PROCLAMATION NAMING COOK PARK SOCCER FIELD "MEAD FIELD". (a) Mayor Bishop read proclamation in full and requested copy be forwarded to members of the Mead family. 22. RESOLUTION NO. 82-145 A RESOLUTION OF THE TIGARD CITY COUNCIL NAMING COOK PARK SOCCER FIELD. (a) Motion by Councilor Cook, seconded by Councilor Brian to adopt. Approved by unanimous vote of Council. Councilor Stimler suggested the Soccer Association be mailed a copy of the proclamation and resolution. Council concurred. 23. PROHIBITING PARKING ON S.W. 66TH AVENUE. (a) Director of Public Works requested this item be removed from the agenda. 24. ORDINANCE No. 82-82 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 10.28 OF THE TIGARD MUNICIPAL CODE BY ADDING TO SECTION 10.28.130 TO PROHIBIT PARKING ON S.W. HAMPTON STREET DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. (a) Motion by Councilor Stimler, seconded by Councilor Brian to adopt. Approved by unanimous vote of Council. RECESS SPECIAL COUNCIL MEETING: 7:51 P.M. PAGE 6 - COUNCIL MINUTES - DECEMBER 20, 1982 25. TURA MEETING (a) ROLL CALL: Present: Agency Members Wilbur Bishop, Tom Brian, John Cook, Nancie Stimler, and Kenneth Scheckla; Director of Public Works, Frank Currie; Finance Director/City Recorder, Doris Hartig; City Administrator, Legal Counsel, Ed Sullivan. (b) City Administrator called attention to TURA Advisory Committee attendance report, noting members who have not attended or only attended as advisory person representing their jurisdiction. This made it difficult for the Committee to attain a quorum and City Administrator suggested Council consider appointing active members who can participate. It was suggested the 3 advisory position could be appointed as ex-officio members and be invited to meetings when items concern them. Consensus of Council was to consider this item at time when the Plan is amended. (c) Council continued to discuss the membership and the need to fill the 3 vacancies. (d) No other business was discussed. (e) ADJOURNMENT OF TURA MEETING: 7:55 P.M. RECONVENE SPECIAL COUNCIL MEETING: 7:55 P.M. 26. POLL RESULTS - TURA ADVISORY VOTE (a) City Recorder reported revised figures including votes received December 20, 1982, as follows: o "Yes" Vote - 745, 40% o "No" Vote - 886, 47% o Unmarked or undecided - 245, 13% o Total Vote Cast - 1887 or 18% response to ballots mailed (b) City Administrator stated he hoped to have the final tally of the other questions within the next 2-3 weeks. 27. ORDINANCE No. 82-83 AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A SPECIAL REVENUE FUND TO BE KNOWN AS THE TIGARD URBAN RENEWAL AGENCY FUND (TURA FUND) FOR THE PURPOSE OF CONFORMING TO THE REQUIREMENTS OF ORS 457.440; AND DECLARING AN EMERGENCY. (a) Motion by Councilor Brian, seconded by Councilor Stimler to adopt. (b) Council and staff discussed the need to establish a fund to account for the collection and processing of these monies. Approved by unanimous vote of Council. PAGE 7 - COUNCIL MINUTES - DECEMBER 20, 1982 28. TAX INCREMENT DISCUSSION - TURA { (a) City Administrator reported to Council he and City Attorney were under the impression the tax increment financing element of the downtown revitalization plan could be repealed by amendment, however, upon research have found the City must go through the same hearing process as when the plan was originally adopted. City Administrator further commented that if Council so desired they could initiate the process by adopting a resolution to repeal the financing element of the downtown plan, however, it would not affect the 1983 collection for tax increment financing. (b) Lengthy discussion followed by Council members with Councilors Brian, Cook, Stimler and Mayor Bishop favoring holding off any action at this time, but rather wait and consider in fall of 1983. Councilor Scheckla expressed his displeasure with this issue and favored taking immediate action to begin process to repeal tax increment financing for fiscal year 1984. (d) Consensus of Council was to consider the issue in September-October of 1983. 29. RESOLUTION No. 82-146 A RESOLUTION OF THE TIGARD CITY COUNCIL ADOPTING SHORT TITLES FOR CITY FUNDS. (a) Motion by Councilor Cook, seconded by Councilor Brian to adopt. Approved by unanimous vote of Council. 30. RESOLUTION No. 82-147 A RESOLUTION OF THE TIGARD CITY COUNCIL TRANSFERRING AND REALLOCATING FUNDS. (a) Motion by Councilor Stimler, seconded by Councilor Brian to adopt. Approved by unanimous vote of Council. 31. ORDINANCE No. 82-84 AN ORDINANCE OF THE TIGARD CITY COUNCIL AMENDING CHAPTER 3.16, DEVELOPMENT CHARGES -- RECREATION FACILITIES, OF THE TIGARD MUNICIPAL CODE; AND FIXING AN EFFECTIVE DATE. PAGE 8 - COUNCIL MINUTES - DECEMBER 20, 1982 (a) City Administrator explained the amendment would allow purchase of r major park equipment in excess of $5,000, with the cost to be pro-rated between the two park districts. This would give a broader purpose to use of these funds. Staff would like to review the entire use of SDC funds next fall after the comprehensive plan is adopted, a capital improvements and financing program is developed. Councilor Scheckla suggested a sunset clause be included to insure a review of this issue. (b) Attorney Sullivan noted corrected sheets distributed pointing out the changes. (e) After considerable discussion, consensus was to add the following language to section two to read as follows: "This ordinance shall be effective on February 1, 1983; provided, however, that the Council shall review Tigard Municipal Code Chapter 3.16 at its first regular meeting in October 1983. (d) Motion by Councilor Stimler; seconded by Councilor Brian to adopt as amended. Approved by unanimous vote of Council. 32. LID STATUS REPORT AND FINANCIAL REPORT (a) Director of Public Works referred to his memo and the chart on the wall noting the last 6 entries have not been assigned an LID number and are in various preliminary stages. He inquired if Council wished staff to proceed. Consensus of Council was to proceed and bring back for formal Council action when ready. Discussion then centered on the status of the various stages of the 72nd LID. John Skourtes, from the audience, suggested the City take a tougher attitude in dealing with the delinquent assessment payments. City Administrator commented staff is developing a policy to enforce payment. 33. OPEN AGENDA: Consideration of Non-Agenda Items identified to the Chair under item 1.3 will be discussed at this time. All persons are encouraged to contact the City Administrator prior to the meeting. 33.1 1983 1st Quarter Calendar (a) Council and City Administrator discussed the proposed calendar noting the observance of two holidays in February. Motion by Councilor Cook, seconded by Councilor Brian to adopt as presented with 2 cancelled Council meetings. Approved by majority vote of Council. Councilor Stimler abstaining. 33.2 Councilor Cook expressed his personal thanks to Councilor Stimler for all the time spent for the City and hoped that she will continue to serve the City, adding he enjoyed working with her. Councilor Brian 1 . concurred with Councilor Cook's comments. Comprehensive Plan Update Report SUMMARY The Building Division generated $ 13,764 .89 in permit fees during November. The total value of new constructions and alterations applied for was $ 1 ,126 , 226 . 00. Code Enf orcement, Annexation Activity and Approval Authority Actions continued. Comprehensive Planning activities reached a point where all elements were in a draft stage for consideration by the Planning Commission and City Council at December hearings. Monahan, Director of Planning and Development RE: Comprehensive Pian Update Report During November the staff completed the remaining draft elements of the Comprehensive Plan. Copies of each element have been distributed to each of the Neighborhood Planning Organizations (NPO), as well as copies of each element report have been made available at the Tigard Public Library. To date five of the elements have been reviewed and adopted by the Planning Commission and City Council. The adopted elements are: Citizen Involvement; Energy; Air , Water and Land Resource Quality; Economy and Public Facilities and Services . In addition, on December 9th the Planning Commission opened the public hearing for the Housing element. Many issues concerning the location of more intensive uses were discussed. The Planning Commission then continued the public hearing on the Housing element until January. During the third week in January the Planning Commission will reopen the public hearings on the remaining elements of the Comprehensive _ Plan. The remaining element reports are: Natural Features and Open Space; Transportation; Housing, Urbanization; the summary document entitled Findings , Policies and Implementation Strategies; the Comprehensive Plan Map, and the interim zoning map. These public hearings will be held January 18 , 20 and 22. It is expected that the City Council will initiate its public hearings during the week of January 31, 1983. The proposed Tigard Community Development Code and Development District Map will be reviewed by the Planning Commission in mid-February. Staff is now in the process of working with the Public Works Department and the Metro Home Builders to make this document more workable. Staff is also in the process of drafting standards for buffering, locational criteria and established/developing areas. These three issues have been cited by the C.C.I. as vital aspects of the Comprehensive Plan. Once completed these standards will be incorporated into the Findings, Policies and Implementation Strategies summary document. This memorandum is presented to you for information only. s- s POLICE DEPARTMENT MONTHLY REPORT November, 1982 t TO: City Administrator FROM: Chief of Police I. Personnel: The department continues to be down one from full strength this month (28) . The position for police officer has not been filled. The average daily department strength was 17.6 as compared to 16.4 of November, 1981. By division, the breakdown is as follows: Administration 1.4; Services Division 4.6; Patrol Division 9.6; and Investigation Division 1.8 II. Service Delivery: The department responded to 337 non-criminal calls for service this month in contrast to 420 calls in 1981; year-to-date total is 5,154. Patrol Division's obligated time was 1,464.6 hours vs. 943.9 non-obligated hours. III. Crime: There were 100 Part I crimes reported this month; only 96 were reported in November last year. Of the Part I crimes reported, 18 were cleared, or F 18.0%, The department responded to 58 Part II crimes, and 26 were cleared. There were 45 persons charged this month as compared to 69 for this same time period last year. Part I crimes increased 4.21. this month over November of 1981. The Investigative Division worked 18 active cases this month; and cleared 7 or 38.9% of the active cases. The property loss was $34,280.44, and $6,142.87 was recovered, or 17.9% IV. Traffic: Patrol Division responded to 32 accidents, of that number 8 were injury. There were 262 citations issued, as compared to 172 for this same time period last year. In addition, 32 warnings were given. The enforcement index was 22.37 V. Police Reserves: The Reserve Unit worked 174 hours this month assisting the department in policing the community. The majority of this time was spent out in the community on patrol and assisting citizens. See attached monthly report from the Reserves for a complete breakdown of their activities. VI. TRAINING: i� A. Intro to Computer Systems. Chief Adams received 3 credit hours from Marylhurst College for completed the above named class. f B. Visual Investigative Analysis. Officer Grisham attended this 8-hour class in Portland on November 19. This was basically a primer for charting crime elements, and is useful for the Detective Sergeant to monitor the pro- gress being made during the investigation of complex crimes. C. Officer Survival. Sgt. . Martin attended a 2-day course on officer survival on November 17 and 18 at Beaverton Police Department. This course was sponsored by the Board on Police Standards and Training, and consisted of lectures, films and slides, as well as a full day of field problems designed to develop and maintain a positive "survival attitude." VII. COMMUNITY RELATIONS: A. Oral Board Participation. 1) Sgt. Branstetter participated in Beaverton Police Department' promotional testing process on November 29• 2) Sgt. Martin assisted Washington County Public Works Department on November 10, by interview- ing candidates for the position of Weighmaster. B. Senior Rap Day. Officer Grisham conducted the annual "Senior Rap Day" on November 8 at Tigard High School. He contacted approximately 125 students during the course of the day. C. Disaster Planning. On November 19, Lt. Jennings met with Eldon Johnson from Tualatin Fire Protection District to discuss disaster planning organization. This meeting lasted 2 hours. D. Law Enforcement Appreciation Dinner. Lt. Jennings, Officer Featherston and his wife, attended the annual law enforcement appreciation dinner held on November 29, and given by the metropolitan area clergy. This dinner lasted for 4 hours. E. Bank Robbery Response. Officer Grisham presented a bank robbery response talk to 25 employees of the U.S. National Bank on November 9, spending 1 hour with them. F. CE2 Advisory Committee. On November 17, Officer Grisham spent one hour with 20 eleventh and twelfth graders at Tigard High School, discussing the CE2 program. G. You and the Law. Officer Grisham gave a You and the Law presentation to 110 sixth graders from James Templeton School on November 22. He spent 1 hour on this detail. H. Kiwanis Children's Camp. On November 17, Officer Grisham spent 1 hour at the Hi Hat, meeting with 25 members of the Kiwanis Club to discuss their children's camp this year. I. On November 30, four 6th graders came to the police station, and Officer Grisham spent one-half hour with them giving• them a fingerprint presentation. NOTE: There were a minimum of 304 citizens contacted by our department this month doing community relations programs, and a total of 38-1/2 man hours were spent doing this. Have we had any contact with the Department? We were skeptical at first, after receiving uncer- tain information. From our initial, first-hand contact, however, the Tigard policemen have been very courteous, concerned, compassionate, and professional in a kindly way. When a family member was assaulted several years ago, their response was immediate and effective. Whether it has been a neighborhood disturbance , common traffic acci- dent or complaint since then, they have acted responsibly; always respectful of their positions and our rights. One of our children ( still) talks excitedly of partic- ipating in their anti-vandalism school program, and proudly displays her picture taken two (2) years ago r with Officer Joe Grisham. Chief Adams and his men continue to perform remark- ably well - keeping our community safe - with limited resources. They deserve our appreciation and thanks for doing such a job with little "reward" . Policy DATE: December 13, 1982 At the request of the Committee for Citizen Involvement, I hereby submit the following: On December 6, 1982, the Committee for Citizen Involvement met to consider policy issues related to housing. One issue discussed related to L.I.D. policy proposed by NPO #3. After considerable discussion the Committee voted against including the proposed language in the housing element, however, the group did ask me to submit the language for your consideration when reviewing the City's L.I.D. policy. Policy Future residential growth in the Tigard Urban Planning Area shall be planned and managed to assure efficient use of the available land, AND TO PROVIDE COMPENSATION TO DEVELOPMENT THAT IS DISPLACED OR SEVERELY IMPACTED BY THE GROWTH. Implementation Strategy WHENEVER THE CITY WIDENS A ROAD SO THAT THE SETBACK BECOMES LESS THAN THE STANDARD MINIMUM SETBACK, THEN THE CITY SHALL PURCHASE THE PROPERTY AND BUILDING(S) AT A FAIR MARKET VALUE WHICH SHALL BE DETERMINED BY ARBITRATION UNLESS THE OWNER AND THE CITY AGREE ON A PRICE. WITH THE AGREEMENT OF THE OWNER, THE CITY MAY PROVIDE OTHER COMPENSATION. Public hearings will reopen in January for the remaining elements: Natural Features and Open Space; Transportation; Housing; Urbanization; the summary document entitled Findings, Policies and Implementation Strategies; the Comprehensive Plan Map and Interim Zoning Map. The proposed Tigard Community Development Code and Development District Map will be reviewed by the Planning Commission in mid-February. ® The Let's Light Up Tigard Committee held a tree lighting ceremony at the Main Street Payless on December 5th. The St. Anthony's Choir and the High School brass ensemble set the mood with our favorite Christmas tunes. Awards were presented for the best commercial and residential Christmas decorations. e Should Tax Increment Funds be used for the Downtown Renewal District? It' s still not really that clear. The final tally of Tigard' s Official Poll on this question was 750 YES (40% of the vote) , 881 NO (47%) and 241 votes undecided or not indicated (13%) . Results of the Tigard Questionnaire should be forthcoming in late January or early February. BOX 5129 ALOHA, OREGON 97006 Dear Donna: It was my understanding from the meeting with the City Managers on November 17, that there was consensus to concentrate on the automation issue and to leave the WCCLS long range plan alone for now. I further understood that the network would work on the plan to be completed before a new operating levy will be presented to the voters, since the long range plan will help shape the levy proposal. I remind you, too, that we have voiced concerns with drafts #1 and #2 of the long range plan, particularly with the idea of "typing" libraries according to service levels to be supported by WCCLS serial levy funds. We are opposed also to increasing service outlets in the unincorporated areas of the county any time in the near future. We have seen no indication on your part to take our reservations into consideration. Under the circumstances, we do not feel it is in our best interest to append a summary of our local long range plan to draft #3 which we have not seen. I believe strongly that any acceptable WCCLS long range plan must issue from discussion and consensus of the network libraries, not as an administrative fait accompli. I endorse the need for long range planning for WCCLS, but I cannot subscribe to the present plan and therefore decline to submit the summary as you requested. As you know, we placed this issue on the ballot in June, 1981 as a separate Washington County Cooperative Library Services (WCCLS) measure. It was defeated. The need for automation continues to increase as usership increases. Every library in the County has experienced anywhere from 12% to 25% increase in circulation. Funds for additional staff are becoming more difficult to find. The automated system will show savings for additional personnel and still enable the libraries to handle more users. The current operating serial levy for WCCLS runs through June, 1984. The projection for a new 3-year WCCLS serial levy is $2.5 million, including $800,000 for the automated system. The professional board for WCCLS sees automation as a desperate, immediate need. Placing the automation measure in the County serial levy will answer that immediate need and lower the amount to be requested for an operating levy. It would be hoped that this would give the operating levy an even better chance for passage. Your favorable consideration on this issue is requested. The Planning Director requested that a Temporary Use application be filed. Wedgwood Homes filed the application and a notice was published in the Tigard Time advertising a Public Hearing on the matter for December 20, 1982. Section 17 . 05.090 of the Tigard Municipal Code outlines the approval process for temporary sales offices within a subdivision. A public hearing is not required. The Council may grant approval for one year for a sales office within the subdivision the land for sale is situated in. STAFF RECOMMENDATION: Staff recommends that the City Council approve one temporary sales office to be located at 13250 S.W. Falcon Rise Drive in the Morning Hill Subdivision. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That Section 10.28.130 of the Tigard Municipal Code, relating to locations where parking is prohibited at any time, be, and the same is hereby amended and supplemented to add thereto a new subsection reading as follows: "10.28.130 Prohibited at any time. No person shall at any time park or leave standing a vehicle of any kind or character, whether motorized or not, and whether attended or unattended, within the following defined portions of public streets and highways within the city: ( ) Within a portion of the right-of-way f S.W. 66th Avenue, being all that portion thereof lying within 225 -eet Northerly of S.W. Since the tax increment finance question will not be able to be resolved this calendar year, we would lime to set out the timeframe if this issue had been on the November 2nd ballot. ORS Chapter 457 and the adopted Plan require the TURA Advisory Committee, Planning Commission, TURA Agency and City Council consider the Issue. Can such an amendment be accomplished prior to January 1, 1983? In the limited time available to research this issue, I have prepared the following response: The Downtown Tigard Revitalization Plan was adopted by the City Council on December 1 , 1981 , pursuant to the grant of power for such urban renewal authority contained in ORS Chapter 457 . Any amendment to either the text of the Plan or the area map is governed by the general language found in ORS 457 . 220 and the more specific provisions of Section 900 of the Plan itself . Specifically, ORS 457 .220 (2) provides that: "Any substantial change made in the urban renewal plan shall , before being carried out, be approved and recorded in the same manner as the original plan. " In addition, ORS 457.085 (h) requires that the local urban renewal plan: " (h) Describe what type of possible future amendments to the plan are so substantial as to require the same notice, hearing and approval procedure required of the original plan under ORS 457 .095 as provided in ORS 457 .220 . " To this end, Section 900 of the City' s own Plan (DPRP) provides that: "Where the proposed modification will substantially change the plan, the modification must be duly approved and adopted by the agency board and the city council in the same manner as the original plan and in accordance with requirements of state and local law. "A. MINOR CHANGES Minor changes such as clarification of language or pro- cedures may be made only by formal written amendment, approved by the agency. EJS:mch 12/15/82 - Page 1 O'DONNELL. SUBSTANTIAL CHANGE Substantial changes shall be regarded as revisions to the plan text; revisions in project boundaries; inclusion of additional project activities; revisions as to the duration of tax increment financing; beyond the ten (10) year term; property acquisitions for redevelopment of and acquisitions of railroad and street right-of-ways for public improvements, Fanno Creek Park acquisitions and vacant property acquisi- tions for offstreet parking as provided in Sections 700 -- Al. , A2 . , A5. , and A6 . or other changes which will substan- tially change the basic planning principles of this plan. " Finally, any approval of an amendment which constitutes a "substantial change" must be by nonemergency ordinance and, consequently, will not take effect for 30 days. Taken together, these various criteria clearly establish that any amendment deemed to be a "substantial change" in the plan requires the same procedure required by statute and used by the city in its initial adoption of the plan in December, 1981 . ORS 457 .095 . This means that the council , acting as the Urban Renewal Agency- of the city, must: s 1 . Forward the proposed amendment to the Planning Commission for recommendations prior to its own consideration of the amendment 1 for approval; k 2 . Give public notice and hold a hearing on the proposed a.r endment prior to approving it; 3. Approve the amendment by nonemergency ordinance which thereby becomes effective 30 days from the date of the council ' s decision. On the other hand, an amendment which could reasonably be termed "minor" requires nothing more than review and approval by the council at a regular or special meeting and could be approved with an emergency clause. The central issue in this instance is whether an amendment of the plan to eliminate tax increment financing as a method of financing improvements is "substantial" or "minor" as defined by Section 900 of the plan. it is my opinion that such an amendment goes far beyond a mere "clarification of language or procedure" and, therefore, can only be termed a "substantial change" which requires the same procedure as plan adoption. Furthermore, it must be noted that such an amendment would eliminate, not merely replace or revise, the sole method of urban renewal financing for the area. EJS :mch 12/15/82 - Page 2 O'DONNELL. I might note that Mr. Oliver Norville, a Portland attorney specializing in urban renewal matters and the drafter of much of ORS Chapter 457 , agrees with this assessment. Having concluded that the proposed amendment would be a "substantial change" requiring the same approval procedures as the original plan, it becomes apparent that any such amendment could not be accomplished prior to January 1 , 1983 . Regardless of when the matter could be reviewed and acted upon by both the Planning Commission and the council , the requirement that such approval must be by nonemergency ordinance effectively eliminates any chance that such an amendment could become effective prior to January 1, 1983 . Without such an amendment prior to that date, the city cannot request that the "freeze" now placed on the area' s tax base be removed for purposes of the 1983 tax roll .
