RESOLUTION No. 80-75 A RESOLUTION OF THE TIGARD CITY COUNCIL AUTHORIZING THE MAYOR AND CITY RECORDER TO SIGN AN AGREEMENT WITH OREGON DEPARTMENT OF TRANSPORTATION (ODOT) FOR TRAFFIC SIGNAL INSTALLATION ON SW HALL BOULEVARD AT HUNZIKER AND SCOFFINS. (b) City Administrator stated the Highway Department was going to place signals to control both the Hunziker and Scoffins intersections. ORDINANCE No. $0-65 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 10.28, OF THE TIGARD MUNICIPAL CODE BY ADDING TO SECTION 10.28.130 TO PROHIBIT PARKING ON A PORTION OF SW HALL BLVD. SOUTHERLY OF SW PACIFIC HIGHWAY; REPEALING SECTIONS 10.28.090(B); 10.28.130 (2A) AND 10.28.130 (4); DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. (a) Motion by Councilman Scheckla, seconded by Councilwoman Stimler to adopt. (b) Director of Public Works recommended approval as the State Highway Department had requested Council concurrence with their request,of no parking along Hall Blvd. He noted that the no ;,parking would facilitate not only the new signals at Hunziker and 'Scoffins, but also the Park 217 office complex and would run along both sides of Hail. Ordinance No. 80-65 was adopted by unanimous vote of Council present. 15. OTHER: (a) Councilwoman Stimler requested staff get cost estimates for the purchase of a new noise meter. She cited different incidents in the City that require a noise meter check before a disturbance could be cleared. (b) Councilwoman Stimler noted that she was still receiving complaints on the _paving problems on Frewing Street. (c) Councilman Scheckla requested staff place additional signs at Cook Park indicating the location of the new restrooms. (d) Planning Director advised Council that T.D.C. has filed a letter requesting Council re-hear-the Cooper Creek proposal.. Council directed Planning Director to advise T.D.C. that their decision to remand to the Planning Commission would be upheld. (e) Director of Public Works requested Council award the Hillview Sanitary Sewer bid at this time. As explained at the July 28, 1980 meeting, an easement was needed for the sewer line to be placed through private property and necessitated the award of the bid be delayed. Director of Public Works PAGE 3 COUNCIL MINUTES AUGUST 11, 1980 recommended Council award the bid to Miller & Sons, Route 3, Box 62, Sherwood, Oregon 97140, in the amount of $14,697.75 with the condition that an addendum to the contract be signed stating that the bid will be considered null and void if the City does not give formal notice to proceed within 60 to 90 days after the acceptance of the contract. This will give the staff time to get the easement needed. Motion by Councilwoman Stimler, seconded by Councilman Scheckla to award the contract for Hillview LID to Miller and Sons in the amount of $14,697.75 with the condition that an addendum to the contract be signed requiring notice to proceed be given to the contractor 60 to 90 days after the contract is signed or the bid would become null and void and would not be binding to the City or the contractor. Joe's proposal on SW Main Street would be considered at the August 12th Planning Commission study session. He stressed that no action would be taken, the meeting was for discussion only. 8:00 P.M. PUBLIC HEARING 16. SW WALNUT STREET LID PROPOSAL - SANITARY SEWER IMPROVEMENTS (a) Public Hearing Opened (b) Director of Public Works gave brief synopsis of LID's history noting that the improvement is for sanitary sewer and there would be some city participation in the cost. -- (c) Public Testimony No one appeared to speak. (d) Director of Public Works recommended Council proceed with the process and approve the ordinance. (e) Public Hearing Closed (f) 'ORDINANCE No. 80-66 AN ORDINANCE CONFIRMING AND RATIFYING THE RESOLUTION OFTHECITY COUNCIL OF 'JULY 28, 1980,WITH RESPECT TO °SW WALNUT STREET SEWER IMPROVEMENT DISTRICT"; APPROVING, RATIFYING AND ADOPTING PLANS, SPECIFICATIONS AND ESTIMATES FOR CONSTRUCTION OF SANITARY SEWER SYSTEM; DECLARING RESULTS OF HEARING HELD WITH RESPECT THERETO; DIRECTINGSOLICITATION OF BIDS FOR CONSTRUCTION; PROVIDING FOR THE I4AKING OF SAID IMPROVEMENTS, AND DECLARING AN EMERGENCY. ' (g) Motion by Councilwoman Stimler, seconded',by Councilman Scheckla to adopt. Approved by unanimous vote of Council present. PUBLIC NOTICE 17. SW KATHERINE:STREET LID (a) Director of. Public Works explained some changes to the final assessment roll noting that Tax Lot No. 301 should be Tax`Map,2Sl 2SB, Tax Lot 100 and .stated the owner of Tax Lot 100 had waived his right to 10 days notice of the hearing. Also that Tax Lots 200 and 201 were assessed wrong and in spreading the assessment equally to all properties the final assessment PAGE 4 - COUNCIL MINUTES - AUGUST 11, 1980 IRW a, a a would be $2,963.02 for all lots except tax lot 600 which would be $13,007.85. Tax Lot 600 was not assessed a service line charge. Director of Public Works recommended approval with the amended assessment roll. (b) Mr. Steve Allison, 10265 SW Katherine Street, appeared to speak questioning the final assessment amount. Director of Public Works stated that the bid had been higher on the work than the preliminary engineer's estimate and thus created a $300.00 increase in the final assessment figures. Mr. Allison also requested the contractor clean up the debris left after the job. City staff stated that this would be accomplished soon. PEMBROOK STREET L.I.D. (a) Director of Public Works stated this was'a sanitary sewer LID and served 10 lots. (b) No one appeared to speak. SW 121ST AVENUE LID (a) Director of Public Works stated that Tax Lot 102 (Pippin) would have no assessment as the LID was not,able to service that lot. He recommended approval of the final assessment roll as indicated. (b) No one appeared to speak. As Councilwoman Stimler was the only member of Council present who had received a"copy of letter from TPOA in response to City's last offer, Council discussed the content of the letter and impact on 1980 contract.' Concensus was to secure more information From Council negotiating team as to specific details regarding the contract language and attempt to negotiate a contract. This meeting was attended by Mr. Joe Walsh from Waker Associates and myself representing the applicant, Tualatin Development Company. Prior to this meeting, we had received correspondence from you (letter dated 7-16-80) informing us of the City Council Meeting and that there would be "No Based on this information, our additional testimony taken by the Council". attendence at this meeting was only for observation of the Council's review of the Planning Commission's recommendation. As you know, however, we were allowed opportunity to speak before the City Council and asked to respond to their questioning. Based on the information we had received from you, we were not prepared for a needed to ' presentation of the type that was adequately review scope of questions offered by the Council.
