(a) City Administrator stated that several of the problems and confusion has
been resolved in a recent meeting with the engineer and citizens, and
recommended approval of the resolution.
(b) Motion by Councilman Cook, seconded by Councilman Scheckla to approve.

(c) Discussion by Council as to whether or not they wished to hear some
testimony this evening. Consensus of Council to delay all testimony
to the September 24, 1979 public hearing.
(d) Motion to approve passed by unanimous vote of Council.
7. APPEAL PLANNING COMMISSION DECISION, Elizabeth Anderson--Canterbury Woods
Condominiums - Consider waiver of fee
(a) City Administrator reported that Mrs. Anderson was appealing an
August 7, 1979 Planning Commission decision. The specific request
before Council is the consideration of waiving the appeal fee, as
per Mrs. Anderson's request.
(b) City Attorney stated that the Council policy of waiving these fees is
based upon "reasonable cause" and "hardship" on the part of the appellant.
He went or. to jay, however, that another party has already had the
transcript prepared and paid the City for this cost. He pointed out
that the appeal fee is primarily used to cover transcript preparation.
(c) Norman Hotz, Hoffman & Hoffman, objected to the waiver of the fee.
(d) Richard Geisert, 8 N. State Street, Lake Oswego, attorney for Mrs.
Anderson, spoke in favor of waiving the fee, pointing out that the
transcript was a matter of public record now that it has been prepared,
and that as the transcript preparation has been paid for the City would
incur no added cost in providing a copy to Mrs. Anderson.
(e) Mayor suggested that the cost of the transcript preparation be shared
equally by Mrs. Anderson and the party who initially requested the
transcript.
(f) Councilwoman Stimler concurred with the Mayor's suggestion.
(g) ' City Attorney felt that splicing the cost would be equitable and could
be handled as an administrative matter.
(h) Motion by Councilman Cooks seconded by Councilman Brian to have the
'parties share the cost of transcript preparation equally, with any
additional costs incurred in the appeal to be ,paid;by Mrs. Anderson.
Approved by unanimous vote of Council.
8. APPEAL DENIAL OF OCCUPANCY PERMITS BY CITY ADMINISTRATOR, Norman Hotz of
Hoffman & Hoffman--Canterbury Woods Condominiums
(a) City Administrator reported that there were several problems remaining
in this project. Specifically the chimney vents and attic trap doors
in the two buildings for which the :developers 'are requesting temporary
occupancy permits, and the eastern fence, trees, emergency: access plans
and chimney;;chases. He went on to recommend that the denial of the
occupancy permits be upheld.

(b) Norman Hotz, partner in Hoffman & Hoffman Inc., expressed his frustration
with the extensive bureaucratic red-tape and citizen pressure they have
experienced with this project. He went on to say that he felt that their
development was the finest in all Tigard.
He explained that the twenty foot tree in the parking lot was intended to
demonstrate to Council just how large a tree of this size was. Ile ex-
plained that the trees had been planted according to the Planning Director's
stake marks and denied that he was aware of the problem with.placement
until after the rest of the trees had been planted in a row. He stated
that they would be unable to plant the two required trees without digging
up the other trees (6-7) in the row.
Mr. Hotz stated that the installation of the fence along the eastern
boundary would be possible, but difficult. Perhaps requiring snaking
the fence between trees or starting and stopping the fence at every
tree. He also stated that as the fence would not be visible, he saw
no value in this requirement. He said that they planned on complying
with the chimney chase and emergency access plan requirements.
He concluded by saying that there was no precedent for denying temporary
occupancy permits for buildings which have been completed even though
the total project is not complete. He also pointed out that the two
most serious problems (the fence and trees) were on the far side of the
project from the buildings for which they are requesting occupancy.
Finally he stated that some buyers might be lost if occupancy permits
could not be obtained soon.
(c) Mark Feichtinger, 900 SW Fifth, representing the Calway Hills Homeowners
Association, stated that the residents agreed that this was a good project,
however, they felt that as the project was so close to the neighbors
and;had a vantage view into lower neighbors property the fence and trees
were essential. He went on to say that even though the fence would not
be very visible, it would act as a "good neighbor" fence restricting
children and pats.
(d) Richard Geisert, attorney for Mrs. Anderson, agreed with Mr. Feichtinger's
testimony and pointed out that if the City allows occupancy before these
problems are corrected, they will lose the leverage to insure completion.
(e) Councilman Brian felt that the trees and fence should be completed as well
as the emergencyaccess plans prior to any ,occupancy. He felt', that the
chimney chases 'could be required on a building by building basis. He went
on to question the necessity of the size of the required trees in light
of the expected difficulty in planting them and suggested that this;be
referred back to staff.
(f) = Councilman Cook agreed with the feelings of Councilman Brian and
suggested that maybe two smaller trees could be substituted for one
larger one.
(g) ' Motion by Councilman Brian, seconded by;Councilman 3checkla to deny the
appeal, and require the appellant to conform with the City Administrator's
letter of September 4, 1979 with the exception of provision #3 (chimney
chases) which could be,handled on a building by-building,basis.

(h) Much discussion by Council on alternative techniques of planting the
trees. City Administrator asked Mr. Feichtinger if the Calway Hills
residents would allow the machinery through the back of their property
to allow planting. Mr. Feichtinger felt he could not answer the question
at this time but felt that if they were to allow access, reimbursement for
any damage to property would be necessary. Council also suggested that
there was an access which should be explored through the Canterbury project.
9. HARVEY RING SEWER AGREEMENT
(a) City Attorney stated that two minor amendments were necessary:
(1) extending time of agreement.and (2) eliminating Unified Sewerage
Agency from the agreement.
(b) City Administrator reported that it had come to his attention that
there was a U.S.A. trunk line along the back of the five property owners
lots, and recoFanended that these owners be allowed a choice in which line
they wished to connect.
(c) Planning Director stated that there was no real rush on this, and
suggested that it be sent back to staff for corrections.
(d) Motion by Councilman Brian, seconded by Councilman Cook to authorize
signing and execution of the agreement with amendments spelling out
landowner choice of hook up.
10. PRESTIGE PROPERTIES - TEMPORARY MODEL HOME REQUEST
(a) City Administrator reviewed this issue for Council and stated that he
would proceed at the staff level on the request. He said that he
brought it before Council because of their recent,,interest in the
subject and the change :in the Ordinance.
11. COMPREHENSIVE PLAN REVISIONS Housing Implementation Plan - Manufactured
Housing
(a) Planning Director read two letters into the record: JoAnn Nordling,
NPO #4 member, objected to the post 1972 requirement stating that
this would be a hardship;on the poor and elderly; she suggested :that
conditional use permits be considered by Council in hardship cases;
Mr. & Mrs. Vining, 15227 SW Alderbrook Place, objected to the placement
of mobile homes at all stating that,they would decrease surrounding
property values.
Planning Director went on to describe several needed amendments
Section 2, (a), Ist line, delete "as", insert "and/or";
vea.tLULL 3, (a), 4th line, delete "or", insert CPand/or";
Section 3, (a), (2), delete in full, insert "Mobile homes shall be
installed under the provisions of the Administrative Rules promulgated
by the Director of Commerce and administered by the State Building
Code Division.";
Section 3, (a), (11), 3rd line, delete "agents", insert "materials";
Section 3, (a), (13), 1st line, add an "s" to subdivision making it
r plural;
Section 3, (b), (8)`, delete in full, 'insert "Mobile hoems shall be
installed under the provisions of the Administrative Rules promulgated

by the Director of Commerce and administered by the State Building Code
Division."
(b) City Attorney recommended some language amendments:
Section 1, add another sentence as follows, "Hereinafter referred
to as 'mobile home'.";
Section 2, (a), 1st line, delete "allow", 2nd line, after"-ment",
insert "shall be allowed";
Section 2, (b), 1st line, delete"allow", 1st line, after "parks", insert
"shall be allowed".
(c) Motion by Councilman Brian, seconded by Councilwoman Stimler to amend
as above in addition to:
Section 3, (a), (3), 2nd line, add to the sentence "as an integral part
of the unit,";
Section 3, (a), (4), delete "or room containing a sink."
Amended by unanimous vote of Council.
(d) ORDINANCE 79-83 AN ORDNANCE AMENDING SECTION 18.20 OF THE TIGARD
MUNICIPAL CODE BY ADDING SECTION 18.20.139 RELATING
TO MOBILE/MANUFACTURED HOME SITING AND FIXING AN
EFFECTIVE DATE.
Motion by Councilman Cook, seconded by Councilman Brian to approve as
amended.
Approved as amended by unanimous vote of Council.

12. APPROVE WASHINGTON COUNTY URBAN PLANNING AGREEMENT
(a) '' Planning Director reported that the City had previously drafted an
agreement and submitted it to Washington County, however, they;objected
$ to our draft and have submitted the draft before Council; tonight. He
went on to say that this draft was acceptable to him and recommended
approval. He also reported that with this agreement, the Mobile Home
Ordinance,''and one more map, we will have completed all LCDC requirements
for our Comprehensive Plan.
(b) '' Motion by Councilman Cook, seconded by Councilman Brian to authorize the
Mayor to 'sign and execute the agreement`.
Approved by unanimous vote of Council.
13. RESOLVE 14ARCIENNE TERRACE HALF-STREET IMPROVEMENT ISSUE - S.W. BONITA ROAD
(a) Planning Director reported that two members of the organization which
developed this project signed (on 5/4/79) a statement of conditions
imposed by the Site Design Review Committee to include agreeing to
make a half-street improvement. He reported .that they later claimed a
misunderstanding and are currently refusing to make the half-street
improvement.

(b) City Attorney questioned if the Planning Commission had allowed a ded-
ication and non-remonstrance agreement instead of the half-street
improvement. Planning Director stated that in February, 1979, the
Planning Commission had allowed the dedication and non-remonstrance
agreement, however shortly thereafter Council changed the policy on this
type of issue, and in March, 1979 the Site Design Review Committee had
amended the earlier Planning Commission conditions to require the half-
street improvement.- He went on to say that the developers were aware of this
change as evidenced by their signatures on the letter specifying conditions
(signed 5/4/79).
(c) Councilman Brian questioned why the occupancy permits had been granted
without catching this problem. Planning Director said that this had
slipped through because of poor staff communication, and went on to say
that the Building and Planning departments are now maintaining good
communication to prevent similar problems. Councilman Brian also
questioned if the occupancy permits had been granted for all of the
buildings. Planning Director was unsure.
(d) Motion by Councilman Cook, seconded by Councilwoman Stimler to require
the completion of the half-street improvement prior to any further
occupancy.
Approved by unanimous vote of Council.
(e) Councilman Brian questioned our leverage if all occupancy permits have
been granted. City Attorney suggested a performance bond, lien or
lawsuit,
14. APPROVE AMENDMENT H.U.D. AGREEMENT - SR. CITIZEN CENTER
(a) City Administrator reported that this agreement needed to be amended
s by deleting "in May of any year" and inserting in it's place "prior
to the date specified by PUD in any year". He stated that this
amendment was required by HUD.
(b) Motion by Councilwoman Stimler, seconded by Councilman Scheckla to
authorize the Mayor to sign and execute as amended.-
Approved by unanimous vote of Council.
15. SELECT APPRAISER - SR. CITIZEN CENTER
(a) City Administrator up-dated Council on the project, stating that we
have :selected the site and sent a letter of intent to acquire land to the
property owner. The next step is .to select the appraisers:
I - as the, primary appraiser, and 1 - as a review appraiser. He recommended
the retention of Harold Meyer and Associates as the primary appraiser,
stating that he had contacted Mr. 'Meyer`who indicated interest. In addition
he recommended one of the following as the review appraiser: 1) J.F. Young;
Z) Russel Parker & Associates; 3) Carl Trowbridge and Associates. He had
not had the opportunity to discuss the appraisal with these firms and
thereforecould not make a final recommendation of one of them.

(b) Motion by Councilman Cook, seconded by Councilwoman Stimler to retain
Harold Meyer & Associates as the primary appraiser, with the review
appraiser to be selected-of the three possible--by the City Administrator.

16. ALTERNATE ATTORNEY FOR EMERGENCY PURPOSES
(a) City Administrator reported that he had investigated
Hattorneyendeds as per
Council's request to serve for emergency purposes.

appointment of De Mar Batchelor, of Schwenn, Bradley & Batchelor. He
went on to say that Mr. Batchelor had been recommended by Joe Bailey and
had indicated his willingness to serve.
(b) Motion by Councilman Brian, seconded by Councilman Cook to appoint
DeMar Batchelor as alternate attorney for emergency purposes.
Approved by unanimous vote of Council.
17. REQUEST BY STRAAM ENGINEER - TRAFFIC SAFETY STUDY - Use of Aerial Photographs
(a) City Administrator stated that there is a Resolution restricting the
use of aerial photographs, therefore St.raam has requested permission
to use them in the Traffic Safety Study. He went on to recommend approval
of this request.
(b) Mayor suggested the possibility of applying costs incurred in this use as
part of the in-kind requirem--nt of the study grant.
(c) yotion by Councilman Cook, seconded by Councilwoman Stimler to approve
the use of the aerial photographs by Straam Engineering for traffic
safety studies only and, if allowed by the Oregon Traffic Safety Com-
mission, to apply any costs as a portion of the in-kind City contribution
to the grant funds.
18. OFFICE EQUIPMENT - NEW POLICE ADDITION
(a) City Administrator requested approval by Council to purchase office
furniture and equipment, telephones, and printing of the new Police
Manual.
(b) Councilman Brian felt that these expenses should come from the existing
budget.
(c) ; Consensus of Council to allow purchases, and transfer funds from the
existing budget as purchases are made.
19. AUTHORIZATION TO REQUEST BIDS FOR IRRIGATION' SYSTEM - COOK PARK SOCCER FIELDS
(a) City Administrator reported that this would be for, lines/pipes and
sprinkler heads in the field. It would still be flexible to any of
several water sources. He recommended authorization to request bids.

(b) Public Works Director up-dated Council on the status of the project,
stating that the irrigation system must be installed prior to planting
grass. He went on to say that fall is the ideal time for planting and
hoped that we could get it in soon. He also stated that the bid is only
for equipment and materials, City staff will install it.
(c) Motion by Councilman Cook, seconded by Councilwoman Stimler to authorize
request for bids.
Approved by unanimous vote of Council.
20. OTHER
(a) City Administrator entered into a record that a request has been made for
a street name change (requesting change from SW King Raysyth to SW
Ponderosa), and reported that he will check on procedures for this change.
(b) Councilman Cook requested that the subject of selection procedures and
criteria for consulting engineers be placed on an up-coming Study Session
agenda.
(c) Councilman Scheckla reported that the Sherwood Elks have volunteered
to build more picnic tables for Cook Park if we can obtain lumber
and do the painting.
(d) Planning Director reported that Hilary Mackenzie has left the staff
to return to school. He also reported that Dave Rothman has joined
the department as an Intern. Finally he stated that the Planning
Commission agendas are empty after this month, demonstrating the slow
down in building in the area.

ORS 192.660 (2) (d) regarding Wheeler - Killion litigation.
Attorney Bailey reviewed recent developments regarding the case, giving Council
an opportunity to evaluate the situation and possible decisions they will have
to make. No action was requested of Council at this time.

SUBJECT: Street Lighting Repairs
I am writing in response to your letter of July 20, 1979, and
to confirm our subsequent conversation of August 24th.
I have enclosed a copy of the list you submitted to me indi
eating the dispostion of each item. In most cases the replace-
ment of a photo cell was all that was required, 4
The reasons for an inoperative light can be many: underground
cable can be damaged, the light fixture may be faulty, and in some
cases the lights may have been installed and not yet energized. In
these cases repair is a much longer process .
In those cases where lights have been installed, but not yet
energized, once we have received written authorization 'from the
City of Tigard, PGE can normally energize those lights in four (4) ,
weeks . This is the amount of time necessary for 'planning and
scheduling of crews . s
I ;appreciate your assistance in identifying those street lights
which are not operating. If ,you have any questions, or if I can be
of service, : please do not hesitate to call on me.

Building Permit -#2790 issued for a single family dwelling
at 11160 SW Novare Court, Tigard has been voided.
The developer, Moore Brothers, Inc. has decided not be
build on that lot. (Lot 41 - Genesis)
Therefore we are requesting a refund (payable to Moore
Brother, Inc. ) be approved in the amount of $1,328.00
which breaks down as follows:
"Building Permit Fee $ 203.00
Sewer Connection Fee 600.00
Sewer Inspection Fee 25.00
Systems DevelopmentCharge 400.00
Park Development Charge 100.00
Total $1,328.00
The Plan Check Fee ($101.50) and the 4% State Surcharge
($8.12) are not refundable.
