ROLL CALL: Present: Mayor John Cook; Councilors: Tom Brian, Kenneth Scheckla, and Ima Scott; City Staff:; Frank Currie, Directorof Public Works;, Bob Jean, City Administrator; Tim Ramis, Legal Counsel; Jerri Widner, 'Finance Director; and Loreen'Wilson,,Deputy City Recorder. 2. CALL TO STAFF AND COUNCIL FOR NON-AGENDA ITEMS a- Councilor Scheckla questioned the conditions of "fills located in> the. City.- City Administrator responded that the staff was 'aware of the fills and permits have been issued. Councilor Scheckla also expressed ,concern regarding the room available' for 'Planning ,Commission meetings. City Administrator stated that staff has looked for other meeting rooms for the Commission during the summer and have been unsuccessul. 3. TOWN & COUNTRY DAYS DISCUSSION a. Judy Christensen offered a report from the Town & Country Days Committee regarding preparation and schedules for this year's celebration- She noted; the :history of the celebration and discussed the measures being taken to decrease the costs incurred by the City. She stated there was concern regarding the 'lengthy process for permits from the City. City Administrator stated a streamlined process would be reviewed by the staff. 4. CIVIC CENTER COMMITTEE REPORT & ARCHITECT SERVICES AGREEMENT a. Valerie Johnson, Chairman of the Civic Center Committee, presented the status of the architect services negotiations. The negotiations included scope of work and fees. The Committee recommended approving a contract which would give a 7.5% fee for architectural work with a fixed fee total of $112,500. b. Legal Counsel recommended Council approve contrect language and approve signature after review with the architect's attorney. C. Motion by Councilor Scheckla, seconded by. Councilor Brian to accept contract as negotiated and authorize City Administrator to sign upon review and acceptance by all parties. Approved by unanimous vote of Council present. 5. 135TH. LID INFORMATIONAL MEETING a. Mayor Cook reported that Washington County will be holding a public hearing on this LID Tuesday, July 24th at 7:00 P.M- in #` Hillsboro. That meeting is to consider the formation of the t district. This evening's meeting is to supply information to the citizens and allow Council to hear citizen input. JULY 16, 19$4 Page 1 - COUNCIL MINUTES - 10 J b. Public Testimony: Richard Boberg, NPO #7 Chairman, notedthe NPO opposes the formation of the district as proposed. He stated the internal subdivision streets were not constructed for the heavy traffic of the proposed LID. He has been unable to receive notice from the County for hearings and 'requested Council' mention this to the County. Mark Bonebrake, 13265 SW Falcon Rise Drive, ` represented the Morning Hill Homeowners Association. They ;oppose the plan because it is not appropriate to have local citizens pay for a large area improvement for traffic from Beaverton to Tualatin. Bob Bledsoe, Chairman NPO #3, stated the NPO opposed the proposed plan. He requested Council go on 'record opposing the street alignment proposed for 135th Avenue. ' He also mentioned the City of Tigard street standards would not allow a 701- street as proposed in the engineering drawings. Roger Anderson, Attorney` for Progress Bible Church, requested Council oppose placement of 130th Avenue on church property. The proposed ' design would limit church expansion. Also the church would experience a very heavy assessment which; would be difficult. He recommended this matter go back to the NPO's for study and review. C. City Administrator stated that this LID was being handled under the County's LID process. Staff recommended the Council support the LID concept with recommendations for alterations to the street plan. d. After lengthy discussion, Councilor Brian moved to indicate Council's support of the LID with the following modifications and concerns. Councilor Scott seconded the motion. 1. 130th Avenue be placed west of the Church property. 2. 135th Avenue be constructed to City standards. 3. Washington County continue contact with the property owners for meeting schedules. 4. Washington County should inform the City of Tigard of meetings in a more time efficient manner. 5. Washington County should notify NPO #7 of all hearings and meetings. Approved by unanimous vote of Council present. 6. 68TH AVENUE PARKWAY STREET LID PRE-ASSESSMENT PUBLIC HEARING a. Public Hearing Reopened (from 7-9-84 meeting) b. Director of Public Works explained the assessment philosophy used on the project and identified the assessment tabulated for each parcel under 4 different assessment methods. Finance Director synopsized the advance refunding process and noted that it would not currently save the City any money. However, she recommended the City should consider this process when the market becomes favorable again. b. The Finance Director also reported on the current status of the baneroft bond delinquencies. Scholl Ferry Road and includes S.W. 135th Ave. , S.W. 132nd Ave., S.W. :130th Ave., and a'porti.on of S.W. 128th Ave., and S.W. Morning Hill Dr., all lying between S.W. Scholls Ferry;Road and S.W. Walnut St , and S.W. Walnut Street from it's connect- ion with S.W. 135th Ave. to S.W. 128th Ave. It contains a total of approximately 374 acres and 151 listed property owners, and provides for ' 2.6 miles of street construction or, reconstruction. H. Existing Conditions 135th Ave. and Walnut St. are established county roads (C.R. 934) with approximately 20' of A.C. pavement in very poor condition. 132nd, 330th and 128th'Avenues'are'totally umimproved except where extensions thereof ( have been recently improved through Morning Hill and Bellwood Subdivisions. The L.I.D. area, all of which is within the Urban Growth Boundary, is substantially undeveloped and provides a major potential for future growth as attested by,the first phase improvements of the Amart SumTer Lake, Brittany Square and Morning Hill Subdivisions. C. Plans & Policies In cmpliance with State wide planning goals, an Urban Growth Boundary (U.G.B.) for the Portland region, has been established to acccnTplish an orderly con- version of urbani.zable land to urban uses. These effected properties are within the Urban Growth boundary and their land use plans were established in accordance with the adopted Bull Mountain Community Plan for those portions within Washington County jurisdiction and in accordance with the City of Tigard's Comprehensive Plan for those lands within the Tigard City limits. The proposed street improvements within this L.I.D. project reflect the a.npliTrentations of the established plans for the orderly improvement of these major streets as per the goals set forth in both the Comprehensive Plans and zoning text of Washington County and the City of Tigard. Public sewer, water, gas, electricity and telephone services are available to serve the properties within the proposed L.I.D. t �= D. Project Description The project proposes to reconstruct S.W. 135th Ave. and Walnut St. with 2-12' travel lanes; 5' bike lanes on each side and with a continuous 14' left turn lane fran future Murray road connection to S.W. 128th St; S.W. 130th Ave. will be constructed with 2-16' lanes and 1-8' parking lane to Feasibility Report Exhibit "A' P. 2 a connection with S.W. 128th Ave. within the Bellwood Subdivision and with ( r S.W. 132nd Ave. ommecting to morning Hill Subdivision. S.W. Morning Hill Dr. Will be extended with 2-16' lanes and 1-8' parking lane to S.W. Walnut St. Storm drainage systems will be constructed as an integral`part' of the street improvements. Intersection irprovements will be constructed at S.W. Scholls Ferry Road with S.W. 135th Ave., and S.W. 130th Ave. to include left turn lanes and in the case of 135th Ave. will include traffic signals. Various existing utilities such as water, sewer, gas, electricity and tele- phone will be modified to mate the street construction and future pro- perty service needs. It is proposed that some sections of planned sanitary sewers will be constructed where they best fit within the street pavement area. `lhe'total street improvement equals 2.6 miles. E. Brief History of Project; In October 1981, a public information meeting was held to determine whether or not a feasibility report should be prepared for the project. Prior to that time, property owners adjacent to the streets to be=improved, had signed petitions supporting the L.I.D. The majority,of the property owners indi- cated sufficient support to warrant proceeding with the'feasibility report. Washington'County subsequently assumed the role of dead authority for a joint L.I.D. project with the City of Tigard and retained Ginther Engineering Inc. .to prepare the feasibility;report. F. How Initiated L.I.D. petitions were secured requesting the City of Tigard and Washington County to construct street improvements on portions of S.W. 128th Ave., S.W. 130th Ave., S.W. 132nd Ave., S.W. 135th Ave., S.W. morning Hill Dr. and S.W. Walnut St. as shown an the Vicinity Map - Exhibit 'B'. G. Area Compatibility All of the area within the proposed L.I.D. project lies within the Urban Growth Boundary which was established to facilitate an orderly conversion of urban- izable land to urban uses. All properties within the proposed district are zoned for a variety of residential uses, -including planned development and a saml.l amount of commercial neighborhood. While the area is substantially un- developed and provides a major potential for future growth, many master plans for development have been approved and the first phases of several subdivisions such as An art Sum Ter Lake, Brittany Square and morning Hill have been con- structed. Major utilities have been constructed thoughout the area including 16 inch € water line in portions of 135th Ave. Gas lines, telephone facilities and electrical services have been extended into portions of the area. A major sewer trunk line (Weir Trunk) has just been constructed through the center of the proposed L.I.D. area. Feasibility Report Exhibit `A� - P.3 H. Source Providers Providers of public utilities within the area include: Wolf Creek Water District, Tigard Water District, City of Tigard, Unified Sewerage Agency, N.W. Natural Cas, Oregon DeparMent of Transportation, Washington County, F Storer T.V., Portland General Electric, General Telephone Co., and Tri Net. Ie Traffic •'; A Clete traffic study was made of all streets to be affected by the'pro- posed'district. Existing and future traffic volutes were analyzed as well as their needs relative to turning movements, sight distances, traffic controls- and street standards.' Pedestrian and bicycle needs were analyzed as were those for Tri-Net and School bus routes. Traffic noise factors were judged to be of little or no significant problem. It was determined that police, fire and other emergency needs are presently provided frau the southeast (Tigard area) and will be enhanced by the proposed project. e A oonnecticn to S.W. 135th Ave.' for the future extension of Murray Road from r' the West has been provided for. Details of traffic consideration are in the appendage to this report. II. BENEFITED AREA A. Method of Determining Benefited Area The definition of the benefited areas is determined to be those properties that have frontage on the streets to be constructed or reconstructed and these properties that lie fully within the area created by the street frontage properties, which while such properties may not front upon a street proposed to be constructed or reconstructed by the L.I.D., said properties will rely on the off-site street improvenents in their inmediate area to provide reasonable egress and ingress to the subject properties, A B. Description of Benefited Area z The boundary of the benefited area is as follows: The northerly boundary x is S.W. Scholls Ferry Road from the West boundary of Amart Summer Lake Subdivision to the intersection of old Scholls Ferry Road with S.W. Scholls Ferry Read. The westerly boundary is the West property lines of these 5 properties fronting the West side of S.W. 135th Ave. and lying between S.W. 135th Ave. and S.W. Scholls Ferry Road. The southerly boundary is the southerly property lines of those properties fronting on the South side of Walnut street from 135th Ave. to 128th Ave. The easterly boundary coincides very nearly with the West and North boundaries of Bellwood Subdivision and the East boundary of the proposed Sumner Lake II Subdivision and the East boundary of the proposed Sumer Lake Park. The South and West boundaries of Amart Summer Lake I Subidivison complete the boundary of the benefited area at their intersection with S.W. Scholls Ferry Road. R4PROVEM S t A Description Som of the proposed i proven-ents will be"defined as off-site imProvenents by virtue of their location and or the fact that they are required by off site or non--local traffic that i nPacts the posed-hTprsvements. This includes interesection improvements on S.W. Scholls Ferry Road with S.W. 135th Ave. and S.W. 130th. Ave. and signals at Schol]s Ferry Road and 135th. It is proposed that the costs of these improvements will be on shared cost basis,with the Oregon Deparfnnt of Transportation. Other off-site improve- ments, will be the various additional street widths to be constructed in excess of the City of Tigard standard 34' wide residential street. The extra width which is to acute non-local or off-site traffic demands is considered to be off-site improv nts. B. Costs The cost of these inprovenents are included in the project cost estimate Schedule III-B. C. SDC Credits & Applications Washington County has a policy of allowing a credit to be granted at"the time of building pen-nits for those properties that have previously been assessed for off-site or extra ordinary improvements. The credits will be determined by the County in advance of building construction and shall not exceed 40% of the S.D.C. fee. The City of Tigard allows an S.D.C. credit also-at the time of building pennits on a defined formula, for those assess- rents properties have been charged for off-site or extra ordinary costs. Right-of-Ways The required Feld street right--of-ways have been identifies and agreed to by the County, City and affected property owners. Most right of-ways as well as required utility easements will be dedicated by the affected,property owners. There are some lixn teed areas where additional`right-of-ways are proposed to be added to the existing street right of-way and it is possible that in me or vorecases, such right--of-gray will have to be acquired by purchase or condennatim. B. Site Distances There are some problems with vehicle sight distances at such locations as the old Scholls Ferry Rd , S.W. Scholls Ferry Rd., and S.W. 135th Ave. connections as well as the connection of S.W. Walnut with S.W. 135th Ave. Design considerations will address these problems C. Zamprovements to be Completed by,Others The Tigard Water District has planned for the extension of their facilities. They will extend the same in the street right-of-ways in coordination with the project at no cost to the L.I.D. The Oregon Department of Transportation t will participate in the improvel of the S.W. Scholls Ferry Read inter- sections with S.W. 135th Ave. and S.W. 130th Ave., with the L.I.D. and ow�le _ do other major improvements to S.W. V olls Ferry Road at no expense gle and natural gas facilities L.I.D. Telephone, electric power, will be nrdified as needed without cost to the L.I.D. VII. OTHER FACTORS Petitions requesting these improvements were collected with nearly a unanamous consent approximately three years ago. Waivers of remonstrances have been received by the County. Approximately 1/3 of the Local Improvextent District area has been annexed to the City of Tigard since the original petitions were submitted, which now represents more than 75% of the L.I.D. area as being within the cities boundary. VIII. SLW+R�F& & FE CC[41EMATIC INS This project was requested by petitions and both the Washington County Plan (Bull Mountain Community Plan) and the City of Tigard comprehensive plan in- dicate the need for the improvements being proposed. Most of the involved area has been committed to approved land development plans and first phase construction such as: Morning Hill, Brittany Square, Suue-'r bake and Spring Lake. A majority of the remaining area is owned in large blocks, such as, . Russell A. Krueger owning 134 acres as an exauple. Since the original pet- itions were presented, requesting the L.I.D., traffic has continued to in- crease, sane hazes have been built in-spite of the economy and utilities Feasibility Report Exhibit 'A' - P. 7 have been extended throughout the area, including a major trunk sewer line that bisects the area. Transportation facilities are very deficient in this area and the proposed L.I'.D. will do much to enhance the area wile transportation needs in addition to providing improved ingress and egress to the developing properties. W. 68th being directed into my property if the blast were direoted in that direction. also I have thiragt stored in the garage in the vicinity that I do 'not want damaged.. " I might mention+ that at the time that the City Surveyor put the marker for the Lateral on my property,,there was not a rock in front of that area of;S. W. 66th.' Then they moved in all the rocks from other areas of construction and then chopped up some of the white ones to put on top. Another complaint I have is that the City of Tigard wit- nessed the two culverts that are in the Highway rigY,t-of-way and are directed into my T. L. 6600, Map 1 S 1 36:DD and yet did not-hing about it. One of the cultrerts (2111) is directed to the area near the- 100_year old oak. A portion of PGE's 5.92-acre Tax Lot 100 (lS136DA) is included within the proposed boundaries of the LID. PGE believes that for the fol- lowing reasons our property will receive;no beneficial use from this proposed road construction. 1. PGE's parcel does not have frontage on the road being constructed by the LID. 2. PGE's parcel is encumbered by a roadway, parking, and landscaping easement in favor of Tax Lot 101, now owned by Warren and Feichmier. A copy of this easement is attached. The law states that the refunding plan shall be submitted to the State following adoption of the ordinance or resolution Treasury within 7 days approving of the refunding plan. There are nine components to be included in the plan. he When the advance refunding is done to effect a cost savins, tScott tate Treasurer's authorization is granted contingent upon the projected savings meeting one of the following criteria: 1. a PV Savings of $5,000,000 or more; 2. a savings ratio of 3% or more; or 3. an annual tax rate impact of 15 cents per $1,000 of assessed value or more Currently, the bond market has been experiencing sales with net interest costs of between 9 and 9 3/4%. Of the issues the City of Tigard has outstanding, four issues have interest rates between 8 1/2 and 16 3/4% with a total outstanding debt of $3,954,573. Using a 9%total interest cost figure for the amount of advance refunding and assuming a present value of .178 for 20 years, the City would not save any would cost the City money to advance refund. money. In fact, it This does not mean, however, that the City should not consider advance refunding at all. If the market becomes favorable again, we can take another look. RM -Although advance refunding would not be advantageous to the City at this time, there is another 'issue' that is of greater concern to me. My concern is the number and amount of delinquent assessments that we have. I have prepared a partial list of delinquencies below: _ Bancroft #11 has only five properties assessed and, two are delinquent. The delinquencies are fourinstallments in the amount of $655.68. Bancroft #13 has five delinquencies with four or more installments in the amount of $4,735.63 and five delinquencies with less than four installments due.` ' Bancroft #14 has been billed three times. There are 32 properties owing $16,264.47 that have never paid 'and 7 that: owe one or two installments. Bancroft #15 has 19 properties that have never paid in the amount of $79,353.69 and 8 that are one or two installments behind. Bancroft #16 has 13 properties that have either not paid or have paid only;one installment in the amount of $33,117+.31. If this trend 'continues to grow, the City will be unable to meet its obligations when the bonds and coupons mature. I have already notified' Council that theactualbond issues are undercapitalized and now I am going to have to tell them that the assessment collections need to be more aggressive. As you will recall, one issue was sold for 10 years with the assessed properties allowed to pay back in 20 years and one issue was sold for a net interest cost of 11.167% with the assessed properties only paying 10%. I would like to request from Council a direction as to how they want to proceed with these collection efforts. When the final recourse is for the City to foreclose on properties, I am alarmed at the number of properties that this would include. Many of these properties have been up for sale by the current owners for a long period of time without success. What chances will the City have to recover its costs if we foreclose? Since assuming the responsibility for the assessments, I have been able to work with some of the delinquent accounts. I have not had time to make contact frequently as one would in private sector collections. I am also concerned about the two local improvement districts that are in process now. Both projects are on the same properties--will we be successful in collecting assessments on these? What about future projects? I don't wish to be an alarmist, but the financial stability of the City may be jeopardized if these trends continue. I would appreciate your advice and direction in this matter.
