reverse curves, any differences in construction costs would be
very small. An estimate of the probable cost of the street and related
utility improvements has been developed for the half-street and full-street
improvements for either alignment:

The cost of land acquisition was set at zero assuming property owners
within the LID would provide right-of-way at no cost. An additional 30
percent was added to the construction ' cost to account for project
administration, engineering and a contingency fund.
The above costs are not guaranteed, but represent the engineer's best
estimate of the prices that can be expected and the amounts that should be
budgeted if the proposed project is let to competitive bidding during the
summer of 1985.
RECOMMENDED ALTERNATIVE
It is recommended that the proposed Hall Blvd. improvements follow the new
centerline alignment with the centerline radii of the two horizontal curves
increased to 240 feet. This alternative was recommended in the traffic
study report done separately from this report and it reflects the existing
pavement striping layout. Over time the pavement striping, which should
follow the centerline of the right-of--way, has shifted away from the exist-
ing right-of-way centerline. The recommended alternative requires that the
right-o€-way be adjusted so that the centerline of the street and right-of-
way are coincident. The recommended alternative shifts the centerline
approximately 7 feet west of the existing centerline through the reverse
curves.
It is also recomimnded that only the west half of Hall Blvd. be improved.
During a meeting with property owners to discuss the proposed LID, it
became clear that most property owners along the east side of Hall Blvd.
were not interested in participating in the LID. Currently there is little
interest in developing property on the east side of Hall Blvd.
It is recommended that a traffic signal be installed at the intersection of
S.W. Hall Blvd. and S.W. Burnham Street. This intersection meets the mini-
mum warrants for the installation of a traffic signal based on Warrant 2,
Interruption of Continuous Traffic, "Manual on Uniform Traffic Control
Devices". Traffic flow information was estimated from a series of traffic
surveys conducted at the site. These traffic surveys were commissioned by
kpff and the results are presented in "City of Tigard, Ball Blvd. at Burn-
ham Road, Preliminary Engineering Review", May 6, 1985, Robert Keech, P.E.,

Ownership of property within the street LID is shown in Table 2 along with
assessed or appraised property values or recent purchase prices. ,Ownership
was determined from the Washington Couny tax toll along with the assessed
value when that information was given. %ben assessed values were not
given, they were determined from recent purchase prices, ` appraisals, or
estimated using the assessed values for similar pieces of property. Rhese
special cases are noted in Table 2. During a meeting with the City of
Tigard and affected property owners, it was discussed that LID boundaries
should appropriately be set back 200 feet from the proposed right-of-way
line. At the intersection of O'Mara and Hall Blvd. the boundary would
extend northwest from the northwest corner of the intersection at a, 45
degree angle to eliminate the potential for a double assessment of Tax Lot
701 should O'Mara Street be improved in the future. Part of Tax lot 400 is
within 200 feet of the right-of-way line for the south half of Burnham
Street but outside the 200-foot line for Hall Blvd. Since Tax Lot 400 does
not have access to Burnham, this area was excluded from the LID, and the
boundary placed along the property line between Tax Lots 200 and 400.
Within the LID boundaries shown in Appendix A, the project oasts would be
distributed by the front footage along the proposed right-of-way line and
by land area within the LID boundaries. Both would be weighted by 50
percent,
Property area within the LID and front footage at the proposed right-of-way
are shown in Table 2 with the proposed assesammt rates.
These assessment rates are approximate. Zhe actual assessment will be
based an final project casts and actual assessed areas and front footages.

RFMFF CALC'UTATIONS
Runoff calculations were performed for an area covering Edgewood and O'Mara
Streets that would be tributary to a proposed storm drain along the west
side of Hall Blvd. The 10 and 25-rear flows were determined using the
rational method (Q=CiA) assuming that storm drains and inlets would be
installed along Edgewood and O'Mara Streets.
The coefficient of runoff, C, was determined from the zoning districts
shown on the Tigard Comprehensive Plan Map, dated May 9, 1983, and the
average slope of the drainage area. All the drainage area, except for a
small area between Hall Blvd., Fanno Creek and O'Mara Street, is zoned
R-4.5 or residential with a 7,500 square fact minimum lot size. The small
area along Hall is zoned R-12 (PD) or 12 units per acre residential with a
Planned development overlay. The existing church at Hall and O'Mara is
allowed as a conditional use within the R-12 zone. S slope of the
drainage area, which ranges from 3 to 5 percent and the zoning correspond
to a runoff coefficient of 0.45.
The drainage area, A) shown in Figure B-1 is 36.9 acres. During the
analysis it was found that the 6.5-acre area surrounding Hillview court and
time of concentration that
shown in Figure B-1 had such a long when it was
included, peak flows were lower than when it was not included. `Ihe storm
drain along Hall Blvd. was sized for a drainage area of 30.4 acres %hich
excluded the area along Hillview Court.
The rainfall intensity, i, was determined from Washington County, "Standard
Engineering Design and construction Specifications for Roade, Table X,
"Rainfall Intensities for East Washington County (for Manges 1 & 2 West)"

A preliminary storm drain and inlet system was layed out along Edgewood and
O'Mara Streets to determine travel time. A maximum inlet spacing Of 500
d�= feet was used in most cases and it was assumed that the storm drains would
be installed parallel to the existing street grade. Peak flower were
determined at each inlet based on the travel time to that inlet and the
downstream pipe was sized to carry the flow. Above the farthest inlet,
upstream travel time was calculated from overland flow. Within the storm
drains, travel time was calculated from the pipe size and slope assuming
the gips was flowing full. Individual travel times were added to determine
the time of concentration.
The runoff calculations are summarized in Table 8-1.
Runoff from the area along Edgewood Street could be diverted into a swale
southeast of the 90-degree bend in the street, reducing the area draining
to Hall Blvd. by 11.2 acres (excluding the area surrounding Hillview
Court). A reduceddrainage area of 19.2 acres would result in peak 10- and
25-year flogs of 14.4 cfs and 17.0 cfs, respectively. These flows are
still large enough to require an 18-inch storm drain along the west side of
Hall Blvd.
The larger area was used to size the storm drain because it does not
exclude the possibility of constructing a system along Edgewood Street that
would drain to ball Blvd. Constructing the system in existing ,street
right-of-ways could be more desirable than placing it in an easement to the
swale.

INFORMATION SUMMARY
Mr. Untalan has over the past few years, inquired about sewer service to his
lot at the corner of S.W. Inez and S.W. 100th Ave. several times. He has been
asked to investigate the interest of other property owners between his
property and the City sewer line. Several options exist, but require several
other, apparently unwilling, property owners to participate.
ALTERNATIVES CONSIDERED
1. Have City staff survey the neighborhood for possible additional interest
and attempt to acquire petition signatures.
2. Ask staff to investigate a possible health hazard condition which would
allow Council the ability to force an L.I.D. for public health .reasons.
3. Authorize construction of a sewer from existing funds and collect a
charge in lieu of assessments when properties connect. (This policy
would require higher reserves in the future.)
4. Wait until sufficient neighborhood interest is expressed.
SUGGESTED ACTION
Staff has no policy direction in this instance and would look to Council for
direction in that regard, recommending that any positive, active approach as
outlined in Alternatives 1, 2 or 3 would be appropriate and recognizing the
additional waenpower resource required in alternatives 1 t 2.

In your May 15, " 1985 letter to Dave Willhite, District
Maintenance Supervisor, you were inquiring as to the status
of the purposed project involving traffic signals at Canterbury
Lane, the closing of the frontage road at Bull Mountain
Road, and access directly into the Canterbury Shopping Center.
I am writing to share the status of this project.
The project that has been described was submitted as a High
Hazard Elimination Project for Title II funds. This is 90%
Federal funds and 10% local match. The State Highway Engineer
has approved the project under delegated authority for the
Transportation Commission, and the project is being submitted
to the Federal Highway Administration for .their approval.
We expect to get a favorable response from the Federal Highway
Administration in the near future. This will then enable
us to begin our preliminary engineering to develop the project.
This project would include a full traffic signal at Canterbury
Lane with pedestrian crossing protection. A left turn lane
for northbound traffic on 99W for a possible direct access
into Canterbury Lane Shopping Center, and this would allow
the closure of the frontage Road at the south end of Canterbury
Square.
A while back, I received a call from Jerry Koive, the owner
of the Canterbury Square Shopping Center, expressing his
interest in the project and a willingness to participate.
We will want to get all parties together at such time as

SUBJECT: Scholls Ferry_Road Discussion
Over the last several years, much discussion has centered on the 5cholls Ferry
Road traffic issues and the proposed Murray Road extension. - At the staff
level, we have tried to define the alternatives available to us which would
provide for a collector street from Murray through developing properties to
121st ane eventually to Walnut Street. A map has been prepared by Frank
Currie which illustrates the staff recommendation and an alternative. We will
present the map to the City Council on July 8th to get input.
Discussions have been hold by the staff with Beaverton's planning staff about
the road location. We have agreed that the alternativesare workable with
possible minor amendments. Linda Davis, Beaverton Planning Director, will
show our proposal to the Beaverton City Council so that both Councils are
aware of the concept prior to your July 10 meeting with Beaverton's Council.
We feel that this is one of the major coordination issues which the two cities
should discuss. Our efforts should be coordinated now concerning road
alignment, traffic improvements, and jurisdiction, so that the development of
this area is accomplished while avoiding conflicts.
The Council should examine the map when presented and give input concerning
the alternative routes and their considering with the Transportation Plan

Regarding the Wastewater Utility System Performance Audit as a Council Goal, I
understand the elements as follows: Appoint Citizens Review Task Force,
Conduct Performance Review of Sewer and Storm Drainage Operations, Review and
Recommend Sewer and Storm Drainage CIP, Review and Recommend Wastewater
Utility Financial Plan and Rate-dilating Criterion, Review and Recommend
Wastewater Rates`.
With the City's share of the latest USA - sewer rate increase and the
0 County-wide Storm Drainage issue still in process, the financial urgency for
rates review is less critical. The City's undercapitalization still, however,
continues to be' a policy concern.
A related issue is the overview of City franchise agreements. A Utilities and
>? Franchises Committee has been considered I suggest we start with the
Wastewater Utilities Task Force. Deal later with the Franchises and potential
merger of these review Task Forces as a later standing Committee.
Council needs to decide how far and how fast to go on the Wastewater Audit
issue. I feel we shouldo through the entire cycle and
g g y get a complete
i review. If so a consultant will be needed to help in the later stages and may
be valuable in some minor capacity thoughout. Alternatively if Council wants.
to stop short, then the consultant probably isn't needed at all if its just an
operations overview.
Recommendation: Decide on the membership and scope of work for the
Committee. Direct preparation of a Resolution for Council approval on 7/8/95.

SUBJECT: ALLOCATION OF W.C.C.L.S. FUNDS FY 1985/86
Background
The City Council approved the 1985-86 budget for the Library on June 24, including
$65,000 carry-over from the 1984-85 WCCLS levy. These are earmarked for furnishings
in the new Library. We still need about $65,000 yet to complete furnishings. On June
25, the county voters approved a $2.5 million 2-year levy for WCCLS. Tigard Public
Library will realize approximately $186,000 this first year. A portion of the new
funds will become available in December, 1985; the remainder in March, 1986.
Discussion;
WCCLS funds are designated for use of the Library. A supplemental budget is
necessary to authorize the expenditure of these funds during FY 1985--86. This could
take a good deal of time and the public deserves to receive the benefit of their taxes
as soon as possible
Two ways to immediately begin upgrading the service would be 1.) to add staff, to
increase open hours, and 2.) to broaden youth services, which in turn frees up the
Assistant Librarian for reference and circulation duties.
Present staffing is 6 FTE (5 full-time and 5 part-time). The Assistant Librarian
has been directing youth services following the lay-off of the Associate Librarian in
June, 1984. The Library is open 40 hours per week. A city of Tigard's size should
have 10 to 15 FTE staff and be open 50 to 55 hours. The youth services program,
though well planned and executed, needs an assigned director. The Assistant Librarian
needs to resume her assigned duties in a more productive manner and also will have
additional responsibilities as we automate our circulation system with WCCLS and we
move into a new facility. At the time we open the new library, we can then have the
Supplemental Budget adjustments in place for staffing and furnishings.
Recommended Action:
- 1.- Increase part-time hours by 40 hours. This will not entail new hiring, but will
increase the hours for present employees, some of whom work as little as 7 hours a
week. This is a 16% increase in present FTE hours. The cost for the FY would be
approximately $11,000 additional.
2. " Open the Library 46.5 hours per week. This is a 16% increase also.
3. Hire an Associate Librarian to work 30 hours a week beginning in September. This
will notbea factor in open hours, but will alleviate the load on Assistant Librarian
and supply necessary support for youth services.
4 Review the furnishings budget and make recommendations from the Library Board to
the Council in August, to coordinate with the Civic Center furnishings bid.
5. Make final program and appropriations adjustments with the Supplemental Budget in
K, November:

City Engineer Services
On Friday, July 5, 1985, I met with Bill Monahan and Frank
Currie to discuss the City's needs for city engineering services
during the time between Frank's departure and the hiring of a
replacement. I would be willing to serve as City Engineer during
this interim period. It appeared that by dividing Frank' s
responsibilities between me and several staff members the number of
engineering tasks that would fall to me could be reduced and my
services would only be required on a part-time or as-needed basis.
The consulting services that we would provide include the
following:
1. Coordinate the work of City staff and engineering
consultants on L. I .D. projects . Twelve existing or
potential L.I.D. projects were identified as requiring
some level of attention.
2. Review development proposals.
3. Review subdivision plats.
4. Consult with City Manager, Development Director, and
engineering and public works staff on engineering related
matters.
The time required for the above tasks will no doubt vary with
the level of development activity in the City. Based upon the time
requirements estimated by Frank Currie we propose that our firm be
retained to provide the above-described services for a fee of
$600.00 per month
* 10-12 hours/month basic services as interim city engineer.

Mr. J. B. Bishop has asked, in concert with Mr. Ed Hardt of the Hwy. Division
of O.D.O.T., that the City agree to certain changes in signal agreement #7749
related to the responsibility of Main Street Land Corp. , (J.B.Bishop). Staff
has no concerns with those changes, and in fact concurs that the situation is
better represented by these changes. However, in reviewing the agreement, we
noted that the street which is the subject of the agreement is no longer a
public street but a private street in the development, and as such, the
developer J.B. Bishop, should assume all those responsibilities which belonged
to the City in the original agreement and the City should no longer be a party
to this agreement.

COOPERATIVE IMPROVEMENT AGREEMENT
PRELIMINARY ENGINEERING AND CONSTRUCTION FINANCE
THIS AGREEMENT is made and entered into by and between the STATE
OF OREGON, acting by and through its Department of Transportation
Highway Division, _hereinafter referred to as "State"; The CITY OF
TIGARD, a municipal corporation of the State of Oregon, acting by and
through its City Officials, hereinafter referred to as "City"; and
MAIN STREET LAND CORPORATION, a corporation authorized to transact
business in the State of Oregon, acting by and through its Corporation
Officers hereinafter referred to as "Corporation". '
WITNESSETH
RECITALS
1. For the purpose of providing an acceptable traffic circula-
tion pattern on public highways and roads in the vicinity of a
proposed commercial development on property owned or controlled by JB
Bishop, the State, City, and Corporation plan and propose to install
traffic control signal equipment on the Pacific Highway West at M.P.
9.53 (Corporation Access) including an interconnect system to the
existing traffic signal system on the Pacific Highway West, herein-
after referred to as "project". The installation will be financed 100
percent by the Corporation with no expense to the State or the City.
2. By the authority granted in QRS 487.850, State is authorized
to determine the character or type of traffic control signals to be
used and to place or erect them upon state highways at places where
Shite deems necessary for the safe and expeditious control of traffic.
No traffic control signals shall be erected or maintained upon any
state highway by any authority other than State, except with its
written approval .
3. By the authority granted in ORS 366.425, as amended by
Chapter 365, Oregon Laws, 1979 , State may, accept deposits of money, or
an irrevocable_letter of credit, from any person, firm or corporation
for the performance of work on any public highway within the State.
When any money or a letter of credit is deposited, the State shall
proceed with the project. Money so deposited shall be disbursed for
the purpose of which it was deposited.

` 4. By the authority granted in ORS 366.770 and 366.775, the
State may enter into cooperative agreements with the various counties
and cities for the performance of work on certain types of improvement
projects with the allocation of costs on terms and conditions mutually
agreeable to the contracting parties.
NOW, THEREFORE, the premises being in general as stated in the
foregoing RECITALS, it is agreed by and between the parties hereto as
follows:
STATE OBLIGATIONS E
1. State shall at Corporation expense, conduct the necessary
field surveys and traffic investigations, identify and obtain or issue
the required permits, arrange for relocation or adjustment of any
conflicting utility facilities, perform all preliminary engineering
and design work required to produce plans, specifications and esti-
mates, advertise for bid proposals, award all contracts and furnish
all construction engineering, material testing, technical inspection
and project manager services for administration of the contract. The
traffic signal installation may be accomplished by the use of State
forces, by contract or by any combination of these methods, as State
shall elect.
2. State shall , upon completion of the project, perform all
necessary maintenance for operation of the traffic signals at no
expense to the City or Corporation, and shall retain complete juris-
diction and control of the timing established for operation of the
traffic signals.
3. State shall , at Corporation expense, lay out and paint the
necessary lane lines and channelization, and erect the required direc-
tional and traffic control signing on the Pacific Highway West and the
Corporation Access Road at M.P. 9.53.
4. State shall compile accurate cost accounting records and
furnish Corporation with an itemized statement of actual costs to date
at the end of each State fiscal year. When the actual total cost of
the project has been computed, State shall furnish Corporation with an
itemized statement of said final costs, including preliminary and
cofistruction engineering, contractor payments and all contingency
items attributable to the project.
CITY OBLIGATIONS
1. City hereby grants the State the right to enter upon and
occupy city street right-of-way for the performance of necessary main-
tenance of the traffic signal equipment.

.;' 2. City shall , upon completion of the project, accept all
responsibility for, and pay all costs of electrical energy in opera-
tion of the traffic signals.
3. City shall adopt a resolution authorizing its designated City
Officials to enter into and execute this agreement, and the same shall
be attached hereto and become a part hereof.
CORPORATION OBLIGATIONS
1. Corporation shall , upon execution of this agreement, forward
to State an advance deposit in the amount of $5,000, said amount being
equal to 100 percent of the estimated total cost of the preliminary
engineering and design work for t e project.
2. Corporation shall, prior to advertising for bid proposals,
forward to the State an advance deposit, or irrevocable letter of
credit, in the amount of 100 percent of the estimated cost for con-
struction of the project. No contract shaTT be awarded or work
commence until such advance deposit has been received by the State.
Upon completion of the project and receipt from State of an
itemized statement of the actual total cost of the project, Corpor-
ation 'shall pay any amount which, when added to Corporation's advance
deposit, will equal 100 percent of theactualtotal cost of the pro-
ject, including preliminary and constructTon engineering, contractor
payments and all contingency items attributable to the project. Any
portion of said advance deposits which is in excess of the total
actual cost will be refunded or released to Corporation.
3. 'Corporation shall provide the necessary right-of-way and
easements for any required roadway widening and for installation and
maintenance of the traffic signal equipment including vehicle detector
loops.
4. Corporation shall maintain the asphaltic concrete pavement
surrounding the vehicle detector loops installed in the Corporation
Access Road in such a manner as to provide adequate protection for
said detector loops, and shall adequately maintain the pavement
markings and signing installed in accord with the plans and specifi-
cations.
GENERAL PROVISIONS
1. State, City and Corporation agree and understand that a
mutual review of the plans and estimates will be conducted prior to
advertisement for construction bid proposals.

IN WITNESS WHEREOF, the parties hereto have set their hands and
affixed their seals as of the day and year hereinafter written. City
has acted in this matter pursuant to Resolution No. ,"adopted
by its City Council on the day of 71985.
The Oregon Transportation Commission, by a duly adopted delega-
tion order, authorized its Chairman or Vice Chairman to act in its
behalf in approving this agreement. Approval was given for this
agreement on by , which approval is
on 'file in the ommiss on records. The delegation order also autho-
rizes the State Highway Engineer to execute the Agreement on behalf of
the Commission.
