10. RESOLUTION No. 79-86 A RESOLUTION AUTHORIZING ISSUANCE OF GENERAL OBLIGATION
WARRANTS IN CONNECTION WITH S.W. VARNS STREET IMPROVEMENT
DISTRICT, S.W. KATHERINE STREET SEWER IMPROVEMENT
DISTRICT AND S.W. 121st AVENUE SEWER IMPROVEMENT DISTRICT.
(a) City Administrator explained that this would allow the issuance of warrants
until the sale of the Bancroft bonds can be completed. He stated that an
amendment was needed in SECTION 1,A. changing the dollar figure from
$45,080.00 to $54,500.00 as this was the lowest bid received. He concluded
by recommending approval.
(b) Motion by Councilman Brian, seconded by Councilman Cook to approve as amended.

(a) Public Works Director reported that the lowest bids received were:
Katherine Street--Sproul Excavating Co.--$37,022.10
121st Avenue--Richard T. Robertson Inc.--$22,936.00
He recommended Council award the bids to these two companies.
(b) Councilwoman Stimler asked how long it would take to start the project,
emphasizing the lengthy delays on the Katherine Street project. Public
works Director stated that it would be a minimum of. 20 days.
(c) Councilman Brian asked why Sproul didn't bid on the 121st Avenue project.
City Recorder stated that he .was not interested in the project as it would
entail working in private yards.
(d) Motion by Councilman Cook, seconded by Councilman Brian to approve.

(e) A resident of Katherine Street urged a,speedy start to the project.'
12. ORDINANCE No. $ ; AN ORDINANCE PROVIDING FOR THE DEVELOPMENT AND REGULATION
OF A CABLE''COMMUNICATIONS SYSTEM FOR TIGARD, 'PROVIDING
PROCEDURES FOR GRANTING FRANCHISES, CREATION OF A.COMMIS-

(a) Legal Counsel reported the amendments made in the Ordinance as per
Council's previous suggestions: primarily deleting the Commission and
replacing all such references to the Council; some deletion of administra-
tive responsibilities designated to Mayor now changed to City Administrator.
He recommended approval.
(b) Motion by Councilman Brian, seconded by Councilwoman. Stimler to approve
as amended.
Approved as amended by unanimous vote of Council.
13. ORDINANCE 79-85 AN ORDINANCE ADOPTING, RATIFYING, AND:CONFIRMING, ALL PROCE-
DURES ANDDETERMINATIONSHERETOFORE MADE WITH RESPECT TO THE
"S W. HUNZIKER STREET IMPROVEMENT DISTRICT" AS SET FORTH IN
PRIOR ORDINANCES AND RESOLUTIONS OF THE CITY COUNCIL, AND
AUTHORIZING THE ISSUANCE OF BONDS PURSUANT TO THE PROVISIONS

(a) City Administrator recommended approval.
(b) Legal Counsel stated that the provisions of this ordinance are exactly
the same as they were prior to the lawsuit. The process of going
through the Courts was merely for the satisfaction of the lenders. He
recommended approval. Attorney noted a special council meeting will be
held November 14, 1979, to review and accept bids.
(c) Motion by Councilwoman Stimler, seconded by Councilman Cook to approve.

14. OTHER
(a) City Administrator reported that Richard Rohde is still willing to improve
the sidewalk in consideration of the City vacating the portion of the
greenway, however., he was not willing to pay the costs (approx. $150.00)
for the vacation. City Administrator recommended that Council reconsider
the placement of burden on the vacation costs.
Motion by Councilman Brian, seconded by Councilman Cook,Council initiate
the vacation of a portion of the greenway in favor of Richard Rohde on the
condition that he installs the sidewalk to City Standards at his own
expense. (Intent of the motion to waive the vacation fees if Rohde installs
sidewalk • at his expense)

15. SUMMER HILLS PARK SANITARY SERER LOCAL IMPROVEMENT DISTRICT
(a) City Administrator summarized the project, and stated that no written
objections had been received to date.. Stanley Reynolds, 12510 S.W. Sumner-
crest Drive, property;'owner of Tax Lot3700notified city he plans to
connect to the Scholls Sewer Trunk Line:

(b) Bonnie Owens, 12450 S.W. Summercrest Drive, asked if the project design
was finalized or if it might be changed if she opts: to connect to the
Scholls trunk line. She also asked when the deadline would be for her
to make a final decision.
(c) Keith Thompson, Regional Consultants, engineer for the City on the
project, reported that the recommended:design`at this time provided
the most economical route, :iIVWeVe1, should 1'11.7. Owens LLec2.Ue to connect
up to the Scholls line, he may redesign the project`. He stated that her
options are still open. He suggested that her property could be kept
in the boundary with a $0.00 assessment.
(d) Harald Busch, 12205 S.W. Summercrest Dr`., asked about timing and the :
next step in t')e project. He stated that Keith Thompson had indicated
that work migh_ begin before this winter. City Administrator reported
that the nen t steps would include finalizing the design, preparing bid

specifications and receiving bids on October 24, 1979. Public Works
Director stated that tie was unsure if the City could have work done this
fall.
(e) Keith Thompson stated that October 24, 1979 would be too early to open
bids as time was needed to finalize plans, request bids, have contractors
prepare bids, etc. He requested that this be set back at least two weeks.
(f) City Administrator recommended that the date referenced in Section 3 be
changed from October 24, 1.979 to November 7, 1979.
(g) Councilman Cook requested that a time limit be set for Mrs. Owens'
decision. Mrs. Owens stated that a decision has been made and promised to
notify staff as soon as possible.
(h) City Administrator noted that an unexpected expense has been added to this
project; a $150.00 surcharge will be imposed on each property to cover an
earlier Leron Heights sewer agreement (a situation where the developer
negotiated for reimbursement as new properties hook up to the line he
developed).
City Administrator concluded by recommending the district be formed and
that 33 lots be assessed on an equal basis.
(i) Legal Counsel stated that the Ordinance needed to be amended by adding
Sections 5,6 and 7 to provide for the use of warrants.
(j) Motion by Councilwoman Stimler, seconded by Councilman urian to amend the
Ordinance by adding section 5, 6 and 7.

VIII. TRAINING
A. Carnival Gambling. Det. Sgt. Branstetter and Officer deBrauwere
atten3ed a two day conference on carnival gambling on August 16 and 17,
receiving 32 man hours of training.
B. On August 21 and 22, Det. Sgt. Branstetter and Corporal Myers
received 32 hours of training on gambling; this presentation being
made by the Washington State Gambling Unit.
C. Advanced Officer Course. Officer Merrill went to the Police
Academy on August 20, attending the advanced officer course for one
week, and receiving updated and current training.
D. Physical Fitness Instructor Course. Sgts. Jennings and Newman
received one week's training on physical fitness, and how to instruct
these techniques to others. This course was sponsored by the Board
on Police Standards and Training, and was held at the Police Academy.
Dates; August 27 thru the 31st.

IX. COMKUNITY RELATIONS
A. Toren and Country Days. All regular personnel and reserve officers
assisted with parade and park details during the 3 days of Tigard Town
and Country. This also officially started our police intern program,
with 2 of the 3 interns giving assistance at the park.
B. See attached report from Juvenile Officer.
C. Oregon School Board Association. Chief Adams attended a four
hour conference meeting of ;the Oregon 'School Board .Association that
was held at the Sheraton motel. This meeting was held in conjunction
with the schooldistrict's attorney todiscussstrike plans.

On Thursday, September 20, 1979, bids were opened and read for the 121st Avenue
Sanitary Sewer L.Y.D.
There were 14 planholders and 3 bidders. A bid tabulation is attached.
The low bidder was Richard T. Robertson, Inc. of Vancouver, Washington, in
the amount of $22,936.00
The Engineer's estimate was $18,580.30 (preliminary estimate for public
hearing $24,000).
I recommend Council award the bid to the low bidder, Richard T. Robertson,
Inc. of Vancouver, Washington in the amount of $22,936.00

SPECIAL PROJECT GRANT APPLICATION.
Staff has received notification of a Fall Special Project Fund Meeting for
Land and Water Conservation Grants. The City will apply for funds for
the improvement of Summerlake Park. This is the grant that we missed
last year. Deadline for applications is October 19, 1979. Staff is
preparing the necessary paperwork now.
CABLE TELEVISION MEETING.
The City Administrator and the Planning Firector attended a meeting with
Washington County: officials and members of various city staff people
concerning the installation of cable television equipment in this area. The

City Attorney of Beaverton was directed to prepare an Intergovernmental
Cooperation Agreement for consideration by City Councils and the County. This
agreement will outline membership of the committee, duties and responsibilities,
funding agreements etc. This document will be presented to Council at a
Study Session. It was the 'feeling of all concerned that the citiesand the
County should present a united front to the cable industry.
CANTERBURY WOODS.
Occupancy Permits have been issued to Canterbury Woods. Staff inspected the
fence construction, the Fire Marshall singed-off the parking area, the chimney'
S chases are being installed and the trees have been planted. The developer
was pleased. Staff was pleased.
MEETINGS.
Staff expects to meet with the Tualatin Irrigation District concerning water for
Cook Park. We will meet with Unified Sewerage Agency people about the lease
possibilites of the garage facilities at the Metzger Plant Site. Gordon Martin
is meeting with ODOT before he returns to the Planning Staff for resolve of his
problem on 99W.`
