City Council Packet - 07/04/1982 M s July 4, 1982 NOTICE OF SPECIAL COUNCIL MEETING Notice is hereby given that a special Cpuncil meeting, called by the Mayor, will be held on July 6, 1982 at P.M. , in Tigard City Hall, 12755 SW Ash Avenue, Tigard, Oregon. The meeting is called for the purpose of considering the following items: e Planning Commission Appointments w TCYS Election Resolution e Update by Administrator on Water Report Wilbur Bishop, Mayor City of Tigard, Oregon T I G A R D C I T Y C 0 U N C I L SPECIAL MEETING MINUTES - JULY 6, 1982 - 6:00 P.M. 1. ROLL CALL: Present: Mayor Wilbur Bishop; Councilors Tom Brian, Nancie Stimler; City Administrator, Bob Jean; Deputy City Recorder, Loreen Wilson. 2. BOARD APPOINTMENTS (a) Mayor Bishop presented a memo to Council with the Selection Committee recommendations for appointments to the vacancies on the Library Board and Planning Commission. (b) Discussion followed among Council members as to the terms of office for each appointment. Staff was directed to confirm the terms of office before the ratification of the appointments at the July 12th meeting. (c) Motion by Councilor Stimler, seconded by Councilor Brian to appoint the following people as indicated: Planning Commission: Frank Tepedino Term Expires 6-30-86 Cliff Speaker Term Expires 6-30-86 Bonnie Owens Term Expires 6-30-86 Phil Edin Term Expires 6-30-85 Approved by unanimous vote of Council present. (d) Motion by Councilor Stimler, seconded by Councilor Brian to appoint the following people as indicated: Library Board: Walt Munhall Term Expires 6-30-86 Susan Mueller Term Expires 6-30-86 Approved by unanimous vote of Council present. 3. TCYS ELECTION RESOLUTION (a) Mr. Bill Knudson, Director of Tigard Community Youth Services (TCYS) presented the projected budget for fiscal year 1982-83 noting that the Board of Directors for TCYS has reduced the levy request $10,000. He mentioned that some of this deficit would be made up by user fees. He stressed that TCYS would be conducting a positive campaign in August, if the Council would approve a resolution returning the issue to the voters on August 10, 1982. (b) Councilor Brian requested the tax rate information be placed on the ballot explanation to assist voters in making a more f educated decision at the polls. L City Administrtor advised against including that information in the ballot explanation since a court decision has ruled against that practice. f (c) Councilor Stimler stated concern about the timing of the election. City Administrator advised Council that TCYS would be paying for any costs the City incurs for the election and recommended passage of the resolution. (d) RESOLUTION No. 82-60 A RESOLUTION OF THE TIGARD CITY COUNCIL CALLING FOR A SPECIAL ELECTION TO SUBMIT TO THE REGISTERED, QUALIFIED VOTERS OF THE CITY A TAX LEVY FOR TIGARD COMMUNITY j YOUTH SERVICES, INC. ` I (e) Motion by Councilor Brian, seconded by Councilor Stimler to ! approve Resolution No. 82-60 and amend the ballot number to read I 51. r Approved by unanimous vote of Council present. (f) Staff and Council discussed the need for long range financial planning between the City and TCYS. City Administrator advised Council that he will be attending the TCYS Board of Directors meeting near the end of the month to begin work in this area. Mayor Bishop stressed that the School District uses TCYS and should be encouraged to participate in funding assistance in the ( future. E 4. UPDATE ON WATER REPORT (a) City Administrator stated there was nothing further to report at this time. 5. GENERAL UPDATE (a) Councilor Stimler requested an update on the meeting held Friday, July 2, 1982 with the homeowners in Winsom Terrace Subdivision. e City Administrator and Mayor Bishop reporteci the outcome of the meeting, noting the problems in the area with Housing Assistance purchasing lots. Administrator reported he will be attempting to work out details with the Director of Housing Assistance in the County and will report back to Council at a later date. All Council members expressed their displeasure with the way Housing Assistance handles the contracts with the City. Concerns were voiced regarding the size and expense of the lots purchased by Housing also. (b) Councilor Brian discussed a sign code violation problem at Law's Nursery. After lengthy discussion, City Administrator said he would contact Building Department regarding the issue and report back to Council. EXECUTIVE SESSION: Tigard City Councilweregardinginto Executive relations under provisions of ORS 192.660 (1) (f) pending litigation. RECONVENE SPECIAL MEETING 7. GENERAL UPDATE CONTINUED (a) Mayor Bishop requested City Administrator check into the following locations in the City. There have been complaints received from citizens regarding gravel on the road, excessive potholes and backfill being placed in the floodplain. Inez Street at 100th or 103rd. 107th Durham Road & 74th Naeve Road City Administrator stated he would report back to Council. 8. Frank Tepedino, Cliff Speaker and Bonnie Owens are interested in being reappointed. Geraldine Kolleas has not asked to be reappointed. I recommend reappointment of Frank Tepedino, Cliff Speaker and Bonnie Owens. I recommend the new appointment of Phil Eden, although I have asked Phil to resign from the Budget Committee and not serve on two major boards at the same time. s There are two appointments to be made to the Library Board. ` Walt Munhall is interested in reappointment; Jean Carlisle is not. Perhaps too often, the efforts of our NPOs and NPO Chairman and Chairwoman go unrecognized. You may be sure that your efforts are appreciated by each Member of the Tigard Planning Commission as well as the City Council Members, the Mayor, the City Administrator and the City Staff. Your alert participation in the growth and well being of the City has assisted all of* us immeasurably in making Tigard a better place in which to live, raise our families and work. However, may I ask yet another favor from all of you? Would you work with me and the rest of the Planning Commission and double your efforts and the efforts of your NPO members on the hcusing element information which the City Staff urgently requires in order to accomplish the task of adopting a comprehensive plan. If we can all get behind this effort and give one big push, I am sure we can get it over the "top" . Please note that because of the increased NPO participation, the Planning Commission has changed its procedures at its meetings to allow specific recognition of NPO members to express the NPO's position and recommendations on each public hearing item. Tepedino FJT:bg cc: City Administrator Mayor f AM M E M O R A N D U M TO: MAYOR AND CITY COUNCIL FROM: BOB JEAN, CITY ADMINISTRATOR DATE: JULY 2, 1982 SUBJECT: POLICE BUDGET AND LABOR SETTLEMENT, CONFIDENTIAL Our policy, as I understand it, is that any Labor Settlement must come from those funds allocated within the Police Department, in order to maintain the relative program balance objective. The Police Union has asked for 8% and is pushing towards arbitration. Since a wage freeze is unlikely from an arbitrator, some adjustment to the Budgeted Pay Plan freeze will be necessary. The Unit Clarification Hearing is set for August 4, 1982, on the Sergeant/Supervisors being out r of the union and on Dispatchers being in a separate union unit. I think our intent should be clear prior to the Unit Clarifi- cation Hearing and yet allow enough time for implementation to occur after arbitration. We stated that we could not afford Sergeants if limited in their use as managers due to union membership. Unless I am directed otherwise by Council , I will reprogram existing funds in the Police Budget to provide for Sergeants for three months under the existing Pay Plan and Corporals only for the last nine months, adding the four extra Corporal positions .while laying off and freezing Sergeant positions.
