ORDINANCE No. 81-49 AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE SECTION 3 .04.010(3) RELATING TO IMPREST CASH ACCOUNTS . (a) Finance Director reported that with the increased sewer bill- ing amounts and relocation of public works department would require a larger amount of funds be held in petty cash to assist in making change by the cashiers . She recommended approval by Council . (b), Motion by Councilman Brian, seconded by Councilwoman Stimler to adopt . Approved by unanimous vote of Council present. 8 . HARVEY KING/MERCER STEEL RAILROAD CROSSING (a) Acting City Administrator summarized the facts surrounding the issue and stated that Mercer Steel is requesting a road .crossing be located at public rail- the northerly end of their parcel to facilitate access and egress for their development and to a landlocked parcel adjacent to them. The property owners will improve the 30- right-of-way and enter into an agreement with railroad for maintenance costs . (b) I-fr. Dan Mercer, Mercer Steel , requested Council apply for the public railroad crossing since Burlington Northern has stated they would not allow a private access . He also noted that the access/egress point would be at the northerly end of his project to assist Mr. John Skourtes ' parcel access across the same location. (c) Staff and Council discussed how the current street license would be affected by this pubI. ic access . (d) Motion by Councilwoman Stimler, seconded by Councilman Scheckla to authorize the Mayor to sign papers requesting the PUC consider a public access/egress across the railroad lines at the Mercer Street property. Approved by unanimous vote of Council present. 9. ORDINANCE No. 81-50 AN ORDINANCE ADOPTING A FIRE PREVENTTON CODE F R HOSE AREAS OF TIGARD NOT WITHIN WASHINGTON COUNTY FIRE DISTRICT No. 1 . (a) Acting City Administrator noted that the Building Official gave his approval to the ordinance as it stands . He stated that the Board of Appeals for the Fire District review was not approved by the City and would be acted on at a later date . (b) Councilman Brian stated he could not support the ordinance if the sprinkler system requirements were included. Staff advised that this had been left out of the ordinance and that the Fire District would report later suggesting an addition of the sprinkler system requirements . (c) Mr. Eldon Johnson, TRFPD, stated that this code was the same as last year except that the new national fire/plumbing/and mechanical codes were included as an update for the code . (d) Motion by Councilman Scheckla , seconded by Councilnan Brian to adopt . Approved by unanimous vote of Council present . 11 . SALARY ADJUSTMENTS (a) President of Council stated the Mayor requested this item be considered at the June 29, 1981 , meeting since the Mayor was not in attendance . DALE 'S GLENN SUBDIVISION S 4-81 (ORDINANCE AiIMENDMENT 79-64) NPO #2 A recommendation from the City of Tigard Planning Commission to amend Ordinance No. 79-64 by changing Condition #3 . (a) Legal Counsel stated that there were two items to be considered . 1 . The Planning Commission denial of the appeal and upholding ® of the Planning Director ' s decision on S 4-81 . 2 . The old ordinance no. 79-64 which changed the zone from R7 to R5 in 1979 . He noted that the second item could be reversed or changed if Council wished, by sending back to the Planning Commission for a zone change which would be initiated by the City. (b) Roger Anderson, 11385 SW 94th Avenue, stated that the neighbors were opposed to the street being put through and requested that the cul-de-sac remain a condition of the zone change as originally adopted. (e) Mr. Russ Lawrence, 8955 SW Commercial Street , requested that Council make a decision to either leave the street a cul-de- sac or put a through street in, at their earliest convenience . He stated that the time span for a new zone change request or further work on this project would create a financial burden to the developer. (f) Councilwoman Stimler, moved to uphold the original condition of Ordinance No. 79-64 by retaining the cul-de-sac street configuration and directed staff to prepare an ordinance for consideration at the June 29 , 1981 , meeting. Comprehensive Plan Revision CPR 8-81 , A-12 to C-3M (Benson property on Ash Avenue) ; 2 . Comprehensive Plan Revision CPR 9-81 , C-5 to C-3M (Valencia Manor Motel property) ; 3 . Planned Unit Development designation, ZCPD 5-81 for C-3M PD development on the entire approximately 16-acre tract; and 4. Approval of C-3M Zone uses in the planned development. The motion was seconded by Funk and approved by unanimous vote of commission. The Commission went on to stress that this approval is not imply- ing approval for the configuation of the buildings or the use of such. (c) Public Testimony Proponents : Mr. teve Domreis , Boutwell , Gordon, Beard & Grimes , P.O. Jane Joy, member of community, opposed the large commercial development due to traffic congestion and hardship on businesses in the area. Mr. Steven Joy, also noted his opposition to the development and requested Council not change the zone to commercial . Cross Examination: Councilman Brian stressed that the only zone change would be on a four (4) acre parcel from A-12 to Commercial and noted that ;r NPO #1 supported the change. RESOLUTION No. 81-70 A RESOLUTION OF THE TIGARD CITY COUNCIL REQUEST- ING AN ANNEXATION PETITION BE FORWARDED TO THE BOUND- ARIREVIEW COMMISSION (SHORT TITLE - BECHTOLD) . (a) Planning Director noted area and stated that the sewer plan issue had been discussed with Mr. Moore and his attorney. (b) Lou Ane Mortensen, 11160 S .W. Fonner, expressed her desire to remain out of the City of Tigard. (c) Mr. Bernie Clark, 13400 SW Walnut, questioned Council as to how an island would be annexed, the Boundary Review Commission authority, and City services . He opposed the annexation of his property. (d) Planning Director recommended approval . (P) Motion by Councilwoman Stimler, seconded by Councilman Brian to approve . SENIOR CITIZEN CENTER REPORT - Change order and costs (a) Councilwoman Stimler reported that the seniors would be meet- ing with her and the Acting City Administrator on Wednesday June 24, 1981 , and requested this item be put on the next agenda for further consideration. (b) Consensus of Council was to consider at the June 29, 1981 meeting . 17 . RESOLUTION No. 81-71 A RESOLUTION OF THE TIGARD CITY COUNCIL TRANS- FERRYING FUNDS FOR UNANTICIPATED EXPENSES . (a) Motion by Councilwoman Stiinler, seconded by Councilman Brian to approve . PAGE 6 - COUNCIL REGULAR MEETING MINUTES , June 22 , 1981 IN (b) Finance Director recommended approval noting that the senior center has not been completed on time and would require a carry- over and prior years tax revenues have been higher than antici- pated for both the TCYS and Loaves and Fishes levies . Approved by unanimous vote of Council present . 18 . RESOLUTION No. 81-72 A RESOLUTION MAKING APPROPRIATIONS FOR THE FISCAL YEAR ENDING JUNE 30 , 1982 . (a) Finance Director noted the fund balance changes and the 28% increase faz health benefits which would be reflected in this resolution. She recommended approval . (b) Motion by Councilman Brian, seconded by Councilwoman Stimler to approve. Approved by unanimous vote of Council present . 19. RESOLUTION No. 81-73 A RESOLUTION DECLARING THE AD VALOREM TAX LEVY FOR THE FISCAL YEAR ENDING JUNE 30, 1982 . (a) Finance Director recommended approval . (b) Legal Counsel stated that the Attorney General ' s opinion will not be received until June 30, 1981 as to whether the Tigard Community Youth Service and Loaves and Fishes levies elections will be considered valid. The State Revenue Department reported that the City should include the figures of the levies in their resolution and budget and remove them later if necessary. (c) Motion by Councilwoman Stimler, seconded by Councilman Brian to approve . Approved by unanimous vote of Council present . 20. RESOLUTION No. 81-74 A RESOLUTION APPROVING THE BUDGET FOR THE FISCAL YEAR ENDING JUNE 30, 1982 . (a) Motion by Councilwoman Stimler, seconded by Councilman Scheckla to approve. (b) Councilman Brian expressed his support of the ICAP computer system proposed for the Police Department . He did request that a monthly report be filed with Council showing the personnel selection criteria used for the individual responsible for the ICRP system in-house; a job description of the position; the work plan for the individual ; implementation and progress of the software and hardware ; and requested a report at the end of one year that would show the effectiveness of the ICAP system. (c) Councilwoman Stimler stated that the City of Beaverton is pur- chasing an ICAP system to be implemented by their Wang computer. (d) Resolution No. 81-74 approved by unanimous vote of Council pre- sent. Consensus of Council was to request reports as suggested by Councilman Brian and instruct staff to investigate the possibility of using the ICRP system on the present Wang system. 21 . ORDINANCE No. 81-52 AN ORDINANCE AMENDING SECTION 2 .04.040 OF THE CITY OF TIGARD CODE, RELATING TO THE DUTIES OF THE CITY ADMINISTRATOR. (a) Motion by Councilwoman Stimler, seconded by Councilman Brian to adopt. Approved by 3-1 majority vote of Council present , Councilman Scheckla voting nay. Ordinance No. 8I-52 will require a second reading. 22 . HAMPTON STREET BIDS - Award (a) Keith Thompson, Coopers & Assoc . , reported that the original low bidder, Bonstan Construction Company had made an error in exten- sion of the costs and the cost now was $362 . 263 : 80 . This would disqualify him as low bidder. Frady Construction Company filed an informal bid as they failed to sign one page of the addendum. Also there was a small error in their extension of the costs which corrected would read $354,359 . 65 , and be considered an informal bid. Both companies concur with respect to the errors . Mr. Thompson and Acting City Administrator recommended Frady Construction Company . be awarded the bid at $354, 359 . 65 . (b) After some discussion, Motion by Councilman Brian, seconded by Councilwoman Stimler to award the bid to Frady Construction Company in the amount of $354,359 . 65. Approved by unanimous vote of Council present . 23 . TMEA/TPOA 1981-82 CONTRACTS (a) Finance Director stated that the contracts were signed by the unions and were presented for Council authorization for the Mayor and Acting City Administrator to sign. (b) Motion by Councilwoman Stimler, seconded by Councilman Scheckla to authorize Mayor and Acting City Administrator to sign the TMEA and TPOA 1981-82 contracts . Approved by unanimous vote of Council present . 24. CIVIC CENTER DISCUSSION (a) Lease Agreement and Related Moving Costs : PAGE 8 - COUNCIL REGULAR MEETING MINUTES, June 22, 1981 Acting City Administrator stated that the MOV costs and rental fees would total an estimated $23,564.02 for the first year . This is more than $3 ,000 over the budgeted amount and computed oNEW . out to be $8 .05/sq• ft. He went on to mention that Mr. Crow is now discussing a need for the City to lease more space than originally agreed upon and suggested that the City go back to i1ir. Crow and work out the lease agreement before proceeding further with the project . Consensus of Council was that a report would be received from staff at the June 29 , 1981 meeting. (b) Civic Center Development Committee (Duties , Responsibilities , Direction) : Council will discuss at the June 29, 1981 meeting. (c) Authorize Appraisal for Civic Center Property: Councilman Brian reported that he had contacted two appraisers and had only received a quote from one . Mr . Harold Myer, Hillsboro , would appraise the Crow Building and site in two (2) or three (3) weeks for a fee of $975 .00 . Councilman Brian reported that this bid was much lower than he expected, however, he requested Council wait until another bid was received before taking action in this matter. Consensus of Council was to discuss further at the June 29, 1981 meeting. 25 . OTHER (a) Councilwoman Stimler expressed her continued appreciation of the work staff is doing on the Update each week. (b) Acting City Administrator requested Council approve a subdivision compliance agreement for Tech Center Business Park and authorize the Mayor and City Recorder to sign. Legal Counsel stated that the mailer did not state "vote yes" but implied that and suggested that the City could be held liable in a court of law if they funded the mailing of the literature. Call to Order The regular meeting of the Tigard Library Boar and Roll Call: g d '•=as called to order by Chairman Betsy Chick at 7:05PM. Excused: Dick Bendixsen. Reports: The minutes of the previous meeting were approved as circulated. The monthly report was reviewed by the Librarian. Discussion centered on 1981-82 budget, which had been finalized by the City Budget Committee on May 6, the computerized circulation system and status of personnel recruitment. The Board indicated their support for putting the computerized circulation system on the June 30 ballot and directed the Librarian to request a resolution from City Council to Washington County Commission indicating their support as well. Madalyn Utz reported that Friends of the Library building committee had changed the date of the rummage-bake sale to June 13 because of schedule conflicts at the Odd Fellows Hall. Book Complaint: Librarian presented a formal complaint against a juvenile book, Peaches by Dindga McCannon. Terri Zagone was asked to read the book and report at the next Board meeting. Administration: a. On April 4, the Librarian and City Finance Director attended a meeting at Hillsboro Library. The discussion concerned placing the Washington County Cooperative Library Services (WCCLS) computerized circulation system, RAIN (for Regional Automated Information Network), on the June 30 ballot. There was concensus among the librarians ' and city managers present that the issue should be placed on the ballot. Based on this meeting, the Librarian recommended to the City Administrator that City Council be asked to send a resolution of support to the County Commission for putting RAIN on the June 30 ballot. This was accomplished at the May 18 City Council meeting. b. Librarian appeared before the Budget Committee on May 6. Librarian requested an additional $1200 for purchase of two air conditioners to alleviate summer ventilation problems. Request was approved. Councilman Tom Brian recommended and the budget com- mittee approved removing $2,500 from the book budget request of $25,000 and placing it in the Library's special building fund. C. Librarian attended WCCLS network relations committee meeting on May 7. Discussion centered on re-writing WCCLS by-laws to more clearly and accurately reflect network and county relationships in an attempt to avoid misunderstandings. Librarian has since resigned as a member of this couuni ttee. d. Librarian attended meeting of the Tigard Downtown Committee on April 14. The Mayor was also present and announced that the City Council would explore locating a civic center in the Crow building at Burnham and Ash. e. Librarian attended a meeting of the Tigard School District librarians and made presentations on the WCCLS RAIN system and its potential for the school libraries. f. Librarian attended WCCLS professional board meeting on May 28. Of interest: Discussion continues on the use of state-aid money that remains after distribution to the cities and maintenance of the union catalog. The group is looking for an equitable means of distributing the per capita money to the community libraries who have no defined population. 2. Personnel- a. Volunteer hours totaled 104.5 for a daily average of 4. b. Volunteers from county and city courts work 33 hours. c. Interviews for the part-time positions, library assistant--youth services, and Assistant librarian--reference, were conducted on May 11. Five candidates for each Position were interviewed by a four.-person board. John Henshell, hired as library assistant-- youth services, began his duties on May 18. On May 5, Rampart Security gave 2 hours of training to all patrol and investigative personnel on alarm systems. 36 man hours of training were received. B. FBI National Academ. Chief Adams attended a luncheon meeting on May 6-, at Grandma's Table. This was a regional meeting of the FBI National Academy, and topic discussed was impact budget cuts will have on the Board of Police Standards and Training. 2 hours were spent. C. . Law Enforcement Council. On May 14, Chief Adams and Lt. Jennings attended a meeting of the Washington County Law Enforce- ment Council in Hillsboro, spending 4 man hours there. D. Crime Analysis Workshop. A 3-day tactical crime analysis workshop was held on May 20, 21 and 22, at Portland Police Bureau. This was attended by Lt. Jennings and Officer Grisham, and 48 man hours were spent. E. 'Homicide Investigation. Cpl. Myers attended a 2 day workshop in Salem on May 26 and 27; topic discussed was homicide investi- gation. Harvey spent nine years trying to obtain a "private" railroad crossing from Burlington Northern. Finally he got the crossing permit. Now he is trying to sell his property to Mercer Industries so that they can construct a large industrial building on the site. We have done the site design review report. The difficulty is that . Burlington Northern would not transfer Harvey's private crossing to Mercer. Mercer needs the P.U.C. approval for a public crossing. The City has to sign the application as the applicant. Staff is asking that Council authorize the Mayor to apply for a public crossing. i✓ercer has agreed as condi ions of site design to install the signals, improve the crossing, carry the insurance and maintain all of the equipment. Frank and I have reviewed this application and have made the necessary corrections to insure that all of the above things are done. We recommend that you at the Mayor to sign the application. I oppose the development in its proposed density on several grounds. First, it will enormously aggravate the traffic problem on already-congested Greenburg Road. Second, it will depreciate the value ofsurrounding proper- ties, including mine. Third, the transient nature of buyers or renters at- tracted to such low-cost, high-density housing will create an island "slum" that will help transform "Terrific Tigard" into "Terrible Tigard. " It should be clear that such housing density will substantially reduce the quality of life for all the people who live in the area. Finally, an eyesore in that portion of the city will be a reflection on the entire city. The proposed development is to take place on only about 2. 5 acres. To build a street and 16 individual homes on such a small parcel of land is very unsound esthetically as well as ecologically. The fact that the st7,---, d;„ parcels are large makes it logical that this property be developed in accord- ance with the original zoning -- that of R-7, not R-5. The zoning change evidently was made in 1979. Why the change was made and who instigated it, I do not know because we were never informed of it. Had we been. inform- ed, I would have opposed it. It is my understanding that even the adjacent property owners were also in the dark about the change. !Parenthetically, let me add, there has been a comedy of errors in the recent notifications concerning the proposed development. This was brought to the attention of the Planning Commission by several persons and acknowledged by the responsible city staff so it does not require documentation here. ) At any rate, the change two years ago to R-5 was a mistake, in my opinion, and whoever instigated it did not have the well-being of Tigard in mind. In its present form the development is beneficial only to the developer, the Falcon Construction Company. The City Council now has an opportunity to right the situation. It is not too late to undo the earlier ill-advised decision. For all of the above reasons, I strongly urge that the Council reject development in the proposed density and rezone the property in question to the original R-7. This would be in the best interest of all the people of T iga rd. As an owner and resident adjacent to Dale's Glenn Subdivision S4-81 , I object to this high density spot zoning of R-5 established in 1979, and request a change to R-7, which would conform to your current minimum standard for this neighborhood. This subdivision matter has been confused beginning with the original action in 1979 when inadequate notice was given to affected property owners. The zoning action in 1979 establishing R-5 was improper because R-7 is the minimum standard for property in this neighborhood not contiguous with S.W. Greenberg Road. I recognize, but disagree, with your planning function dedication to high density housing. At a hearing on June 2, 1981 , random cotimients by Planning Commission members referred to our section of S.W. 92nd Ave. off Greenberg as an example of "poor planning" , and R-5 high density housing in Portland as quite satisfactory. We feel we have a pleasant place to live here and object to the potential hazards to our future enjoyment of our property by your "good planning" placement of high density housing nearby. Many of us moved here to avoid the high density housing of Portland. If that is what we wanted we could have annexed to Portland instead of incorporating Tigard. High density housing has broughturbanization type problems including higher crime rates. Our pleasant living "poor planning" on S.W. 92nd Ave. has not been a source nor an object of crime in Tigard like your high density "good planning" has brought. I respectfully request that your mistake made in 1979 be corrected and the R-5 zoning be changed to R-7, your current minimum standard for this area. If you decline to make this change, I request that you require an appropriate buffer such as an eight foot fence along the east boundary of Dale's Glenn Subdivision S4-81 to reduce noise, visual pollution and foot traffic disturbance to permit continued enjoyment of our property. On .Tune 19;1979 the P1a,-I,zil,g Commission approved Zone Change 22-79. On August 14, 1979 I approved Subdivision 3-79 for Dales' Glenn for sixteen (16) lots. Since then nothing has happened. Recently, the property changed hands. The new developer made a new application to this department because under the Tigard Murnicipal Code, if substantial progress towards completion of a project does not take place within one (1) year, a new application must be made. The notice that you received, should have been mailed March 25, 1981, which would have given you ample time to respond. Obviously, an externsion is I will not take Final Action on Dales' Glenn until April 27, 1981. At that time, I will prepare a Staff Report which will be available for your review upon request. This report will contain all the conditions for development to proceed. The developer will then agree to the conditions by signing the "acknowledgement" and he then will apply for building permits. The Council directed me to look especially at Section 2 . 04 . 040 of the Tigard City Code. The following is my suggested revision of that provision in the light of what I understood to be Council direction. If this is not what you want, please let me know what changes, if any, you would wish to sce. The amendment to Section 2 . 04 . 040 is as follows (material in () is deleted, while material underlined is added) : "2 . 04. 040 Duties. The City Administrator shall : (1) Exercise control and supervision of all activities , departments and offices of city government, except the office of municipal judge and the office of city attorney, and shall interview, select and recommend to the mayor and council all applicants proposed for all city offices, and make recommen- dations to the mayor and council concerning the replacement of any city appointive officer, other than the mayor and councilmen( ; ) , and shall have authority to appoint to or remove from established positions , subordinate employees of the city; (including) provided, however, that department heads shall be appointed and removed only with the consent of the council. ***" I have examined the Tigard Police Manual and find no need for any changes. I have not, however, been supplied with a copy of the Personnel Manual and would probably have to review that manual to determine whether there were anv further changes to be made. Ed Walden, Building Official is planning to participate in a PB and CPUC Installation Seminar in Oregon City. Mr. Walden received a Certificate of Completion of 4.3 units in structural analysis and design of wood framed buildings June 13, Alice Carrick, Police _records Supervisor will be participating in dispatch Supervisor training in Wilsonville June 23rd. and 24th. The Seminar is sponsored by the associated Public Safety Communications officers-. HUD PAYMENT AUTHORIZED FOR SENIOR CENTER The final payment of $3,126 from the U. S. Department of Housing and Urban Development Community Development Block Grant Program was authorized by the Washington County Commissioners June 16th for the first phase construction of the Tigard Senior Citizens Center. The amended award of $79,200 was used for land acquisition and architectural design of the Senior Center. INTERVIEWS SCHEDULED FOR BILLING TYPIST Candidates for the temporary Billing Typist position will be interviewed Monday, June 22nd. Upon filling the position, the new employee is scheduled to start working July 1. SUMMER HELP JOINS LIBRARY Sandra Thorne will be on staff at the library throughout the summer on a part time basis. Sandra has worked at the library for the past 3 years during the summer and has completed her first year at the University of Oregon. STREET OVERLAP UNDERWAY Tigard, Bonita Road, 76th and a portion of Garrett street have been paved as of June 18. Street markings will be added after all designated streets have been overlayed. EQUIPMENT DEMONSTRATED TO CREW Representatives of Toro, Hustler, and Cushman have been demonstrating new (� equipment lines of sweepers and mowers to the Public Works Department crew. POLICE DEPARVIENT PAINTED G & C Painting of Hillsboro completed painting of the Police Station on June 17. The cost of the painting was $675 which was $325 under budget.
