VISITOR'S AGENDA o Darwin Thatcher, 9015 SW Kimberly Drive, submitted a petition to grant him or any ;succeeding property owner at''9815 SW Kimberly Drive, the privilege of not installing a sidewalk along SW 98th Ave. from Kimberly Drive to the Summerfield golf course until such time as the community of Summerfield also installs a` continuation of the sidewalk from the Thatcher property. Mr. Thatcher requested this` item' be put on a future agenda for consideration, u i a City Administrator responded staff will review and tentatively consider at 1/23/84 meeting. Mr. Thatcher to meet with staff prior ' to 1/23/84. 4. SW 68TH AVENUE LID REPORT a. Director of Public Works stated he had not heard from the State of Oregon regarding the City's proposal and recommended the item be continued. b. Public Hearing Opened o Planning Director summarized history of application and Planning Commission's action. He noted the original request was for 174 units and stated no ruling is necessary at this time for this property. He spoke to the buildable land and area in the floodplain that may be dedicated to the City. b. Public Testimony - Proponents o Dean. Werst, Attorney, 8101 SW Nyberg, Tualatin, OR, representing property owners Smith and Williams, described the features of the buildable land and services available for development of the property. He estimated they would dedicate approximately 15 aces to the floodplain for Cook Park use as well as dedicate some open space land. Opponents gy c No one appeared to testify. o Planning Director stated staff favors the 'proposal. - o Mayor Bishop spoke to his concerns regarding this property located between Cook Park and the High School on 92nd. He felt with the high density allowed and access only on 92nd it would create; additional traffic problems in the high school .stadium area. He stated he could not support the high density request. o Council and staff discussed the issues of purchase of the,park 'land, ` t" number of units proposed, issues of access and 'safety issues. It was x noted an application,wouldhave to go through SDR or a subdivision application process. Rerouting traffic through to S.W. 85th or some other alternative route ,to alleviate the problem was discussed. Public Hearing Closed t" d. Motion by Councilor Cook, seconded by ,Councilor Scott to approve as amended. Approved by unanimous vote of Council. 12 APPROVE CROW SITE APPRAISAL AND APPROPRIATE $1,000 FROM CONTINGENCY.- a. Councilor Scott stated she was not in favor of the Crow site appraisal and suggested Mr. Crow furnish' a current appraisal. Councilors 'Scott: and Scheckla suggested: the Library Board talk with Mr. Crow regarding the appraisal. City Administrator explained the Library Board was requesting the current appraisal as they felt Councilors Scott and Sckeckla's 'objection to this site was the lack of a> current appraisal. Councilor Brian commented there are other sites that will need the same information and that the Library Board will have to use their best judgment from the information available and come back later to Council regarding requests for appraisals. b. Motion by Councilor Scott, seconded' by Councilor Scheckla to disapprove the request for $1,000 for appraisal for the Crow site. Approved by 4-1 vote with Mayor Bishop voting NAY. d 4 13. Motion by Councilor Cook, ' seconded by Councilor Brian', to approve solicitation ofquotations for emergency repair work and bring "back to Council for approval. Approved by unanimous 'vote of Council. 16. APPOINT PLANNING COMMISSION MEMBER a. Mayor Bishop recommended appointment of Mr. Robert -Nunn to fill unexpired term ,of Commissioner Christen whose term expires ';7/1/85. Mayor Bishop stated Mr. Nunn had been interviewed by ;the Committee earlier in the year and rated highly.:` He further stated he saw no reason to ,interview him again. o Councilor Scheckla objectedto the appointment stating a process had been set up to interview interested people and to be 'fair the City should advertise for new applicants and;go through the process. b. Motion by Councilor Scheckla, seconded by Councilor Scott, to wait wiih;appointment' until January and interview'candidates. Approved by 4-1 vote of Council with Mayor Bishop voting NAY. 17. CANCEL COUNCIL REGULAR MEETING OF 12/12/83 AND AMEND COUNCIL CALENDAR. a. Council discussed proposed Council calendar and consensus was to cancel 1/14/84 Saturday workshop and reschedule for 1/16/84 starting at 5:30 P.M. ; location to be worked out by staff. b. Motion by Councilor Scheckla, seconded by Councilor Scott to approve calendar as amended. Approved by unanimous vote of Council. o Councilor Brian suggested a volunteer be appointed as facilitator for the workshop. Staff to inquire if Dr. Edner from Portland State would be interested and report back to 'Council. 18. AUTHORIZE ASSISTANT FINANCE DIRECTOR/APPOINT ACTING CITY RECORDER a. APPROVE AND AUTHORIZE SIGNING OF CDBG AGREEMENT FOR FANNO CREEK PARK'. a. Councilor Scheckla requested Director of Public Works explain details of grant. Director of Public Works responded noting project includes a channel change for Fanno sCreek to be funded from storm drainage fund. He further explained $4900 was for in-kind services which will be for staff map making and surveying. Discussion followed regarding expiration of the agreement and if project could be :completed in time. Director of Public Works suggested Council approve signing .of agreement contingent upon extension of time to approximately fall of 1984. b. Motion by 'Councilor Brian, seconded by Councilor Scott to ,approve signing ofthe ,agreement contingent upon modification by ;Public Works staff regarding extension of time for project completion. Tualatin Fire District is asking each city and county to approve this Fire Prevention Code by resolution in accordance with ORS 478.924 (see attachment). This revised Fire i Prevention Code;adopts the 1982 Edition of the Uniform Fire Code, Uniform Building Code and the Uniformmechanical Code. In an effort to standardize code enforcement Tualatin Fire District has adopted the same Fire Prevention Code as Washington County Fire District #1 and the City of Beaverton. This 3000 GPM water flow requirement has been in affect in Washington County District #1 and the City of Beaverton for sane time. It reduces the need to provide additional equipment and manpower to ccubat fire in high-rise occupancies. He also explained how they had come up with`the-figure°of 175 units. o Discussion followed regarding density, the letter from USA and street improvements for Std 92nd o Commissioner Moen suggested approving the proposal with a Planned Development overlay. o Nag Shaw, 16225 SW 93rd Avenue was concerned with the effect 20 units per acre would have on the area. She also asked what would prevent them from building apartment or putting in a mobil home park if this density was approved. o Director of Planning and Development Monahan stated the application, if approved would only allow 12 units per acre with a density trans for to a miximum of 15 units per acre and the other issue would be raised during the Planned Development or Subdivison application process. o Discussion followed regarding the LCDC requirement of 10 units per acre. o Commissioner F,yre asked if it would be economically feasible to development this property at loos density. The existing Public Facilities, i.e. water line on SW 92nd and sewer trunk line on southern edge of property ` line have the adequate capacity to serve the proposed development. The :site is within one half of a mile of then public transportation. There are no single family homes within 200 feet of the subject site. However, since' property to the east is designated Light Industrial on the Comprehensive _Plan Map, this would -warrant buffering in future. Thesiteis within one -half of a mile from a neighborhood commercial center (on corner of Hall Blvd. and Durham Road). There is a public park (Cook Park) immediately to the south of the site. Approximately 70% of the;, land is in the floodplain. The applicant has expressed' his willingness to dedicate some of that land to the City for development or expansion of Cook Park. 2. ' It is our opinion that while we have observed no further movement in the slide, f there are too many unknowns to allow the repair to gait through the winter without some attention.
