4. LAND SALE PROCEDURE
ORDINANCE N0. 85 _0 AN ORDINANCE PROVIDING FOR THE SALE OF CITY
PROPERTY BY THE CITY OR BY A REAL ESTATE AGENT
AND DECLARING AN EMERGENCY.
a. Councilor Brian moved, Councilor Edwards seconded, to adopt
Ordinance No. 85-09.
Approved by unanimous vote of Council present.
b. Councilor Brian requested the Pt,blic Notice be amended to have the
three items deleted to save money and be published in the Sunday
Oregonian on March 17 & 24, 1985 rather than in the Tigard Times.
If there are further questions, the Assistance Finance Director
can be contacted.
Mayor Cook, Councilors Scott, Edin, and Edwards concurred.

5. CRIMINAL CODE AMENDMENT
a. ORDINANCE NO. 85-10 AN AMENDMENT TO ORDINANCE NO. 84-65 BY ADDING
SECTION 7.28.050 REFUSING TO ASSIST PEACE
OFFICER THAT WAS INADVERTENTLY OMITTED WHEN
ORDINANCE NO. 84-65 WAS ADOPTED BY CITY
COUNCIL AND ADDED TO THE TIGARD CRIMINAL
CODE, AND DECLARING AN EMERGENCY.
b. Chief Adams stated this ordinance was just a housekeeping item F
that was inadvertently omitted when Ordinance No. 84-65 was
adopted.
C. Councilor Edwards moved, Councilor Brian seconded, to adopt
Ordinance No. 85-10-
Approved by unanimous vote of Council present.
6. AUDIT DISCUSSION
a. City Administrator stated the Council was handed an Aud'itor's
Summary of surrounding jurisdictions. He also requested that the
City retain Cooper's & Lybrand as the Auditors. City
Administrator asked what additional information Council would like
to see. The auditor's only do what the State asks.
b. Councilor Edin stated the policy questions should be answered by
the Auditors in the Management letter. Council Edin also asked a
proposal be requested from Coopers & Lybrand to see what they will
be charging for services.
7. TRANSPORTATION COMMITTEE ACTION STATEMENT
a. City Engineer introduced Tom Sullivan, Chairman of the
Transportation Committee.
Tom Sullivan stated there was two reasons for appearing before
Council. 1) To let the Coun(.il know that the Transportation
Committee is actively doing something and 2) to get informal
approval of what the Committee is doing. The goal is to make
competent recommendations and the primary task is to be a group of
citizens who ,are knowledgeable about the Transportation plan. Mr.
Sullivan stated they would like to add one more item to the
Committee's Action Plan. 10. "Coordinate activities with related
Committees."
b. Councilor Brian suggested the Transportation Committee sponsor a
workshop in May sometime.
Council complemented the Committee on their good start and was
very supportive.

c. Councilor Edin moved, Councilor Scott seconded, to accept the
Transportation Advisory Committee Action Plan amended to add 010.
Coordinate activities with related committees.
Approved by unanimous vote of Council present.
8. SERVICE LEVEL PRIORITIES (cont. from 3/4/85)
a. POLICE
a Chief Adams continued his summary of the Police Services.
Fie requested that Loud Parties be added to the Priority 11
list and Abandoned Vehicles be moved from Priority III to
Priority II.
o Councilor Brian requested the dispatchers keep a log for 60
days on the number and time of calls not responded to.
o Consensus of Council was to add Loud Parties to the
Priority II list and move Abandoned Vehicles from the
Priority III list to the Priority II list. Also, to keep a
log for 60 days on the number and time of calls not
responded to and report back.
b. COMMUNITY DEVELOPMENT
o Director of Community Development Services Monahan gave a
summary of what each section of his department does and the
levels of work being done.
o Councilor Edin asked Director Monahan if there were :any
specific problems.
o Director Monahan stated some of the special projects in
Planning were being put behind. In the Building Department
Codes Enforcement was put on the back burner when this
section is busy. In Engineering manhours would be saved
once the Geological Information System is implemented.
C. OPERATIONS SERVICES
o City Engineer Currie stated the Wastewater section was
operating at Levels II b III which are the same. The
Streets section is operating at Level II. The Parks
section is at Level 11/2. Support Services is at Level II
1/2 — III.
o Councilor Scott had some concern regarding the lack of P.R.
some of the work crews are showing. Councilor Edin asked
if any training was being done or has been done regarding
public relations. City Engineer stated there is or has not
been training in that regard.

° o City Administrator gave a summary of projects he was
responsible for along with the responsibilities of the
Executive Secretary and Administrative Assistant. The
difference between Level II and Level I would be to cut the
Administrative Assistant position. The projects of this .
position would be shifted to the City Administrator or the
Department Heads which in turn would cut back on other
projects.
9. REVIEW COUNCIL CALENDAR

a. City Administrator went over the Council Calendar of February 21,
1985. The changes are as follows: March 18 8, 21, 1985 Counci ..
meetings will be cancelled. The City Administrator's review wily
be scheduled for March 28, 1985. The Budget Committee will hold
meetings on April 1 6 3, 1985 along with the other dates listed on
the memo.
10. COUNCIL COMMUNITY RELATIONS DISCUSSION (Questionnaire?)
a. City Administrator stated this item was a Council goal.
Councilor Edin stated he proposed this goal. He would like to
brainstorm with someone both inside the community and out who has
had success with community relations or community support and to
get ideas on how to go about it. He stated he did not object to a
questionnaire.
Mayor Cook suggested the Council turn in their ideas to the City
Administrator's office and have the secretary put together the
list of ideas and bring back to a Council meeting to discuss.
City Administrator suggested the Council have a workshop sometime
in April or May for brainstorming with someone from both inside
and out of the community. A questionnaire could be sent out after
this workshop, possibly in June.
Councilor Edwards felt preliminary steps should be taken with
communication with the press, department heads, and NPO's. He did
not feel a questionnaire should be done at this time.
A workshop will be scheduled for May 13, 1985.
Councilor Edwards suggested a synopsis of the Budget Committee
minutes be sent to the Boards and Committees so they would have an
idea of what is going on.

11.1 CITY ADMINISTRATOR'S PERFORMANCE REVIEW CRITERIA
a. City Administrator stated the performance review criteria is
required to be adopted prior to the City Administrator's review.
Councilor Scott expressed concern regarding other projects that
were not listed on the review form. Mayor Cook stated these
items could be referred to under the Notes or Comments.
b. Councilor Edin moved, seconded by Councilor Scott, to adopt the
Performance Review Criteria.

11.2 COMPREHENSIVE PLAN REVIEW FEE WAIVER - Chatterley
a. Director of Community Services Monahan stated Mr. Chatterley
was assured by a letter from Jeremy Coursolle, Associate
Planner, in 1981 that his property would be zoned R-7. In the
process of the Comprehensive Plan Map the zone was changed to
R-5. Staff is therefore requesting a fee waiver by honoring
the letter sent to Mr. Chatterley.

SW Main Street. Staff has been unsuccessful in attempting to sell the
property under the provisions of ORS 221.725 Notwithstanding ORS 22.1,725,
th City Council may adopt under ORS 221.727 an alternative procedure for the
sale of city property.
The proposed ordinance provides an alternative procedure for the sale through
a real estate broker in accordance with specific selection procedures,

2. Staff continue to attempt to sell property.
SUGGESTED ACTION
Recommend adopting ordinance and instruct staff to publish notice in Tigard

The City of Tigard is requesting written proposals for the selection of a real
estate broker for the sale of City real property located at 12420 SW Plain

is - not only in dispatching and recordskeeping, but in othex areas as .
well.. It stands to reason, therefore, that there would be a ripple effect in
the workload if the performance expectations of other divisions increased;

additional support would be needed.
Additional support would assist Administration Division, shifting crime
analysis to Support Services. ICAP data entry would be done on a routine and
creating time for the crime analyst to perform the
timely basis, tlRereby r
analysis functions. A ComnnitY Services officer could be hired to provide
support to the citi7-ns of Tigard, such as crime prevention. The routine
adninistrat -,Ye typing now done by the Services Manager would be done, thus
giv -, .ter time to provide more support and supervision to her division.
Patrol Division would be writing more citations, creating more radio
traffic and teletype transactions. Carding and filing duties would increase
as well. With increased non-obligated time, case clearances would rise, again
creating
additional workload. An increase in property/evidence functions will
occur.
In Investigation Division, more cases would be investigated, and the
numbers of taped interviews would increase accordingly. With additional•
clerical support, detectives would be able to dictate their reports; at core
level they either hand write or type their own. As in the Patrol Division,
more case clearances would occur. The increased workload in this Division
alone would necessitate a clerical person to spend their entire shift just
assisting then.
Additional support would greatly enhance the Support Services Division,
providing the necessary relief for vacations, sicknesses and maternity leaves.
At core level, shortages of personnel creates a backlog of investigative
{ typing, property duties, and other functions. As stated before, if
performance expectations in other divisions increase, we could not afford to
let this backlog occur.
Autcoation of records would certainly assist the efficiency of our
division, and help give the clerical support necessary. However, it must be
rem mbered that all the records stored manually must be entered into the
ccuputer; this will be a long and time consuming process.
As stated above, our division gives support to all other divisions. As
they increase their workload, we increase our workload.

DEVELOPMENT SERVICES
Planning
Service levels in planning are directly affected by the amount of
development actively underway in the City. During the strong growth periods,
such as we began to experience last year, the amount of time devoted to public
assistance and development application reviews increases greatly. As a
result, the time available for special projects decreases.
The analysis of service levels is based on today's activity level, which
is strong, but not at peak. If peak development activity began, staffing
projected at Level III would be needed to provide Level II service. This
distinction should be kept in mind throughout the review of each entity of
development services. Similarly, 3hou ld the amount of development decrease to
the low level which was present in Tigard in 1981 and 1982, Level II staffing
can perform Level III work.

Overall, if the level of building activity increases while staff level
remains constant, the following occurs:
— Plan checks take longer to be completed.
— Field inspections are only those that are required.
— Less technical assistance is given in the field and in the office.
— Godes enforcement is limited to emergency situations.
— Building Division input to development reviews at the early stages is
limited.
— Assistance to other departments is less available.
Level III service assumes the same level of development activity as
existed last summer. Since that time, activity has greatly increased,
particularly in terms of large scale residential, commercial, and commercial
alterations. Due to this, if a third inspector were available, the amount of
time committed to plans checks and field reviews would increase.

Action Plan
PURPOSE: is to serve the Tigard City Council in an advisory capacity;
providing advice, recommendations , consultations, limited analysis, and
expanded public input to the City Council, City Staff, and others, on
all matters directly associated with the development and implementation
of the Transportation Public Facilities Plan, and its interrelationship

To engage in actions and activities which assist and ensure the

facilities plan for the greater Tigard area.
POWERS AND DUTIES:
-Review regional and local transportation plans.
-Review the Transportation Public Facilities Plan with staff
-Annually review and update the related Capital Improvements
Plan priorities.
-Review and recommend as to related engineering standards and
Plan policies.
-.Review and recommend a balance of budget resources between
operations and capital.
OBJECTIVES:
1. Become familiar with transportation issues and with
responsible agencies, committees, and citizen groups, as well
as other resources.
2. Develop a working structure to facilitate understanding and
planning.
3 . Establish liaison with City Council and City staff.
4. Establish relationship with citizens, other City committees,
neighboring cities, and regional and county agencies.
5. Become familiar with budgets, funding needs and sources
6. Identify problems and critical issues.
7. Review alternative solutions and make recommendations to City
Council and staff.
8 . Serve as advocates of regional transportation issues which may
affect Tigard.
9 . Encourage and promote public awareness of transportation
issues.

A G R E E M E N T
The Tigard City Council has declared the entire assessment
balance plus interest on the property described ( at the time
of assessment) , as 2S112A L2802, 14750 SW 72nd, Tigard ,
Oregon, immediately due and payable in full as authorized by
Tigard Municipal Code Chapter 13 (Ord. No. 85-44) , unless
the property owner enters into a formal binding payment.

The undersigned property owner of the assessed property
became delinquent in its installment payments, however. , all
delinquencies were paid in full on or before February :15,
1985. Upon crediting the property owner with payment of
principal and accrued interest, the outstanding principal
balance as of December 15, 1984 is $15,785.91. In lieu of
foreclosure as authorized by the Tigard Municipal Code
Chapter 13 and Oregon Revised Statutes (ORS Chapter 223) ,
the City of Tigard and Samack, Inc. agree to the following
schedule:
That beginning June 15, 1985 Samack shall continue to pay
its semi-annual installments of $972.96 principal, plus s
accrued interest, for the previous six months as each
installment becomes due.
Should Samack fail to comply with this payment schedule= and
should it fail to pay its regular semi-annual installment,
Samack shall be in breach of this agreement. Upon such
breach, the City shall proceed with collection by sale of
the property as provided by Tigard Municipal Code Chapter 13
and Oregon Revised Statutes (ORS Chapter 223) .
